Mir\u00ebpo, po ashtu dihet se ka sektor\u00eb q\u00eb prekin interesat shtet\u00ebrore p\u00ebr t\u00eb cilat sekreti \u00ebsht\u00eb i domosdosh\u00ebm si siguria, inteligjenca, rendi apo edhe diplomacia. Kardinali Risheli, kryeministri i famsh\u00ebm i Franc\u00ebs dikur thoshte se \u201cSekreti \u00ebsht\u00eb shpirti i pun\u00ebve t\u00eb shtetit\u201d. Mungesa e informimit t\u00eb publikut mbi t\u00eb gjitha diskutimet e prapaskenat e negociatave n\u00eb Bruksel, jo vet\u00ebm q\u00eb nuk \u00ebsht\u00eb ndonj\u00eb shkelje, por \u00ebsht\u00eb norm\u00eb apo praktik\u00eb tipike n\u00eb marr\u00ebdh\u00ebniet nd\u00ebrkomb\u00ebtare. Prandaj, p\u00ebr hir t\u00eb s\u00eb v\u00ebrtet\u00ebs, \u00a0duhet th\u00ebn\u00eb q\u00eb k\u00ebto pretendime p\u00ebr transparenc\u00eb negociatash ose burojn\u00eb nga nj\u00eb injoranc\u00eb e thell\u00eb p\u00ebr m\u00ebnyr\u00ebn se si b\u00ebhen negociatat n\u00ebp\u00ebr bot\u00eb ose jan\u00eb thjesht nj\u00eb mask\u00eb p\u00ebr t\u00eb kamufluar kund\u00ebrshtimin q\u00eb ekziston ndaj dialogut n\u00eb p\u00ebrgjith\u00ebsi e Tha\u00e7it si kryenegociator n\u00eb ve\u00e7anti.<\/p>\n<p>Pik\u00ebs\u00ebpari duhet b\u00ebr\u00eb nj\u00eb dallim midis marr\u00ebveshjeve sekrete dhe negociatave sekrete. N\u00eb p\u00ebrgjith\u00ebsi sot ka nj\u00eb konsensus nd\u00ebrkomb\u00ebtar kund\u00ebr traktateve sekrete mes shteteve t\u00eb cilat ishin shum\u00eb t\u00eb shpeshta n\u00eb shekullin e 19-t\u00eb por jan\u00eb shum\u00eb t\u00eb rralla sot. Me ardhjen n\u00eb pushtet t\u00eb bolshevik\u00ebve, pas Revolucionit t\u00eb Tetorit n\u00eb n\u00ebntor 1917, Leon Trocki b\u00ebri publike traktatet sekret\u00eb q\u00eb cari kishte b\u00ebr\u00eb me fuqit\u00eb e m\u00ebdha t\u00eb aleanc\u00ebs \u00eb Antant\u00ebs, duke theksuar k\u00ebtu Marr\u00ebveshjen e Kostandinopoj\u00ebs e cila parashikonte ndarjen e Perandoris\u00eb Osmane mes Rusis\u00eb e vendeve t\u00eb tjera partnere si dhe Paktin e Londr\u00ebs q\u00eb joshi italian\u00ebt q\u00eb t\u00eb dilnin nga Blloku Trepal\u00ebsh n\u00eb k\u00ebmbim t\u00eb gllab\u00ebrimit t\u00eb nj\u00eb pjese t\u00eb bregdetit shqiptar dhe dalmatin. B\u00ebrja publike e k\u00ebtyre marr\u00ebveshjeve shkaktoi nj\u00eb indinjat\u00eb dhe siklet t\u00eb madh anemban\u00eb bot\u00ebs duke fermentuar nj\u00eb klim\u00eb t\u00eb p\u00ebrshtatshme nd\u00ebrkomb\u00ebtare kund\u00ebr marr\u00ebveshjeve nd\u00ebrkomb\u00ebtare. Prandaj, jo rast\u00ebsisht, pika e par\u00eb, n\u00eb list\u00ebn e 14 pikave t\u00eb paraqitura n\u00eb 1918 nga presidenti Uillson p\u00ebr t\u00eb nd\u00ebrtuar nj\u00eb rend t\u00eb ri nd\u00ebrkomb\u00ebtar, ishte pik\u00ebrisht pika p\u00ebr eliminimin e ujdive sekrete n\u00eb diplomaci.