Ky hap \u00ebsht\u00eb vazhdim\u00ebsi e nj\u00eb s\u00ebr\u00eb veprimesh q\u00eb K\u00ebshilli Gjyq\u00ebsor i Kosov\u00ebs ka nd\u00ebrmarr\u00eb &#8211; si asnj\u00ebher\u00eb m\u00eb par\u00eb &#8211; p\u00ebr t\u00eb hapur sistemin gjyq\u00ebsor ndaj publikut.<\/em><\/h4>\n<p style=\"font-weight: 400;\">Emrat dhe mbiemrat e njer\u00ebzve t\u00eb d\u00ebnuar p\u00ebr korrupsion, vrasje ose krime tjera m\u00eb nuk do t\u00eb anonimizohen n\u00eb aktgjykimet q\u00eb i shpallin ata fajtor\u00eb p\u00ebr krimet q\u00eb kan\u00eb b\u00ebr\u00eb.<\/p>\n<p style=\"font-weight: 400;\">K\u00ebshtu ka vendosur K\u00ebshillit Gjyq\u00ebsor i Kosov\u00ebs (KGjK-s\u00eb), trupi q\u00eb \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr organizimin dhe funksionimin e gjykatave, me an\u00eb t\u00eb Udh\u00ebzimit p\u00ebr publikimin e vendimeve gjyq\u00ebsore 2025, t\u00eb miratuar n\u00eb mbledhjen 343, m\u00eb 28 shkurt 2024.<\/p>\n<p style=\"font-weight: 400;\">Vendimi i KGjK-s\u00eb p\u00ebr t\u00eb miratuar k\u00ebt\u00eb udh\u00ebzim dhe p\u00ebr t\u00eb hapur edhe m\u00eb shum\u00eb sistemin gjyq\u00ebsor n\u00ebp\u00ebrmjet procesit t\u00eb deanonimizimit t\u00eb vendimeve gjyq\u00ebsore, \u00ebsht\u00eb i mir\u00ebseardhur dhe me dometh\u00ebnie historike n\u00eb fush\u00ebn e rritjes s\u00eb transparenc\u00ebs s\u00eb sistemit gjyq\u00ebsor t\u00eb Kosov\u00ebs.<\/p>\n<p style=\"font-weight: 400;\">Fillimisht, vendimi korrekton nj\u00eb vendim t\u00eb gabuar t\u00eb KGjK-s\u00eb t\u00eb vitit 2016 p\u00ebr anonimizimin e t\u00eb gjitha vendimeve gjyq\u00ebsore (civile dhe penale), vendim ky q\u00eb kishte ndikuar n\u00eb uljen e transparenc\u00ebs s\u00eb sistemit gjyq\u00ebsor. Po ashtu, vendimi kishte b\u00ebr\u00eb q\u00eb gjykatat t\u00eb duken joprofesionale, pasi q\u00eb nj\u00eb pjes\u00eb e madhe e aktgjykimeve asnj\u00ebher\u00eb nuk jan\u00eb anonimizuar t\u00ebr\u00ebsisht dhe pal\u00ebt leht\u00ebsisht kan\u00eb mundur t\u00eb identifikohen (<a href=\"https:\/\/sbunker.org\/en\/analize\/ti-anonimizosh-kriminelet\/\">lexo k\u00ebtu analiz\u00ebn e vendimit t\u00eb kaluar<\/a>).<\/p>\n<p style=\"font-weight: 400;\">Vendimi p\u00ebr t\u00eb publikuar emrat dhe mbiemrat e personave t\u00eb d\u00ebnuar, p\u00ebrve\u00e7 q\u00eb \u00ebsht\u00eb obligim ligjor sipas legjislacionit penal n\u00eb fuqi, \u00ebsht\u00eb n\u00eb interes t\u00eb publikut pasi mund\u00ebson informimin p\u00ebr kryer\u00ebsit e krimeve dhe d\u00ebnimet ndaj tyre. Gjykimi dhe d\u00ebnimi i kriminel\u00ebve q\u00eb rrezikojn\u00eb shoq\u00ebrin\u00eb nuk duhet t\u00eb zhvillohet si nj\u00eb proces abstrakt ku nga vendimet gjyq\u00ebsore t\u00eb publikuara online nuk mund t\u00eb kuptohen as informacionet bazike si\u00e7 \u00ebsht\u00eb, p\u00ebr shembull, informacioni se p\u00ebr k\u00eb \u00ebsht\u00eb zhvilluar procesi gjyq\u00ebsor dhe n\u00ebse personi \u00ebsht\u00eb shpallur fajtor ose jo.