D\u00ebmi \u00ebsht\u00eb b\u00ebr\u00eb, p\u00ebrkund\u00ebr t\u00ebrheqjes s\u00eb tyre.<\/p>\n<\/div>\n<div class=\"news-down\">\n<div class=\"news-left\">\n<p>Kur ministrja kosovare e drejt\u00ebsis\u00eb, Dhurata Hoxha, propozoi para dy jav\u00ebsh rishikimin e dekriminalizimit t\u00eb shpifjes,\u00a0<a href=\"https:\/\/md.rks-gov.net\/page.aspx?id=1,39,1732&amp;id=1,39,1732\">tha se nenet e prozuara qen\u00eb OK<\/a>, sepse bazoheshin n\u00eb praktik\u00ebn m\u00eb t\u00eb mir\u00eb t\u00eb BE-s\u00eb &#8211; t\u00eb Gjermanis\u00eb dhe standardeve t\u00eb krijuara nga Gjykata Europiane p\u00ebr t\u00eb Drejtat e Njeriut (GjEDNj).<\/p>\n<p>Nenet e propozuara t\u00eb projektligjit mund\u00ebsonin burgosjen e atyre q\u00eb n\u00eb t\u00eb ardhmen shpifin kund\u00ebr shtetit dhe fyejn\u00eb simbolet dhe institucionet shtet\u00ebrore.<\/p>\n<p>Por, t\u00eb dyja faktet e ministris\u00eb jan\u00eb t\u00eb rrejshme apo &#8220;fakte alternative&#8221;.<\/p>\n<p>Gjithashtu, rikriminalizimi i shpifjes ka koh\u00eb q\u00eb p\u00ebrmendet nga disa deputet\u00eb n\u00eb forume m\u00eb pak formale dhe mund t\u00eb propozohet prap\u00eb. P\u00ebr k\u00ebt\u00eb arsye, ndon\u00ebse nenet kund\u00ebrth\u00ebn\u00ebse u t\u00ebrhoq\u00ebn, \u00ebsht\u00eb me r\u00ebnd\u00ebsi t\u00eb ofrohen argumente pse kriminalizimi i shpifjes nuk \u00ebsht\u00eb dashur dhe nuk duhet t\u00eb propozohet asnj\u00ebher\u00eb n\u00eb t\u00eb ardhmen.<\/p>\n<p><strong>\u00c7far\u00eb ishte propozuar?<\/strong><\/p>\n<p>Zyra Ligjore e Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb (MD) m\u00eb 20 prill 2017, p\u00ebrmes e-mailit kishte k\u00ebrkuar komente nga disa organizata t\u00eb shoq\u00ebris\u00eb civile n\u00eb lidhje me propozimin p\u00ebr rishikimin e dekriminalizimit t\u00eb shpifjes p\u00ebr t\u00eb cilin shkruante se ende nuk kishte q\u00ebndrim t\u00eb prer\u00eb.<\/p>\n<p>MD-ja pyeste n\u00ebse Kodit Penal q\u00eb \u00ebsht\u00eb n\u00eb fuqi duhet\/mund t\u2019i shtohen dy nene me t\u00eb cilat shpifjet dhe fyerjet ndaj shtetit, simboleve shtet\u00ebrore dhe organeve kushtetuese do t\u00eb d\u00ebnoheshin me gjob\u00eb ose d\u00ebnim me burg deri n\u00eb pes\u00eb vjet.<\/p>\n<p>K\u00ebshtu, do t\u00eb d\u00ebnohej kushdo q\u00eb publikisht, n\u00eb nj\u00eb takim, ose n\u00ebp\u00ebrmjet shp\u00ebrndarjes s\u00eb materialeve t\u00eb shkruara, do t\u00eb fyente apo me keqdashje do t\u00eb shprehte p\u00ebrbuzje ndaj Kosov\u00ebs, ose ndaj rendit t\u00eb saj kushtetues, do t\u00eb fyente ngjyrat, flamurin, stem\u00ebn ose himnin e vendit. Edhe shpifja ndaj institucioneve si Presidenti, Kuvendi, Qeveria, Gjykata Kushtetuese do t\u00eb ishte e d\u00ebnueshme.