<\/p>\n<p>Krejt e kund\u00ebrta q\u00ebndron me negociatat sekrete ku bisedimet jan\u00eb sekrete, mir\u00ebpo rezultati i tyre, pra marr\u00ebveshja finale \u00ebsht\u00eb \u00a0publike. Lidhur me negociatat ekziston nj\u00eb paradigm\u00eb e konsoliduar dhe e pranuar gjer\u00ebsisht q\u00eb ato \u00ebsht\u00eb m\u00eb mir\u00eb q\u00eb t\u00eb zhvillohen n\u00eb m\u00ebnyr\u00eb sekrete. Faktikisht, paprekshm\u00ebria e \u00e7antave dhe korrier\u00ebve diplomatik\u00eb, komunikimi me mesazhe t\u00eb shifruara apo bisedimet e fshehta n\u00ebn rrogoz jan\u00eb pjes\u00eb thelb\u00ebsore e diplomacis\u00eb e madje jan\u00eb koduar n\u00eb t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare. Mjafton t\u00eb lexosh Konvent\u00ebn e Vjen\u00ebs p\u00ebr Marr\u00ebdh\u00ebniet Diplomatike t\u00eb vitit 1961 p\u00ebr t\u00eb kuptuar se ajo \u00ebsht\u00eb konceptuar si nj\u00eb instrument q\u00eb u mund\u00ebson diplomat\u00ebve p\u00ebr ta mbrojtur e mbajtur informacionin t\u00eb fsheht\u00eb prej shtetit prit\u00ebs, prej shteteve t\u00eb tjera e prej mbar\u00eb publikut. Madje ka shpesh raste ku jo vet\u00ebm q\u00eb bisedimet mbahen sekrete, por q\u00eb shpesh p\u00ebr hir t\u00eb interesave shtet\u00ebrore, publiku nuk e di fare q\u00eb \u00ebsht\u00eb duke u b\u00ebr\u00eb nj\u00eb negociat\u00eb. Kur u mor vesh gatishm\u00ebria e SHBA-ve p\u00ebr t\u00eb b\u00ebr\u00eb nj\u00eb marr\u00ebveshje paqe me Vietnamin Verior, Henry Kissinger kishte b\u00ebr\u00eb tashm\u00eb 12 raunde takimesh sekrete me vietkong\u00ebt dhe kinez\u00ebt.<\/p>\n<p>Po ashtu duhet th\u00ebn\u00eb se publiku i gjer\u00eb nuk ka as aft\u00ebsin\u00eb as koh\u00ebn p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb m\u00ebnyr\u00eb konstruktive n\u00eb debatin diplomatik q\u00eb mund t\u00eb ndizet si rezultat i b\u00ebrjes publike t\u00eb t\u00eb gjitha informatave lidhur me negociatat. Negociatat p\u00ebr p\u00ebrmbylljen e faz\u00ebs finale t\u00eb dialogut me Serbin\u00eb jan\u00eb tejet t\u00eb nd\u00ebrlikuara e vijn\u00eb pas 7 vitesh negociatash t\u00eb vazhdueshme t\u00eb koklavitura teknike. P\u00ebr k\u00ebt\u00eb arsye \u00ebsht\u00eb goxha e v\u00ebshtir\u00eb q\u00eb t\u00eb pritet q\u00eb qytetar\u00ebt e thjesht\u00eb t\u00eb ken\u00eb njohurin\u00eb, ekspertiz\u00ebn apo informimin e plot\u00eb q\u00eb nevojitet p\u00ebr t\u00eb patur nj\u00eb opinion t\u00eb pjekur dhe t\u00eb duhur mbi nj\u00eb \u00e7\u00ebshtje si kjo, e cila nj\u00ebherazi ngjan shum\u00eb emocione dhimbje e marazi t\u00eb cilat e mjegullojn\u00eb akoma m\u00eb shum\u00eb mendimin e arsyesh\u00ebm.<\/p>\n<p>Kur flitet p\u00ebr emocione, vlen t\u00eb p\u00ebrmendet se m\u00eb shum\u00eb sesa shqet\u00ebsimi p\u00ebr transparenc\u00ebn, shumica e kund\u00ebrshtar\u00ebve t\u00eb dialogut thjesht i kan\u00eb ende syt\u00eb t\u00eb errur nga instinkti i hakmarrjes e nuk ndihen gati p\u00ebr t\u00eb kap\u00ebrdir\u00eb nj\u00eb marr\u00ebveshje me armiqt\u00eb historik\u00eb. Mir\u00ebpo shtetet serioze dhe burr\u00ebshtetasit nuk e kan\u00eb luksin t\u00eb ngelen peng t\u00eb vajtimit e marazit dhe duhet t\u00eb kap\u00ebrcejn\u00eb pengesat emocionale p\u00ebr hir t\u00eb interesave shtet\u00ebrore. Rasti m\u00eb ekstrem q\u00eb e d\u00ebshmon k\u00ebt\u00eb gj\u00eb n\u00ebp\u00ebr bot\u00eb \u00ebsht\u00eb negocimi me aktor\u00ebt jokonvencional\u00eb apo joshtet\u00ebror\u00eb sikurse jan\u00eb terrorist\u00ebt.