Kjo pyetje m\u00eb shum\u00eb drejtohet nga paqart\u00ebsia q\u00eb lidhet me disponimin e partive politike q\u00eb t\u00eb mos bashk\u00ebpunojn\u00eb me koalicionin q\u00eb ka fituar shumic\u00ebn e vendeve n\u00eb Kuvend, por nuk ka shumic\u00ebn p\u00ebr t\u00eb formuar qeverin\u00eb. K\u00ebsisoj, duke interpretuar legjislacionin p\u00ebrkat\u00ebs, praktik\u00ebn dhe opinionin e Gjykat\u00ebs Kushtetuese, arrijm\u00eb n\u00eb p\u00ebrfundimin q\u00eb mandati i dyt\u00eb p\u00ebr t\u00eb tentuar formimin e qeveris\u00eb i takon sipas ligjit partis\u00eb s\u00eb dyt\u00eb me m\u00eb s\u00eb shumti vende n\u00eb kuvend, dhe vet\u00ebm n\u00eb rrethana shum\u00eb specifike, mandati i dyt\u00eb do t\u2019i takonte edhe nj\u00eb her\u00eb partis\u00eb s\u00eb par\u00eb.<\/p>\n<p>Pyetja lidhet direkt me mandatarin e dyt\u00eb, dhe se cila\/i parti\/koalicion \u00ebsht\u00eb titullar\/e t\u00eb propozoj\u00eb kandidatin e dyt\u00eb p\u00ebr kryeminist\u00ebr, n\u00eb rast se partia\/koalicioni me m\u00eb shum\u00eb vende n\u00eb Kuvend, nuk fiton besimin e kuvendit, pra mbi 50% e t\u00eb gjith\u00eb deputet\u00ebve t\u00eb Kuvendit t\u00eb Kosov\u00ebs.<\/p>\n<p>N\u00eb baz\u00eb t\u00eb asaj q\u00eb kam pikasur, mbizot\u00ebron bindja q\u00eb Presidenti sipas diskrecionit t\u00eb tij, ka t\u00eb drejt\u00eb t\u2019i jap\u00eb mandatin partis\u00eb\/koalicionit me m\u00eb shum\u00eb vende n\u00eb kuvend edhe pas d\u00ebshtimit t\u00eb par\u00eb p\u00ebr t\u00eb fituar besimin e Kuvendit, si\u00e7 shprehet edhe vendimi i Gjykat\u00ebs Kushtetuese lidhur me\u00a0<em>\u2018vler\u00ebsimin e p\u00ebrputhshm\u00ebris\u00eb s\u00eb nenit 84 (14) [Kompetencat e Presidentit] me nenin 95 [Zgjedhja e Qeveris\u00eb] t\u00eb Kushtetut\u00ebs se Republik\u00ebs s\u00eb Kosov\u00ebs\u2019.<\/em><\/p>\n<p>Leximi i neneve p\u00ebrkat\u00ebse t\u00eb kushtetut\u00ebs dhe interpretimi i gjykat\u00ebs nuk \u00ebsht\u00eb eksplicit sa i p\u00ebrket pyetjes se kujt i takon mandati p\u00ebr t\u00eb formuar qeverin\u00eb n\u00eb her\u00ebn e dyt\u00eb, sidoqoft\u00eb gjuha e vendimit t\u00eb kushtetueses sugjeron q\u00eb mandatori i dyt\u00eb duhet t\u00eb jet\u00eb partia e dyt\u00eb me m\u00eb shum\u00eb vende n\u00eb kuvend. Presidenti i Kosov\u00ebs, edhe pse me ndikim t\u00eb caktuar n\u00eb politik\u00ebn e vendit, duhet t\u00eb jet\u00eb i paansh\u00ebm sa i p\u00ebrket dh\u00ebnies s\u00eb mandatit kandidatit t\u00eb partis\u00eb s\u00eb dyt\u00eb me m\u00eb shum\u00eb vende n\u00eb Kuvend, pasi partia\/koalicioni q\u00eb ka fituar