N\u00eb fakt, n\u00eb vitin 2023 as q\u00eb mund t\u00eb paramendohet tejkalimi i nj\u00eb muaji me k\u00ebt\u00eb nivel t\u00eb pag\u00ebs minimale.<\/p>\n<p>Sipas t\u00eb dh\u00ebnave nga Administrata Tatimore e Kosov\u00ebs, do t\u00eb jen\u00eb rreth\u00a0<a href=\"https:\/\/www.institutigap.org\/documents\/12511_paga_minimale.pdf\">105 mij\u00eb p\u00ebrfitues<\/a>\u00a0n\u00eb rast t\u00eb rritjes s\u00eb pag\u00ebs minimale. P\u00ebrfituesit m\u00eb t\u00eb m\u00ebdhenj nga nj\u00eb rritje e pag\u00ebs minimale do t\u00eb jen\u00eb sektori i tregtis\u00eb me shumic\u00eb dhe pakic\u00eb, industria p\u00ebrpunuese, gastronomia, sektori financiar dhe nd\u00ebrtimtaria.<\/p>\n<p>P\u00ebrkund\u00ebr r\u00ebnd\u00ebsis\u00eb jetike q\u00eb ka rritja e pag\u00ebs minimale, ajo ende nuk \u00ebsht\u00eb b\u00ebr\u00eb n\u00eb Qeverin\u00eb Kurti 2. N\u00eb nd\u00ebrkoh\u00eb, Qeveria ka proceduar p\u00ebr miratim n\u00eb Kuvendin e Kosov\u00ebs Projektligjin p\u00ebr pag\u00ebn minimale, t\u00eb cilin e ka konsideruar si nj\u00ebrin nd\u00ebr projektligjet m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb propozuar n\u00eb qeverisjen e saj.<\/p>\n<p><a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=57255\">Projektligji i miratuar<\/a>\u00a0nuk p\u00ebrcakton shum\u00ebn e pag\u00ebs minimale, por u hap rrug\u00ebn ndryshimit dhe plot\u00ebsimit t\u00eb ligjeve q\u00eb p\u00ebrcaktojn\u00eb shum\u00ebn e beneficionit n\u00eb lart\u00ebsi t\u00eb pag\u00ebs minimale, procedur\u00ebn e caktimit t\u00eb pag\u00ebs minimale dhe shkall\u00ebt tatimore n\u00eb t\u00eb ardhurat personale vjetore.<\/p>\n<p>Qeveria kishte respektuar standardet minimale t\u00eb konsultimit paraprak (5 dit\u00eb) dhe t\u00eb konsultimit me publikun (15 dit\u00eb) n\u00eb Platform\u00ebn Online t\u00eb Konsultimeve Publike. Komente kishin d\u00ebrguar Shoqata e t\u00eb Verb\u00ebrve t\u00eb Kosov\u00ebs dhe Handikosi, por asnj\u00eb koment i tyre nuk \u00ebsht\u00eb pranuar nga Ministria e Financave, Pun\u00ebs dhe Transfereve p\u00ebr t\u2019u b\u00ebr\u00eb pjes\u00eb e projektligjit t\u00eb propozuar.<\/p>\n<p>Pra, me k\u00ebt\u00eb\u00a0<a href=\"https:\/\/www.kuvendikosoves.org\/Uploads\/Data\/Documents\/PLperproceduratpercaktiminepagesminimaledheshkallatatimoreneTPV_sAk8chU6h6.pdf\">projektligj<\/a>\u00a0shkelen standardet minimale t\u00eb hartimit t\u00eb legjislacionit, b\u00ebhet p\u00ebrjashtimi i K\u00ebshillit Ekonomiko-Social, injorohen k\u00ebrkesat p\u00ebr konsultim t\u00eb plot\u00eb, standard i p\u00ebrcaktuar nga Organizata Nd\u00ebrkomb\u00ebtare e Pun\u00ebs.<\/p>\n<p>Gjithashtu, m\u00ebnyra se si \u00ebsht\u00eb shkruar dhe forma se si \u00ebsht\u00eb prezantuar n\u00eb Kuvend p\u00ebrb\u00ebn problem n\u00eb vete.