N\u00eb fakt, n\u00eb vend se disa nga pabarazit\u00eb, konfliktet nd\u00ebrprogramore dhe paqart\u00ebsit\u00eb e njohura t\u00eb k\u00ebtij sistemi t\u00eb zgjidheshin p\u00ebrmes dialogut social, ato kan\u00eb filluar t\u00eb shtrohen n\u00eb gjykata. Kjo performanc\u00eb bie ndesh me orientimin social demokratik t\u00eb LVV-s\u00eb dhe premtimet zgjedhore t\u00eb saj.<\/p>\n<p>P\u00ebr shembull, m\u00eb 16 janar 2023, Gjykata Kushtetuese e Kosov\u00ebs publikoi nj\u00eb\u00a0<a href=\"https:\/\/gjk-ks.org\/wp-content\/uploads\/2023\/01\/ko_190_19_agj_shq.pdf\">aktgjykim<\/a>\u00a0me t\u00eb cilin e shpall njohjen e pjes\u00ebrishme t\u00eb stazhit t\u00eb pun\u00ebs p\u00ebr periudh\u00ebn e viteve 1990-t\u00eb n\u00eb mospajtim me Kushtetut\u00ebn e Kosov\u00ebs dhe konventat e zbatueshme nd\u00ebrkomb\u00ebtare (nenet p\u00ebr barazi para ligjit, ndalim t\u00eb diskriminimit dhe ndalim t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb diskriminimit). Me legjislacionin n\u00eb fuqi, stazhi i ishte njohur vet\u00ebm disa kategorive t\u00eb pun\u00ebtor\u00ebve t\u00eb sistemit socialist, q\u00eb m\u00eb pas ishin angazhuar n\u00eb ish-qeverin\u00eb ose shtetin paralel kosovar, por jo edhe pun\u00ebtor\u00ebve t\u00eb tjer\u00eb q\u00eb kishin humbur krejt\u00ebsisht pun\u00ebn p\u00ebr shkak t\u00eb masave diskriminuese t\u00eb regjimit jugosllav pas 1989-t\u00ebs. Kjo (mos)njohje pastaj ka ndikuar kualifikimin p\u00ebr pensionin ose kompensimin q\u00eb Qeveria ua b\u00ebn kontribuesve t\u00eb sistemit pensional t\u00eb paraluft\u00ebs, pasi p\u00ebr kualifikim k\u00ebrkohen s\u00eb paku 15 vite stazh pune (ose kontribuimi). Me k\u00ebt\u00eb aktgjykim, nenet e legjislacionit n\u00eb fuqi q\u00eb p\u00ebrkufizojn\u00eb njohjen e pjes\u00ebrishme t\u00eb stazhit shfuqizohen nga 15 korriku 2023.<\/p>\n<p>Nj\u00eb shembull tjet\u00ebr i r\u00ebnd\u00ebsish\u00ebm ilustrues i aktivizimit t\u00eb gjykatave n\u00eb munges\u00eb t\u00eb reform\u00ebs n\u00eb sistemin e mbrojtjes sociale jan\u00eb aktgjykimet e gjykatave t\u00eb rregullta n\u00eb lidhje me pensionin e aft\u00ebsis\u00eb s\u00eb p\u00ebrhershme t\u00eb kufizuar. Viteve t\u00eb fundit, disa aktgjykime t\u00eb k\u00ebtilla t\u00eb ve\u00e7anta \u00a0u kan\u00eb dh\u00ebn\u00eb t\u00eb drejt\u00eb p\u00ebrfituesve t\u00eb k\u00ebtij pensioni t\u00eb jen\u00eb aktiv\u00eb (duke punuar me pag\u00eb), n\u00eb kund\u00ebrshtim me interpretimin n\u00eb praktik\u00eb t\u00eb Qeveris\u00eb, e cila, ndon\u00ebse pa baz\u00eb ligjore, e zbaton programin si transfer social vet\u00ebm p\u00ebr persona me