<\/p>\n<p>Shoq\u00ebria civile kishte vet\u00ebm shtat\u00eb dit\u00eb pune p\u00ebr t\u2019u p\u00ebrgjigjur. Propozimet u b\u00ebn\u00eb publike p\u00ebrmes nj\u00eb reagimi n\u00eb mediat sociale nga deputetja e Vet\u00ebvendosjes, Puhie Demaku.<\/p>\n<p>N\u00eb tentativ\u00eb p\u00ebr t\u00eb menaxhuar reagimin e ashp\u00ebr publik q\u00eb erdhi nga Asociacioni i Gazetar\u00ebve t\u00eb Kosov\u00ebs, Federata Europiane e Gazetar\u00ebve, disa organizata joqeveritare dhe komentator\u00eb t\u00eb ndrysh\u00ebm, MD-ja l\u00ebshoi tri komunikata t\u00eb ndryshme brenda kat\u00ebr dit\u00ebsh. Nj\u00ebher\u00eb\u00a0<a href=\"https:\/\/md.rks-gov.net\/page.aspx?id=1,39,1732&amp;id=1,39,1732\">sqaroi\u00a0<\/a>se b\u00ebhej fjal\u00eb p\u00ebr nj\u00eb draft t\u00eb kodit penal, pastaj\u00a0<a href=\"https:\/\/md.rks-gov.net\/page.aspx?id=1,39,1734&amp;id=1,39,1734\">ftoi<\/a>\u00a0publikun t\u00eb ofronte komente dhe m\u00eb 30 prill\u00a0<a href=\"https:\/\/md.rks-gov.net\/page.aspx?id=1,39,1736&amp;id=1,39,1736\">announced\u00a0<\/a>opinionin se t\u00ebrhiqej nga nenet p\u00ebr shkak t\u00eb \u201cshqet\u00ebsimeve t\u00eb ngritura nga shoq\u00ebria civile.\u201d<\/p>\n<p><strong>Faktet e rrejshme t\u00eb MD-s\u00eb<\/strong><\/p>\n<p>Ministria deklaronte se kishte \u00a0marr\u00eb p\u00ebr baz\u00eb praktikat e mira t\u00eb vendeve t\u00eb Bashkimit Europian n\u00eb p\u00ebrgjith\u00ebsi dhe t\u00eb Gjermanis\u00eb n\u00eb ve\u00e7anti. Kjo nuk \u00ebsht\u00eb e v\u00ebrtet\u00eb pasi q\u00eb\u00a0<a href=\"http:\/\/legaldb.freemedia.at\/wp-content\/uploads\/2015\/05\/IPI-OutofBalance-Final-Jan2015.pdf\">Mbret\u00ebria e Bashkuar dhe Irlanda, q\u00eb kan\u00eb dekriminalizuar shpifjen m\u00eb 2009<\/a>, konsiderohen si modelet m\u00eb t\u00eb mira n\u00eb BE. Kodi Penal i Gjermanis\u00eb \u00ebsht\u00eb hartuar kur shpifja ishte p\u00ebrgjith\u00ebsisht vep\u00ebr penale. Tash q\u00eb ekzistojn\u00eb rekomandime t\u00eb qarta nga\u00a0<a href=\"http:\/\/assembly.coe.int\/nw\/xml\/XRef\/Xref-XML2HTML-en.asp?fileid=11684&amp;lang=en\">Council of Europe<\/a>\u00a0and\u00a0<a href=\"https:\/\/eeas.europa.eu\/delegations\/kosovo\/25213\/statement-eu-officeeu-special-representative-regarding-possible-changes-kosovo-criminal-code_en\">European Comission<\/a>, q\u00eb shpifja duhet t\u00eb dekriminalizohet, edhe vet\u00eb Gjermania ka nisur dekriminalizimin duke filluar me shpifjen ndaj krer\u00ebve t\u00eb shteteve t\u00eb huaja.