Tha\u00e7i, p\u00ebrkundrazi, kishte humbur pun\u00ebn dhe ishte d\u00ebnuar me gjob\u00eb, nd\u00ebr t\u00eb tjera, p\u00ebr zbulim t\u00eb fsheht\u00ebsis\u00eb zyrtare.<\/p>\n<p><a href=\"https:\/\/sbunker.net\/teh\/42789\/sinjalizuesi-i-dyfishte-thaci\/\" target=\"_blank\" rel=\"noopener\">Sinjalizimi\u00a0<\/a>\u00ebsht\u00eb e drejta e nj\u00eb personi q\u00eb t\u00eb raportoj\u00eb ose shpalos\u00eb informacione p\u00ebr nj\u00eb k\u00ebrc\u00ebnim ose cenim t\u00eb interesit publik n\u00eb kontekst t\u00eb marr\u00ebdh\u00ebni\u00ebs s\u00eb pun\u00ebs, qoft\u00eb n\u00eb sektorin publik qoft\u00eb n\u00eb at\u00eb privat. P\u00ebr m\u00eb tep\u00ebr, \u00ebsht\u00eb e drejt\u00eb e pun\u00ebtorit (dhe jo vet\u00ebm) t\u00eb shprehet lirsh\u00ebm n\u00eb vendin e pun\u00ebs pa pasur frik\u00eb nga hakmarrja. Sinjalizuesit g\u00ebzojn\u00eb mbrojtje t\u00eb ve\u00e7ant\u00eb, sepse ata shpesh jan\u00eb personat e vet\u00ebm q\u00eb kan\u00eb informacione p\u00ebr ndonj\u00eb cenim t\u00eb interesit publik.<\/p>\n<p>Me nism\u00ebn p\u00ebr p\u00ebrmir\u00ebsimin e baz\u00ebs ligjore q\u00eb mbron sinjalizuesit, Kosova i \u00ebsht\u00eb bashkuar vendeve si Irlanda, Malta, Serbia etj. n\u00eb rregullimin e sinjalizimit. M\u00eb 23 prill 2018, edhe\u00a0<a href=\"http:\/\/europa.eu\/rapid\/press-release_IP-18-3441_en.htm\" target=\"_blank\" rel=\"noopener\">Komisioni Europian (KE) n\u00eb Bruksel propozoi Direktiv\u00eb<\/a>\u00a0p\u00ebr Mbrojtjen e Personave q\u00eb Raportojn\u00eb Shkelje t\u00eb ligjit europian. N\u00ebse propozim-direktiva aprovohet nga K\u00ebshilli Europian dhe Parlamenti Europian, t\u00eb gjitha shtetet an\u00ebtare (dhe rrjedhimisht edhe shtetet kandidate) t\u00eb BE-s\u00eb do t\u00eb detyrohen t\u00eb nxjerrin legjislacion vendor p\u00ebr mbrojtjen e sinjalizuesve.<\/p>\n<p>Aktualisht sinjalizimi n\u00eb Kosov\u00eb rregullohet dob\u00ebt me Ligjin p\u00ebr Mbrojtjen e Informator\u00ebve i cili \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me standardet e K\u00ebshillit t\u00eb Europ\u00ebs (KE) dhe praktik\u00ebn gjyq\u00ebsore t\u00eb Gjykat\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut (GjEDNj). Ligji \u00ebsht\u00eb i em\u00ebrtuar gabimisht, nuk e njeh sinjalizimin e jasht\u00ebm, nuk rregullon procedur\u00ebn e sinjalizimit, nuk ofron mbrojtje t\u00eb duhur p\u00ebr sinjalizues dhe nuk p\u00ebrcakton sanksione. T\u00eb gjitha k\u00ebto aspekte jan\u00eb adresuar me projektligjin e ri.