Kosova, si shtet i ri, n\u00eb p\u00ebrvoj\u00ebn e saj t\u00eb shkurt\u00eb me marr\u00ebveshje, ka shfaqur mosnjohje t\u00eb k\u00ebtij procesi duke: (a) n\u00ebnshkruar marr\u00ebveshje p\u00ebr t\u00eb cilat nj\u00eb pjes\u00eb e konsiderushme e partive politike pretendojn\u00eb se p\u00ebrmbajn\u00eb gabime faktike (demarkacioni me Malin e Zi) dhe kushtetuese (Asociacioni i Komunave me Shumic\u00eb Serbe), (b) n\u00ebnshkruar por mos-ratifikuar marr\u00ebveshje (demarkacioni me Malin e Zi), dhe (c) sfiduar\u00a0 marr\u00ebveshje t\u00eb arritura nga institucionet paraprake (rivler\u00ebsimi i Dhomave t\u00eb Specializuara). Ky shkrim argumenton se institucionet e vendit duhet t\u00eb nd\u00ebrmarrin tre hapa t\u00eb domosdosh\u00ebm, t\u00eb elaboruar n\u00eb vijim, p\u00ebr t\u00eb evituar n\u00eb t\u00eb ardhmen gabimet q\u00eb nd\u00ebrlidhen me marr\u00ebveshje nd\u00ebrkomb\u00ebtare.<\/p>\n<p><strong>1. T\u00eb rritet koordinimi nd\u00ebrmjet Qeveris\u00eb dhe Kuvendit para n\u00ebnshkrimit t\u00eb marr\u00ebveshjeve nd\u00ebrkomb\u00ebtare.<\/strong><\/p>\n<p>Dihet mir\u00ebfilli se n\u00eb baz\u00eb t\u00eb s\u00eb drejt\u00ebs vendore, Qeveria n\u00ebnshkruan, nd\u00ebrsa Kuvendi ratifikon marr\u00ebveshjet nd\u00ebrkomb\u00ebtare. Megjithat\u00eb, n\u00eb nivel t\u00eb marr\u00ebdh\u00ebnieve nd\u00ebrkomb\u00ebtare, kur Qeveria n\u00ebnshkruan marr\u00ebveshje, ajo jep zotime\u00a0<em>shtet\u00ebrore<\/em>\u00a0n\u00eb nivel nd\u00ebrkomb\u00ebtar se mund t\u2019i zbatoj\u00eb marr\u00ebveshjet e arritura. N\u00eb k\u00ebt\u00eb nivel, refuzimi eventual nga Kuvendi i marr\u00ebveshjes nd\u00ebrkomb\u00ebtare nuk shihet n\u00eb kontekst t\u00eb pavar\u00ebsis\u00eb institucionale, por tregon munges\u00ebn e koordinimit nd\u00ebr-institucional dhe paaft\u00ebsin\u00eb shtet\u00ebrore p\u00ebr t\u00eb zbatuar zotimet e pranuara.<\/p>\n<p>Nga kjo q\u00eb u theksua, Qeveria nuk duhet t\u00eb hyj\u00eb n\u00eb marr\u00ebveshje nd\u00ebrkomb\u00ebtare dhe t\u00eb k\u00ebrkoj\u00eb nga Kuvendi ratifikimin e tyre, n\u00ebse ky i fundit nuk ka konsensus politik n\u00eb koh\u00ebn e duhur. Qeveria nuk mund ta vendos\u00eb Kuvendin para aktit t\u00eb kryer me marr\u00ebveshjet e arritura. Kuvendi nuk \u00ebsht\u00eb \u201cvul\u00eb gome\u201d q\u00eb me automatiz\u00ebm aprovon marr\u00ebveshjet nd\u00ebrkomb\u00ebtare t\u00eb negociuara nga ekzekutivi. P\u00ebr k\u00ebt\u00eb arsye, ekzekutivi duhet t\u00eb parafoj\u00eb apo n\u00ebnshkruaj\u00eb marr\u00ebveshje nd\u00ebrkomb\u00ebtare vet\u00ebm pasi t\u00eb siguroj\u00eb se ka p\u00ebrkrahjen e domosdoshme n\u00eb parlament. Nj\u00eb gj\u00eb