<\/p>\n<p>Nj\u00ebjt\u00eb, ndon\u00ebse m\u00eb hapa shum\u00eb t\u00eb ngadalt\u00eb, jan\u00eb duke vepruar edhe disa nga\u00a0<a href=\"https:\/\/ipi.media\/criminal-defamation-unduly-limits-media-freedom\/\">tri t\u00eb kat\u00ebrtat e shteteve an\u00ebtare<\/a>\u00a0t\u00eb Organizat\u00ebs p\u00ebr Siguri dhe Bashk\u00ebpunim n\u00eb Europ\u00eb (OSBE) n\u00eb t\u00eb cilat shpifja rregullohet me legjislacion penal. MD-ja do ta kishte shum\u00eb t\u00eb v\u00ebshtir\u00eb, n\u00ebse jo t\u00eb pamundur, t\u00eb identifikonte nj\u00eb shtet demokratik q\u00eb s\u00eb voni ka propozuar legjislacion penal p\u00ebr mbrojtje nga shpifja.<\/p>\n<p>Ministria po ashtu rrejsh\u00ebm deklaroi se nenet e propozuara qen\u00eb n\u00eb p\u00ebrputhje me Konvent\u00ebn dhe jurisprudenc\u00ebn e GjEDNj-s\u00eb. Gjykata e Strasburgut n\u00eb rastin e famsh\u00ebm\u00a0<a href=\"https:\/\/hudoc.echr.coe.int\/eng#{%22documentcollectionid2%22:[%22GRANDCHAMBER%22,%22CHAMBER%22]}\">Cumpana\u00a0dhe Mazare v. Romanis\u00eb\u00a0(2004)<\/a>\u00a0e ka b\u00ebr\u00eb t\u00eb qart\u00eb se d\u00ebnimi me burg p\u00ebr shpifje \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me nenin 10 t\u00eb Konvent\u00ebs q\u00eb garanton t\u00eb drejt\u00ebn e liris\u00eb s\u00eb shprehjes.<\/p>\n<p>N\u00eb k\u00ebt\u00eb rast q\u00eb kishte t\u00eb b\u00ebnte me dy gazetar\u00eb q\u00eb ishin d\u00ebnuar me burg (por ishin falur m\u00eb von\u00eb p\u00ebr nj\u00eb shkrim q\u00eb kishin botuar), gjykata ka th\u00ebn\u00eb se d\u00ebnimi me burg p\u00ebr shpifje klasike n\u00eb kontekst t\u00eb debatit p\u00ebr nj\u00eb \u00e7\u00ebshtje me interes publik, nuk mund t\u00eb arsyetohej. D\u00ebnimi me burg arsyetohet vet\u00ebm n\u00eb rastet e nxitjes s\u00eb urrejtjes dhe dhun\u00ebs, sipas GjEDNj-s\u00eb. Edhe pse gjykata e Strasburgut ende nuk ka th\u00ebn\u00eb se ekzistimi i shpifjes penale per se n\u00eb m\u00ebnyr\u00eb automatike \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me nenin 10 t\u00eb Konvent\u00ebs, p\u00ebr shkak t\u00eb k\u00ebtij precedenti t\u00eb krijuar n\u00eb Cumpana\u00a0dhe Mazare v. Romanis\u00eb, shtetet si Gjermania kan\u00eb v\u00ebn\u00eb n\u00eb \u201cgjum\u00eb\u201d legjislacionin q\u00eb parasheh d\u00ebnimin me burg p\u00ebr shpifje dhe nenet ekzistuese nuk p\u00ebrdoren n\u00eb praktik\u00eb.