<\/p>\n<p style=\"font-weight: 400;\">Arsye tjet\u00ebr p\u00ebrse ky udh\u00ebzim ka r\u00ebnd\u00ebsi t\u00eb madhe \u00ebsht\u00eb se anonimizimi i aktgjykimit dekurajon raportimin e vendimeve gjyq\u00ebsore ose hulumtimin e tyre (qoft\u00eb p\u00ebr nevoja t\u00eb monitorimit, akademike ose t\u00eb tjera), meqen\u00ebse aktgjykimet pas anonimizimit jan\u00eb aq t\u00eb pakuptueshme, sa k\u00ebrkohen p\u00ebrpjekje madhore p\u00ebr t\u00eb kuptuar rrethanat e rastit apo arsyeshm\u00ebrin\u00eb e dh\u00ebn\u00eb nga gjykatat. Publikimi me emra dhe mbiemra do ta b\u00ebj\u00eb m\u00eb t\u00eb leht\u00eb gjetjen e aktgjykimeve online dhe leximin e tyre dhe do t\u00eb kontribuoj\u00eb n\u00eb rritjen e monitorimit t\u00eb sistemit gjyq\u00ebsor nga ana e mediave, aktivist\u00ebve, hulumtuesve dhe organizatave joqeveritare.<\/p>\n<p style=\"font-weight: 400;\">Publikimi i vendimeve gjyq\u00ebsore penale me emra dhe mbiemra t\u00eb personave t\u00eb d\u00ebnuar \u00ebsht\u00eb n\u00eb linj\u00eb t\u00eb plot\u00eb m\u00eb m\u00ebnyr\u00ebn aktuale t\u00eb organizimit t\u00eb gjykimeve penale, ku seancat gjyq\u00ebsore, edhe ato ku shpallen aktgjykimet, jan\u00eb t\u00eb hapura p\u00ebr publikun dhe p\u00ebr mediat deri n\u00eb at\u00eb mas\u00eb sa mund t\u00eb transmetohen edhe live n\u00eb televizione ose online. P\u00ebrderisa emrat e personave t\u00eb akuzuar p\u00ebr krime b\u00ebhen publik\u00eb p\u00ebrgjat\u00eb zhvillimit t\u00eb gjykimit, \u00ebsht\u00eb e pakuptimt\u00eb q\u00eb n\u00eb fund t\u00eb procesit, pasi ata emra t\u00eb jen\u00eb b\u00ebr\u00eb t\u00eb njohur p\u00ebr publikun, t\u00eb anonimizohen.<\/p>\n<p style=\"font-weight: 400;\">Megjithat\u00eb, t\u00eb d\u00ebnuarit g\u00ebzojn\u00eb t\u00eb drejta si\u00e7 \u00ebsht\u00eb e drejta e privat\u00ebsis\u00eb dhe e drejta p\u00ebr t\u2019u risocializuar n\u00eb shoq\u00ebri pas kryerjes s\u00eb d\u00ebnimit. Draftuesit e udh\u00ebzimit kan\u00eb parapar\u00eb t\u00eb drejt\u00ebn e personave t\u00eb d\u00ebnuar q\u00eb t\u00eb largojn\u00eb t\u00eb dh\u00ebnat e tyre online, e njohur si \u201ce drejta p\u00ebr t\u2019u harruar\u201d, ashtu q\u00eb n\u00eb momentin kur d\u00ebnimi fshihet nga evidenca penale, aktgjykimi do largohet nga faqja e internetit e gjykat\u00ebs p\u00ebrkat\u00ebse. Kjo metod\u00eb balancon n\u00eb m\u00ebnyr\u00eb t\u00eb drejt\u00eb nevoj\u00ebn p\u00ebr transparenc\u00eb dhe t\u00eb drejt\u00ebn e privat\u00ebsis\u00eb s\u00eb t\u00eb d\u00ebnuarve pas kryerjes s\u00eb d\u00ebnimit. E drejta p\u00ebr t&#8217;u harruar \u00ebsht\u00eb e drejt\u00eb bashk\u00ebkohore ligjore q\u00eb u mund\u00ebson individ\u00ebve t\u00eb k\u00ebrkojn\u00eb heqjen e t\u00eb dh\u00ebnave t\u00eb tyre personale nga platformat online, motor\u00ebt e k\u00ebrkimit (search engine) ose nga bazat e t\u00eb dh\u00ebnave, ve\u00e7an\u00ebrisht kur t\u00eb dh\u00ebnat jan\u00eb t\u00eb vjetruara, jorelevante ose i shkaktojn\u00eb d\u00ebm individit.