paaft\u00ebsi\u00a0<em>t\u00eb plot\u00eb\u00a0<\/em>t\u00eb p\u00ebrhershme p\u00ebr pun\u00eb. Pra, nisur nga k\u00ebto interpretime t\u00eb gjykatave t\u00eb rregullta, shteti mund t\u00eb jet\u00eb duke penalizuar rreth 19,500 persona q\u00eb marrin pension p\u00ebr aft\u00ebsi t\u00eb p\u00ebrhershme t\u00eb kufizuar nga e drejta p\u00ebr pun\u00eb. N\u00eb\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=9517\">ligjin p\u00ebr Pensionet e Financuara nga Shteti<\/a>\u00a0and\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=9517\">udh\u00ebzimin p\u00ebrkat\u00ebs administrativ<\/a>, askund nuk p\u00ebrmendet \u2013 si\u00e7 p\u00ebrmendej n\u00eb\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=9517\">ligjin paraprak t\u00eb trash\u00ebguar nga UNMIK-u<\/a>\u00a0\u2013 se p\u00ebrfituesit e pensionit duhet t\u00eb ken\u00eb paaft\u00ebsi\u00a0<em>t\u00eb plot\u00eb<\/em>\u00a0pune. Duke e zbatuar k\u00ebt\u00eb pension si m\u00eb her\u00ebt, pavar\u00ebsisht ndryshimeve ligjore q\u00eb kan\u00eb ndodhur m\u00eb 2014\/15, shteti jo vet\u00ebm q\u00eb shkel ligjin, por diskriminon k\u00ebt\u00eb kategori shoq\u00ebrore edhe n\u00eb rrafshin e p\u00ebrfshirjes sociale (ku b\u00ebn pjes\u00eb edhe p\u00ebrfshirja n\u00eb tregun e pun\u00ebs), ndryshe nga programet tjera q\u00eb mbulojn\u00eb personat me aft\u00ebsi t\u00eb kufizuar (si p.sh. pensionet p\u00ebr t\u00eb verbrit, p\u00ebr personat tetraplegjik\u00eb dhe paraplegjik\u00eb, dhe p\u00ebr invalid\u00ebt ushtarak\u00eb dhe civil\u00eb t\u00eb luft\u00ebs).<\/p>\n<p>K\u00ebto pabarazi e diskriminime, si dhe konfliktet e paqart\u00ebsit\u00eb brenda dhe nd\u00ebrmjet programeve sociale, q\u00eb adresoheshin me nismat reformuese t\u00eb pajet\u00ebsuara, do t\u00eb duhej t\u00eb zgjidheshin me negocim mbar\u00ebshoq\u00ebror, t\u00eb hapur dhe t\u00eb drejtuar nga Qeveria, e jo me aktgjykime dhe interpretime gjykatash. Negocimi duhet t\u00eb konsideroj\u00eb edhe dimensione tjera si\u00e7 jan\u00eb: ngarkesat e reja buxhetore, p\u00ebrshtatja e kapacitetit implementues t\u00eb administrat\u00ebs, ambiciet e p\u00ebrfshirjes sociale, solidaritetit, e t\u00eb tjera.<\/p>\n<p>K\u00ebshtu, kompensimi aktual nga shteti p\u00ebr ish-kontributdh\u00ebn\u00ebsit l\u00ebshohet p\u00ebr rreth 48,500 persona (t\u00eb dh\u00ebnat e\u00a0<a href=\"https:\/\/ask.rks-gov.net\/media\/7263\/statistikat-e-mireqenies-sociale-dhjetor-2023.pdf\">dhjetorit 2022<\/a>), kurse 206,386 persona kan\u00eb qen\u00eb n\u00eb marr\u00ebdh\u00ebnie formale pune m\u00eb 1984 (viti i fundit relevant p\u00ebr t\u00eb b\u00ebr\u00eb 15 vite stazh