Tre vjet pas plot\u00ebsimit t\u00eb ndryshimeve n\u00eb ligjin p\u00ebr nd\u00ebrtesat e banimit n\u00eb bashk\u00ebpron\u00ebsi, me nj\u00eb histori q\u00eb zgjat qysh nga paslufta, e q\u00eb assesi spo i gjendet zgjidhje.<\/p>\n<\/div>\n<div class=\"news-down\">\n<div class=\"news-left\">\n<p>Organizimi i jet\u00ebs n\u00eb nd\u00ebrtesa e banimit n\u00eb bashk\u00ebpron\u00ebsi \u00ebsht\u00eb p\u00ebrgjegj\u00ebsi e pronar\u00ebve t\u00eb nj\u00ebsive individuale, p\u00ebrmes shoqat\u00ebs s\u00eb pronar\u00ebve dhe kryesis\u00eb s\u00eb shoqat\u00ebs t\u00eb cil\u00ebt kontraktojn\u00eb nj\u00eb administrator t\u00eb certifikuar, i cili \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr ushtrimin e menaxhimit, mir\u00ebmbajtjes dhe sh\u00ebrbimeve t\u00eb tjera p\u00ebr t\u00eb mir\u00ebn e nd\u00ebrtes\u00ebs. Kjo \u00ebsht\u00eb fryma n\u00eb t\u00eb cil\u00ebn \u00ebsht\u00eb nd\u00ebrtuar Ligji p\u00ebr Nd\u00ebrtesat e Banimit n\u00eb Bashk\u00ebpron\u00ebsi, duke kaluar p\u00ebrgjegj\u00ebsin\u00eb e organizmit dhe funksionimit t\u00eb jet\u00ebs n\u00eb bashk\u00ebpron\u00ebsi vet\u00eb qytetar\u00ebve.<\/p>\n<p>Ting\u00ebllon e leht\u00eb p\u00ebr t\u2019u b\u00ebr\u00eb realitet, madje edhe ashtu duhet t\u00eb jet\u00eb. Problematik\u00eb tjet\u00ebr n\u00eb rastin kur Shoqata do t\u00eb mund t\u00eb themelohej si person juridik \u00ebsht\u00eb \u00e7\u00ebshtja e kapitalit themeltar e cila \u00ebsht\u00eb e padefinuar n\u00eb kontekst t\u00eb organizimit t\u00eb mundsh\u00ebm t\u00eb Shoqat\u00ebs si person juridik, meqen\u00ebse ligji p\u00ebr Shoq\u00ebrit\u00eb Tregtare obligon themeluesit p\u00ebr kapital themeltar, nd\u00ebrsa n\u00eb an\u00ebn tjet\u00ebr Ligji p\u00ebr Nd\u00ebrtesa e Banimit n\u00eb Bashk\u00ebpron\u00ebsi nuk parasheh pjes\u00eb t\u00eb pasuris\u00eb s\u00eb p\u00ebrbashk\u00ebt e cila mund t\u00eb p\u00ebrdoret si kapital n\u00eb frym\u00ebn q\u00eb k\u00ebrkohet n\u00eb baz\u00eb t\u00eb dispozitave t\u00eb ligjit p\u00ebr Shoq\u00ebrit\u00eb Tregtare.<\/p>\n<p>Andaj, n\u00eb t\u00eb dy variantet ligjv\u00ebn\u00ebsi ka qen\u00eb krejt\u00ebsisht i paqart\u00eb duke mos marr\u00eb parasysh ligjet e tjera strukturore q\u00eb kan\u00eb p\u00ebrpar\u00ebsi p\u00ebr \u00e7\u00ebshtje t\u00eb ve\u00e7anta t\u00eb rregulluara nga to, e q\u00eb p\u00ebr konsekuenc\u00eb, proces i organizimit t\u00eb jet\u00ebs n\u00eb bashk\u00ebpron\u00ebsi mbetet ende i pafilluar edhe 3 vjet pas plot\u00ebsimndryshimeve t\u00eb k\u00ebtij ligji.<\/p>\n<p>*<\/p>\n<p>Po si mund t\u00eb zgjidhet problemi i themelimit, i regjistrimit dhe i an\u00ebtar\u00ebsis\u00eb s\u00eb Shoqat\u00ebs s\u00eb Pronar\u00ebve?