<\/p>\n<p>S\u00eb pari, Qeveria e Kosov\u00ebs nuk ka b\u00ebr\u00eb nj\u00eb analiz\u00eb t\u00eb detajuar t\u00eb ligjeve q\u00eb synohet t\u00eb ndryshohen. Kur kemi t\u00eb b\u00ebjm\u00eb me propozim-ndryshime themelore t\u00eb cilat prekin politika publike sociale q\u00eb afektojn\u00eb me qindra-mij\u00ebra pun\u00ebtor\u00eb, e po ashtu edhe sektorin privat, i cili p\u00ebrmes tatimeve kontribuon n\u00eb buxhetin e shtetit, at\u00ebher\u00eb k\u00ebto propozime duhet t\u00eb jen\u00eb pjes\u00eb e nj\u00eb reforme t\u00eb t\u00ebr\u00ebsishme t\u00eb k\u00ebtyre politikave, n\u00eb k\u00ebt\u00eb rast sociale dhe tatimore.<\/p>\n<p>S\u00eb dyti, sjellja e nj\u00eb projektligji p\u00ebr t\u2019i ndryshuar disa ligje t\u00eb tjera p\u00ebrdoret edhe n\u00eb disa parlamente kur jemi te \u00e7\u00ebshtja e efikasitetit. Por, n\u00eb p\u00ebrgjith\u00ebsi, k\u00ebto projektligje kan\u00eb t\u00eb b\u00ebjn\u00eb m\u00eb shum\u00eb me projektligje t\u00eb cilat rregullojn\u00eb \u00e7\u00ebshtje buxhetore dhe financiare, sikurse ligji vjetor i buxhetit, por jo i \u00e7\u00ebshtjeve themelore si\u00e7 \u00ebsht\u00eb ky me pag\u00ebn minimale dhe \u00e7\u00ebshtjet q\u00eb prekin n\u00eb themel dialogun social.<\/p>\n<p>Pas polarizimit t\u00eb skajsh\u00ebm nd\u00ebrmjet pozit\u00ebs dhe opozit\u00ebs n\u00eb seanc\u00ebn e par\u00eb plenare n\u00eb shqyrtimin e par\u00eb dhe pas shtyrjeve t\u00eb shumta,\u00a0<a href=\"https:\/\/www.kuvendikosoves.org\/Uploads\/Data\/Documents\/142Vendimpermiratimneparim_4yVtJfVWH5.pdf\">Kuvendi e miratoi k\u00ebt\u00eb projektligj m\u00eb 14 qershor 2022<\/a>. Muajin q\u00eb vjen b\u00ebhet nj\u00eb vit q\u00ebkur Kuvendi miratoi k\u00ebt\u00eb projektligj n\u00eb lexim t\u00eb par\u00eb dhe q\u00eb nga ajo koh\u00eb, p\u00ebrkund\u00ebr faktit q\u00eb kan\u00eb kaluar t\u00eb gjitha afatet procedurale p\u00ebr shqyrtimin e tij n\u00eb lexim t\u00eb dyt\u00eb, i nj\u00ebjti nuk \u00ebsht\u00eb proceduar p\u00ebr n\u00eb seanc\u00eb plenare.<\/p>\n<p>Vonesat e shumta p\u00ebr aprovimin e Projektligjit p\u00ebr pag\u00ebn minimale p\u00ebrb\u00ebjn\u00eb shkelje t\u00eb ligjit dhe interesave t\u00eb qytetar\u00ebve. Mostrajtimi i projektligjit p\u00ebr nj\u00eb koh\u00eb aq t\u00eb gjat\u00eb \u00ebsht\u00eb problematizuar vet\u00ebm nj\u00ebher\u00eb n\u00eb Komisionin p\u00ebr Buxhet, Pun\u00eb dhe Transfere (KBPT), nd\u00ebrsa sipas informacioneve zyrtare,\u00a0<a href=\"https:\/\/www.kuvendikosoves.org\/Uploads\/Data\/SessionFiles\/2022_05_05_ts_Seanca_5Bnr89WmEY.pdf\">p\u00ebrkund\u00ebr q\u00eb p\u00ebr k\u00ebt\u00eb projektligj kan\u00eb mbajtur fjalime 14 deputet\u00eb<\/a>, propozim-amendamente kan\u00eb parashtruar vet\u00ebm tre prej tyre. Niveli kaq i ul\u00ebt i propozimeve tregon p\u00ebr p\u00ebrkushtimin e deputet\u00ebve q\u00eb problematizuan disa \u00e7\u00ebshtje n\u00eb lexim t\u00eb par\u00eb, por q\u00eb nuk d\u00ebrguan amendamente p\u00ebr t\u2019i ndryshuar dhe plot\u00ebsuar ato.