N\u00eb ve\u00e7anti, KES-i ka p\u00ebr synim zhvillimin e dialogut social p\u00ebr t\u00eb pun\u00ebsuarit dhe pun\u00ebdh\u00ebn\u00ebsit, si dhe realizimin e t\u00eb drejtave t\u00eb tyre ekonomike p\u00ebrmes marr\u00ebveshjeve dhe konsultimit me Qeverin\u00eb p\u00ebr \u00e7\u00ebshtje t\u00eb interesit t\u00eb p\u00ebrbashk\u00ebt.<\/strong><\/p>\n<p>Megjithat\u00eb, prej gati tre vjet\u00ebsh, Ministria e Financave, Pun\u00ebs dhe Transfereve (MFPT) nuk ka nd\u00ebrmarr\u00eb veprime p\u00ebr ta ndryshuar gjendjen.<\/p>\n<p>Gjithashtu, Kuvendi i Kosov\u00ebs, ndon\u00ebse ka mandat kushtetues dhe ligjor p\u00ebr t\u00eb mbik\u00ebqyrur pun\u00ebn e ekzekutivit, nuk e ka adresuar asnj\u00ebher\u00eb mosfunksionalizimin e KES-it.<\/p>\n<p><a href=\"https:\/\/kli-ks.org\/monitoruesi-i-legjislatures-se-viii-te\/\" target=\"_blank\" rel=\"noopener\">N\u00eb legjislatur\u00ebn VIII-t\u00eb<\/a> t\u00eb Kuvendit (2021-2025) mungesa e debatit parlamentar rreth KES-it ka reflektuar munges\u00ebn serioze t\u00eb vullnetit politik p\u00ebr ta trajtuar dialogun social si prioritet shtet\u00ebror, duke krijuar pasoja serioze ekonomike dhe sociale p\u00ebr pun\u00ebtor\u00ebt dhe pun\u00ebdh\u00ebn\u00ebsit.<\/p>\n<h3><strong>Shembull konkret i shkeljes s\u00eb ligjit: p\u00ebrcaktimi i pag\u00ebs minimale<\/strong><\/h3>\n<p>Paga minimale n\u00eb vitet 2023, <a href=\"https:\/\/www.evropaelire.org\/a\/vendimi-per-pagen-minimale-ngre-dilema-ligjore-\/33104398.html\" target=\"_blank\" rel=\"noopener\">2024<\/a> dhe 2025 \u00ebsht\u00eb p\u00ebrcaktuar pa funksionimin e <a href=\"https:\/\/ekonomiaonline.com\/murati-thirri-takim-jakaj-nga-ikd-sqaron-kur-mund-te-rritet-paga-minimale\/\" target=\"_blank\" rel=\"noopener\">mekanizmit ligjor<\/a> q\u00eb duhet ta udh\u00ebheq\u00eb k\u00ebt\u00eb proces (KES-it) dhe pa konsultim me partner\u00ebt social\u00eb, duke e zhvendosur vendimmarrjen nga dialogu social n\u00eb vendime t\u00eb nj\u00ebanshme t\u00eb Ministris\u00eb.<\/p>\n<p>Ligji p\u00ebrcakton qart\u00eb se paga minimale duhet t\u00eb bazohet n\u00eb analiz\u00eb t\u00eb kostos s\u00eb jetes\u00ebs, shkall\u00ebs s\u00eb papun\u00ebsis\u00eb, gjendjes n\u00eb tregun e pun\u00ebs dhe nivelit t\u00eb produktivitetit e konkurrenc\u00ebs, si dhe t\u00eb propozohet n\u00eb kuad\u00ebr t\u00eb KES-it, ose t\u00eb pakt\u00ebn pas informimit formal t\u00eb tij.<\/p>\n<h3><strong>Konkursi i vitit 2024: shkelje mbi shkelje<\/strong><\/h3>\n<p>N\u00eb dhjetor t\u00eb vitit 2024, MFPT-ja shpalli konkursin p\u00ebr p\u00ebrfaq\u00ebsimin e organizatave t\u00eb pun\u00ebtor\u00ebve dhe pun\u00ebdh\u00ebn\u00ebsve n\u00eb KES.<\/p>\n<p>Megjithat\u00eb, m\u00ebnyra e shpalljes s\u00eb konkursit ngre dilema serioze ligjore, pasi procesi \u00ebsht\u00eb iniciuar nga nj\u00eb minist\u00ebr q\u00eb n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb ushtronte edhe funksionin e deputetit, pa dh\u00ebn\u00eb dor\u00ebheqje si\u00e7 k\u00ebrkon ligji. Nj\u00eb praktik\u00eb e till\u00eb bie ndesh me parimin kushtetues t\u00eb ndarjes s\u00eb pushteteve dhe \u00ebsht\u00eb konfirmuar si e paligjshme edhe nga <a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=102922\" target=\"_blank\" rel=\"noopener\">Gjykata Supreme<\/a>, e cila ka shfuqizuar akte t\u00eb MFPT-s\u00eb t\u00eb nxjerra nga persona q\u00eb, pas certifikimit t\u00eb rezultateve zgjedhore, nuk kishin m\u00eb kompetenca ekzekutive. P\u00ebr pasoj\u00eb, edhe konkursi p\u00ebr KES-in mbetet i ekspozuar ndaj kontestimit dhe v\u00eb n\u00eb pik\u00ebpyetje ligjshm\u00ebrin\u00eb e gjith\u00eb procesit.