<\/p>\n<p>Projektligji i draftuar nga Ministria e Drejt\u00ebsis\u00eb &#8211; me mb\u00ebshtetjen e KE-s\u00eb, zyr\u00ebs s\u00eb BE-s\u00eb n\u00eb Kosov\u00eb dhe pjes\u00ebmarrjen e disa institucioneve publike dhe organizatave t\u00eb shoq\u00ebris\u00eb civile &#8211; \u00ebsht\u00eb nd\u00ebr m\u00eb t\u00eb avancuarit n\u00eb Europ\u00eb. Mir\u00ebpo, projektligji \u00ebsht\u00eb vet\u00ebm hapi i par\u00eb n\u00eb p\u00ebrmir\u00ebsimin e mbrojtjes ligjore t\u00eb sinjalizuesve.<\/p>\n<p><strong>Cilat jan\u00eb risit\u00eb e projektligjit?<\/strong><\/p>\n<p>N\u00ebse projektligji miratohet n\u00eb Kuvend, personat q\u00eb raportojn\u00eb informata apo dyshime p\u00ebr shkelje do t\u00eb quhen\u00a0<em>sinjalizues\u00a0<\/em>dhe jo\u00a0<em>informator\u00eb<\/em>. Ky term \u00ebsht\u00eb i duhur ngase \u00ebsht\u00eb m\u00eb i p\u00ebraf\u00ebrti me fjal\u00ebn \u201csignaling\u201d si\u00e7 \u00ebsht\u00eb definuar sinjalizimi nga GjEDNj-ja n\u00eb rastin\u00a0<a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-85016\" target=\"_blank\" rel=\"noopener\">Guja k. Moldov\u00ebs<\/a>\u00a0dhe nuk asocion n\u00eb spiunazh apo kall\u00ebzim penal.<\/p>\n<p>Projektligji parasheh tri nivele t\u00eb sinjalizimit: sinjalizimin e brendsh\u00ebm q\u00eb lejon sinjalizuesin t\u00eb raportoj\u00eb informata brenda institucionit ku punon, sinjalizimin e jasht\u00ebm tek autoriteti kompetent (Agjencioni Kund\u00ebr Korrupsion p\u00ebr sektorin publik dhe rregullator\u00ebt tjer\u00eb p\u00ebr sektorin privat) dhe sinjalizimin publik q\u00eb lejon shpalosjen e informacioneve n\u00eb media, tek organizatat joqeveritare, n\u00eb internet etj. Me ligjin aktual, sinjalizuesit humbin \u00e7do t\u00eb drejt\u00eb n\u00eb mbrojtje n\u00ebse shpalosin informata publikisht.<\/p>\n<p>Projektligji nuk mbron vet\u00ebm pun\u00ebtorin, por ofron p\u00ebrkufizim t\u00eb gjer\u00eb\u00a0<em>t\u00eb personit n\u00eb kontekst t\u00eb pun\u00ebs<\/em>\u00a0duke p\u00ebrfshir\u00eb k\u00ebshtu personin q\u00eb \u00ebsht\u00eb n\u00eb marr\u00ebdh\u00ebnie pune, bashk\u00ebpun\u00ebtorin e jasht\u00ebm, vullnetarin, kandidatin p\u00ebr pun\u00ebsim dhe personin e kontraktuar p\u00ebr t\u00eb ofruar sh\u00ebrbime. Mbrojtje parashihet edhe p\u00ebr personin i cili ndihmon sinjalizuesin.<\/p>\n<p>Institucionet q\u00eb kan\u00eb m\u00eb shum\u00eb se 30 pun\u00ebtor\u00eb dhe kompanit\u00eb private me m\u00eb shum\u00eb se 50 pun\u00ebtor\u00eb do t\u00eb obligohen q\u00eb t\u00eb caktojn\u00eb zyrtarin p\u00ebrgjegj\u00ebs p\u00ebr pranimin dhe trajtimin e sinjalizimeve. Pun\u00ebdh\u00ebn\u00ebsi do t\u00eb detyrohet t\u00eb informoj\u00eb sinjalizuesin brenda 15 dit\u00ebsh n\u00ebse sinjalizimi \u00ebsht\u00eb pranuar apo refuzuar nd\u00ebrsa hetimi administrativ i sinjalizimit duhet t\u00eb duhej t\u00eb p\u00ebrfundonte (n\u00eb parim) brenda 45 dit\u00ebsh. Sanksioni p\u00ebr moscaktimin e zyrtarit p\u00ebrgjegj\u00ebs do t\u00eb jet\u00eb deri n\u00eb 20,000 euro.