Me k\u00ebt\u00eb realizohet kontrolli i shp\u00ebrndarjes s\u00eb\u00a0t\u00eb\u00a0mirave publike, andaj roli i tyre n\u00eb\u00a0demokratizimin e p\u00ebrgjithsh\u00ebm t\u00eb\u00a0shoq\u00ebris\u00eb\u00a0padyshim se \u00ebsht\u00eb thelb\u00ebsor. N\u00eb aspektin e finacimit t\u00eb partive politike duhet theksuar problemin e munges\u00ebs s\u00eb transparenc\u00ebs dhe t\u00eb llogaridh\u00ebnies s\u00eb t\u00eb dh\u00ebnave financiare t\u00eb partive politike, gjegj\u00ebsisht munges\u00ebn e p\u00ebrputhshm\u00ebris\u00eb s\u00eb shpenzimeve sidomos gjat\u00eb fushatave parazgjedhore n\u00eb nj\u00eb an\u00eb si dhe t\u00eb pasqyrave financiare n\u00eb an\u00ebn tjet\u00ebr. Po ashtu, duhet p\u00ebrmendur edhe munges\u00ebn e mbik\u00ebqyrjes s\u00eb financave t\u00eb partive politike nga t\u00eb gjitha institucionet publike kompetente si Kuvendi i Kosov\u00ebs, Komisioni Qendror i Zgjedhjeve \u2013 Zyra p\u00ebr Regjistrimin e Partive Politike. \u00a0Nevoj\u00eb urgjente mbetet rregullimi i \u00e7\u00ebshtjes s\u00eb auditimit t\u00eb pasqyrave financiare vjetore dhe t\u00eb shpenzimeve gjat\u00eb zgjedhjeve t\u00eb partive politike.<\/p>\n<p>Problem tjeter q\u00eb ka t\u00eb b\u00ebj\u00eb me finacimin e partive politike mbetet mungesa e transparenc\u00ebs s\u00eb pasqyrave financiare t\u00eb partive politike si dhe mungesa e mekanizmave t\u00eb mir\u00ebfillt\u00eb t\u00eb mbik\u00ebqyrjes s\u00eb shpenzimeve gjat\u00eb fushatave zgjedhore. N\u00eb p\u00ebrgjith\u00ebsi, Raportet e Progresit t\u00eb BE-s\u00eb p\u00ebr Kosov\u00ebn theksojn\u00eb se pasqyrat financiare t\u00eb partive politike nuk shfaqin t\u00eb dh\u00ebna t\u00eb plota t\u00eb aktiviteteve financiare vjetore t\u00eb partive politike. Sipas k\u00ebtyre raporteve, duket sheshazi se nga pasqyrat e audituara vjetore financiare nuk mund t\u00eb nxirren p\u00ebrfundime t\u00eb plota dhe t\u00eb sakta mbi qarkullimet financiare vjetore t\u00eb partive politike.<\/p>\n<p>Ndryshimet ligjore q\u00eb u b\u00ebn\u00eb me Ligjin nr.04\/L-212 p\u00ebr plot\u00ebsim-ndryshimin e Ligjit p\u00ebr Financimin e Subjekteve Politike, me an\u00eb t\u00eb t\u00eb cilit kompetenca e p\u00ebrzgjedhjes s\u00eb auditor\u00ebve p\u00ebr auditimin e pasqyrave financiare t\u00eb partive politike u bart nga KQZ-ja te Kuvendi i Kosov\u00ebs, b\u00ebri q\u00eb pasqyrat financiare t\u00eb partive politike t\u00eb mbesin t\u00eb paaudituara p\u00ebr pes\u00eb vite me radh\u00eb. Ato m\u00eb pas u audituan por auditimi u b\u00eb bashk\u00eb p\u00ebr pese vite dhe nj\u00eb auditim i till\u00eb e ka pasur pothuajse t\u00eb pamundur t\u00eb evidentoj\u00eb shkeljet potenciale.