e till\u00eb do t\u2019i zvog\u00eblonte befasit\u00eb n\u00eb traktat-b\u00ebrje dhe do t\u00eb rriste kredibilitetin shtet\u00ebror. P\u00ebr t\u2019u mund\u00ebsuar kjo, Qeveria duhet t\u00eb k\u00ebrkoj\u00eb nga Kuvendi p\u00eblqimin p\u00ebr marr\u00ebveshje t\u00eb negociuara para se ato t\u2019i n\u00ebnshkruaj\u00eb apo parafoj\u00eb. Kjo mund t\u00eb realizohet duke amendamentuar Ligjin p\u00ebr Marr\u00ebveshje Nd\u00ebrkomb\u00ebtare. Kosova mund t\u00eb huazoj\u00eb praktik\u00ebn e SHBA-s\u00eb\u00a0<a href=\"https:\/\/www.state.gov\/s\/l\/treaty\/c175\/\" target=\"_blank\" rel=\"noopener\">(Qarkorja 175)<\/a>\u00a0dhe Holand\u00ebs\u00a0<a href=\"https:\/\/www.biicl.org\/documents\/58_netherlands_treaty_report.pdf?showdocument=1\" target=\"_blank\" rel=\"noopener\">(Ligji p\u00ebr Aprovim dhe Publikim t\u00eb Traktateve)<\/a>\u00a0p\u00ebr rregullimin e k\u00ebsaj \u00e7\u00ebshtje (Kuvendi ka n\u00eb dispozicion mendimin tim ligjor t\u00eb detajuar, t\u00eb p\u00ebrgatitur p\u00ebr KDI, p\u00ebr realizimin e reform\u00ebs n\u00eb fjal\u00eb).<\/p>\n<p><strong>2. T\u00eb p\u00ebrfshihen ekspert\u00eb n\u00eb negociim t\u00eb marr\u00ebveshjeve dhe instrumenteve tjera t\u00eb karakterit nd\u00ebrkomb\u00ebtar<\/strong><\/p>\n<p>P\u00ebrvojat paraprake tregojn\u00eb p\u00ebr mos-p\u00ebrfshirje t\u00eb mjaftueshme t\u00eb ekspert\u00ebve t\u00eb fushave p\u00ebrkat\u00ebse gjat\u00eb negociimit t\u00eb marr\u00ebveshjeve. Shembulli i parafimit t\u00eb dokumentit q\u00eb parasheh themelimin e Asociacionit t\u00eb Komunave me Shumic\u00eb Serbe tregon se si Kosova ka parafuar nj\u00eb dokument qart\u00ebsisht kund\u00ebr-kushtetues. \u00cbsht\u00eb v\u00ebshtir\u00eb t\u00eb gjenden ekspert nga e drejta kushtetuese q\u00eb do ta konsideronin k\u00ebt\u00eb dokument n\u00eb harmoni me Kushtetut\u00ebn e Kosov\u00ebs. Shembulli tregon se ekipi politik p\u00ebr negociim t\u00eb marr\u00ebveshjes duhet t\u00eb ket\u00eb mb\u00ebshtetje nga ekspert\u00eb profesional\u00eb. Kjo nuk n\u00ebnkupton se ekspert\u00ebt duhet t\u00eb marrin rolin e politik-b\u00ebr\u00ebsve, por t\u00eb par\u00ebt duhet t\u00eb gjejn\u00eb zgjidhje ligjore n\u00eb kuad\u00ebr t\u00eb sistemit kushtetues p\u00ebr realizimin e objektivave politike.<\/p>\n<p><strong>3. Qeverit\u00eb e reja t\u00eb respektojn\u00eb marr\u00ebveshjet e arritura nga qeverit\u00eb paraprake.