Familjar\u00ebt e viktimave t\u00eb luft\u00ebs k\u00ebrkojn\u00eb drejt\u00ebsi p\u00ebr familjar\u00ebt e tyre t\u00eb cil\u00ebt kan\u00eb p\u00ebsuar gjat\u00eb luft\u00ebs, kurse shteti i sapodal\u00eb nga lufta angazhohet n\u00eb krijimin dhe forcimin e institucioneve shtet\u00ebrore. Nj\u00ebzet\u00eb vite pas p\u00ebrfundimit t\u00eb luft\u00ebs familjar\u00ebt e viktimave t\u00eb zhg\u00ebnjyer dhe pa shpres\u00eb se nj\u00eb dit\u00eb do t\u00eb d\u00ebnohen vras\u00ebsit e t\u00eb dashurve t\u00eb tyre. Si pasoj\u00eb e luft\u00ebs n\u00eb Kosov\u00eb jan\u00eb vrar\u00eb dhe zhdukur rreth\u00a0<a href=\"http:\/\/www.kosovskaknjigapamcenja.org\/?page_id=48&amp;lang=zh\">13 500<\/a>\u00a0persona, ku rreth 80 % t\u00eb prej tyre jan\u00eb civil\u00eb t\u00eb cil\u00ebt nuk kan\u00eb marr\u00eb pjes\u00eb n\u00eb konflikt.<\/p>\n<p>Me hetimin dhe gjykimin e krimeve t\u00eb luft\u00ebs n\u00eb Kosov\u00eb jan\u00eb marr\u00eb\u00a0<a href=\"https:\/\/www.icty.org\/\">Tribunali Penal Nd\u00ebrkomb\u00ebtar p\u00ebr ish Jugosllavin\u00eb<\/a>\u00a0i cila ka pushuar s\u00eb ekzistuari n\u00eb dhjetor t\u00eb vitit 2017; gjykatat vendore t\u00eb Kosov\u00ebs duke p\u00ebrfshir\u00eb misionet e\u00a0<a href=\"https:\/\/unmik.unmissions.org\/\">UNMIK<\/a>-ut (2000-2008),\u00a0<a href=\"https:\/\/www.eulex-kosovo.eu\/\">EULEX<\/a>-it (2009-2018) dhe prokuror\u00ebt vendor\u00eb q\u00eb nga viti 2015; gjykatat n\u00eb Serbi; si dhe tani\u00a0<a href=\"https:\/\/www.scp-ks.org\/sq\">Dhomat e Specializuara dhe Zyra e Prokurorit t\u00eb Specializuar n\u00eb Kosov\u00eb<\/a>\u00a0me seli n\u00eb Hag\u00eb, t\u00eb cilat paralelisht me gjyq\u00ebsorin vendor kan\u00eb kompetenc\u00eb q\u00eb t\u2019i hetojn\u00eb dhe gjykojn\u00eb krimet e luft\u00ebs dhe krimet kund\u00ebr njer\u00ebzimit t\u00eb cil\u00ebt kan\u00eb ndodhur n\u00eb Kosov\u00eb gjat\u00eb periudh\u00ebs 1998-2000.<\/p>\n<p>Lidhur me k\u00ebto krime nga institucionet e lartp\u00ebrmendura jan\u00eb akuzuar rreth 190 persona ku prej tyre jan\u00eb d\u00ebnuar vet\u00ebm 65 persona (8 persona jan\u00eb d\u00ebnuar nga TPNJ-a, 17 persona nga gjyq\u00ebsori n\u00eb Serbi dhe 40 persona nga gjyq\u00ebsori n\u00eb Kosov\u00eb).