Raporte dhe analiza vendore, por edhe\u00a0<a href=\"https:\/\/www.institutigap.org\/documents\/11054_Administrata.pdf\">Raportet e Vendit (Progresit) t\u00eb Komisionit Evropian<\/a>\u00a0[1], kan\u00eb theksuar k\u00ebto t\u00eb meta dhe kan\u00eb b\u00ebr\u00eb thirrje p\u00ebr adresimin e tyre tash e disa vite.<\/p>\n<p>Reforma e racionalizimit t\u00eb agjencive ekzekutive dhe rregullator\u00ebve n\u00eb Kosov\u00eb u iniciua n\u00eb vitin 2016. Ajo \u00ebsht\u00eb n\u00eb proces p\u00ebrmes Planit t\u00eb Veprimit p\u00ebr\u00a0<a href=\"https:\/\/map.rks-gov.net\/desk\/inc\/media\/CE9D3498-C350-4A20-BF96-C1B7BCA5737E.pdf\">Racionalizimin e Agjencive (PVRA) t\u00eb miratuar nga Qeveria e Kosov\u00ebs n\u00eb 2018.<\/a>\u00a0PVRA parasheh q\u00eb reforma e racionalizimit t\u00eb zgjas\u00eb deri n\u00eb vitin 2021 dhe t\u00eb prek\u00eb agjencit\u00eb e pavarura me kompentenca ekzekutive, agjencit\u00eb ekzekutive brenda Qeveris\u00eb dhe rregullator\u00ebt (n\u00eb total 60 syresh). Sipas PVRA, 7 Agjenci t\u00eb Pavarura do t\u00eb p\u00ebrfshihen n\u00eb val\u00ebn e par\u00eb, nd\u00ebrkaq n\u00eb val\u00ebn e dyt\u00eb, tret\u00eb dhe t\u00eb kat\u00ebrt do t\u00eb adresohen agjencit\u00eb ekzekutive brenda Qeveris\u00eb dhe rregullator\u00ebt. Gjithashtu vlen t\u00eb ceket se reforma gjithashtu \u00ebsht\u00eb prioritet i marr\u00ebveshjes Kosov\u00eb-BE Agjenda p\u00ebr Reforma Evropiane (ERA), andaj r\u00ebnd\u00ebsia e saj fiton pesh\u00eb edhe nga planin e integrimit evropian.<\/p>\n<p>Pse \u00ebsht\u00eb e nevojshme kjo reform\u00eb dhe pse duhet p\u00ebrkrahur ajo? Ka disa probleme t\u00eb identifikuara q\u00eb e b\u00ebjn\u00eb k\u00ebt\u00eb reform\u00eb jo vet\u00ebm t\u00eb nevojshme, por t\u00eb domosdoshme.<\/p>\n<p>E para \u00ebsht\u00eb madh\u00ebsia. Kosova ka 32 Agjenci t\u00eb pavarura q\u00eb funksionojn\u00eb n\u00eb kuad\u00ebr t\u00eb Parlamentit. Me k\u00ebt\u00eb shif\u00ebr, Kosova ka m\u00eb s\u00eb shumti agjenci q\u00eb i raportojn\u00eb Parlamentit n\u00eb Ballkan. Brenda legjislacionit n\u00eb Kosov\u00eb ekzistojn\u00eb mbi 20 kategori konceptuale p\u00ebr k\u00ebta trupa (Agjenci, Agjencion, K\u00ebshill, Komision etj.). P\u00ebrpos kostos buxhetore t\u00eb imponuar nga funksionimi i tyre dhe numri i t\u00eb pun\u00ebsuarve, nj\u00eb shif\u00ebr kaq e lart\u00eb gjithashtu doemos krijon dyfishim t\u00eb kompetencave me trupa tjer\u00eb t\u00eb administrat\u00ebs publike, ta z\u00ebm\u00eb, K\u00ebshilli p\u00ebr Trash\u00ebgimi Kulturore ushtron kompetenca t\u00eb ngjashme me Departamentin p\u00ebr Trash\u00ebgimi Kulturore n\u00eb MKRS. Duplifikime t\u00eb k\u00ebtilla q\u00eb jan\u00eb t\u00eb zakonshme, e kan\u00eb d\u00ebmtuar funksionimin efektiv t\u00eb aparatit shtet\u00ebror. Duhet cekur se institucione t\u00eb pavarura si Komisioni Qendror Zgjedhor, Banka Qendrore etj. q\u00eb jan\u00eb pjes\u00eb e Kushtetut\u00ebs me nene t\u00eb ve\u00e7anta nuk jan\u00eb p\u00ebrfshir\u00eb n\u00eb procesin e reform\u00ebs, por ajo p\u00ebrfshin vet\u00ebm agjencit\u00eb e themeluara me\u00a0<a href=\"https:\/\/ec.europa.eu\/neighbourhood-enlargement\/sites\/near\/files\/20190529-kosovo-report.pdf\">Nenin 142.