<\/p>\n<p>Komisioni p\u00ebr Buxhet, Pun\u00eb dhe Transfere (KBPT) p\u00ebrgjat\u00eb nj\u00eb viti nuk ka organizuar asnj\u00eb aktivitet si\u00e7 \u00ebsht\u00eb ai p\u00ebr d\u00ebgjimet publike, aktivitet i cili do t\u00eb mund\u00ebsonte marrjen e mendimeve nga ekspert\u00ebt, grupet e interesit, shoq\u00ebria civile dhe qytetar\u00ebt. Komisioni ka d\u00ebshtuar t\u00eb mbledh\u00eb informacione dhe d\u00ebshmi t\u00eb cilat do t\u00eb kishin ndikuar n\u00eb ligjb\u00ebrjen e Kuvendit, konkretisht t\u00eb k\u00ebtij projektligji. Praktika e mosorganizimit t\u00eb d\u00ebgjimeve publike nuk \u00ebsht\u00eb adekuate. N\u00eb rastin kur kemi t\u00eb b\u00ebjm\u00eb m\u00eb projektligje komplekse dhe kur propozimet jan\u00eb t\u00eb diskutueshme &#8211; t\u00eb kontestueshme ligj\u00ebrisht dhe politikisht &#8211; i takon Kuvendit q\u00eb brenda kompetencave t\u00eb tij t\u00eb zhvilloj\u00eb d\u00ebgjim publik, t\u00eb marr\u00eb informacione dhe k\u00ebshilla shtes\u00eb p\u00ebr probleme t\u00eb ve\u00e7anta q\u00eb lidhen me projektligjin, n\u00eb m\u00ebnyr\u00eb q\u00eb krejt n\u00eb fund t\u00eb sigurohet p\u00ebrfshirja e grupeve t\u00eb interesit.<\/p>\n<p>Por, problemet themelore nuk p\u00ebrb\u00ebjn\u00eb aspektet procedurale t\u00eb trajtimit t\u00eb k\u00ebtij projektligji. \u00a0P\u00ebrjashtimi i vendimmarrjes finale t\u00eb K\u00ebshilli Ekonomiko-Social si dhe injorimi i k\u00ebrkes\u00ebs p\u00ebr konsultim t\u00eb plot\u00eb, standard i p\u00ebrcaktuar nga Organizata Nd\u00ebrkomb\u00ebtare e Pun\u00ebs p\u00ebr caktimin e pag\u00ebs minimale, p\u00ebrb\u00ebjn\u00eb probleme p\u00ebrmbajtjesore t\u00eb k\u00ebtij projektligji.<\/p>\n<p>According to\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=2747\">legjislacionit aktual,<\/a>\u00a0K\u00ebshilli Ekonomiko-Social themelohet me q\u00ebllim t\u00eb vendosjes dhe zhvillimit t\u00eb dialogut social n\u00eb Republik\u00ebn e Kosov\u00ebs p\u00ebr t\u00eb pun\u00ebsuarit dhe pun\u00ebdh\u00ebn\u00ebsit, p\u00ebr \u00e7\u00ebshtje t\u00eb r\u00ebnd\u00ebsis\u00eb s\u00eb ve\u00e7ant\u00eb. P\u00ebrb\u00ebrja e KES-it p\u00ebrb\u00ebhet nga organizatat e t\u00eb pun\u00ebsuarve (sindikatat), organizatat e pun\u00ebdh\u00ebn\u00ebsve dhe Qeveria e Kosov\u00ebs, nd\u00ebrsa vendimet e KES-it miratohen me 2\/3 e votave t\u00eb an\u00ebtar\u00ebve t\u00eb p\u00ebrhersh\u00ebm t\u00eb KES-it.