<\/p>\n<p style=\"font-weight: 400;\"><strong><em>Kur mund t\u00eb publikohen t\u00eb plota vendimet gjyq\u00ebsore civile dhe administrative?<\/em><\/strong><\/p>\n<p style=\"font-weight: 400;\">T\u00eb gjitha vendimet gjyq\u00ebsore civile dhe administrative, ku pal\u00eb jan\u00eb personat juridik\u00eb dhe institucionet publike, do t\u00eb publikohen t\u00eb plota dhe pa anonimizim. N\u00ebse n\u00eb t\u00eb nj\u00ebjtin aktgjykim p\u00ebrmenden edhe emra t\u00eb personave fizik\u00eb ata do t\u00eb anonimizohen.<\/p>\n<p style=\"font-weight: 400;\">Nj\u00eb vendim i till\u00eb i KGjK-s\u00eb \u00ebsht\u00eb i drejt\u00eb p\u00ebr shkak se n\u00eb gjykimet e fush\u00ebs civile ka raste t\u00eb shumta ku ka pak ose fare interes t\u00eb publikut q\u00eb t\u00eb kuptoj\u00eb identitetin e plot\u00eb t\u00eb pal\u00ebve si p\u00ebr shembull rastet rreth ndarjes s\u00eb pron\u00ebs n\u00eb mes t\u00eb personave fizik\u00eb privat\u00eb.<\/p>\n<p style=\"font-weight: 400;\">Megjithat\u00eb, udh\u00ebzimi l\u00eb hap\u00ebsir\u00eb q\u00eb vendimet gjyq\u00ebsore civile dhe administrative t\u00eb publikohen pa anonimizim p\u00ebr shkak t\u00eb interesit publik. P\u00ebr t\u00eb ndodhur di\u00e7ka e till\u00eb duhet t\u00eb p\u00ebrmbushet nj\u00ebri nga k\u00ebto kritere: publikimi i vendimeve kontribuon n\u00eb \u00e7\u00ebshtje me interes publik, pala e p\u00ebrfshir\u00eb \u00ebsht\u00eb figur\u00eb politike ose publike, si dhe \u00e7\u00ebshtja ka t\u00eb b\u00ebj\u00eb me shpenzimin e paras\u00eb publike.<\/p>\n<p style=\"font-weight: 400;\">Nj\u00eb gj\u00eb e till\u00eb nuk ka qen\u00eb e parapar\u00eb m\u00eb her\u00ebt dhe tani \u00ebsht\u00eb krijuar mund\u00ebsia q\u00eb vendimet gjyq\u00ebsore civile apo administrative t\u00eb publikohen pa anonimizim kur gjyqtari i \u00e7\u00ebshtjes konsideron q\u00eb ka interes t\u00eb p\u00ebrgjithsh\u00ebm p\u00ebr t\u2019i publikuar ato.<\/p>\n<p style=\"font-weight: 400;\">Mund t\u00eb argumentohet q\u00eb ekziston interes publik i lart\u00eb i publikimit t\u00eb vendimeve gjyq\u00ebsore civile t\u00eb plota pa anonimizim n\u00eb rastet q\u00eb nd\u00ebrlidhen me mbrojtjen e reputacionit nga shpifja p\u00ebrmes mediave. Aktualisht, Gjykata Themelore n\u00eb Prishtin\u00eb ka qindra raste t\u00eb shpifjes n\u00eb pun\u00eb. Vet\u00ebm vitin e kaluar jan\u00eb ushtruar m\u00eb shum\u00eb se 110 padi p\u00ebr shpifje, nj\u00eb pjes\u00eb e konsiderueshme e t\u00eb cilave p\u00ebrfshijn\u00eb media dhe figura publike. Aktgjykimet p\u00ebr shpifje q\u00eb p\u00ebrfshijn\u00eb media dhe figura publike \u2013 qoft\u00eb kur t\u00eb paditurit shpallen shpif\u00ebs ose jo \u2013 duhet t\u00eb publikohen, p\u00ebr shkak se k\u00ebto aktgjykime kan\u00eb