<\/p>\n<p>Sinjalizuesi p\u00ebr her\u00eb t\u00eb par\u00eb do t\u00eb ket\u00eb mund\u00ebsin\u00eb q\u00eb t\u2019ia ndaloj\u00eb pun\u00ebdh\u00ebn\u00ebsit largimin e tij nga puna p\u00ebr shkak t\u00eb sinjalizimit p\u00ebrmes t\u00eb mas\u00ebs s\u00eb p\u00ebrkohshme gjyq\u00ebsore. P\u00ebr m\u00eb\u00a0tep\u00ebr, asnj\u00eb procedur\u00eb penale, civile apo disiplinore nuk do t\u00eb mund t\u00eb inicohet kund\u00ebr sinjalizuesit n\u00eb lidhje me sinjalizimin e b\u00ebr\u00eb. P\u00ebr t\u00eb kompletuar mbrojtjen e sinjalizuesve, deputet\u00ebt do t\u00eb duhej t\u00eb shtonin nj\u00eb nen n\u00eb kodin penal, i cili \u00ebsht\u00eb duke u amendamentuar, me t\u00eb cilin do t\u00eb penalizoheshin personat q\u00eb nd\u00ebrmarrin veprime hakmarr\u00ebse ndaj sinjalizuesve.<\/p>\n<p>Nj\u00eb nd\u00ebr arritjet e r\u00ebnd\u00ebsishme t\u00eb k\u00ebtij projektligji \u00ebsht\u00eb v\u00ebnia e obligimit p\u00ebr organet kompetente q\u00eb t\u00eb caktojn\u00eb procedur\u00eb t\u00eb ve\u00e7ant\u00eb p\u00ebr pranimin dhe trajtimin e sinjalizimeve n\u00eb fush\u00ebn e siguris\u00eb\u00a0komb\u00ebtare, mbrojtjes, inteligjenc\u00ebs dhe marr\u00ebdh\u00ebnieve nd\u00ebrkomb\u00ebtare. Praktikisht kjo do t\u00eb thot\u00eb q\u00eb institucionet si Agjencia e Kosov\u00ebs p\u00ebr Inteligjenc\u00eb apo Nj\u00ebsia e Inteligjenc\u00ebs Financiare do t\u00eb jen\u00eb t\u00eb obliguara t\u00eb rregullojn\u00eb procedur\u00ebn e sinjalizimit p\u00ebr spiun\u00ebt dhe pun\u00ebtor\u00ebt tjer\u00eb.<\/p>\n<p><strong>Sfidat dhe obligimet e institucioneve<\/strong><\/p>\n<p>Suksesi i k\u00ebsaj nisme ligjore do t\u00eb varet nga faktor\u00eb t\u00eb ndrysh\u00ebm, por mbi t\u00eb gjitha nga vullneti politik. Deputet\u00ebt, pavar\u00ebsisht p\u00ebrkat\u00ebsis\u00eb partiake, do t\u00eb duhej ta miratonin projektligjin n\u00eb Kuvend pa e dob\u00ebsuar at\u00eb gjat\u00eb shqyrtimit n\u00ebp\u00ebr komisione. Ligji aktual \u00ebsht\u00eb i pazbatuesh\u00ebm p\u00ebr shkak se fjala \u201cduhet\u201d, q\u00eb obligonte caktimin e personit zyrtar p\u00ebr pranimin e informatave, ishte ndryshuar n\u00eb \u201cmund\u201d nga deputet\u00ebt e periudh\u00ebs s\u00eb kat\u00ebrt legjislative 2011-2014.