<\/a><\/p>\n<p>Sfid\u00eb serioze ka paraqitur procesi i raportimit n\u00eb Kuvend. Prej 32 agjencive q\u00eb i raportojn\u00eb Kuvendit, 21 do t\u00eb p\u00ebrfshihen n\u00eb reform\u00eb, duke ndryshuar linj\u00ebn e llogaridh\u00ebnies nga Kuvendi n\u00eb Qeveri. Ky \u00ebsht\u00eb nj\u00eb hap i logjiksh\u00ebm pasi ato ushtrojn\u00eb p\u00ebrgjegj\u00ebsi puro ekzekutive, andaj nuk do duhej t\u2019i raportonin Kuvendit, por Qeveris\u00eb, meq\u00eb Kuvendit i mungojn\u00eb kapacitetet njer\u00ebzore dhe profesionale p\u00ebr t\u00eb kryer mbik\u00ebqyrje cil\u00ebsore. Konkretisht, \u00ebsht\u00eb e zakonshme q\u00eb deputet\u00ebt t\u00eb ken\u00eb munges\u00eb t\u00eb kapaciteteve p\u00ebr t\u00eb mbik\u00ebqyrur funksionimin e sektor\u00ebve specifik\u00eb, sikund\u00ebr energjia, rregullimi i pronave e t\u00eb ngjashme.<\/p>\n<p><a href=\"https:\/\/ec.europa.eu\/neighbourhood-enlargement\/sites\/near\/files\/20190529-kosovo-report.pdf\">P\u00ebr m\u00eb tep\u00ebr, edhe procesi i raportimit q\u00eb ka ndodhur, ka l\u00ebn\u00eb jo pak p\u00ebr t\u00eb d\u00ebshiruar<\/a>. Si ilustrim, ka pasur raste kur agjenci t\u00eb caktuara, si me Agjencin\u00eb Kosovare t\u00eb Privatizimit, q\u00eb nuk e kan\u00eb kryer raportimin vjetor para Kuvendit. Pasojat e k\u00ebsaj? Asnj\u00eb. Kjo p\u00ebr shkak se Parlamenti nuk ka mekanizma p\u00ebr t\u2019i ndjekur n\u00eb raste t\u00eb k\u00ebtilla. Prandaj, duke marr\u00eb p\u00ebr baz\u00eb trajektoren e deritanishme, futja e agjencive me kompetenca ekzekutive n\u00eb qeveri do t\u00eb p\u00ebrmir\u00ebsonte procesin e raportimit dhe monitorimit.<\/p>\n<p>Sfid\u00eb gjithashtu \u00ebsht\u00eb pavar\u00ebsia e pazakont\u00eb e k\u00ebtyre trupave. Agjencit\u00eb e pavarura kan\u00eb g\u00ebzuar pavar\u00ebsi t\u00eb theksuar financiare dhe organizative, p\u00ebr shkak se jan\u00eb themeluar me ligje t\u00eb ve\u00e7anta. P\u00ebrmes ligjeve t\u00eb ve\u00e7anta k\u00ebta trupa kan\u00eb rregulluar funksionimin e brendsh\u00ebm ndaras nga administrate publike, p\u00ebr shembull pagat dhe statusin e punonj\u00ebsve. Por me miratimin e\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=18684\">Ligjit p\u00ebr Organizmin dhe Funksionimin e Administrat\u00ebs Shtet\u00ebrore dhe t\u00eb Agjencive t\u00eb Pavarura\u00a0<\/a>jan\u00eb krijuar kushtet q\u00eb kjo t\u00eb ndryshoj\u00eb dhe t\u00eb b\u00ebhet harmonizimi i plot\u00eb i statusit t\u00eb agjencive dhe punonj\u00ebsve t\u00eb tyre me pjes\u00ebn tjet\u00ebr t\u00eb adminsitrat\u00ebs publike.