<\/p>\n<p>Arsyeja se p\u00ebrse nuk ka pasur m\u00eb shum\u00eb sukses n\u00eb nd\u00ebshkueshm\u00ebrin\u00eb e kriminel\u00ebve t\u00eb luft\u00ebs \u00ebsht\u00eb sepse institucionet gjyq\u00ebsore jan\u00eb ballafaquar me shum\u00eb sfidat p\u00ebrgjat\u00eb k\u00ebtyre viteve. Disa prej sfidave kryesore jan\u00eb: ndikimi n\u00eb d\u00ebshmitar\u00eb; mungesa e bashk\u00ebpunimit mes prokuroris\u00eb s\u00eb Kosov\u00ebs dhe t\u00eb Serbis\u00eb; koha (me kalimin e koh\u00ebs kujtesa zbehet, d\u00ebshmitar\u00ebt dhe t\u00eb dyshuarit vdesin); mandatet e kufizuara t\u00eb misioneve nd\u00ebrkomb\u00ebtare n\u00eb Kosov\u00eb dhe nd\u00ebrrimi i shpesht\u00eb i stafit nd\u00ebrkomb\u00ebtar ka ndikuar negativisht n\u00eb intensitetin e pun\u00ebs; si dhe n\u00eb fund numri jo i mjaftuesh\u00ebm i prokuror\u00ebve vendor\u00eb dhe stafit mb\u00ebshtet\u00ebs t\u00eb angazhuar n\u00eb hetimin e krimeve t\u00eb luft\u00ebs.<\/p>\n<p>P\u00ebrmes raporteve t\u00eb<a href=\"http:\/\/www.hlc-kosovo.org\/\">\u00a0Fondit p\u00ebr t\u00eb Drejt\u00ebn Humanitare Kosov\u00eb<\/a>\u00a0lidhur me monitorimin e gjykimeve p\u00ebr krimet e luft\u00ebs n\u00eb Kosov\u00eb jan\u00eb evidentuar t\u00eb gjitha ngecjet dhe sfidat me t\u00eb cilat \u00ebsht\u00eb ballafaquar dhe ende ballafaqohet gjyq\u00ebsori kosovar, duke ofruar edhe rekomandimet konkrete p\u00ebr p\u00ebrmir\u00ebsimin e gjendjes s\u00eb gjyq\u00ebsorit. N\u00eb raportin vjetor t\u00eb viti 2013 i quajtur\u00a0<a href=\"http:\/\/www.hlc-kosovo.org\/wp-content\/uploads\/2018\/07\/Pages-from-HLC-Kosovo-annual-report-on-WCT-2013-ENG.pdf\">\u201cD\u00ebshmitar\u00ebt ende Thembra e Akilit n\u00eb gjykimet e profilit t\u00eb lart\u00eb\u201d<\/a>\u00a0p\u00ebrshkruhet gjendja reale e d\u00ebshmitar\u00ebve t\u00eb cil\u00ebt p\u00ebr arsye t\u00eb ndryshme kan\u00eb hequr dor\u00eb nga d\u00ebshmit\u00eb e tyre paraprake me t\u00eb cilat e kan\u00eb mb\u00ebshtetur aktakuz\u00ebn. Gjat\u00eb ballafaqimit me deklaratat e tyre t\u00eb m\u00ebhershme ata kan\u00eb potencuar: se i kan\u00eb n\u00ebnshkruar deklaratat n\u00eb anglisht; se nuk dinin \u00e7far\u00eb kan\u00eb n\u00ebnshkruar; se deklaratat n\u00eb procedurat paraprake i kan\u00eb dh\u00ebn\u00eb n\u00ebn presion; se dallimet n\u00eb d\u00ebshmit\u00eb e tyre paraprake dhe aktuale kan\u00eb qen\u00eb rezultat i p\u00ebrkthimit t\u00eb dob\u00ebt etj. K\u00ebto jan\u00eb disa prej arsyeve q\u00eb d\u00ebshmitar\u00ebt i kan\u00eb p\u00ebrdorur gjat\u00eb refuzimit p\u00ebr t\u2019u p\u00ebrgjigjur pyetjeve t\u00eb prokurorit dhe t\u00eb gjykat\u00ebs. Vet\u00ebm gjat\u00eb k\u00ebsaj periudhe nj\u00eb vje\u00e7are nga numri i gjithmbarsh\u00ebm i