t\u00eb njohur pune p\u00ebr kualifikim). N\u00ebse kriteri i njohjes s\u00eb pjes\u00ebrishme t\u00eb stazhit &#8211; vet\u00ebm p\u00ebr kategorit\u00eb e t\u00eb pun\u00ebsuarve nga Qeveria paralele &#8211; shfuqizohet dhe vendime tjera nga Qeveria\/Kuvendi i sot\u00ebm nuk do ket\u00eb, at\u00ebher\u00eb n\u00eb parim deri af\u00ebr 150,000 persona tjer\u00eb (nj\u00eb pjes\u00eb e t\u00eb cil\u00ebve mund t\u00eb ket\u00eb emigruar dhe jeton jasht\u00eb vendit) mund t\u00eb kualifikohen p\u00ebr pension, \u00e7far\u00eb r\u00ebndon shpenzimin social. Pabarazia dhe diskrimini aktual n\u00eb pension (si\u00e7 kuptohen n\u00eb aktgjykim) brenda grupit t\u00eb ish-kontributdh\u00ebn\u00ebsve do t\u00eb hiqeshin, mir\u00ebpo kjo nuk do t\u2019i sh\u00ebrbente interesave tjera t\u00eb r\u00ebnd\u00ebsishme shoq\u00ebrore, si rritja e solidaritetit shoq\u00ebror p\u00ebrmes rishikimit t\u00eb baz\u00ebs s\u00eb financimit q\u00eb sot i kontribuon rishp\u00ebrndarjes perverse (duke marr\u00eb nga t\u00eb varfrit p\u00ebr t\u00eb \u00e7uar drejt nj\u00eb kategorie q\u00eb historikisht ka qen\u00eb n\u00eb pun\u00eb, pra m\u00eb mir\u00eb se shumica e t\u00eb tjer\u00ebve t\u00eb papun\u00eb), p\u00ebrmir\u00ebsimit t\u00eb q\u00ebndrueshm\u00ebris\u00eb afatgjat\u00eb t\u00eb sistemit pensional, incentivizimit t\u00eb pun\u00ebsimit, etj.<\/p>\n<p>Tutje, n\u00eb rastin e personave q\u00eb marrin pensionin p\u00ebr aft\u00ebsin\u00eb e p\u00ebrhershme t\u00eb kufizuar, proceset gjyq\u00ebsore q\u00eb kan\u00eb kontekstuar penalizimin e t\u00eb drejt\u00ebs p\u00ebr pun\u00eb t\u00eb k\u00ebtyre personave (n\u00eb rastet kur mund t\u00eb punojn\u00eb) kan\u00eb zgjatur me vite. N\u00eb vend se t\u00eb detyrohen t\u00eb kalojn\u00eb procedura dhe stres t\u00eb k\u00ebtill\u00eb, reforma e sistemit t\u00eb mbrojtjes sociale do duhej t\u00eb siguronte q\u00eb t\u00eb p\u00ebrshtaten t\u00eb gjitha pjes\u00ebt e ve\u00e7anta t\u00eb sistemit p\u00ebr t\u2019i kontribuuar dhe ndihmuar p\u00ebrfshirjes sa m\u00eb t\u00eb gj\u00ebr\u00eb sociale t\u00eb k\u00ebtyre personave.<\/p>\n<p>Prandaj, vendimi i Gjykat\u00ebs Kushtetuese me aktgjykimin e p\u00ebrmendur m\u00eb lart\u00eb, q\u00eb Qeveria dhe Kuvendi brenda gjasht\u00eb muajsh ta plot\u00ebsojn\u00eb legjislacionin n\u00eb lidhje me stazhin e kontributdh\u00ebn\u00ebsve, duhet t\u00eb shfryt\u00ebzohet p\u00ebr t\u2019iu rikthyer reform\u00ebs s\u00eb p\u00ebrgjithshme.