<\/p>\n<p>E fundit por jo m\u00eb pak e r\u00ebnd\u00ebsishmja \u00ebsht\u00eb politizimi i skajsh\u00ebm i procesit t\u00eb zgjedhjes s\u00eb bordeve dhe aty n\u00eb pozita drejtuese. Me disa p\u00ebrjashtime t\u00eb pak\u00ebta, t\u00eb gjitha Bordet e Agjencive zgjedhen p\u00ebrmes Parlamentit, duke qen\u00eb plot\u00ebsisht n\u00eb dor\u00eb t\u00eb partive. N\u00eb k\u00ebt\u00eb plan, gjat\u00eb zgjedhjes s\u00eb bordeve kriteri i profesionalizmit shpesh \u00ebsht\u00eb z\u00ebv\u00ebnd\u00ebsuar me af\u00ebrsin\u00eb apo an\u00ebtar\u00ebsin\u00eb partiake, sikur ceket edhe n\u00eb Raportin e fundit t\u00eb\u00a0<a href=\"https:\/\/ec.europa.eu\/neighbourhood-enlargement\/sites\/near\/files\/20190529-kosovo-report.pdf\">Vendit t\u00eb Komisionit Evropian<\/a>. Duke qen\u00eb produkt i marr\u00ebveshjeve nd\u00ebrmjet partive politike, m\u00eb shpesh sesa rrall\u00eb, bordet e agjencive t\u00eb pavarura u kan\u00eb dh\u00ebn\u00eb atyre mund\u00ebsi reale p\u00ebr t\u00eb zhvilluar patronazhin, klientelizmin dhe nepotizmin, me nj\u00eb fjal\u00eb u kan\u00eb ofuar atyre nj\u00eb pist\u00eb t\u00eb \u00e7mueshme p\u00ebr zgjerim ndikimi dhe pushteti.<\/p>\n<p>Reforma e racionalizimit m\u00ebton t\u00eb ofroj\u00eb zgjidhje p\u00ebr k\u00ebto sfida. Ajo synon t\u00eb zvog\u00ebloj\u00eb shpenzimet publike, t\u00eb p\u00ebrmir\u00ebsoj\u00eb performanc\u00ebn e administrat\u00ebs publike p\u00ebrmes rregullimit t\u00eb linjave t\u00eb raportimit dhe monitorimit, duke ruajtur pavar\u00ebsin\u00eb funksionale t\u00eb k\u00ebtyre trupave dhe uljes s\u00eb mund\u00ebsive p\u00ebr politizim. Reforma mori nj\u00eb shtys\u00eb serioze me miratimin e tre ligjeve korniz\u00eb n\u00eb Dhjetor 2018, k\u00ebsisoj racionalizimi i agjencive do duhej t\u00eb shihej si vazhdim i natyrsh\u00ebm i k\u00ebtij hapi.<\/p>\n<p>Aktualisht, zbatimi i racionalizimit \u00ebsht\u00eb n\u00eb nj\u00eb periudh\u00eb ngecjeje. Dy projektligjet p\u00ebr val\u00ebn e par\u00eb q\u00eb do t\u00eb p\u00ebrfshijn\u00eb 7 agjenci ishin parapar\u00eb t\u00eb dilnin n\u00eb Qeveri n\u00eb Pranver\u00eb, por nuk ndodhi p\u00ebr shkak t\u00eb vonesave. P\u00ebr m\u00eb shum\u00eb, me dor\u00ebheqjen e kryeministrit t\u00eb Kosov\u00ebs n\u00eb fund t\u00eb korrikut situata \u00ebsht\u00eb v\u00ebshtir\u00ebsuar edhe m\u00eb. N\u00eb aspektin politik nuk \u00ebsht\u00eb hasur ndonj\u00eb vullnet nga Qeveria apo partit\u00eb e m\u00ebdha q\u00eb reforma t\u00eb shtyhet p\u00ebrpara deri tash. Si pasoj\u00eb e ngushtimit t\u00eb mund\u00ebsive p\u00ebr ushtrim t\u00eb pushtetit q\u00eb reforma do t\u00eb prodhoj\u00eb p\u00ebr partit\u00eb dhe deputet\u00ebt, zbatimi \u00ebsht\u00eb pritur me rezistenc\u00eb nga k\u00ebto t\u00eb fundit.<\/p>\n<p>N\u00eb an\u00ebn tjet\u00ebr, p\u00ebr arsyet u shpjeguan m\u00eb lart, reforma e racionalizimit duhet t\u00eb shihet si nj\u00eb interes shtet\u00ebror, q\u00eb e p\u00ebrmir\u00ebson funksionimin e administrat\u00ebs publike dhe kursen parat\u00eb e qytetar\u00ebve, por edhe si nj\u00eb hap afrues i Kosov\u00ebn me BE-n\u00eb. Ajo duhet t\u00eb p\u00ebrkrahet nga qytetar\u00ebt dhe shoq\u00ebria civile.