<\/p>\n<p>N\u00eb parim shtetet demokratike deklarohen se refuzojn\u00eb t\u00eb negociojn\u00eb me terrorist\u00ebt, sepse nuk duan t\u00eb b\u00ebhen peng t\u00eb dhun\u00ebs dhe nuk duan q\u00eb ata q\u00eb shkaktojn\u00eb dhun\u00ebn t\u00eb shp\u00ebrblehen. Pranimi i terrorist\u00ebve n\u00eb tryez\u00eb t\u00eb bisedimeve n\u00eb nj\u00ebfar\u00eb m\u00ebnyre i amniston apo i legjitimon aktet e tyre t\u00eb dhunshme dhe nd\u00ebrkoh\u00eb dekurajon ata aktor\u00eb dhe faktor\u00eb q\u00eb p\u00ebrpiqet t\u00eb arrijn\u00eb q\u00ebllimet e tyre politike me mjete paq\u00ebsore. Megjithat\u00eb, n\u00eb realitet, n\u00eb praktik\u00eb, qeverive demokratike m\u00eb t\u00eb avancuara shpesh u duhet q\u00eb t\u00eb negociojn\u00eb me terrorist\u00ebt. K\u00ebshtu p\u00ebr shembull qeveria spanjolle u ul n\u00eb bisedime me terrorist\u00ebt bask\u00eb t\u00eb ETA-s vet\u00ebm gjasht\u00eb muaj pasi ky grup kishte vrar\u00eb 21 qytetar\u00eb n\u00eb 19 qershor 1987, \u00a0n\u00ebp\u00ebrmjet nj\u00eb makine bombe t\u00eb vendosur n\u00eb supermarkat\u00ebn Hipercor n\u00eb Barcelon\u00eb. Izraeli q\u00eb \u00ebsht\u00eb i njohur p\u00ebr dor\u00ebn e ashp\u00ebr me t\u00eb cil\u00ebn e trajton terrorizmin, negocioi n\u00eb m\u00ebnyr\u00eb t\u00eb fsheht\u00eb marr\u00ebveshjet e Oslos n\u00eb vitin 1993 edhe Organizata\u00a0p\u00ebr\u00a0\u00c7lirimin\u00a0e Palestin\u00ebs vazhdonte aktivitetet e saj terroriste dhe refuzonte q\u00eb t\u00eb njihte t\u00eb drejt\u00ebn e shtetit t\u00eb Izraelit p\u00ebr t\u00eb ekzistuar. Britanik\u00ebt e mbajt\u00ebn nj\u00eb ur\u00eb komunikimi me terrorist\u00ebt e IRA-as edhe n\u00eb vitin 1991 kur kjo organizat\u00eb pothuaj shfarosi t\u00eb gjith\u00eb kabinetin qeveritar t\u00eb Britanis\u00eb n\u00ebp\u00ebrmjet nj\u00eb sulmi me mortaj\u00eb. Po ashtu n\u00eb vitet e fundit \u00ebsht\u00eb b\u00ebr\u00eb tashm\u00eb publike se ka pasur bisedime intensive sekrete t\u00eb amerikan\u00ebve me taleban\u00ebt.<\/p>\n<p>Gjithsesi rasti i dialogut me Serbin\u00eb nuk \u00ebsht\u00eb aspekt ekstrem sikurse jan\u00eb negociatat sekrete me terrorist\u00ebt, por \u00ebsht\u00eb nj\u00eb rast relativisht i zakonsh\u00ebm e i p\u00ebrhapur, \u00a0sepse sot pothuaj nj\u00eb e treta e shteteve t\u00eb bot\u00ebs jan\u00eb shtete q\u00eb po tranzitojn\u00eb drejt demokracis\u00eb pasi kan\u00eb dal\u00eb nga nj\u00eb konflikt nd\u00ebrshtet\u00ebror apo luft\u00eb civile. Pra ka nj\u00eb praktik\u00eb goxha t\u00eb konsoliduar t\u00eb mbajtjes s\u00eb negociatave sekrete p\u00ebr t\u00eb v\u00ebn\u00eb kapak ndaj konflikteve t\u00eb s\u00eb kaluar\u00ebs. Sekreti n\u00eb negociata \u00ebsht\u00eb i nevojsh\u00ebm qoft\u00eb