<\/p>\n<p><strong>Financimi i partive politike<\/strong><\/p>\n<p>Dy burimet kryesore t\u00eb financave t\u00eb partive politike vijn\u00eb nga buxheti publik dhe nga donator\u00eb t\u00eb jasht\u00ebm, pastaj n\u00eb form\u00eb t\u00eb parave t\u00eb gatshme ose n\u00eb at\u00eb t\u00eb kontributeve n\u00eb mallra dhe sh\u00ebrbime. N\u00eb k\u00ebt\u00eb mes, dy subjektet politike (PDK dhe Vet\u00ebvendosje!) kan\u00eb natyr\u00eb t\u00eb p\u00ebraf\u00ebrt t\u00eb financimit, pra p\u00ebr t\u00eb dyja partit\u00eb burimet kryesore t\u00eb financave vijn\u00eb nga buxheti i shtetit dhe nga donator\u00eb t\u00eb ndrysh\u00ebm q\u00eb n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb jan\u00eb edhe p\u00ebrfituesit kryesor\u00eb t\u00eb miliona eurove nga buxheti publik. Partia Demokratike e Kosov\u00ebs dhe \u00a0Vet\u00ebvendosje! deklarojn\u00eb t\u00eb hyra t\u00eb jashtme nga persona fizik\u00eb, duke mos p\u00ebrjashtuar as bizneset private si financues t\u00eb tyre n\u00eb vlera shum\u00eb m\u00eb t\u00eb larta se sa subjektet e tjera politike. Vlera totale e tender\u00ebve t\u00eb fituar nga financuesit e LVV-s\u00eb \u00ebsht\u00eb 59,701,559 euro, p\u00ebrderisa financuesit e PDK-s\u00eb kan\u00eb marr\u00eb gjithsej 162,517,080 euro.<\/p>\n<p>N\u00eb baz\u00eb t\u00eb dokumenteve zyrtare e nj\u00ebjta gj\u00eb nuk ka ndodhur me tri partit\u00eb e tjera (LDK, AKR, dhe AAK), edhe pse p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb k\u00ebto parti ishin dhe jan\u00eb n\u00eb pushtet. N\u00eb k\u00ebt\u00eb rrafsh, t\u00eb dh\u00ebnat tregojn\u00eb se financuesit e LDK-s\u00eb n\u00eb ve\u00e7anti kan\u00eb p\u00ebrfituar m\u00eb s\u00eb paku nga tender\u00ebt publik\u00eb. Rast konkret p\u00ebr k\u00ebt\u00eb \u00ebsht\u00eb Komuna e Prishtin\u00ebs, e cila edhe pse p\u00ebr disa mandate ishte udh\u00ebhequr nga LDK-ja, mbi 13 milion\u00eb euro nga tender\u00ebt publik\u00eb ua kishte\u00a0dh\u00ebn\u00eb kompanive t\u00eb cilat e kishin financuar PDK-n\u00eb. T\u00eb dh\u00ebnat tregojn\u00eb se financuesit e LDK-s\u00eb kan\u00eb marr\u00eb 419,631 euro nga tender\u00ebt publik\u00eb, ata t\u00eb AAK-\u00a0s\u00eb 9,767,240 euro, p\u00ebrderisa ata t\u00eb AKR-s\u00eb 3,089,817 euro. LDK-ja dhe AAK-ja e deklarojn\u00eb pjes\u00ebn m\u00eb t\u00eb madhe t\u00eb t\u00eb hyrave si t\u00eb hyra nga buxheti, por edhe n\u00eb rastet kur deklarojn\u00eb t\u00eb hyra si donacione shumica prej tyre jan\u00eb emra t\u00eb an\u00ebtar\u00ebve t\u00eb k\u00ebtij subjekti pollitik. Nj\u00eb natyr\u00eb krejt tjet\u00ebr t\u00eb financimit e ka AKR-ja, e cila n\u00eb zgjedhjet e fundit nuk arriti ta kaloj\u00eb as pragun. Me plot shkelje ligji k\u00ebt\u00eb parti e kan\u00eb financuar familjar\u00eb t\u00eb kryetarit t\u00eb k\u00ebsaj partie, Behgjet Pacollit.