d\u00ebshmitar\u00ebve, pes\u00eb (5) d\u00ebshmitar\u00eb kan\u00eb d\u00ebshmuar n\u00eb cil\u00ebsin\u00eb e d\u00ebshmitarit t\u00eb mbrojtur, shtat\u00eb (7) d\u00ebshmitar\u00eb nga ana e prokuroris\u00eb jan\u00eb propozuar si d\u00ebshmitar\u00eb anonim, tre (3) prej tyre kan\u00eb d\u00ebshmuar me video lidhje me z\u00eb t\u00eb ndryshuar dhe me fytyr\u00eb t\u00eb mjegulluar, kat\u00ebr (4) kan\u00eb refuzuar statusin e d\u00ebshmitarit anonim dhe kan\u00eb d\u00ebshmuar publikisht duke refuzuar edhe m\u00eb tutje t\u00eb jen\u00eb d\u00ebshmitar\u00eb t\u00eb prokuroris\u00eb.\u00a0<a href=\"https:\/\/www.mei-ks.net\/repository\/docs\/raporti_i_progresit_2016_shqip.pdf\">Raporti<\/a>\u00a0mbi progresin i Komisionit Evropian p\u00ebr vitin 2016 konstatoi se: \u201csistemi i mbrojtjes s\u00eb d\u00ebshmitar\u00ebve, me gjith\u00eb faktin se ka kapacitetet adekuate, p\u00ebr momentin nuk ka d\u00ebshmitar\u00eb n\u00ebn mbrojtje p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb besimit n\u00eb k\u00ebt\u00eb sistem\u201d.<\/p>\n<p>Dy dekada nga p\u00ebrfundimi i luft\u00ebs qindra dhe mij\u00ebra d\u00ebshmitar\u00eb okular\u00eb kan\u00eb nd\u00ebrruar jet\u00eb. D\u00ebshmit\u00eb q\u00eb ata mund t\u00eb ken\u00eb dh\u00ebn\u00eb n\u00eb organet hetimore derisa kan\u00eb qen\u00eb t\u00eb gjall\u00eb, nuk kan\u00eb m\u00eb pesh\u00eb t\u00eb madhe n\u00eb shqyrtimet gjyq\u00ebsore. Gjat\u00eb k\u00ebsaj periudhe edhe qindra prej kryer\u00ebsve kan\u00eb nd\u00ebrruar jet\u00eb, duke pamund\u00ebsuar k\u00ebshtu \u00e7far\u00ebdo hapje t\u00eb m\u00ebtejme t\u00eb procedurave gjyq\u00ebsore.<\/p>\n<p>Me n\u00ebnshkrimin e\u00a0<a href=\"https:\/\/www.nato.int\/kosovo\/docu\/a990609a.htm\">Marr\u00ebveshjes s\u00eb Kumanov\u00ebs<\/a>, t\u00eb dat\u00ebs 9 qershor 1999, forcat ushtarake t\u00eb RFJ-s\u00eb dhe forcat policore serbe jan\u00eb larguar nga territori i Kosov\u00ebs. Q\u00eb nga ky moment numri i madh i kryer\u00ebsve t\u00eb krimeve t\u00eb luft\u00ebs e kan\u00eb l\u00ebshuar territorin e Kosov\u00ebs. Mungesa e bashk\u00ebpunimit juridik nd\u00ebrkomb\u00ebtar\u00eb mes Kosov\u00ebs dhe Serbis\u00eb, mos shk\u00ebmbimi i informatave mes prokurorive t\u00eb k\u00ebtyre dy shteteve ka krijuar klim\u00eb t\u00eb volitshme p\u00ebr kryer\u00ebsit t\u00eb cil\u00ebt kan\u00eb kryer krimet e luft\u00ebs n\u00eb Kosov\u00eb. Fakti q\u00eb shtetet nuk i ekstradojn\u00eb t\u00eb dyshuarit, e n\u00eb an\u00ebn tjet\u00ebr as vet\u00eb shtetet nuk kan\u00eb treguar ndonj\u00eb progres t\u00eb madh n\u00eb gjykimin e shtetaseve t\u00eb vet\u00eb, tregon qart\u00eb se kjo \u00ebsht\u00eb nj\u00eb prej sfidave m\u00eb t\u00eb m\u00ebdha q\u00eb duhet sa m\u00eb par\u00eb t\u00eb nd\u00ebrmerren masat e nevojshme.