CEDAW \u00ebsht\u00eb drejtp\u00ebrdrejt e zbatueshme n\u00eb Kosov\u00eb, ngase p\u00ebrmban referenc\u00eb direkte n\u00eb<a href=\"http:\/\/kryeministri-ks.net\/wp-content\/uploads\/2018\/03\/Kushtetuta.e.Republikes.se_.Kosoves-2.pdf\">\u00a0Kushtetut\u00ebn e Kosov\u00ebs<\/a>.\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ACTDetail.aspx?ActlD=2544\">Ligji p\u00ebr Zgjedhjet e P\u00ebrgjithshme<\/a>\u00a0and\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ACTDetail.aspx?ActlD=2544\">Ligji p\u00ebr Zgjedhjet Lokale<\/a>, parashohin kuot\u00ebn gjinore prej s\u00eb paku 30% t\u00eb kandidat\u00ebve p\u00ebr deputet\u00eb n\u00eb listat zgjedhore.<\/p>\n<p>Pakoja e Ligjeve Kund\u00ebr Diskriminimit q\u00eb ka \u00ebsht\u00eb adoptuar n\u00eb vitin 2015, ku b\u00ebjne pjes\u00eb: Ligji Kund\u00ebr Diskriminimit, Ligji p\u00ebr Ombudspersonin dhe Ligji p\u00ebr Barazi Gjinore, garantojn\u00eb t\u00eb drejta t\u00eb barabarta t\u00eb pjes\u00ebmarrjes s\u00eb jet\u00ebs publike t\u00eb qytetar\u00ebve.<\/p>\n<p>Lidhur me k\u00ebt\u00eb, ligji specifik, ai p\u00ebr Barazi Gjinore, parasheh 50% t\u00eb p\u00ebrfaq\u00ebsimit gjinor (p\u00ebrfaq\u00ebsim i barabart\u00eb i t\u00eb dy gjinive), n\u00eb \u00e7do mekaniz\u00ebm dhe nivel t\u00eb pjes\u00ebmarrjes n\u00eb jet\u00ebn politike dhe publike. Me Ligjin p\u00ebr Barazi Gjinore parashihet edhe themelimi i Agjencis\u00eb p\u00ebr Barazi Gjinore si institucion q\u00ebndror i cili integron aspektin gjinor n\u00eb politikb\u00ebrjen n\u00eb nivel shtet\u00ebror. Poashtu parasheh eksistimin e zyrtar\u00ebve p\u00ebr barazi gjinore n\u00eb \u00e7do komun\u00eb dhe ministri.<\/p>\n<p>Ky ligj poashtu rregullon \u00e7\u00ebshtjen e buxhtimit gjinor i cili nga viti 2015 \u00ebsht\u00eb obligativ p\u00ebr t\u00eb gjitha organizatat buxhetore n\u00eb Kosov\u00eb, p\u00ebrfshir\u00eb komunat, ministrit\u00eb dhe institucionet tjera.<\/p>\n<p>\u201cVler\u00ebsimi i Programit t\u00eb Kosov\u00ebs p\u00ebr Barazi Gjinore 2008-2013 ka shpalosur se p\u00ebrkund\u00ebr p\u00ebrparimit t\u00eb arritur me ca nga treguesit socio-ekonomik, deri n\u00eb vitin 2013, grat\u00eb n\u00eb Kosov\u00eb ishin n\u00eb pozit\u00eb disavantazhi krahasuar me burrat\u201d [1]. Programi i ri p\u00ebr barazi gjinore i cili i p\u00ebrcakton fushat prioritare sa i p\u00ebrket barazis\u00eb gjinore \u00ebsht\u00eb duke u hartuar nga Agjencia p\u00ebr Barazi Gjinore dhe do t\u00eb jet\u00eb i vlefsh\u00ebm p\u00ebr periudh\u00ebn 2019-2023.<\/p>\n<p><strong>P\u00ebrfaq\u00ebsimi gjinor n\u00eb Kuvendin e Kosov\u00ebs, komunat dhe partit\u00eb politike &#8211; Ku q\u00ebndron problemi?