r\u00ebnd\u00ebsi t\u00eb lart\u00eb p\u00ebr lirin\u00eb e shprehjes. Publikimi i tyre do t\u00eb mund\u00ebsonte monitorim m\u00eb t\u00eb madh dhe m\u00eb t\u00eb leht\u00eb t\u00eb m\u00ebnyr\u00ebs s\u00eb si gjykata i trajton k\u00ebto l\u00ebnd\u00eb dhe po ashtu do t\u2019ia mund\u00ebsonte publikut t\u00eb kuptonte cilat media abuzojn\u00eb lirin\u00eb e shprehjes, duke ia d\u00ebmtuar reputacionin njer\u00ebzve q\u00eb nuk e meritojn\u00eb t\u2019u d\u00ebmtohet reputacioni.<\/p>\n<p style=\"font-weight: 400;\"><strong><em>\u00a0<\/em><\/strong><strong><em>Rritja e transparenc\u00ebs s\u00eb sistemit gjyq\u00ebsor dhe mbrojtja nga ndikimi politik<\/em><\/strong><\/p>\n<p style=\"font-weight: 400;\">K\u00ebshilli Gjyq\u00ebsor i Kosov\u00ebs ka nd\u00ebrmarr\u00eb veprime t\u00eb lavd\u00ebrueshme q\u00eb kan\u00eb rritur transparenc\u00ebn e sistemit gjyq\u00ebsor t\u00eb Kosov\u00ebs dhe q\u00eb mund t\u00eb sh\u00ebrbejn\u00eb si shembull p\u00ebr institucionet tjera.<\/p>\n<p style=\"font-weight: 400;\">Arritja me e madhe \u00ebsht\u00eb forcimi i transparenc\u00ebs dhe meritokracis\u00eb n\u00eb p\u00ebrzgjedhjen e gjyqtar\u00ebve. KGjK-ja \u00ebsht\u00eb p\u00ebrgjegj\u00ebse p\u00ebr rekrutimin e gjyqtar\u00ebve, t\u00eb cil\u00ebt pastaj dekretohen nga ana e Presidentes s\u00eb Kosov\u00ebs. N\u00eb kat\u00ebr vjet\u00ebt e kaluar jan\u00eb rekrutuar rreth 150 gjyqtar\u00eb n\u00eb procese t\u00eb ndryshme q\u00eb jan\u00eb zhvilluar n\u00ebn monitorim t\u00eb rrept\u00eb t\u00eb organizatave joqeveritare dhe komunitetit nd\u00ebrkomb\u00ebtar n\u00eb Kosov\u00eb. KGjK-ja, jo vet\u00ebm q\u00eb ka qen\u00eb e hapur ndaj monitoruesve, por \u00ebsht\u00eb siguruar q\u00eb ata s\u00eb fundmi t\u00eb ken\u00eb qasje n\u00eb aktivitetet parap\u00ebrgatitore t\u00eb rekrutimit (nga p\u00ebrgatitja e pyetjeve e deri te vler\u00ebsimi dhe intervistimi i kandidat\u00ebve), duke ua mund\u00ebsuar atyre t\u00eb krijojn\u00eb nj\u00eb vler\u00ebsim p\u00ebr procesin n\u00eb t\u00ebr\u00ebsi. Megjithat\u00eb, praktika e K\u00ebshillit q\u00eb t\u00eb k\u00ebrkoj\u00eb nga monitoruesit e proceseve rekrutuese t\u00eb n\u00ebnshkruajn\u00eb <em>deklarata p\u00ebr ruajtjen e konfidencialitetit<\/em> meriton diskutim serioz p\u00ebr t\u2019u siguruar q\u00eb liria e shprehjes dhe roli i orgnizatave joqeveritare nuk kufizohet paarsyesh\u00ebm.<\/p>\n<p style=\"font-weight: 400;\">T\u00eb gjitha mbledhjet e KGjK-s\u00eb transmetohen live n\u00eb kanalin e youtube t\u00eb vet\u00eb institucionit dhe \u00e7dokush ka mund\u00ebsi t\u00eb ndjek\u00eb n\u00eb koh\u00eb reale ose m\u00eb pas, diskutimet dhe vendimet q\u00eb merren aty.