<\/strong><\/p>\n<p>Cikli i nd\u00ebrrimit t\u00eb qeverive \u00ebsht\u00eb i natyrsh\u00ebm. Pik\u00ebrisht duke pretenduar ndryshimet, partit\u00eb opozitare vijn\u00eb n\u00eb pushtet. Megjithat\u00eb, politika shtet\u00ebrore q\u00eb nd\u00ebrlidhet me kushtet q\u00eb dalin nga marr\u00ebveshjet paraprake duhet zbatuar pa marr\u00eb parasysh nd\u00ebrrimeve n\u00eb Qeveri apo Kuvend. P\u00ebr t\u00eb ilustruar obligimet e derivuara, do t\u2019i referohem shembullit t\u00eb Greqis\u00eb p\u00ebr qasjen q\u00eb qeveria e re atje kishte marr\u00eb ndaj obligimeve q\u00eb nd\u00ebrlidheshin me borxhin nd\u00ebrkomb\u00ebtar gjat\u00eb kriz\u00ebs financiare dhe reagimin e shteteve tjera t\u00eb Eurozon\u00ebs.<\/p>\n<p>Kur ministri grek Varufakis k\u00ebrkonte ri-negocimin e kushteve t\u00eb marr\u00ebveshjes me ministrat e Eurozon\u00ebs p\u00ebr shkak t\u00eb ndryshimit t\u00eb qeveris\u00eb greke, homologu i tij gjerman,\u00a0<a href=\"https:\/\/www.newstatesman.com\/world-affairs\/2015\/07\/yanis-varoufakis-full-transcript-our-battle-save-greece\" target=\"_blank\" rel=\"noopener\">Sch\u00e4uble, ju p\u00ebrgjigj<\/a>:<\/p>\n<p>\u201cUn\u00eb nuk do t\u2019i diskutoj me ju kushtet e marr\u00ebveshjes p\u00ebr t\u00eb cilat \u00ebsht\u00eb pajtuar qeveria juaj e m\u00ebparshme, pasi q\u00eb nuk lejojm\u00eb q\u00eb zgjedhjet n\u00eb Greqi t\u00eb ndryshojn\u00eb marr\u00ebveshjen. Ne jemi 19 vende an\u00ebtare t\u00eb Eurozon\u00ebs dhe n\u00eb rast se sa her\u00eb t\u00eb ket\u00eb zgjedhje n\u00eb vendet tona e ndryshojm\u00eb q\u00ebndrimin p\u00ebr kushtet e marr\u00ebveshjes, at\u00ebher\u00eb marr\u00ebveshjet nd\u00ebrmjet nesh nuk do t\u00eb kishin kurrfar\u00eb kuptimi\u201d.<\/p>\n<p>N\u00eb fund Greqia u detyrua t\u2019i p\u00ebrmbush\u00eb obligimet q\u00eb derivonin nga qeverit\u00eb parapake. Megjithat\u00eb, zvarritja e mosp\u00ebrmbushjes i kushtoi shum\u00eb Greqis\u00eb. K\u00ebto \u2018kriza\u2019 n\u00eb fakt nuk nd\u00ebrlidhen\u00a0me q\u00ebllimin e arritjes s\u00eb\u00a0marr\u00ebveshjeve n\u00eb\u00a0fjal\u00eb, por me hapat dhe m\u00ebnyr\u00ebn e konkludimit dhe m\u00eb pas mos-zbatimit t\u00eb\u00a0tyre nga ana e institucioneve vendore. Kjo tregon se problemet jan\u00eb\u00a0t\u00eb\u00a0natyr\u00ebs sa politike aq edhe teknike-profesionale.<\/p>\n<p>P\u00ebrvoja jo e mir\u00eb e deritanishme n\u00eb traktat-b\u00ebrje k\u00ebrkon reflektim t\u00eb brendsh\u00ebm dhe jo gjah p\u00ebr gjetjen e fajtorve t\u00eb jasht\u00ebm. Kosova si shtet i ri, vet\u00ebm sa ka filluar rrug\u00ebtimin e tij n\u00eb traktat-b\u00ebrje. N\u00ebse klasa politike ka interesim q\u00eb vendi t\u00eb fuqizoj\u00eb subjektivitetin nd\u00ebrkomb\u00ebtar dhe t\u00eb krijoj\u00eb aleanca nd\u00ebr-shtet\u00ebrore, duhet t\u00eb nd\u00ebrmarr\u00eb veprime konkrete p\u00ebr krijimin e praktikave t\u00eb mira n\u00eb traktat-b\u00ebrje.