shumic\u00ebn relative ka d\u00ebshtuar t\u00eb marr\u00eb besimin e Kuvendit. Roli i tij \u00ebsht\u00eb m\u00eb shum\u00eb simbolik, dhe injorimi i paarsyesh\u00ebm i partis\u00eb s\u00eb dyt\u00eb me m\u00eb shum\u00eb vende n\u00eb Kuvend do t\u00eb tejkalonte kompetenc\u00ebn e tij dhe t\u00eb rrezikonte procesin e rregullt dhe ndarjen e balanc\u00ebn e pushteteve si\u00e7 rregullohet me kushtetut\u00eb.<\/p>\n<p>Neni 95.4 i Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs parasheh q\u00eb n\u00eb rastin kur\u00a0<em>\u2018p\u00ebrb\u00ebrja e propozuar e Qeveris\u00eb nuk merr shumic\u00ebn e votave t\u00eb nevojshme, Presidenti i Republik\u00ebs s\u00eb Kosov\u00ebs, brenda dhjet\u00eb (10) dit\u00ebsh em\u00ebron kandidatin tjet\u00ebr sipas s\u00eb nj\u00ebjt\u00ebs procedur\u00eb.\u2019<\/em><\/p>\n<p>Komentari i Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, e trajton Nenin 95.4 si mjet q\u00eb nuk \u2018<em>[lejon] q\u00eb kandidati p\u00ebr kryeminist\u00ebr q\u00eb caktohet nga ana e presidentit t\u00eb vij\u00eb nga nj\u00eb proces konsultues me nj\u00eb parti\/koalicion q\u00eb nuk e ka shumic\u00ebn e ul\u00ebseve n\u00eb Kuvend. Kjo, prandaj, e b\u00ebn ndalimin q\u00eb kandidati p\u00ebr kryeminist\u00ebr t\u00eb zgjidhet nga nj\u00eb parti\/koalicion q\u00eb nuk e ka shumic\u00ebn n\u00eb Kuvend.\u2019<\/em><\/p>\n<p>T\u00eb lexuarit e shpjegimit t\u00eb komentarit na b\u00ebn t\u00eb kuptojm\u00eb q\u00eb interpretimi i z. Hasani i referohet tekstualisht paragrafit p\u00ebrkat\u00ebs, dhe n\u00eb munges\u00eb t\u00eb praktik\u00ebs n\u00eb t\u00eb kaluar\u00ebn, dhe krahasimit me sistemet e ngjashme parlamentare, ai nuk i kontribuon q\u00ebllimit ton\u00eb p\u00ebr t\u2019iu p\u00ebrgjigjur pyetjes s\u00eb shtruar n\u00eb k\u00ebt\u00eb artikull.<\/p>\n<p>Madje ai tashm\u00eb \u00ebsht\u00eb jo-aktual pasi q\u00eb n\u00eb zgjedhjet e kaluara u em\u00ebrua p\u00ebr kryeminist\u00ebr pik\u00ebrisht nj\u00eb kandidat q\u00eb erdhi nga nj\u00eb proces konsultues dhe i takonte nj\u00eb partie q\u00eb nuk kishte shumic\u00ebn e ul\u00ebseve n\u00eb kuvend. Dhe meq\u00eb sipas paragrafit 4, rregullat procedurale p\u00ebr em\u00ebrimin e kandidatit n\u00eb her\u00ebn e dyt\u00eb jan\u00eb identike me procedurat e ndjekura sipas paragrafit 1 t\u00eb nenit 95, at\u00ebher\u00eb em\u00ebrimi i nj\u00eb kandidati q\u00eb nuk i takon partis\u00eb apo koalicionit me shumic\u00eb relative nuk p\u00ebrb\u00ebn problem, dhe p\u00ebr m\u00eb shum\u00eb interpretimi i komentarit tashm\u00eb nuk p\u00ebrkon me praktik\u00ebn e deritanishme n\u00eb Kosov\u00eb.