\u00a0<\/strong><\/p>\n<p>Problemi i pjes\u00ebmarrjes s\u00eb grave n\u00eb sfer\u00ebn shoq\u00ebrore lidhet ngusht\u00eb me munges\u00ebn e pjes\u00ebmarrjes s\u00eb tyre ne organet e vendimmarjes publike. Qeveria n\u00eb ikje \u00ebsht\u00eb nj\u00eb shembull i keqqeverisjes sa i p\u00ebrket p\u00ebrfaq\u00ebsimit t\u00eb grave n\u00eb Qeverin\u00eb e Kosov\u00ebs. Nga 21 ministra vet\u00ebm 2 ishin gra [2]. Ishin 32% gra dhe 68% burra n\u00eb Kuvendin e Kosoves [3]. N\u00eb legjislatur\u00ebn e kaluar, vet\u00ebm nj\u00eb parti parlamentare ishte udh\u00ebhequr nga nj\u00eb grua. B\u00ebhet fjal\u00eb p\u00ebr partin\u00eb &#8220;Alternativa&#8221;, e cila ishte udh\u00ebhequr nga ish kryetarja e komun\u00ebs s\u00eb Gjakov\u00ebs, znj. Mimoza Kusari Lila.\u00a0[4]<\/p>\n<p>N\u00eb nivel komune p\u00ebr zgjdhjet evitit 2017, kemi patur vet\u00ebm 4% t\u00eb grave kandidate p\u00ebr kryetare t\u00eb komun\u00ebs, nga 204 kandidat\u00eb.\u00a0[5]<\/p>\n<p>Kjo lidhet ngusht\u00eb me munges\u00ebn e p\u00ebrfaq\u00ebsimit t\u00eb grave n\u00eb t\u00eb gjitha pozitat vendimarr\u00ebse duke filluar nga partit\u00eb politike. Ligji p\u00ebr Barazi Gjinore, th\u00ebrret p\u00ebr 50% t\u00eb p\u00ebrfq\u00ebsimi t\u00eb grave n\u00eb t\u00eb gjitha organet e vendimmarjes publike dhe politike. Mungesa e zbatimit t\u00eb Ligjit p\u00ebr Barazi Gjinore nuk shihet vet\u00ebm n\u00eb p\u00ebrfaq\u00ebsimin e partive politike. \u201cP\u00ebrfaq\u00ebsimi i barabart\u00eb gjinor n\u00eb t\u00eb gjitha organet legjislative, ekzekutive dhe gjyq\u00ebsore dhe institucionet e tjera publike arrihet kur sigurohet p\u00ebrfaq\u00ebsimi minimal prej pes\u00ebdhjet\u00eb p\u00ebrqind (50%) p\u00ebr secil\u00ebn gjini, p\u00ebrfshir\u00eb edhe organet tjera drejtuese dhe vendimmarr\u00ebse\u201d (Ligji p\u00ebr Barazi Gjinore, neni 6, pika 8).<\/p>\n<p>Duke par\u00eb trendet negative t\u00eb nominimit t\u00eb grave n\u00eb listat p\u00ebr kandidate p\u00ebr deputet\u00eb t\u00eb Kuvendit t\u00eb Kosov\u00ebs, dit\u00eb m\u00eb her\u00ebt Avokati i Popullit e l\u00ebshoj nj\u00eb komunikat\u00eb n\u00eb lidhje me zgjedhjet e parakohshme parlamentare t\u00eb vitit 2019, n\u00eb Kosov\u00eb. N\u00eb k\u00ebt\u00eb komunikat\u00eb th\u00ebrret p\u00ebr respektimin e Ligjit p\u00ebr Barazi Gjinore. M\u00eb konkretisht,<\/p>\n<p>Avokati i Popullit u rikujton subjekteve politike se Ligji nr. 05\/L-020 p\u00ebr Barazi Gjinore, respektivisht neni 14 i tij, shprehimisht thot\u00eb: \u201cPartit\u00eb politike me aktet e tyre obligohen t\u00eb zbatojn\u00eb masat p\u00ebr promovimin e pjes\u00ebmarrjes s\u00eb barabart\u00eb t\u00eb meshkujve dhe femrave n\u00eb organet dhe trupat e partive, n\u00eb pajtim me dispozitat e nenit 6 t\u00eb k\u00ebtij ligji.