<\/p>\n<p><strong>Zbatimi i ligjit p\u00ebr financimin e partive politike<\/strong><\/p>\n<p>Deri n\u00eb mesin e vitit 2013, legjislacioni q\u00eb rregullon financimin e partive politike nuk ka p\u00ebrmbajtur asnj\u00eb dispozit\u00eb q\u00eb rregullon financimin e partive politike nga bizneset t\u00eb cilat n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb ofrojn\u00eb edhe sh\u00ebrbime apo mallra p\u00ebr institucionet publike. Edhe pse u ndryshua disa her\u00eb, Ligji p\u00ebr Financimin e Subjekteve Politike nuk adreson n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb marr\u00ebdh\u00ebnien nd\u00ebrmjet financimit t\u00eb partive politike nga subjekteve afariste q\u00eb n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb ofrojn\u00eb edhe sh\u00ebrbime apo mallra p\u00ebr institucionet publike. Partive politike u k\u00ebrkohet me ligj p\u00ebrpilimi i nj\u00eb liste t\u00eb ve\u00e7ant\u00eb t\u00eb t\u00eb gjith\u00eb donator\u00ebve q\u00eb ofrojn\u00eb sh\u00ebrbime apo mallra p\u00ebr institucionet publike, por sipas raporteve t\u00eb auditimit partit\u00eb nuk e p\u00ebrfillin nj\u00eb k\u00ebrkes\u00eb t\u00eb till\u00eb.<\/p>\n<p>Megjith\u00ebse u punua p\u00ebr plot\u00ebsimin e korniz\u00ebs ligjore p\u00ebr financimin e partive politike, Ligji n\u00eb fjal\u00eb dhe rregullat e KQZ-s\u00eb d\u00ebshtojn\u00eb t\u00eb adresojn\u00eb nj\u00eb mori \u00e7\u00ebshtjesh q\u00eb prekin transparenc\u00ebn e financave t\u00eb partive politike. Ligji, n\u00eb mes tjerash, n\u00eb asnj\u00eb nga nenet e tij nuk adresonte shprehimisht \u00e7\u00ebshtjen e transparenc\u00ebs s\u00eb donacioneve apo kontributeve t\u00eb tjera\u00a0<strong>q\u00eb<\/strong>\u00a0<strong>marrin individ\u00ebt brenda partive politike<\/strong>\u00a0q\u00eb garojn\u00eb p\u00ebr deputet apo asambleist gjat\u00eb fushatave zgjedhore. Ligji i obligon vet\u00ebm partit\u00eb politike t\u00eb deklarojn\u00eb pranimin e kontributeve por nuk u b\u00ebn nj\u00eb k\u00ebrkes\u00eb t\u00eb till\u00eb edhe kandidat\u00ebve q\u00eb garojn\u00eb p\u00ebr deputet. Po ashtu, kuy Ligj parasheh masa shum\u00eb t\u00eb buta nd\u00ebshkimore p\u00ebr partit\u00eb politike n\u00eb rast se ato nuk u p\u00ebrmbahet k\u00ebrkesave ligjore. K\u00ebto masa t\u00eb buta n\u00eb fakt kan\u00eb b\u00ebr\u00eb q\u00eb partit\u00eb politike n\u00eb vazhdim\u00ebsi t\u00eb shkelin normat ligjore n\u00eb fuqi.<\/p>\n<p><strong>Ndryshimet e nevojshme<\/strong><\/p>\n<p>Megjith\u00ebse financimi i partive politike u rregullua me Ligjin e vitit 2010, i cili u ndryshuar dhe u plot\u00ebsuar n\u00eb vitin 2012 dhe 2013, dhe p\u00ebrs\u00ebri \u00ebsht\u00eb n\u00eb proces t\u00eb ndryshimit (projektligji gjendet ne Kuvendin e Kosov\u00ebs), ekzistojn\u00eb shum\u00eb probleme dhe zbraz\u00ebtira juridike q\u00eb po e b\u00ebjn\u00eb Ligjin n\u00eb fjal\u00eb t\u00eb pazbatuesh\u00ebm dhe t\u00eb pasuksessh\u00ebm karshi rregullimit t\u00eb financimit t\u00eb partive politike. Hulumtimet e organizat\u00ebs \u00c7ohu! nxjerrin n\u00eb pah munges\u00ebn e theksuar t\u00eb dispozitave ligjore q\u00eb e rregullojn\u00eb finacimin e partive politike, n\u00eb ve\u00e7anti kur b\u00ebhet fjal\u00eb p\u00ebr:<\/p>\n<p><strong>&#8211;\u00a0<\/strong>Financimin e partive