<\/p>\n<h3><strong>Marr\u00ebveshjet kolektive, kriter i paarritsh\u00ebm n\u00eb praktik\u00eb<\/strong><\/h3>\n<p>Nj\u00eb nga kushtet p\u00ebr p\u00ebrfaq\u00ebsimin e sindikatave n\u00eb K\u00ebshillin Ekonomiko-Social \u00ebsht\u00eb q\u00eb ato t\u00eb ken\u00eb t\u00eb lidhura marr\u00ebveshje kolektive me pun\u00ebdh\u00ebn\u00ebsit. Ky kusht synon q\u00eb n\u00eb dialogun social t\u00eb marrin pjes\u00eb organizata q\u00eb realisht p\u00ebrfaq\u00ebsojn\u00eb pun\u00ebtor\u00ebt dhe kan\u00eb kapacitet negociues.<\/p>\n<p>N\u00eb praktik\u00eb, ky kusht, edhe pse ligjor, \u00ebsht\u00eb problematik, pasi prej m\u00eb shum\u00eb se pes\u00eb vjet\u00ebsh Kosova nuk ka kontrat\u00eb kolektive t\u00eb p\u00ebrgjithshme, nd\u00ebrsa kontratat sektoriale jan\u00eb t\u00eb pamundura ose jan\u00eb t\u00ebrhequr n\u00eb <a href=\"https:\/\/kli-ks.org\/wp-content\/uploads\/2024\/10\/MUNGESA-E-KONTRATAVE-KOLEKTIVE-Deshtimi-per-te-siguruar-dialog-social-dhe-mbrojtje-kolektive-te-punetoreve.pdf\" target=\"_blank\" rel=\"noopener\">m\u00ebnyr\u00eb t\u00eb nj\u00ebanshme<\/a>, si n\u00eb sektor\u00ebt e arsimit dhe sh\u00ebndet\u00ebsis\u00eb. Si rezultat, kriteri i \u201cmarr\u00ebveshjeve kolektive\u201d penalizon sindikatat p\u00ebr nj\u00eb situat\u00eb q\u00eb nuk varet prej tyre, por nga mungesa e vullnetit t\u00eb institucioneve.<\/p>\n<p>P\u00ebr shkak t\u00eb munges\u00ebs s\u00eb marr\u00ebveshjeve kolektive funksionale, kontestet e pun\u00ebs nuk jan\u00eb zgjidhur p\u00ebrmes dialogut, por jan\u00eb transferuar masivisht n\u00eb gjykata. Rasti i <a href=\"https:\/\/kli-ks.org\/wp-content\/uploads\/2024\/09\/IKD-Kosto-e-pagave-jubilare-te-papaguara-2.pdf\" target=\"_blank\" rel=\"noopener\">pagave jubilare<\/a>, shujtave dhe udh\u00ebtimit, tregon qart\u00eb d\u00ebshtimin e mbrojtjes kolektive. Mij\u00ebra padi kan\u00eb krijuar barr\u00eb t\u00eb madhe financiare p\u00ebr shtetin dhe kan\u00eb d\u00ebshmuar se mungesa e dialogut social prodhon kosto m\u00eb t\u00eb larta sesa nj\u00eb sistem funksional i negociimit kolektiv.<\/p>\n<h3><strong>Zgjidhja \u00ebsht\u00eb e qart\u00eb, por k\u00ebrkon vullnet politik<\/strong><\/h3>\n<p>Zgjidhja e k\u00ebsaj bllokade \u00ebsht\u00eb e realizueshme. Qeveria duhet t\u00eb ndjek\u00eb nj\u00eb proces t\u00eb rregullt dhe ligj\u00ebrisht t\u00eb past\u00ebr p\u00ebr konstituimin e K\u00ebshillit Ekonomiko-Social, duke sqaruar kriteret e p\u00ebrfaq\u00ebsimit dhe duke krijuar kushte reale p\u00ebr dialog social.<\/p>\n<p>Pas zgjedhjeve t\u00eb fundit, ku L\u00ebvizja Vet\u00ebvendosje ka dal\u00eb fituese dhe pritet t\u00eb formoj\u00eb institucionet e reja, MFPT-ja duhet ta rishpall\u00eb konkursin p\u00ebrmes nj\u00eb ministri q\u00eb e ushtron mandatin n\u00eb p\u00ebrputhje t\u00eb plot\u00eb me ligjin.<\/p>\n<p>N\u00eb k\u00ebt\u00eb situat\u00eb, <a href=\"https:\/\/www.facebook.com\/photo?fbid=1151893793781263&amp;set=a.227867519517233\" target=\"_blank\" rel=\"noopener\">konkursi i dhjetorit 2024<\/a> vet\u00ebm sa ka shtuar paqart\u00ebsi dhe dyshime ligjore, duke e b\u00ebr\u00eb edhe m\u00eb t\u00eb domosdosh\u00ebm nj\u00eb proces t\u00eb ri, t\u00eb drejt\u00eb dhe t\u00eb besuesh\u00ebm, p\u00ebr ta kthyer KES-in n\u00eb mekaniz\u00ebm funksional t\u00eb dialogut social.<\/p>","protected":false},"excerpt":{"rendered":"<p>K\u00ebshilli Ekonomiko-Social (KES) \u00ebsht\u00eb i pakonstituuar q\u00eb nga prilli i vitit 2023, kur edhe i ka p\u00ebrfunduar mandati.