\u201d Neni 6, paragrafi 7, i k\u00ebtij ligji, nd\u00ebr t\u00eb tjera, specifikon: \u201cOrganet legjislative, ekzekutive dhe gjyq\u00ebsore n\u00eb t\u00eb gjitha nivelet, si dhe institucionet tjera publike, jan\u00eb t\u00eb obliguara t\u00eb miratojn\u00eb dhe zbatojn\u00eb masa t\u00eb ve\u00e7anta p\u00ebr t\u00eb arritur p\u00ebrfaq\u00ebsimin e gjinis\u00eb m\u00eb pak t\u00eb p\u00ebrfaq\u00ebsuar, deri n\u00eb arritjen e p\u00ebrfaq\u00ebsimit t\u00eb barabart\u00eb t\u00eb femrave dhe meshkujve sipas k\u00ebtij ligji.\u201d<\/p>\n<p>Me k\u00ebt\u00eb u b\u00ebhet apel partive politike q\u00eb t\u00eb ken\u00eb parasysh q\u00eb n\u00eb list\u00eb zgjedhore t\u00eb p\u00ebrfshihet numri i barabart\u00eb i grave dhe burrave sipas k\u00ebtij ligji. P\u00ebr m\u00eb tep\u00ebr, Ligji p\u00ebr Barazi Gjinore, nuk p\u00ebrq\u00ebndrohet vet\u00ebm n\u00eb listat zgjdhore, por edhe n\u00eb p\u00ebrfaq\u00ebsimin e barabart\u00eb edhe n\u00eb t\u00eb gjitha organet e zgjedhjeve, p\u00ebrfshir\u00eb edhe p\u00ebrb\u00ebrjen e pjes\u00ebtar\u00ebve t\u00eb k\u00ebshillave t\u00eb vendvotimeve, t\u00eb cil\u00ebt duhet t\u00eb jen\u00eb te p\u00ebrb\u00ebra nga t\u00eb dy gjinit\u00eb.<\/p>\n<p>Pjes\u00ebmarrja e grave n\u00eb listat e kandidat\u00ebve p\u00ebr deputete t\u00eb Kuvendit t\u00eb Kosov\u00ebs dhe kuota gjinore n\u00eb vet\u00eb Kuvendin e Kosov\u00ebs, jan\u00eb masa shum\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb barazis\u00eb gjinore n\u00eb vend. K\u00ebto jan\u00eb masa afirmative, t\u00eb p\u00ebrkohshme, t\u00eb cilat n\u00eb nj\u00eb periudhe t\u00eb gjat\u00eb duhet t\u00eb kontribuojn\u00eb n\u00eb nd\u00ebrrim t\u00eb mentalitetit t\u00eb p\u00ebrgjithsh\u00ebm sa i p\u00ebrket grave n\u00eb politike. Nj\u00eb trend i till\u00eb mund t\u00eb shihet shum\u00eb leht\u00eb, ngase nga nj\u00eb cik\u00ebl zgj\u00ebdhor n\u00eb tjetrin, jemi d\u00ebshmitar\u00eb t\u00eb rritjes s\u00eb numrit t\u00eb grave t\u00eb cilat jan\u00eb b\u00ebr\u00eb deputete t\u00eb Kuvendit t\u00eb Kosov\u00ebs me vota q\u00eb i kan\u00eb marr\u00eb n\u00eb gar\u00eb me deputet\u00eb burra, pa kuot\u00eb gjinore.<\/p>\n<p>Mir\u00ebpo, p\u00ebr t\u00eb patur nj\u00eb p\u00ebrfaq\u00ebsim t\u00eb mir\u00ebfillt\u00eb politik t\u00eb grave, nd\u00ebrrimi thelb\u00ebsor duhet t\u00eb ndodh\u00eb n\u00eb vet\u00eb parti politike. Grat\u00eb n\u00eb parti politike nuk kan\u00eb qasje t\u00eb barabart\u00eb n\u00eb burime t\u00eb financiare sa i p\u00ebrket t\u00eb mb\u00ebshtjetejs s\u00eb aktiviteteve partiake, si\u00e7 kan\u00eb burrat. Qasja n\u00eb media me q\u00ebllim t\u00eb promovimit dhe paraqitjes s\u00eb programit t\u00eb tyre \u00ebsht\u00eb shpeshher\u00eb n\u00eb hije p\u00ebr shkak t\u00eb hap\u00ebsir\u00ebs q\u00eb e z\u00ebn\u00eb burrat.