<\/p>\n<p>Meqen\u00ebse vetorganizimi qytetar \u00ebsht\u00eb problematik\u00eb m\u00eb vete dhe me q\u00ebllim t\u00eb \u2018ringjalljes\u2019 s\u00eb bashk\u00ebsive lokale si elemente t\u00eb r\u00ebnd\u00ebsishme t\u00eb jet\u00ebs \u2018institucionale\u2019 komunale, e q\u00eb po ashtu, jeta n\u00eb bashk\u00ebpron\u00ebsi t\u00eb mbetet brenda kornizave t\u00eb qeverisjes lokale, mbaj q\u00ebndrimin q\u00eb identifikimi i blloqeve\/objekteve q\u00eb edhe fizikisht jan\u00eb t\u00eb p\u00ebrshtatshme p\u00ebr t\u00eb themeluar Shoqat\u00ebn e Pronar\u00ebve t\u00eb identifikohen, dhe t\u00eb iniciohet themelimi i Shoqatave nga vet\u00eb bashk\u00ebsit\u00eb lokale. Gjithashtu, Shoqata e Pronar\u00ebve nuk duhet t\u00eb ket\u00eb status t\u00eb ve\u00e7ant\u00eb juridik (OJQ ose Person Juridik) por me aktin themeltar i cili deponohet n\u00eb Bashk\u00ebsin\u00eb Lokale, p\u00ebrcaktohen t\u00eb drejtat dhe obligimet e shoqat\u00ebs si dhe organet e t\u00eb nj\u00ebjt\u00ebs (kryesia e shoqat\u00ebs). E\u00a0gjitha kjo b\u00ebhet n\u00eb prezenc\u00ebn e nj\u00eb noteri si autoritet me p\u00ebrgjegj\u00ebsi publike n\u00eb t\u00eb cil\u00ebn an\u00ebtar\u00ebt (pronar\u00ebt e nj\u00ebsive individuale) deklarativisht shprehin vullnetin e tyre p\u00ebr t\u00eb qen\u00eb pjes\u00eb e an\u00ebtar\u00ebsis\u00eb s\u00eb gjer\u00eb t\u00eb Shoqat\u00ebs.<\/p>\n<p>Nd\u00ebrkaq, me nj\u00eb rregullore komunale do t\u00eb rregullohej \u00e7\u00ebshtja e kontraktimit t\u00eb Administrator\u00ebve, duke p\u00ebrcaktuar qart\u00eb procedurat e kontraktimit t\u00eb administrator\u00ebve dhe hap\u00ebsir\u00ebs n\u00eb met\u00ebr katror, t\u00eb cil\u00ebn nj\u00eb Administrator mund ta menaxhoj\u00eb, ngase n\u00eb ligjin aktual k\u00ebto \u00e7\u00ebshtje nuk jan\u00eb t\u00eb p\u00ebrcaktuara.<\/p>\n<p>*<\/p>\n<p>Realiteti 17 vje\u00e7ar i munges\u00ebs s\u00eb Administrator\u00ebve, ka sjell\u00eb probleme p\u00ebr jet\u00eb normale n\u00eb nd\u00ebrtesat e banimit kolektiv, biznese ilegale t\u00eb mir\u00ebmbajtjes \u2013 pa p\u00ebrgjegj\u00ebsi e pa standarde, e mbi t\u00eb gjitha kusht\u00ebzime kontraktuale non sens nga nd\u00ebrtues t\u00eb pasluft\u00ebs, t\u00eb cil\u00ebt n\u00eb kontratat e shit-blerjes s\u00eb nj\u00ebsive banesore ose afariste kan\u00eb kusht\u00ebzuar bler\u00ebsit p\u00ebr sh\u00ebrbime t\u00eb mir\u00ebmbajtjes me \u00e7mime t\u00eb larta dhe me sh\u00ebrbime t\u00eb kompanive pa administrator\u00eb t\u00eb certifikuar e pa standarde t\u00eb kontrolluara, me t\u00eb pun\u00ebsuar ilegal e pa asnj\u00eb detyrim tatimor p\u00ebr shtetin.