p\u00ebrkundrejt pal\u00ebs tjet\u00ebr e qoft\u00eb p\u00ebrkundrejt opinionit publik t\u00eb brendsh\u00ebm. Ashtu sikurse nj\u00eb trajner nuk b\u00ebn publike t\u00eb gjitha skemat dhe strategjit\u00eb e parashikuara para nj\u00eb ndeshje futbolli sepse kjo gj\u00eb i jep mund\u00ebsi kund\u00ebrshtarit q\u00eb t\u2019iu paraprij\u00eb e t\u2019iu gjej\u00eb nj\u00eb kund\u00ebrp\u00ebrgjigje efikase, edhe negociatori mban shum\u00eb gj\u00ebra n\u00eb konfidencialitet t\u00eb plot\u00eb. T\u00eb k\u00ebrkosh nga negociatori q\u00eb t\u00eb negocioj\u00eb me transparenc\u00eb t\u00eb plot\u00eb \u00ebsht\u00eb nj\u00ebsoj sikur t\u00eb k\u00ebrkohet nga nj\u00eb lojtar pokeri q\u00eb t\u00eb luaj\u00eb me letrat q\u00eb ka n\u00eb dor\u00eb zbuluar para kund\u00ebrshtarit. Hapja e materialeve t\u00eb negociatave do zbulonte ndjeshm\u00ebrit\u00eb dhe rrethanat e tjera delikate t\u00eb Kosov\u00ebs duke e v\u00ebn\u00eb pal\u00ebn ton\u00eb n\u00eb pozicion inferior ndaj Serbis\u00eb por edhe ndaj shteteve t\u00eb tjera.<\/p>\n<p>P\u00ebr ta kuptuar sesa i hersh\u00ebm \u00ebsht\u00eb ky tension midis transparenc\u00ebs q\u00eb p\u00ebrb\u00ebn nj\u00eb shtyll\u00eb t\u00eb demokracis\u00eb dhe nevoj\u00ebs p\u00ebr konfidencialitet n\u00eb negociata, mjafton t\u00eb lexohet mesazhi i Xhorxh Uashingtonit p\u00ebr Kongresin n\u00eb mars t\u00eb vitit 1796, kur ai refuzoi q\u00eb t\u00eb b\u00ebnte publike udh\u00ebzimet dhe dokumentet e p\u00ebrdorura n\u00eb negociatat me mbretin Xhorxh III. \u201cNatyra e negociatave t\u00eb huaja k\u00ebrkon kujdes, dhe suksesi i tyre shpesh duhet t\u00eb varet nga sekreti; madje edhe kur t\u00eb nxirret p\u00ebrfundimi, nj\u00eb zbulim i plot\u00eb i t\u00eb gjitha masave, k\u00ebrkesave apo koncesioneve eventuale q\u00eb mund t\u00eb jen\u00eb propozuar ose parashikuar do t\u00eb ishte gj\u00eb jasht\u00ebzakonisht e pamatur, sepse kjo mund t\u00eb shkaktoj\u00eb nj\u00eb ndikim t\u00eb d\u00ebmsh\u00ebm n\u00eb negociatat e ardhshme ose t\u00eb krijoj\u00eb v\u00ebshtir\u00ebsi t\u00eb menj\u00ebhershme, ndoshta rrezik dhe \u00e7rregullime, n\u00eb lidhje me fuqit\u00eb e tjera\u201d.<\/p>\n<p>Mir\u00ebpo negociatat jan\u00eb t\u00eb nevojshme q\u00eb t\u00eb mbahen t\u00eb fshehura jo vet\u00ebm ndaj vendeve t\u00eb tjera por edhe ndaj opinionit publik t\u00eb vendit t\u00eb vet\u00eb negociatorit. N\u00eb fund t\u00eb fundit negociatat \u00e7ojn\u00eb drejt nj\u00eb kompromisi t\u00eb dyansh\u00ebm q\u00eb k\u00ebrkon q\u00eb t\u00eb dy pal\u00ebt t\u00eb fokusohen n\u00eb interesa e tyre e jo n\u00eb q\u00ebndrimet e deklaruara. Po ashtu kuptohet q\u00eb duhet l\u00ebshuar diku p\u00ebr ta bindur pal\u00ebn tjet\u00ebr q\u00eb t\u00eb ket\u00eb interes tek negociatat dhe rezultati i tyre. Asnj\u00eb negociator nuk do t\u00eb donte q\u00eb t\u00eb merret vesh paraprakisht se \u00e7far\u00eb l\u00ebshimesh apo tolerimesh jan\u00eb t\u00eb gatsh\u00ebm t\u00eb b\u00ebjn\u00eb