<\/p>\n<p>Ministria e Drejt\u00ebsis\u00eb do t\u00eb duhej, pa vones\u00eb, t\u00eb aprovonte aktet n\u00ebnligjore q\u00eb do t\u00eb mund\u00ebsonin zbatimin e ligjit. Pas hyrjes s\u00eb ligjit n\u00eb fuqi, qeveria do t\u00eb duhej t\u00eb ndante buxhet shtes\u00eb p\u00ebr resurse njer\u00ebzore p\u00ebr Agjencionin Kund\u00ebr Korrupsionit (AKK) meq\u00eb do ta ket\u00eb barr\u00ebn m\u00eb t\u00eb madhe t\u00eb zbatimit t\u00eb k\u00ebtij ligji. AKK \u00ebsht\u00eb parapar\u00eb si autoritet kompetent p\u00ebr sinjalizim t\u00eb jasht\u00ebm p\u00ebr sektorin publik dhe p\u00ebr hartimin e raportit vjetor p\u00ebr sinjalizimet n\u00eb sektorin publik dhe privat.<\/p>\n<p>Sektori privat po ashtu duhet t\u00eb ket\u00eb rol m\u00eb aktiv n\u00eb jet\u00ebsimin e k\u00ebtij ligji. Gjat\u00eb hartimit t\u00eb projektligjit, odat ekonomike nuk kan\u00eb shprehur interesim p\u00ebr pjes\u00ebmarrje ndon\u00ebse ligji parasheh obligime konkrete p\u00ebr kompanit\u00eb private. Moszbatimi i detyrimeve t\u00eb parashikuara me k\u00ebt\u00eb ligj do t\u00eb mund t\u2019i kushtoj\u00eb kompanive private deri n\u00eb 20,000 mij\u00eb euro.<\/p>\n<p>Polic\u00ebt, prokuror\u00ebt dhe gjykat\u00ebsit do t\u00eb jen\u00eb zyrtar\u00ebt kryesor\u00eb q\u00eb do t\u00eb vendosin interpretimin e ligjit t\u00eb ri. Polic\u00ebt dhe prokuror\u00ebt, t\u00eb cil\u00ebt e kan\u00eb t\u00eb v\u00ebshtir\u00eb t\u00eb shikojn\u00eb p\u00ebrtej Kodit t\u00eb Procedur\u00ebs Penale dhe atij Penal, do t\u00eb duhej t\u00eb tregojn\u00eb kujdes t\u00eb shtuar n\u00eb rastet e sinjalizimit. Gjykat\u00ebsit po ashtu do t\u00eb duhej t\u00eb trajtojn\u00eb me urgjenc\u00eb propozimet p\u00ebr masa t\u00eb p\u00ebrkohshme dhe t\u00eb gjykojn\u00eb rastet e sinjalizimit bazuar n\u00eb nenin 10 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/p>\n<p>Mbetet shqet\u00ebsues\u00a0fakti q\u00eb Ministria e Drejt\u00ebsis\u00eb nuk ka ofruar koh\u00eb t\u00eb mjaftueshme p\u00ebr konsultim publik ashtu si\u00e7 k\u00ebrkohet ligj\u00ebrisht. Mir\u00ebpo, gazetar\u00ebt dhe pal\u00ebt tjera t\u00eb interesit ende kan\u00eb koh\u00eb t\u00eb kontribuojn\u00eb me komente duke iu drejtuar Kuvendit t\u00eb Kosov\u00ebs.<\/p>\n<p>Projektligji \u00ebsht\u00eb hartuar n\u00eb momentin kur institucionet jan\u00eb duke p\u00ebrgatitur nj\u00eb pako ligjesh n\u00eb fush\u00ebn e masave kund\u00ebr korrupsionit n\u00eb p\u00ebrpjekje p\u00ebr t\u00eb bindur institucionet europiane t\u00eb lejojn\u00eb kosovar\u00ebt t\u00eb l\u00ebvizin lirsh\u00ebm n\u00eb shtetet e BE-s\u00eb. Duke pasur parasysh shkall\u00ebn e lart\u00eb t\u00eb korrupsionit, \u00ebsht\u00eb logjike dhe e nevojshme q\u00eb Kosova t\u00eb b\u00ebhet shembull n\u00eb fush\u00ebn e sinjalizimit.