politike nga bizneset private;<\/p>\n<p><strong>&#8211;<\/strong>\u00a0Munges\u00ebn e auditimit t\u00eb financave t\u00eb subjekteve politike;<\/p>\n<p><strong>&#8211;<\/strong>\u00a0Mosdeklarimin e pasqyrave financiare t\u00eb secilit kandidat ve\u00e7 e ve\u00e7;<\/p>\n<p><strong>&#8211;<\/strong>\u00a0Mund\u00ebsin\u00eb e publikimit t\u00eb raporteve financiare para se t\u00eb b\u00ebhet auditimi i tyre;<\/p>\n<p><strong>&#8211;<\/strong>\u00a0Shp\u00ebrndarjen e pabarabart\u00eb e mjeteve financiare brenda subjektit politik, sidomos p\u00ebr kandidatet.<\/p>\n<p>Reforma e nevojshme zgjedhore duhet t\u2019i adresoj\u00eb me prioritet k\u00ebto \u00e7\u00ebshtje:<\/p>\n<p><strong>&#8211; Mbik\u00ebqyrja e financimit t\u00eb subjekteve politike\u00a0<\/strong>nga bizneset private p\u00ebrmes shtimit t\u00eb kontrollit gjat\u00eb procedurave t\u00eb tenderimit;<\/p>\n<p><strong>&#8211; Auditimi i i subjekteve politike\u00a0<\/strong>t\u00eb adresohet dhe t\u00eb mos mbesin t\u00eb paaudituara pasqyrat financiare t\u00eb partive politike. Kjo duhet t\u00eb b\u00ebhet ose p\u00ebrmes Zyr\u00ebs Komb\u00ebtare t\u00eb Auditimit, ose p\u00ebrmes KQZ-s\u00eb, gjegj\u00ebsisht Zyr\u00ebs p\u00ebr Regjistrimin e Subjekteve Politike, por duke krijuar nj\u00eb nj\u00ebsi t\u00eb ve\u00e7ant\u00eb e cila merret me mbikqyrjen e shtuar t\u00eb financave t\u00eb partive politike;<\/p>\n<p><strong>&#8211; Njohja ligjore e kandidat\u00ebve\u00a0<\/strong>si shpenzues individual\u00eb gjat\u00eb fushtave, e jo vet\u00ebm si subjekt politik n\u00eb p\u00ebrgjith\u00ebsi, sepse ka kandidat\u00eb t\u00eb cil\u00ebt shpenzojn\u00eb sa gjysma e t\u00ebr\u00eb subjektit;<\/p>\n<p><strong>&#8211; Publikimi i raporteve financiare t\u00eb subjekteve politike<\/strong>\u00a0para se t\u00eb b\u00ebhet auditimi i tyre, pasi q\u00eb p\u00ebr shkak t\u00eb vonesave t\u00eb auditimit publikimi i k\u00ebtyre raporteve pas nj\u00eb kohe t\u00eb gjat\u00eb ndikon n\u00eb uljen e interesimit dhe efikasitetit t\u00eb k\u00ebtyre raporteve;<\/p>\n<p><strong>&#8211; Krijimi sa m\u00eb i shpejt\u00eb i korniz\u00ebs ligjore<\/strong>\u00a0p\u00ebr financimin e partive politike, meqen\u00ebse deri m\u00eb tani asnj\u00eb legjislatur\u00eb nuk i ka kushtuar r\u00ebnd\u00ebsin\u00eb e duhur k\u00ebsaj \u00e7\u00ebshtjeje;<\/p>\n<p><strong>&#8211; Shp\u00ebrndarja e barabart\u00eb e mjeteve financiare\u00a0<\/strong>nd\u00ebrmjet kandidat\u00ebve t\u00eb nj\u00eb partie politike, e sidomos nd\u00ebrmjet kandidat\u00ebve dhe kandidateve.<\/p>\n<p>&#8212;-<\/p>\n<p><em>Ky shkrim mb\u00ebshtetet nga D4D, si pjes\u00eb\u00a0e projektit &#8216;Avancimi i proceseve demokratike&#8217; financuar nga\u00a0Departamenti Federal i Pun\u00ebve t\u00eb\u00a0Jashtme t\u00eb\u00a0Zvicr\u00ebs.<\/em><\/p>","protected":false},"excerpt":{"rendered":"<p>Synimi primar i partive politike \u00ebsht\u00eb\u00a0marrja dhe mbajtja e pushtetit.