<\/p>\n<p>Projektligji i propozuar shkel parimet dhe standardet nd\u00ebrkomb\u00ebtare t\u00eb p\u00ebrcaktuara me k\u00ebt\u00eb ligj n\u00eb lidhje me vendimmarrjen prej shumic\u00ebs s\u00eb kualifikuar kur bie fjala p\u00ebr pag\u00ebn minimale.<\/p>\n<p>N\u00eb Nenin 6 t\u00eb projektligjit t\u00eb propozuar,\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDocumentDetail.aspx?ActID=2735\">ndryshohet Neni 56, paragrafi 1 Ligjit t\u00eb Pun\u00ebs<\/a>\u00a0me \u00e7ka i mund\u00ebsohet Qeveris\u00eb q\u00eb vet\u00ebm p\u00ebrmes njoftimit n\u00eb adres\u00eb t\u00eb K\u00ebshillit Ekonomiko-Social, t\u00eb vendos\u00eb p\u00ebr lart\u00ebsin\u00eb e pag\u00ebs minimale n\u00eb fund t\u00eb \u00e7do viti kalendarik dhe krejt kjo si pasoj\u00eb e munges\u00ebs eventuale t\u00eb propozimit\/konsensusit nga KES-i.<\/p>\n<p>M\u00ebnyra e p\u00ebrcaktimit t\u00eb pag\u00ebs minimale duhet shikuar n\u00eb kontekst t\u00eb nj\u00eb konsensusi t\u00eb gjer\u00eb social, ekonomik dhe politik. P\u00ebrvoja argumenton se sa m\u00eb e gjer\u00eb p\u00ebrb\u00ebrja, sa m\u00eb i madh dialogu nd\u00ebrmjet akter\u00ebve t\u00eb ndrysh\u00ebm, p\u00ebrcaktimi i pag\u00ebs minimale do t\u00eb shihej dhe do t\u00eb konsiderohej efektiv tek aplikimi i saj. Propozimi p\u00ebr nivelin e pag\u00ebs minimale duhet t\u00eb jet\u00eb pjes\u00eb e konsensusit t\u00eb gjer\u00eb nd\u00ebrmjet organizatave t\u00eb pun\u00ebs, organizatave sindikale dhe Qeveris\u00eb, sepse vet\u00ebm n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb \u00ebsht\u00eb efektiv miratimi i nj\u00eb politike t\u00eb till\u00eb publike sociale dhe ekonomike.<\/p>\n<p>K\u00ebrkesa p\u00ebr konsultim t\u00eb plot\u00eb \u00ebsht\u00eb k\u00ebrkes\u00eb bazike e cila rrjedh edhe nga Konventa Nr. 135 (1970) e Organizat\u00ebs Nd\u00ebrkomb\u00ebtare t\u00eb Pun\u00ebs p\u00ebr caktimin e pag\u00ebs minimale. Sipas k\u00ebsaj konvente, qeveria \u00ebsht\u00eb p\u00ebrgjegj\u00ebsja kryesore e cila i krijon dhe i ruan kushtet p\u00ebr nj\u00eb dialog t\u00eb mir\u00ebfillt\u00eb social dhe nj\u00eb proces q\u00eb do t\u2019i rriste shanset q\u00eb nj\u00eb pag\u00eb minimale t&#8217;u p\u00ebrgjigjet nevojave t\u00eb pal\u00ebve t\u00eb ndryshme dhe q\u00eb kontribuon n\u00eb zhvillimin mbar\u00ebkomb\u00ebtar. P\u00ebr m\u00eb tep\u00ebr, Komiteti i Ekspert\u00ebve t\u00eb ILO-s\u00eb p\u00ebr Aplikimin e Konvent\u00ebs dhe Rekomandimet q\u00eb ata i nxjerrin, thekson se konsultimi n\u00ebnkupton m\u00eb shum\u00eb sesa thjesht shk\u00ebmbim informacioni \u2013 konsultimi n\u00ebnkupton procesin i cili mb\u00ebrrin tek objektivi i pal\u00ebve q\u00eb t\u00eb arrihet nj\u00eb marr\u00ebveshje.<\/p>\n<p>K\u00ebto dy aspekte themelore, si\u00e7 shihet, nuk jan\u00eb par\u00eb t\u00eb r\u00ebnd\u00ebsishme nga Ministria e Financave, Pun\u00ebs dhe Transfereve.