<\/p>\n<p>Meq\u00eb tani kemi zgjidhur dilem\u00ebn n\u00eb raport me interpretimin e komentarit, dhe kemi konstatuar q\u00eb objekti dhe q\u00ebllimi i paragrafit nuk ka t\u00eb b\u00ebj\u00eb me lejimin apo moslejimin q\u00eb kandidati q\u00eb em\u00ebrohet her\u00ebn e dyt\u00eb t\u00eb vij\u00eb nga nj\u00eb proces konsultativ dhe nga nj\u00eb parti q\u00eb nuk p\u00ebrb\u00ebn shumic\u00ebn relative, na mbetet q\u00eb t\u00eb merret p\u00ebr objekt vet\u00eb vendimi i kushtetueses n\u00eb lidhje me k\u00ebt\u00eb \u00e7\u00ebshtje.<\/p>\n<p>Gjykata kushtetuese n\u00eb vendimin e saj t\u00eb vitit 2014 n\u00eb lidhje me\u00a0<em>\u2018vler\u00ebsimin e p\u00ebrputhshm\u00ebris\u00eb s\u00eb nenit 84 (14) [Kompetencat e Presidentit] me nenin 95 [Zgjedhja e Qeverise] t\u00eb Kushtetut\u00ebs se Republik\u00ebs s\u00eb Kosov\u00ebs\u2019, duke interpretuar paragrafin 4 t\u00eb nenit 95, thekson se \u00ebsht\u00eb n\u00eb \u2018diskrecionin e Presidentit q\u00eb, pas konsultimeve me partit\u00eb dhe me koalicionet, t\u00eb vendos\u00eb se cil\u00ebs parti ose cilit koalicion do t\u2019i jepet mandati p\u00ebr t\u00eb propozuar kandidatin tjet\u00ebr p\u00ebr Kryeminist\u00ebr\u2019<\/em>\u00a0(para 90). M\u00eb tutje vendimi shprehet se Presidenti do t\u00eb vler\u00ebsoj\u00eb se cila \u00ebsht\u00eb gjasa m\u00eb e madhe q\u00eb nj\u00eb kandidat i caktuar t\u00eb arrij\u00eb mir\u00ebbesimin e kuvendit (para 93).<\/p>\n<p>P\u00ebrfundimisht kushtetuesja vendos q\u00eb Presidenti n\u00eb<em>\u00a0\u2018diskrecionin e tij\/saj&#8230; em\u00ebron kandidatin tjet\u00ebr p\u00ebr Kryeminist\u00ebr, pas konsultimit me partit\u00eb apo koalicionet\u2019<\/em>, duke vazhduar m\u00eb tutje q\u00eb nuk p\u00ebrjashtohet mund\u00ebsia q\u00eb Presidenti t\u00eb vendos\u00eb t\u2019i jap\u00eb partis\u00eb apo koalicionit t\u00eb par\u00eb, mund\u00ebsin\u00eb q\u00eb t\u00eb propozoj\u00eb kandidatin tjet\u00ebr p\u00ebr Kryeminist\u00ebr.<\/p>\n<p>Vendimi i kushtetueses e shpreh qart\u00eb q\u00eb: n\u00eb her\u00ebn e dyt\u00eb Presidenti em\u00ebron kandidatin p\u00ebr Kryeminist\u00ebr n\u00eb konsultim me partit\u00eb apo koalicionet tjera, duke mos e p\u00ebrjashtuar mund\u00ebsin\u00eb ta em\u00ebroj\u00eb kandidatin nga partia e par\u00eb q\u00eb ka d\u00ebshtuar t\u00eb marr\u00eb besimin e kuvendit, por pa e specifikuar se n\u00eb \u00e7far\u00eb rrethanash Presidenti ka t\u00eb drejt\u00eb ta b\u00ebj\u00eb nj\u00eb gj\u00eb t\u00eb till\u00eb.