{"id":13127,"date":"2025-09-04T12:38:16","date_gmt":"2025-09-04T10:38:16","guid":{"rendered":"https:\/\/sbunker.org\/?p=13127"},"modified":"2025-09-04T12:39:29","modified_gmt":"2025-09-04T10:39:29","slug":"arrestimi-ndalimi-dhe-pranimi-i-fajesise-i-igor-popoviqit-fiasko-per-diplomacine-serbe","status":"publish","type":"post","link":"https:\/\/sbunker.org\/en\/opinion\/arrestimi-ndalimi-dhe-pranimi-i-fajesise-i-igor-popoviqit-fiasko-per-diplomacine-serbe\/","title":{"rendered":"Igor Popovic\u2019s Arrest, Detention, and Plea Deal in Kosovo: A Fiasco for Serbian Diplomacy"},"content":{"rendered":"<p class=\" translation-block\">On July 18, Kosovo Police <\/span><a href=\"https:\/\/www.slobodnaevropa.org\/a\/hapsenje-kancelarija-za-kosovo-popovic-srbija\/33478031.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">arrested<\/span><\/a><span style=\"font-weight: 400\"> Igor Popovic, former Deputy Director of the Office for Kosovo and Metohija (Serbian government office in charge of the EU facilitated dialogue with Pristina), on charges of inciting ethnic hatred after he referred to the Kosovo Liberation Army (KLA) as a terrorist organization.<\/p>\n<p><span style=\"font-weight: 400;\">This is not the first time a Serbian official was arrested. In 2018, Marko Djuric, then Director of the Office, was arrested for illegally crossing into Kosovo.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Such arrests are rare. The main difference is that Djuric was promptly released, while Popovic faced a 30-day detention, reflecting both the gravity of the alleged offense and strained relations between Belgrade and Pristina.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under international law, particularly the 1961 Vienna Convention, the arrest of foreign officials is prohibited, and host states are obliged to ensure the security of such officials. However, since Serbia does not recognize Kosovo as a state, it has not invoked diplomatic immunity for its officials.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite the norm, there have been notable breaches where officials protected by immunity were arrested or detained: the Iran Hostage Crisis (1979\u201381), when over 50 U.S. diplomats were held captive; the detention of a Belarusian diplomat in Moscow in the 1990s, resolved after Minsk\u2019s protest; and Bosnian Serbs\u2019 detention of UN peacekeepers in 1995, ended by international pressure.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Most of these incidents occurred in countries experiencing severe conflict or political crises.\u00a0<\/span><\/p>\n<p class=\" translation-block\">However, Popovic was neither an accredited diplomat, since Serbia does not recognize Kosovo, nor a high official under the <\/span><a href=\"https:\/\/www.kim.gov.rs\/p21.php\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">2014 Agreement on Official Visits<\/span><\/a><span style=\"font-weight: 400\">. The Agreement only applies to top political leaders, ministers, parliamentary deputies, heads of government offices and agencies, high judicial officials, prosecutors, and religious leaders.<\/p>\n<p><span style=\"font-weight: 400;\">As a deputy director of a government office, Popovic falls outside this list. Thus, while a public official under Serbian law, in Kosovo he was treated as any other foreign citizen and subject to domestic rules.\u00a0<\/span><\/p>\n<p class=\" translation-block\">Additionally, Serbia and Kosovo do not recognize each other\u2019s courts, yet the Popovic case may challenge this. Popovic did not contest the charges on free speech grounds and reached a plea deal in the Basic Court in Pristina by <\/span><a href=\"https:\/\/www.danas.rs\/vesti\/politika\/igor-popovic-priznao-krivicu-kosovo\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">pleading guilty<\/span><\/a><span style=\"font-weight: 400\">. In turn, he was fined \u20ac3,000, expelled, and banned from entering Kosovo for two years.<\/p>\n<p><span style=\"font-weight: 400;\">An important question is whether this sets a precedent for the future. One might assume that when a Serbian public official appears before a Kosovo court and signs a plea agreement with the Kosovo prosecutor, it could influence Belgrade\u2019s official stance toward Kosovo\u2019s judiciary. However, in this instance, no precedent was established.\u00a0<\/span><\/p>\n<p class=\" translation-block\">The Serbian Ministry of Justice  <\/span><a href=\"https:\/\/www.rtv.rs\/sr_lat\/politika\/ministarstvo-pravde-sporazum-o-priznanju-krivice-popovica-ne-proizvodi-pravno-dejstvo-u-srbiji_1649033.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">stated<\/span><\/a><span style=\"font-weight: 400\"> that Popovic\u2019s plea deal has no legal effect in Serbia, claiming he was forced to plead guilty under pressure and that his rights were violated.<\/p>\n<p class=\" translation-block\">However, <\/span><a href=\"https:\/\/telegrafi.com\/demantohet-serbia-pa-kercenime-e-presione-deklarata-e-plote-e-popoviqit-kur-e-pranoi-fajesine-ne-prishtine\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">video footage<\/span><\/a><span style=\"font-weight: 400\"> of the verdict tells a different story. When asked by a Kosovo judge if he felt pressured to plead guilty, Popovic replied no. Regardless, upon returning to Serbia, he  <\/span><a href=\"https:\/\/kossev.info\/popovic-priznao-krivicu-pa-usmeno-otpriznao-nakon-ulaska-u-centralnu-srbiju-ministarstvo-pravde-smatra-sporazum-nevazecim\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">rejected <\/span><\/a><span style=\"font-weight: 400\"> the plea deal, stating, \u201c<\/span><i><span style=\"font-weight: 400\">there is no deal with Kurti\u2019s judiciary.\u201d<\/span><\/i><span style=\"font-weight: 400\"><\/span><\/p>\n<p><span style=\"font-weight: 400;\">The arrest, detention, and handling of the Igor Popovic case have come at a high cost for Serbia, damaging its image and credibility.\u00a0<\/span><\/p>\n<p class=\" translation-block\">To complicate matters, during Popovic\u2019s custody in Kosovo, Dukagjini TV published evidence that he had <\/span><a href=\"https:\/\/www.danas.rs\/vesti\/politika\/igor-popovic-eu-tajni-snimak-mediji-bia\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">secretly recorded<\/span><\/a><span style=\"font-weight: 400\"> closed meetings with EU officials, allegedly on behalf of the Serbian Security Information Agency (BIA). The release of the recording at the time of his arrest placed Serbia in a difficult position, undermined Popovic\u2019s standing, and may have influenced his decision to plead guilty.<\/p>\n<p class=\" translation-block\">Given the ongoing <\/span><a href=\"https:\/\/sbunker.org\/en\/analize\/vuciqi-dhe-sns-ja-nuk-kane-me-monopol-lavjerresi-politik-ne-serbi-po-lekundet\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">political crisis<\/span><\/a><span style=\"font-weight: 400\"> and civil unrest in Serbia, the Brussels recording scandal could further strain relations with the EU.