<\/p>\n<p>Deri m\u00eb tash, Qeveria e LVV-s\u00eb ka argumentuar se nj\u00eb pjes\u00eb e reformave, q\u00eb premtohen me\u00a0<a href=\"https:\/\/masht.rks-gov.net\/wp-content\/uploads\/2022\/06\/Programi-i-Qeverise-se-Kosoves-2021-2025.pdf\">programin e saj qeveris\u00ebs (2021-2025)<\/a>, \u00ebsht\u00eb penguar nga moskalimi i nj\u00eb\u00a0<a href=\"http:\/\/www.kuvendikosoves.org\/Uploads\/Data\/Documents\/162Marreveshja_ueuHWbwzhh.pdf\">marr\u00ebveshjeje<\/a>\u00a0huazimi, n\u00eb vler\u00eb t\u00eb 47 milion\u00eb eurove, me Asociacionin Nd\u00ebrkomb\u00ebtar p\u00ebr Zhvillim (pjes\u00eb e Grupit t\u00eb Bank\u00ebs Bot\u00ebrore). Kjo qasje \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me zotimet programore t\u00eb Qeveris\u00eb s\u00eb LVV-s\u00eb p\u00ebr ristrukturim t\u00eb skemave sociale e pensionale n\u00eb kuad\u00ebr t\u00eb politikave publike m\u00eb progresive dhe t\u00eb vet\u00ebvendosjes m\u00eb t\u00eb madhe vendore. Organizatat nd\u00ebrkomb\u00ebtare duhet t\u00eb ndihmojn\u00eb me ekspertiz\u00ebn dhe pranin\u00eb e tyre n\u00eb proces, mir\u00ebpo nuk duhet lejuar q\u00eb t\u00eb rikthehen si vendimmarr\u00ebse dominuese. Disa nga zgjidhjet e shtyra n\u00eb t\u00eb kaluar\u00ebn nga k\u00ebto organizata, si Banka Bot\u00ebrore, kan\u00eb d\u00ebshtuar t\u00eb mb\u00ebshtesin solidaritetin shoq\u00ebror dhe demokratizimin e vendit, duke qen\u00eb t\u00eb orientuara m\u00eb shum\u00eb nga ideologjia neoliberale sesa nga nevojat lokale.<\/p>\n<p>Kosova duhet t\u00eb filloj\u00eb t\u00eb mendoj\u00eb vet\u00eb dhe kontekstualisht p\u00ebr problemet dhe mbrojtjen sociale q\u00eb form\u00ebson karakterin e n\u00ebnshtet\u00ebsis\u00eb: koha \u00ebsht\u00eb e mjaftueshme, aft\u00ebsi vendore ka, dhe ekziston edhe nj\u00eb tradit\u00eb e negocimit dhe kapacitetit implementues.<\/p>\n<p>Konkretisht, Qeveria mund ta prioritizoj\u00eb krijimin e nj\u00eb shtylle n\u00eb sistemin pensional t\u00eb njohur si\u00a0<em>Beveridge<\/em>\u00a0(me pagesa t\u00eb barabarta\/sheshta, l\u00ebshuar p\u00ebr dhe financuar nga kontributdh\u00ebn\u00ebsit) p\u00ebr ta vendosur nd\u00ebrmjet pensionit baz\u00eb universal dhe kursimeve personale. Kjo shtyll\u00eb do t\u00eb ishte modeste. Do t\u00eb mund t\u00eb paguante, t\u00eb themi, 150 EUR n\u00eb muaj p\u00ebr fillim (mbi pensionin baz\u00eb \u2013 i qassh\u00ebm nga t\u00eb gjith\u00eb t\u00eb moshuarit), me kushtin e 20-25 viteve kontribuim qoft\u00eb n\u00eb sistemin e para 1989 (me njohje t\u00eb viteve 1990) qoft\u00eb n\u00eb Fondin e Kursimeve Pensionale t\u00eb Kosov\u00ebs (t\u00eb njohur si Trust-i) dhe me kushtin e banimit n\u00eb Kosov\u00eb. Pra, n\u00eb pensionin\u00a0<em>Beveridge<\/em>\u00a0do t\u00eb kualifikoheshin automatikisht p\u00ebrfituesit