<\/p>\n<p>S\u00eb pari duhet t\u00eb theksojm\u00eb se Presidenti nuk ka t\u00eb drejt\u00eb q\u00eb n\u00eb m\u00ebnyr\u00eb arbitrare t\u2019i jap\u00eb mandatin e dyt\u00eb edhe nj\u00eb her\u00eb partis\u00eb\/koalicionit m\u00eb t\u00eb madh. Ai, si\u00e7 shprehet edhe vendimi i kushtetueses, duhet s\u00eb pari t\u00eb konsultohet me partit\u00eb dhe koalicionet. Gjykata termat \u2018parti\u2019 dhe \u2018koalicion\u2019 i p\u00ebrdor n\u00eb shum\u00ebs, q\u00eb do t\u00eb thot\u00eb se partia q\u00eb ka d\u00ebshtuar t\u00eb marr\u00eb besimin e kuvendit p\u00ebrjashtohet nga ky proces, dhe subjekte t\u00eb konsultimit jan\u00eb partit\u00eb ose koalicionet e tjera, respektivisht partia apo koalicioni i dyt\u00eb me m\u00eb shumt\u00eb vende n\u00eb kuvend.<\/p>\n<p>Termi\u00a0<em>konsultohet<\/em>, nuk n\u00ebnkupton negocimin e Presidentit me partin\u00eb apo koalicionin p\u00ebrkat\u00ebs, madje as p\u00ebr kompozicionin e qeveris\u00eb s\u00eb mundshme, pasi nj\u00eb gj\u00eb e till\u00eb do t\u00eb tejkalonte kompetencat e tij, dhe do t\u00eb pengonte efektin e zgjedhjeve n\u00eb formimin e qeveris\u00eb. Nj\u00eb gj\u00eb e till\u00eb nuk do t\u00eb ishte n\u00eb funksion t\u00eb ushtrimit t\u00eb vullnetit popullor p\u00ebrmes vot\u00ebs, dhe do t\u00eb p\u00ebrb\u00ebnte shkelje t\u00eb rendit kushtetues dhe ndarjes s\u00eb pushteteve. Presidenti n\u00eb k\u00ebt\u00eb rast konsultohet vet\u00ebm n\u00eb lidhje me kandidatin p\u00ebr kryeminist\u00ebr, emrin e t\u00eb cilit nuk ka t\u00eb drejt\u00eb ta refuzoj\u00eb.<\/p>\n<p><em>Konsultimi<\/em>\u00a0me partit\u00eb e tjera \u00ebsht\u00eb detyrim kushtetues i Presidentit, dhe sipas vendimit t\u00eb kushtetueses \u00ebsht\u00eb n\u00eb funksion t\u00eb identifikimit n\u00ebse mandatari i dyt\u00eb ka gjas\u00eb reale q\u00eb t\u00eb marr\u00eb miratimin e kuvendit. (shih para. 86)<\/p>\n<p>Shumica e nevojshme n\u00eb kuvend p\u00ebr t\u00eb formuar qeverin\u00eb nuk \u00ebsht\u00eb parakusht p\u00ebr t\u2019u em\u00ebruar kandidati i partis\u00eb s\u00eb dyt\u00eb m\u00eb t\u00eb madhe, pasi q\u00eb Presidenti nuk e miraton qeverin\u00eb, dhe ai nuk ka gjas\u00eb reale ta dij\u00eb se a do t\u00eb votohet qeveria e propozuar n\u00eb kuvend apo jo. P\u00ebr m\u00eb tep\u00ebr, sigurimi i shumic\u00ebs s\u00eb nevojshme n\u00eb kuvend, nuk \u00ebsht\u00eb parakusht p\u00ebr em\u00ebrimin e kandidatit p\u00ebr Kryeminist\u00ebr as her\u00ebn e par\u00eb pik\u00ebrisht p\u00ebr arsyen e lart\u00eb p\u00ebrmendur si\u00e7 shprehet edhe vendimi i gjykat\u00ebs. Paragrafi 4 i Nenit 95 