pa u siguruar q\u00eb kan\u00eb marr\u00eb s\u00eb paku nj\u00eb gj\u00eb ngjashm\u00ebrisht t\u00eb vlefshme n\u00eb k\u00ebmbim. Pra \u00a0negociator\u00ebt q\u00eb ta b\u00ebjn\u00eb pun\u00ebn si\u00e7 duhet t\u00eb jen\u00eb t\u00eb siguruar se ata do t\u00eb vler\u00ebsohen e gjykohen p\u00ebr rezultatin p\u00ebrfundimtar t\u00eb bisedimeve e jo p\u00ebr procesin. N\u00ebse procesi do t\u00eb ishte objektivi kryesor e jo ujdia finale, at\u00ebher\u00eb kuptohet q\u00eb negociator\u00ebt do t\u00eb fokusoheshin m\u00eb shum\u00eb tek procesi sesa tek arritja e nj\u00eb marr\u00ebveshjeje. Mir\u00ebpo t\u00eb gjith\u00eb e dim\u00eb q\u00eb p\u00ebr negociator\u00ebt dhe p\u00ebr mbar\u00eb shoq\u00ebrin\u00eb, interesi kryesor \u00ebsht\u00eb rezultati; pra ujdia e realizuar e jo m\u00ebnyra sesi e arrijn\u00eb.<\/p>\n<p>\u00cbsht\u00eb e kot\u00eb q\u00eb t\u00eb paragjykohet duke u thirrur n\u00eb transparenc\u00eb sepse ne nuk e dim\u00eb se \u00e7far\u00eb ka brenda nj\u00eb marr\u00ebveshje derisa ajo t\u00eb p\u00ebrfundoj\u00eb, dhe \u00a0kjo nevoj\u00eb publike p\u00ebr transparenc\u00eb do t\u00eb shterohet pas arritjes t\u00eb saj sepse do t\u00eb ket\u00eb koh\u00eb t\u00eb mjaftueshme pas p\u00ebrfundimit t\u00eb negociatave p\u00ebr t\u00eb debatuar dhe ratifikuar paket\u00ebn e ujdis\u00eb s\u00eb arritur. Pra me r\u00ebnd\u00ebsi t\u00eb madhe \u00ebsht\u00eb transparenca e plot\u00eb e ujdis\u00eb s\u00eb arritur e jo veprimet e nd\u00ebrmarra p\u00ebr ta arritur at\u00eb. Paragjykimet n\u00eb vetvete jan\u00eb shpesh pengesa t\u00eb m\u00ebdha p\u00ebr t\u00eb arritur marr\u00ebveshje paqeje. N\u00eb munges\u00eb t\u00eb bisedimeve, negociator\u00ebt nuk e din\u00eb a \u00ebsht\u00eb e arritshme apo jo nj\u00eb marr\u00ebveshje nga e cila p\u00ebrfitojn\u00eb t\u00eb dy pal\u00ebt. Po ashtu nuk e din\u00eb se cili propozim p\u00ebr marr\u00ebveshje do t\u00eb marr\u00eb mb\u00ebshtetjen e duhur nga parlamenti \u00a0e cili propozim do t\u00eb bllokohej. Negociatat jan\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb pashmangshme ekuacione me shum\u00eb t\u00eb panjohura dhe n\u00ebse shtetet e ndryshme do t\u00eb prisnin deri sa t\u00eb kishin informacion t\u00eb plot\u00eb mbi t\u00eb gjitha elementet e nj\u00eb konflikti apo mosmarr\u00ebveshje, gjasat jan\u00eb t\u00eb m\u00ebdha q\u00eb nuk do t\u00eb kishte ndonj\u00ebher\u00eb negociata p\u00ebr \u00e7\u00ebshtje komplekse si \u00e7\u00ebshtja jon\u00eb.<\/p>\n<p>Duhet kuptuar se bisedimet sekrete u ndihmojn\u00eb diplomat\u00ebve q\u00eb t\u00eb jen\u00eb t\u00eb lir\u00eb dhe t\u00eb sinqert\u00eb n\u00eb shprehjen e pik\u00ebpamjeve t\u00eb tyre duke mund\u00ebsuar nd\u00ebrtimin e nj\u00eb raporti mir\u00ebbesimi dhe kanali t\u00eb pranuesh\u00ebm komunikimi me pal\u00ebn tjet\u00ebr. Diplomacia e hapur e transparente ting\u00ebllon dinjitoze n\u00eb teori por mund t\u00eb jet\u00eb mashtruese n\u00eb praktik\u00eb.