<\/p>\n<p>Lidhur me k\u00ebt\u00eb, kur flasim p\u00ebr grat\u00eb politikane n\u00eb media, \u00ebsht\u00eb shum\u00eb e r\u00ebnd\u00ebsishme t\u00eb shohim se si k\u00ebto marr\u00ebdh\u00ebnie t\u00eb fuqis\u00eb dhe ushtrimi i fuqis\u00eb institucionale luan nj\u00eb rol t\u00eb\u00a0 \u00a0 r\u00ebnd\u00ebsish\u00ebm n\u00eb m\u00ebnyr\u00ebn se si paraqiten grat\u00eb politikane n\u00eb media. Grat\u00eb n\u00eb p\u00ebrgjith\u00ebsi i n\u00ebnshtrohen nj\u00eb diskursi t\u00eb komunikimit t\u00eb cilat i redukton ato n\u00eb form\u00eb dhe jo n\u00eb p\u00ebrmbajtje, duke u munduar q\u00eb t\u2019i zhvesh\u00eb nga fuqia e pozit\u00ebs q\u00eb e kan\u00eb si politikane.<\/p>\n<p>Nj\u00eb takatik\u00eb e cila p\u00ebrdoret p\u00ebr paraqitjen e grave politikane \u00ebsht\u00eb \u201ctaktika e vler\u00ebsimit pozitiv t\u00eb pamjes\u201d [6]. Grat\u00eb kur intervistohen zakonisht pyeten p\u00ebr tema m\u00eb shum\u00eb sociale, nd\u00ebrsa pyetjet rreth temave lidhur me shtetformim, si psh temat lidhur me ushtrin\u00eb, ndarjen buxhetore, etj. jan\u00eb temat q\u00eb u shtrohen burrave.<\/p>\n<p>Grat\u00eb politikane ngrihen m\u00eb tep\u00ebr n\u00eb piadestal kur e fillojn\u00eb karrier\u00ebn politike por edhe u\u00a0n\u00ebnshtrohen kritikave m\u00eb t\u00eb shumta n\u00eb rast t\u00eb d\u00ebshtimit n\u00eb politik\u00eb. \u201cGrat\u00eb politikane udh\u00ebheq\u00ebse, p\u00ebr shembull i n\u00ebnshtrohen m\u00eb tep\u00ebr nj\u00eb rishikimi t\u00eb kujdessh\u00ebm (apo gjykimi) medial, to cilat i atribuohen prirjes s\u00eb mediave ndaj stereotipeve gjinore t\u00eb cilat i favorizojn\u00eb burrat n\u00eb raport me grat\u00eb n\u00eb pushtet\u201d [7]\u00a0. Poashtu, t\u00eb qenit i fuqish\u00ebm apo t\u00eb t\u00eb pasurit t\u00eb nj\u00eb pozite m\u00eb t\u00eb lart\u00eb asocohet me burrat, dhe n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb edhe perceptohet se burrat q\u00eb jan\u00eb n\u00eb pozit\u00eb m\u00eb t\u00eb lart\u00eb n\u00eb politik\u00eb e q\u00eb \u00ebsht\u00eb zakonisht e sakt\u00eb, jan\u00eb m\u00eb t\u00eb fuqish\u00ebm se grat\u00eb t\u00eb cilat marrin pjes\u00eb n\u00eb shkall\u00eb shum\u00eb m\u00eb t\u00eb vog\u00ebl n\u00eb vendimmarrje politike.<\/p>\n<p>\u00c7ka m\u00eb tutje?<\/p>\n<p>Marr\u00eb parasysh q\u00eb korniza legjislative q\u00eb garanton pjes\u00ebmarrje t\u00eb grave n\u00eb jet\u00ebn publike \u00ebsht\u00eb mjaft e konsoliduar, \u00ebsht\u00eb detyr\u00eb e Kuvendit t\u00eb Kosov\u00ebs t\u00eb luaj rolin e vet t\u00eb mbik\u00ebqyrjes s\u00eb implementimit t\u00eb ligjeve dhe t\u00eb prodhoj\u00eb rekomandime p\u00ebr p\u00ebrmir\u00ebsim legjislativ aty ku ka mang\u00ebsi. Poashtu, vendosja e kuotave gjinore n\u00eb organet udh\u00ebheq\u00ebse t\u00eb partive politike, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb grantohet pjes\u00ebmarrja e grave n\u00eb vendimmarrjen politike brenda k\u00ebtyre strukturave.