<\/p>\n<p>Kaq p\u00ebr praktikat e BE-s\u00eb dhe t\u00eb Gjermanis\u00eb. Pra, nuk ishte e v\u00ebrtet\u00eb q\u00eb nenet e propozuara ishin n\u00eb p\u00ebrputhje me to.<\/p>\n<p><strong>P\u00ebrvoja e brendshme<\/strong><\/p>\n<p>N\u00eb Kosov\u00eb, shpifja ndaj t\u00eb gjith\u00eb personave fillimisht ishte rregulluar n\u00eb vitin 2003 me nenin 187 dhe 188 t\u00eb\u00a0<a href=\"https:\/\/hudoc.echr.coe.int\/eng#{%22documentcollectionid2%22:[%22GRANDCHAMBER%22,%22CHAMBER%22]}\">Kodit t\u00eb P\u00ebrkohsh\u00ebm Penal<\/a>\u00a0q\u00eb d\u00ebnonte shpifjen dhe fyerjen me gjob\u00eb ose me burg deri n\u00eb tre muaj. Pas presionit nd\u00ebrkomb\u00ebtar, shpifja ishte dekriminalizuar m\u00eb 2007 kur ishte miratuar Ligji Civil Kund\u00ebr Shpifjes dhe Fyerjes i cili kishte hyr\u00eb n\u00eb fuqi nj\u00eb vit m\u00eb pas.<\/p>\n<p>Ndon\u00ebse tani ka nevoj\u00eb t\u00eb p\u00ebrdit\u00ebsohet, Ligji Civil Kund\u00ebr Shpifjes dhe Fyerjes n\u00eb at\u00eb koh\u00eb ishte aq i avancuar sa parashihte q\u00eb \u201cautoritetet publike ndalohen nga paraqitja e k\u00ebrkes\u00ebs p\u00ebr kompensim p\u00ebr d\u00ebmin e shkaktuar nga shpifja ose fyerja. Zyrtar\u00ebt publik\u00eb mund t\u00eb paraqesin k\u00ebrkes\u00eb p\u00ebr kompensim e d\u00ebmit nga shpifja apo fyerja privatisht dhe ekskluzivisht n\u00eb kapacitetin e tyre personal\u201d.<\/p>\n<p>Kjo baz\u00eb ligjore \u00ebsht\u00eb dashur t\u2019i mjaftoj\u00eb MD-s\u00eb q\u00eb t\u00eb mos propozonte kriminalizimin e shpifjes.<\/p>\n<p>Gjat\u00eb vitit 2008 deri m\u00eb 2012 kishte pasiguri juridike sepse n\u00eb fuqi ishin nj\u00ebkoh\u00ebsisht ligji civil dhe nenet penale. N\u00eb gjykata arrinin padi kryesisht bazuar n\u00eb legjislacionin penal. P\u00ebr k\u00ebt\u00eb arsye, m\u00eb 2012, Supremja e Kosov\u00ebs ishte detyruar t\u00eb nxirrte nj\u00eb Q\u00ebndrim Parimor me t\u00eb cilin p\u00ebrfundimisht vendoste q\u00eb shpifja rregullohej vet\u00ebm m\u00eb ligj civil. MD-ja ka injoruar edhe q\u00ebndrimin e Supremes.<\/p>\n<p>N\u00ebse propozimet e MD-s\u00eb do t\u00eb kalonin, do t\u00eb kthenin Kosov\u00ebn 10 vjet prapa kur shpifja d\u00ebnohej me burg dhe do t\u00eb mund t\u00eb kishin\u00a0<em>efekt<\/em>\u00a0<em>frenimi<\/em>\u00a0te gazetar\u00ebt dhe t\u00eb gjith\u00eb ata q\u00eb kritikojn\u00eb politik\u00ebn, shoq\u00ebrin\u00eb dhe institucionet e tyre. Eventualisht, ato me siguri do t\u00eb shpalleshin kund\u00ebrkushtetuese n\u00ebse do t\u00eb d\u00ebrgoheshin n\u00eb Gjykat\u00ebn Kushtetuese.