<\/p>\n<p>Gjat\u00eb k\u00ebtij viti jan\u00eb b\u00ebr\u00eb edhe ndryshimet n\u00eb Kodin e Procedur\u00ebs Penale t\u00eb Kosov\u00ebs (KPPK) duke e shtuar nj\u00eb dispozit\u00eb q\u00eb lejon gjykimin n\u00eb munges\u00eb t\u00eb personave t\u00eb cil\u00ebt nuk jan\u00eb t\u00eb kapsh\u00ebm p\u00ebr organet e Kosov\u00ebs. Disa jurist\u00eb e p\u00ebrkrahin k\u00ebt\u00eb ndryshim disa e kund\u00ebrshtojn\u00eb. Shtrohet pyetja ku \u00ebsht\u00eb q\u00ebllimi i d\u00ebnimit n\u00eb munges\u00eb n\u00ebse personi i dyshuar apo i d\u00ebnuar n\u00eb munges\u00eb edhe po qe se arrestohet p\u00ebrmes Interpolit ai ka t\u00eb drejt\u00eb n\u00eb rigjykim. Ky ndryshim i KPPK-\u00ebs mund t\u00eb jep rezultate vet\u00ebm n\u00eb ngritjen e numrit t\u00eb personave t\u00eb akuzuar dhe t\u00eb d\u00ebnuar por jo edhe n\u00eb burgosjen e tyre. Ky veprim i nd\u00ebrmarr\u00eb nuk do t\u00eb krijoj\u00eb satisfaksion p\u00ebr familjar\u00ebt e viktimave kur e din\u00eb se vras\u00ebsit e familjar\u00ebve t\u00eb tyre nuk jan\u00eb duke e vuajtur d\u00ebnimin.<\/p>\n<p>N\u00eb Kosov\u00eb me hetimin dhe gjykimin e krimeve t\u00eb luft\u00ebs kryesisht jan\u00eb marr\u00eb misionet nd\u00ebrkomb\u00ebtare. K\u00ebto misione kan\u00eb pasur mandate t\u00eb kufizuara, personeli i t\u00eb cilit ka pasur kontratat e limituara, kurse rastet e krimeve t\u00eb luft\u00ebs jan\u00eb raste voluminoze dhe procedurat gjyq\u00ebsore deri n\u00eb vendim t\u00eb plotfuqish\u00ebm jan\u00eb disa vje\u00e7are. Kemi shembullin kur nj\u00eb rast p\u00ebr krimet e luft\u00ebs ka filluar n\u00eb vitin 2003 me aktakuz\u00eb t\u00eb prokurorit t\u00eb UNMIK-ut kurse ka p\u00ebrfunduar n\u00eb vitin 2016 me p\u00ebrfaq\u00ebsim nga prokuror\u00eb t\u00eb EULEX-it, dhe sigurisht q\u00eb gjat\u00eb k\u00ebsaj periudhe jan\u00eb ndryshuar disa prokuror\u00eb gjat\u00eb p\u00ebrfaq\u00ebsimit t\u00eb k\u00ebsaj aktakuze para gjykat\u00ebs. Krejt ky proces natyrsh\u00ebm k\u00ebrkon koh\u00eb q\u00eb secilit prokuror t\u00eb ri i duhet p\u00ebr t&#8217;u familjarizuar me dosjet voluminoze, gj\u00eb q\u00eb ndikon n\u00eb (mos) efikasitetin e zgjidhjes s\u00eb rastit.