{"id":11604,"date":"2024-12-24T10:53:30","date_gmt":"2024-12-24T08:53:30","guid":{"rendered":"https:\/\/sbunker.org\/?p=11604"},"modified":"2024-12-24T11:47:44","modified_gmt":"2024-12-24T09:47:44","slug":"politika-e-fjaleve-asociacioni-bashkesia-apo-vetemenaxhimi-i-komunave-me-shumice-serbe-ne-kosove","status":"publish","type":"post","link":"https:\/\/sbunker.org\/en\/analize\/politika-e-fjaleve-asociacioni-bashkesia-apo-vetemenaxhimi-i-komunave-me-shumice-serbe-ne-kosove\/","title":{"rendered":"The Politics of Words: Association, Community, or Self-Management of Serb-Majority Municipalities in Kosovo?"},"content":{"rendered":"<p class=\" translation-block\">In 2013, Serbia and Kosovo <\/span><a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_13_347\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">reached the First Agreement on Principles Governing Normalization of Relations<\/span><\/a><span style=\"font-weight: 400\"> (Brussels Agreement). The central point of the agreement was the establishment of an  <\/span><i><span style=\"font-weight: 400\">Association\/Community of Serb Majority Municipalities<\/span><\/i><span style=\"font-weight: 400\"> (ASM) which would give more powers to local Serbs on issues pertaining to healthcare, education, urban planning and other related areas.<\/p>\n<p class=\" translation-block\">This was a result of the so-called <\/span><a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/19448953.2020.1715668\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">\u201cconstructive ambiguity\u201d<\/span><\/a><span style=\"font-weight: 400\"> a policy by the EU at the time, providing two options (Association\/Community) for parties in the dialogue, with the aim of facilitating easier integration of Serbs and Serbian institutions in the political system of Kosovo. Since then, however, the gap between the two sides has been widening, with each side insisting on one of the options.<\/p>\n<p class=\" translation-block\">Over the years, the Serbian leadership has favored the term <\/span><i><span style=\"font-weight: 400\">Community <\/span><\/i><span style=\"font-weight: 400\"> (Serbian: Zajednica), while the Kosovar leadership has preferred the term <\/span><i><span style=\"font-weight: 400\">Association<\/span><\/i><span style=\"font-weight: 400\">. In both everyday communication and official documents, Serbia insists on <\/span><i><span style=\"font-weight: 400\">Community <\/span><\/i><span style=\"font-weight: 400\"> (Serbian Zajednica), while Pristina uses <\/span><i><span style=\"font-weight: 400\">Association<\/span><\/i><span style=\"font-weight: 400\">. The distinction is not merely terminological; it reflects deeper underlying meanings.<\/p>\n<p><b>Association vs. Community: Terminological Differences<\/b><\/p>\n<p class=\" translation-block\">In English, Albanian, and Serbian, the term <\/span><i><span style=\"font-weight: 400\">Community<\/span><\/i><span style=\"font-weight: 400\"> typically refers to a broad group of people with shared characteristics or circumstances, such as the community of 7th graders in a school or the community of doctors.<\/p>\n<p class=\" translation-block\">On the other hand, the term  <\/span><i><span style=\"font-weight: 400\">\u201cAssociation\u201d <\/span><\/i><span style=\"font-weight: 400\">carries a more formal or organizational meaning. For example, while the \u201ccommunity of journalists\u201d can refer to an informal group, the \u201cAssociation of Journalists\u201d denotes a structured, recognized and often registered entity with defined roles and responsibilities.<\/p>\n<p class=\" translation-block\">Considering these distinctions, when referring to the <\/span><i><span style=\"font-weight: 400\">Association\/Community of Serb-Majority Municipalities<\/span><\/i><span style=\"font-weight: 400\"> (ASM), the term <\/span><i><span style=\"font-weight: 400\">Association<\/span><\/i><span style=\"font-weight: 400\"> more accurately reflects a legal and organizational framework, rather than the broader, informal meaning of  <\/span><i><span style=\"font-weight: 400\">Community<\/span><\/i><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, upon closer examination, it becomes evident that the preference for using one term over the other is not based on literal meanings but rather on political considerations.\u00a0\u00a0<\/span><\/p>\n<p><b>Belgrade prefers the \u201cCommunity of Serb-Majority Municipalities\u201d<\/b><\/p>\n<p class=\" translation-block\">The term <\/span><i><span style=\"font-weight: 400\">Community<\/span><\/i><span style=\"font-weight: 400\"> (Serbian Zajednica) can be interpreted as a \u201cunion\u201d in the Serbian language, referring to a union of municipalities that come together and delegate their competencies to the Community administration (e.g.: President, Council, Assembly).<\/p>\n<p class=\" translation-block\">Moreover, the Serbian leadership insists on the term <\/span><i><span style=\"font-weight: 400\">Community, <\/span><\/i><span style=\"font-weight: 400\"> because it finds its basis in the <\/span><a href=\"https:\/\/www.srbija.gov.rs\/kosovo-metohija\/?id=90142\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400\">Assembly of Community of Serb Municipalities of the Autonomous Province of Kosovo and Metohija<\/span><\/i><\/a> <span style=\"font-weight: 400\">\u2013 a body established by Serb members of local assemblies of 26 municipalities across Kosovo in 2008 following the unilateral Declaration of Independence of Kosovo.<\/p>\n<p class=\" translation-block\"><i><span style=\"font-weight: 400\">The Assembly of Community  <\/span><\/i><span style=\"font-weight: 400\">existed until the 2013 Brussels Agreement when it was dismantled. Belgrade often refers to the <\/span><i><span style=\"font-weight: 400\">Community of Serb Municipalities<\/span><\/i><span style=\"font-weight: 400\"> as a continuation of that Assembly.