<\/p>\n<p>Kufizimi i liris\u00eb s\u00eb shprehjes p\u00ebr t\u00eb mbrojtur reputacionin duhet t\u00eb rregullohet vet\u00ebm me legjislacion civil. Ndryshimi i kodit penal \u00ebsht\u00eb propozuar nga presidenti Hashim Tha\u00e7i. M\u00ebsimi q\u00eb ministrja Hoxha, presidenti Tha\u00e7i, qeveritar\u00ebt, ligjv\u00ebn\u00ebsit dhe t\u00eb gjith\u00eb zyrtar\u00ebt ligjor\u00eb t\u00eb p\u00ebrfshir\u00eb n\u00eb ligjb\u00ebrje duhet t\u00eb nxjerrin nga ky rast \u00ebsht\u00eb se ka kaluar koha kur copy-paste i ligjeve nga vendet demokratike p\u00ebrb\u00ebnte arsye t\u00eb mjaftueshme p\u00ebr t\u00eb imponuar rregulla e ligje n\u00eb shoq\u00ebrin\u00eb kosovare.<\/p>\n<p>Liria e shprehjes \u00ebsht\u00eb nj\u00eb nd\u00ebr t\u00eb drejtat themelore t\u00eb njeriut q\u00eb mund\u00ebson vet\u00eb-zhvillimin dhe mbajtjen e autoriteteve n\u00ebn p\u00ebrgjegj\u00ebsi publike. Legjislacioni p\u00ebrkat\u00ebs duhet t\u00eb mendohet mir\u00eb dhe nuk guxon t\u00eb propozohet pa u diskutuar paraprakisht me organizatat e shoq\u00ebris\u00eb civile dhe me gazetar\u00eb. N\u00eb t\u00eb kund\u00ebrt\u00ebn, do t\u00eb ket\u00eb iniciativa t\u00eb d\u00ebshtuara si kjo fal\u00eb s\u00eb cil\u00ebs Kosova u sigurua q\u00eb do t\u00eb p\u00ebrmendet negativisht n\u00eb raportet e organizatave nd\u00ebrkomb\u00ebtare q\u00eb b\u00ebjn\u00eb vler\u00ebsimin e liris\u00eb s\u00eb mediave.<\/p>\n<p>Edhe m\u00eb shum\u00eb sesa p\u00ebrmendja nga organizatat e huaja monitoruese, \u00ebsht\u00eb problematike mosp\u00ebrcjellja e zhvillimeve ligjore nga njer\u00ebzit e paguar p\u00ebr k\u00ebt\u00eb pun\u00eb nga paraja publike, moskuptimi i q\u00ebllimit t\u00eb parimit t\u00eb liris\u00eb s\u00eb shprehjes dhe dredhia politike prapa k\u00ebsaj iniciative. Qeveria ka zero nevoj\u00eb p\u00ebr ta kufizuar lirin\u00eb e shprehjes n\u00eb k\u00ebt\u00eb form\u00eb, kurse hap\u00ebsir\u00eb t\u00eb bollshme q\u00eb t\u00eb punoj\u00eb q\u00eb liria e shprehjes t\u00eb p\u00ebrdoret.<\/p>\n<p>Por, qeveria mund t\u00eb p\u00ebrfshihet n\u00eb debat p\u00ebr lirin\u00eb e shprehjes. T\u2019i tregoj\u00eb opinionit se n\u00eb cilat ngjarje ose manifestime kishte fyerje dhe shpifje, sipas mendimit t\u00eb saj. T\u00eb mos harrojm\u00eb se ne jemi nj\u00eb vend q\u00eb fyhemi prej qeveris\u00eb p\u00ebr \u00e7do dit\u00eb (me nismat dhe rezultatet e saj).