<\/p>\n<p>Q\u00eb nga mesi i qershorit t\u00eb vitit 2014, EULEX-i gradualisht ka filluar transferimin e kompetencave ekzekutive tek prokuroria vendore. N\u00eb qershor t\u00eb vitit 2018, EULEX-it i jan\u00eb hequr kompetencat ekzekutive dhe tani vepron vet\u00ebm n\u00eb cil\u00ebsin\u00eb e monitoruesit. Q\u00eb nga pranimi i kompetencave ekzekutive prokuroria vendore ka t\u00eb angazhuar tre prokuror\u00eb dhe ka ngritur vet\u00ebm kat\u00ebr aktakuza ndaj kat\u00ebr personave n\u00eb pes\u00eb vitet e fundit.<\/p>\n<p>Vullneti politik i t\u00eb dy vendeve t\u00eb dala nga lufta kurr\u00eb nuk ka qen\u00eb q\u00eb t\u00eb d\u00ebnohen kryer\u00ebsit e krimeve t\u00eb luft\u00ebs dhe krimeve kund\u00ebr njer\u00ebzimit, pasi q\u00eb t\u00eb d\u00ebnuarit p\u00ebr k\u00ebto veprat penale, si n\u00eb Kosov\u00eb ashtu edhe n\u00eb Serbi jan\u00eb par\u00eb si heronjt\u00eb dhe n\u00eb shumic\u00ebn e rasteve drejtp\u00ebrs\u00ebdrejti nga udh\u00ebheq\u00ebsit shtet\u00ebror\u00eb jan\u00eb dekoruar me mir\u00ebnjohje dhe jan\u00eb avancuar n\u00eb pozita ky\u00e7e t\u00eb institucioneve t\u00eb shtetit.<\/p>\n<p>Gjithashtu disa prej mediave n\u00eb Kosov\u00eb duhet t&#8217;i japin m\u00eb tep\u00ebr mb\u00ebshtetje dhe p\u00ebrkushtim viktimave t\u00eb krimeve t\u00eb luft\u00ebs pasi q\u00eb deri m\u00eb tash disa prej tyre kan\u00eb treguar p\u00ebrkushtim konsideruesh\u00ebm m\u00eb t\u00eb madh p\u00ebr personat t\u00eb cil\u00ebt kan\u00eb qen\u00eb t\u00eb akuzuar. Kjo reflektohet shpesh n\u00ebp\u00ebr emisione televizive ku prezantohen prova t\u00eb nj\u00eb anshme, duke i ofruar hap\u00ebsir\u00eb personave t\u00eb d\u00ebnuar q\u00eb t&#8217;i mohojn\u00eb aktgjykimet e plotfuqishme, me q\u00ebllim q\u00eb t\u00eb krijohet nj\u00eb p\u00ebrshtypje n\u00eb opinion se ata jan\u00eb t\u00eb d\u00ebnuar n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme.<\/p>\n<p>Paqja nuk nd\u00ebrtohet duke i neglizhuar familjet e viktimave t\u00eb luft\u00ebs, paqja nuk nd\u00ebrtohet duke i ikur bashk\u00ebpunimit mes Kosov\u00ebs dhe Serbis\u00eb, paqja nuk nd\u00ebrtohet duke i k\u00ebrc\u00ebnuar d\u00ebshmitar\u00ebt, paqja nuk nd\u00ebrtohet duke ndikuar n\u00eb gjyq\u00ebsor, paqja nuk nd\u00ebrtohet kur n\u00eb tavolin\u00ebn e bisedimeve politikan\u00ebt i ikin k\u00ebtyre temave. Krejt kjo tregon se politikan\u00ebt deri m\u00eb sot nuk kan\u00eb pasur vullnet dhe guxim q\u00eb t\u00eb ballafaqohen me t\u00eb kaluar\u00ebn.