shprehet qart\u00eb q\u00eb em\u00ebrimi i kandidatit p\u00ebr Kryeminist\u00ebr n\u00eb her\u00ebn e dyt\u00eb duhet t\u00eb b\u00ebhet p\u00ebrmes t\u00eb nj\u00ebjt\u00ebs procedur\u00eb sikur her\u00ebn e par\u00eb, rrjedhimisht ky parakusht nuk mund t\u00eb imponohet as her\u00ebn e dyt\u00eb, dhe do t\u00eb p\u00ebrb\u00ebnte nj\u00eb non sens legal n\u00eb rast t\u00eb kund\u00ebrt.<\/p>\n<p>Presidenti nuk mundet ta dij\u00eb n\u00ebse i em\u00ebruari i tij do t\u00eb jet\u00eb n\u00eb gjendje ta formoj\u00eb qeverin\u00eb, pasi n\u00eb lidhje me k\u00ebt\u00eb gj\u00eb \u00ebsht\u00eb kuvendi autoriteti i vet\u00ebm dhe final. Nj\u00eb gj\u00eb e till\u00eb do t\u00eb mund t\u00eb ndodhte n\u00eb vende t\u00eb tjera, si shembulli n\u00eb Holand\u00eb ku mbreti cakton nj\u00eb informateur q\u00eb e informon lidhur me negociatat mes partive dhe gjasave p\u00ebr t\u2019u miratuar qeveria, marr\u00ebveshjes rreth programit qeveris\u00ebs etj., por sisteme t\u00eb tilla kan\u00eb t\u00ebr\u00ebsisht kompozicion tjet\u00ebr nga ai i Kosov\u00ebs.<\/p>\n<p>Sa i p\u00ebrket pik\u00ebs problematike ku Presidenti ka mund\u00ebsin\u00eb ta em\u00ebroj\u00eb kandidatin nga partia e par\u00eb q\u00eb ka d\u00ebshtuar t\u00eb marr\u00eb besimin e kuvendit, kjo n\u00ebnkuptohet vet\u00ebm n\u00ebse partia e dyt\u00eb me m\u00eb shum\u00eb vende n\u00eb kuvend d\u00ebshton ta propozoj\u00eb kandidatin e saj p\u00ebr Kryeminist\u00ebr pran\u00eb Presidentit, apo n\u00eb rrethana t\u00eb caktuara refuzon t\u00eb konsultohet si\u00e7 ka ndodhur edhe n\u00eb Greqi n\u00eb zgjedhjet e vitit 2012. Kjo n\u00eb asnj\u00eb rrethan\u00eb nuk n\u00ebnkupton q\u00eb Presidenti duke anashkaluar partit\u00eb tjera t\u2019ia jap\u00eb s\u00ebrish mandatorin partis\u00eb s\u00eb par\u00eb, por vet\u00ebm n\u00eb rrethana shum\u00eb specifike ku Presidenti i jep mund\u00ebsin\u00eb edhe nj\u00eb her\u00eb partis\u00eb m\u00eb t\u00eb madhe, pasi partit\u00eb e tjera kan\u00eb d\u00ebshtuar t\u00eb paraqesin kandidatin e tyre p\u00ebr kryeminist\u00ebr, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb evitohet p\u00ebrs\u00ebritja e zgjedhjeve.<\/p>\n<p>N\u00eb rrethanat aktuale, kjo do t\u00eb thot\u00eb q\u00eb n\u00eb rast se koalicioni PAN, si shumic\u00eb relative nuk arrin t\u00eb fitoj\u00eb besimin e legjislativit, at\u00ebher\u00eb titullar i t\u00eb drejt\u00ebs p\u00ebr t\u00eb marr\u00eb mandatin \u00ebsht\u00eb partia e dyt\u00eb me m\u00eb shum\u00eb vende n\u00eb kuvend, n\u00eb rastin ton\u00eb L\u00ebvizja Vet\u00ebvendosje.