<\/p>\n<p class=\" translation-block\">Stemming from this <\/span><i><span style=\"font-weight: 400\">Assembly of Community<\/span><\/i><span style=\"font-weight: 400\"> comes the shortened name often used in Belgrade and Serbian circles \u2013 <\/span><i><span style=\"font-weight: 400\">Community of Serb Municipalities<\/span><\/i><span style=\"font-weight: 400\">. This is an attempt by Belgrade to present the ASM as a natural extension of the <\/span><i><span style=\"font-weight: 400\">Assembly of Community, <\/span><\/i><span style=\"font-weight: 400\"> which deviates even from the 2013 Brussels Agreement.<\/p>\n<p><b>Pristina insists on the \u201cAssociation of Serb-Majority Municipalities\u201d<\/b><\/p>\n<p class=\" translation-block\">Different governments in Kosovo in the past ten years have insisted on using the term Association when referring to the <\/span><i><span style=\"font-weight: 400\">Association\/Community of Serb-Majority Municipalities <\/span><\/i><span style=\"font-weight: 400\">(ASM). This preference stems from the fact that the term <\/span><i><span style=\"font-weight: 400\">Association<\/span><\/i><span style=\"font-weight: 400\">aligns more with the concept of inter-municipal cooperation rather than territorial autonomy, which the term <\/span><i><span style=\"font-weight: 400\">Community<\/span><\/i><span style=\"font-weight: 400\"><\/span> might imply.<\/p>\n<p class=\" translation-block\">Another key aspect of this distinction is that the <\/span><i><span style=\"font-weight: 400\">Association<\/span><\/i><span style=\"font-weight: 400\"> can be understood very closely as a nonprofit or non-governmental organization focused on cultural cooperation, rather than the transfer of municipal powers to another layer of governance.<\/p>\n<p class=\" translation-block\">Furthermore, the <\/span><i><span style=\"font-weight: 400\">Association<\/span><\/i><span style=\"font-weight: 400\"> has been a subject of intense political clashes between various political parties in Kosovo. The ruling party of Kosovo, the Self-Determination Movement (Levizja Vetevendosje), which was in opposition at the time, organized a series of protests that escalated with violence.<\/p>\n<p class=\" translation-block\">The Self-Determination Movement rose to power with the slogan \u201c<\/span><a href=\"https:\/\/www.youtube.com\/watch?v=cmW9anX3nbc&amp;ab_channel=TopChannelAlbania\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Zajednica nuk kalon\u201d<\/span><\/a><span style=\"font-weight: 400\"> (Zajednica shall not pass), deliberately using the Serbian term \u201cZajednica\u201d (instead of Association) to provoke nationalistic sentiments and instill fear among the population. By choosing this term, they aimed to equate Zajednica with the idea of a \u201c<\/span><a href=\"https:\/\/telegrafi.com\/en\/Republika-Srpska-also-launched-a-court-for-the-association-as-a-community\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">new Republika Srpska in Kosovo.<\/span><\/a><span style=\"font-weight: 400\">\u201d<\/p>\n<p><span style=\"font-weight: 400;\">This shift reflects an attempt to distance the public from the emotionally charged term \u201cZajednica\u201d they previously exploited, replacing it with a less provocative alternative that suits their current political narrative.\u00a0<\/span><\/p>\n<p class=\" translation-block\">The Prime Minister of Kosovo, Albin Kurti, has now agreed to implement a degree of  <\/span><i><span style=\"font-weight: 400\">self-management<\/span><\/i><span style=\"font-weight: 400\"> for Kosovo Serbs under the Ohrid Agreement, adding further complexity to the ongoing debate surrounding terminology over the ASM.<\/p>\n<p><b>From \u201cAssociation\/Community\u201d to \u201cSelf-management\u201d<\/b><\/p>\n<p class=\" translation-block\">When the <\/span><i><span style=\"font-weight: 400\">Association\/Community of Serb-Majority Municipalities, <\/span><\/i><span style=\"font-weight: 400\"> (ASM) was introduced in the 2013 Brussels Agreement, both terms\u2014<\/span><i><span style=\"font-weight: 400\">Association<\/span><\/i><span style=\"font-weight: 400\"> and <\/span><i><span style=\"font-weight: 400\">Community<\/span><\/i><span style=\"font-weight: 400\">\u2014were used interchangeably. This indicated that the EU, as a facilitator, was offering two options for the parties in the dialogue. However, regardless of the terminology used by parties, the ASM remains unimplemented.<\/p>\n<p class=\" translation-block\">Ten years after the Brussels Agreement, Kosovo and Serbia reached the <\/span><a href=\"https:\/\/www.eeas.europa.eu\/eeas\/belgrade-pristina-dialogue-agreement-path-normalisation-between-kosovo-and-serbia_en\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400\">Agreement on the Path to Normalization Between Kosovo and Serbia<\/span><\/i><\/a> <span style=\"font-weight: 400\">(Ohrid Agreement). While the agreement avoids explicit references to the \u201cAssociation\u201d or \u201cCommunity,\u201d it introduces the concept of \"self-management\" for local Serbs in Kosovo, adding further complexity to the situation.<\/p>\n<p class=\" translation-block\">The debate over the terms <\/span><i><span style=\"font-weight: 400\">Community <\/span><\/i><span style=\"font-weight: 400\"> and  <\/span><i><span style=\"font-weight: 400\">Association<\/span><\/i><span style=\"font-weight: 400\"> is more than just a matter of terminology; it is a disagreement over the extent of autonomy or self-management the Kosovo Serb community will have under this arrangement.