e skem\u00ebs aktuale kontributdh\u00ebn\u00ebse dhe do t\u00eb shtoheshin t\u00eb tjer\u00ebt bazuar n\u00eb kriteret e reja. Pensioni do t\u00eb mund t\u00eb menaxhohej nga Trusti, q\u00eb do t\u00eb mund t\u00eb transformohej n\u00eb Administrat\u00ebn e Sigurimit Shoq\u00ebror (ASS), duke zgjeruar p\u00ebrgjegj\u00ebsit\u00eb e tij p\u00ebrtej menaxhimit t\u00eb kursimeve pensionale &#8211; n\u00eb menaxhim t\u00eb sigurimeve sociale. Kjo zgjidhje do t\u00eb shmangte shum\u00eb pabarazi n\u00eb kualifikim, por edhe do t\u00eb ndikonte n\u00eb nxitjen e pun\u00ebsimit, solidaritetin shoq\u00ebror, rishp\u00ebrndarjen dhe balancimin e baz\u00ebs s\u00eb financimit t\u00eb pensioneve, si dhe n\u00eb rritjen e adekuat\u00ebsis\u00eb s\u00eb ardhshme pensionale.<\/p>\n<p>N\u00eb shembullin tjet\u00ebr konkret, q\u00eb ka t\u00eb b\u00ebj\u00eb me personat me aft\u00ebsi t\u00eb kufizuara, Kosova mund ta universalizoj\u00eb\u00a0 l\u00ebshimin e transfereve sociale (pra t\u00eb mos ket\u00eb qasje kategorike dhe me kritere t\u00eb ndryshme) bazuar n\u00eb shkall\u00eb t\u00eb p\u00ebrqindjes t\u00eb humbjes s\u00eb kapacitetit funksional t\u00eb p\u00ebrhersh\u00ebm p\u00ebr mb\u00ebshtetje t\u00eb jetes\u00ebs (jo vet\u00ebm t\u00eb pun\u00ebs). Disa vende n\u00eb Europ\u00eb l\u00ebshojn\u00eb kompensime nga shkalla 25% e lart\u00eb e paaft\u00ebsis\u00eb, e shum\u00eb t\u00eb tjera nisin nga shkalla 50% (p.sh.\u00a0<a href=\"https:\/\/ec.europa.eu\/social\/BlobServlet?docId=26480&amp;langId=en\">Suedia, Hugaria, etj.<\/a>). P\u00ebrve\u00e7q\u00eb nuk duhet t\u00eb ndalohet p\u00ebrfshirja n\u00eb tregun e pun\u00ebs, p\u00ebrfshirja mund t\u00eb mb\u00ebshtetet e leht\u00ebsohet me incentiva t\u00eb tjera n\u00eb kuad\u00ebr t\u00eb formimit t\u00eb sigurimit shoq\u00ebror dhe shtetnd\u00ebrtimit t\u00eb gjithansh\u00ebm (si\u00e7 b\u00ebhet sot me disa nga taksat e aplikuara).<\/p>\n<p>Afati deri m\u00eb 15 korrik jep koh\u00eb t\u00eb mjaftueshme p\u00ebr t\u00eb negociuar nj\u00eb kontrat\u00eb sociale t\u00eb nevojshme dhe m\u00eb progresive. Mir\u00ebpo, k\u00ebrkohet paradigm\u00eb e re politikash, me m\u00eb shum\u00eb dialog dhe vendimmarrje vendore. N\u00eb p\u00ebrgjith\u00ebsi, kontrata e rinegociuar sociale do duhej t\u2019i kontribuoj\u00eb rritjes s\u00eb solidaritetit, barazis\u00eb gjinore, balancit gjenerativ t\u00eb shpenzimit social dhe zgjerimit t\u00eb k\u00ebtij shpenzimi kah sh\u00ebrbimet sociale (kujdesi i hersh\u00ebm p\u00ebr f\u00ebmij\u00ebt, kujdesi sh\u00ebndet\u00ebsor, kujdesi afatgjat\u00eb p\u00ebr personat n\u00eb nevoj\u00eb, etj).