<\/p>\n<p style=\"font-weight: 400;\">K\u00ebshilli \u00ebsht\u00eb nd\u00ebr t\u00eb pakt\u00ebt, n\u00ebse jo i vetmi institucion publik n\u00eb Kosov\u00eb, q\u00eb me vetiniciativ\u00eb ka v\u00ebn\u00eb n\u00eb dispozicion mbledhjet p\u00ebr publikun e gjer\u00eb n\u00ebp\u00ebrmjet transmetimit live online. K\u00ebshtu, secili an\u00ebtar i publikut ka mund\u00ebsi q\u00eb t\u00eb monitoroj\u00eb n\u00eb vazhdim\u00ebsi pun\u00ebn e K\u00ebshillit online ose duke shkuar fizikisht n\u00eb zyrat e tij.<\/p>\n<p style=\"font-weight: 400;\">Nj\u00eb an\u00eb tjet\u00ebr pozitive e KGjK-s\u00eb \u00ebsht\u00eb organizimi i p\u00ebrvitsh\u00ebm i ngjarjes \u201cDit\u00ebt e Gjyq\u00ebsorit\u201d, ku gjyqtar\u00ebt prezantojn\u00eb dhe ndajn\u00eb me publikun pun\u00ebt e tyre, por nj\u00ebkoh\u00ebsisht ftojn\u00eb edhe p\u00ebrfaq\u00ebsues t\u00eb shoq\u00ebris\u00eb civile e aktivist\u00eb t\u00eb cil\u00ebt shfryt\u00ebzojn\u00eb pik\u00ebrisht k\u00ebto ngjarje t\u00eb ndajn\u00eb p\u00ebrshtypjet e tyre, duke p\u00ebrfshir\u00eb kritikat e tyre, me p\u00ebrfaq\u00ebsuesit m\u00eb t\u00eb lart\u00eb t\u00eb sistemit gjyq\u00ebsor (autorja e k\u00ebtij blogu ka qen\u00eb e ftuar si fol\u00ebse n\u00eb vitin 2023).<\/p>\n<p style=\"font-weight: 400;\">T\u00eb gjitha k\u00ebto veprime konkrete q\u00eb kan\u00eb sh\u00ebrbyer p\u00ebr rritjen e transparenc\u00ebs \u2013 transmetimi i mbledhjeve live online, organizimi i proceseve transparente t\u00eb rekrutimit, zhvillimi i dialogut\u00a0 t\u00eb vazhduesh\u00ebm me pushtetin e kat\u00ebrt, etj \u2013 duhet t\u00eb sh\u00ebrbejn\u00eb si model i qasjes s\u00eb hapur ndaj publikut dhe duhet t\u00eb ndiqen nga institucionet tjera publike n\u00eb vend.<\/p>\n<p style=\"font-weight: 400;\">Rritja e transparenc\u00ebs n\u00eb sistemin gjyq\u00ebsor \u00ebsht\u00eb b\u00ebr\u00eb gjat\u00eb koh\u00ebs sa KGjK-ja ka p\u00ebrb\u00ebrjen aktuale t\u00eb udh\u00ebhequr nga kryesuesi i saj Albert Zogaj. Ai dhe an\u00ebtar\u00ebt e tjer\u00eb t\u00eb K\u00ebshillit mbeten m\u00eb meritor\u00ebt p\u00ebr arritjet pozitive t\u00eb viteve t\u00eb fundit n\u00eb pushtetin gjyq\u00ebsor. K\u00ebshilli aktual do t\u00eb mbahet n\u00eb mend q\u00eb ka l\u00ebn\u00eb trash\u00ebgimi nisjen e luft\u00ebs kund\u00ebr korrupsionit n\u00eb sistemin gjyq\u00ebsor, krijimin e gjeneratave t\u00eb reja t\u00eb gjykat\u00ebsve profesionist\u00eb dhe me integritet dhe rritjen radikale t\u00eb transparenc\u00ebs s\u00eb sistemit gjyq\u00ebsor.<\/p>\n<p style=\"font-weight: 400;\">Ata po ashtu do t\u00eb mbahen n\u00eb mend si t\u00eb vetmit q\u00eb kan\u00eb guxuar t\u00eb ngren\u00eb z\u00ebrin n\u00eb mbrojtje t\u00eb gjyq\u00ebsorit kur ai sulmohej nga partia n\u00eb pushtet L\u00ebvizja Vet\u00ebvendosje, duke kritikuar dhe ballafaquar p\u00ebrfaq\u00ebsuesit e saj edhe n\u00eb studio televizive dhe duke ia d\u00ebshmuar me pun\u00eb politik\u00ebs q\u00eb vetingu i propozuar ishte i pamenduar mir\u00eb dhe i panevojsh\u00ebm dhe se gjyq\u00ebsori duhet t\u00eb rregullohet fillishimisht p\u00ebrbrenda.
