Rastet e i ish-arkatarit t\u00eb Pro-Credit Bank, pun\u00ebtor\u00ebve t\u00eb RTK-s\u00eb dhe prokurores Bamieh t\u00eb EULEX-it hyjn\u00eb n\u00eb k\u00ebt\u00eb kategori. K\u00ebto raste, edhe pse t\u00eb ndryshme p\u00ebr nga specifikat, kan\u00eb t\u00eb p\u00ebrbashk\u00ebt nxitjen e debatit p\u00ebr sinjalizuesit dhe trajtimin e tyre.<\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\">Ky shkrim, ka p\u00ebr q\u00ebllim t\u2019i kontribuoj\u00eb k\u00ebtij debati duke shtjelluar t\u00eb drejtat dhe p\u00ebrgjegj\u00ebsit\u00eb e sinjalizuesit dhe m\u00ebnyr\u00ebs se si duhet trajtuar k\u00ebto raste nga gjykatat vendore.<\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\">Tanim\u00eb \u00ebsht\u00eb sqaruar se e drejta e liris\u00eb s\u00eb shprehjes i mund\u00ebson sinjalizuesit t\u00eb zbuloj\u00eb fsheht\u00ebsin\u00eb zyrtare n\u00eb rastet kur rrezikohet apo d\u00ebmtohet interesi publik. Gjykata Evropiane p\u00ebr t\u00eb Drejtat e Njeriut (Gjykata e Strasburgut)<a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-85016#{\" target=\"_blank\" rel=\"noopener\">\u00a0ka vendosur<\/a>\u00a0se \u201cinteresi q\u00eb mund t\u00eb ket\u00eb publiku n\u00eb informat\u00ebn e caktuar ndonj\u00ebher\u00eb mund t\u00eb jet\u00eb aq i r\u00ebnd\u00ebsish\u00ebm saq\u00eb e mbizot\u00ebron edhe obligimin ligjor p\u00ebr ruajtjen e konfidencialitetit.\u201d<\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\">Megjithat\u00eb sinjalizuesi duhet t\u00eb jet\u00eb i v\u00ebmendsh\u00ebm se publikimi i informat\u00ebs konfidenciale nuk mbrohet me automatiz\u00ebm me lirin\u00eb e shprehjes. N\u00eb rastin<a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-85016#{\" target=\"_blank\" rel=\"noopener\">\u00a0Guja kund\u00ebr Molldavis\u00eb Gjykata e Strasburgut<\/a>\u00a0ka qart\u00ebsuar se sinjalizuesi mbrohet me lirin\u00eb e shprehjes vet\u00ebm at\u00ebher\u00eb kur: 1. informat\u00ebn konfidenciale e d\u00ebrgon tek autoritetet p\u00ebrgjegj\u00ebse, 2. ekziston interesi publik p\u00ebr informat\u00ebn e dh\u00ebn\u00eb, 3. informata \u00ebsht\u00eb autentike dhe 4. sinjalizuesi ka q\u00ebllim t\u00eb mir\u00eb[1]. K\u00ebto parime zbatohen n\u00eb \u00e7do rast gjyq\u00ebsor p\u00ebr t\u00eb balancuar lirin\u00eb e shprehjes dhe obligimin e konfidencialitetit.<\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\"><em>Informata duhet t\u00eb d\u00ebrgohet tek autoritetet p\u00ebrgjegj\u00ebse<\/em><\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\">Kur i pun\u00ebsuari v\u00ebren veprime t\u00eb cilat jan\u00eb kund\u00ebr interesit publik, ai fillimisht duhet t\u00eb njoftoj\u00eb mbik\u00ebqyr\u00ebsin n\u00eb pun\u00eb. Sipas Gjykat\u00ebs s\u00eb Strasburgut \u201cvet\u00ebm at\u00ebher\u00eb kur raportimi n\u00eb k\u00ebto autoritete \u00ebsht\u00eb qart\u00ebsisht jo-praktik, informata, si mund\u00ebsi e fundit, ndahet me publikun.\u201d Pra, vet\u00ebm kur ka dyshime t\u00eb bazuara se autoritetet n\u00eb pun\u00eb e m\u00eb pas prokuroria nuk do t\u00eb nd\u00ebrmarrin hapat adekuat, sinjalizuesi, si mund\u00ebsi t\u00eb fundit, e ndan informat\u00ebn konfidenciale me publikun n\u00ebp\u00ebrmjet mediave apo formave t\u00eb tjera adekuate[2].<\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\">Sipas k\u00ebtij parimi, nuk mjafton vet\u00ebm q\u00ebllimi i mir\u00eb i sinjalizuesit por edhe ndjekja e procedur\u00ebs adekuate. Kjo p\u00ebr shkak se sipas Gjykat\u00ebs s\u00eb Strasburgut \u201cp\u00ebr t\u00eb vler\u00ebsuar n\u00ebse kufizimi i liris\u00eb s\u00eb shprehjes \u00ebsht\u00eb proporcional, [ajo do] t\u00eb marr\u00eb parasysh n\u00ebse personi q\u00eb ka shpalosur fsheht\u00ebsin\u00eb zyrtare ka pasur mund\u00ebsi tjet\u00ebr efektive p\u00ebr t\u00eb p\u00ebrmir\u00ebsuar keqb\u00ebrjet q\u00eb ka pasur p\u00ebr q\u00ebllim t\u2019i shpalos\u00eb\u201d.<\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\">Duhet t\u00eb ekzistoj\u00eb interesi publik p\u00ebr informat\u00ebn e dh\u00ebn\u00eb<\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\">N\u00eb nj\u00eb shoq\u00ebri demokratike publiku ka interes legjitim t\u00eb jet\u00eb i informuar lidhur me \u00e7\u00ebshtjet q\u00eb hyjn\u00eb n\u00eb fush\u00ebn e debateve politike. P\u00ebr k\u00ebt\u00eb arsye Gjykata e Strasburgut ka konstatuar se \u00e7\u00ebshtjet e ndarjes s\u00eb pushtetit, keqp\u00ebrdorimet e zyrtar\u00ebve t\u00eb lart\u00eb politik dhe korrupsioni jan\u00eb disa prej fushave n\u00eb t\u00eb cilat mund t\u00eb arsyetohet zbulimi i fsheht\u00ebsis\u00eb zyrtare.<\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\"><em>Informata duhet t\u00eb jet\u00eb autentike<\/em><\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\">Sipas Gjykat\u00ebs s\u00eb Strasburgut, liria e shprehjes ka jo vet\u00ebm t\u00eb drejta por edhe obligime dhe p\u00ebrgjegj\u00ebsi. P\u00ebr k\u00ebt\u00eb arsye sinjalizuesi duhet t\u00eb verifikoj\u00eb n\u00ebse informata e ndar\u00eb me publikun \u00ebsht\u00eb e sakt\u00eb dhe e besueshme. Gjykata konstaton se aktet e motivuara p\u00ebr q\u00ebllime personale nuk e justifikojn\u00eb mbrojtjen e atyre personave me lirin\u00eb e shprehjes. Mbrojtja e liris\u00eb s\u00eb shprehjes arsyeton zbulimin e fsheht\u00ebsis\u00eb zyrtare vet\u00ebm kur sinjalizuesi ka vepruar me q\u00ebllim t\u00eb mir\u00eb, ka pasur me t\u00eb v\u00ebrtet\u00eb p\u00ebr q\u00ebllim t\u00eb mbroj\u00eb interesin publik dhe nuk ka pasur asnj\u00eb mund\u00ebsi tjet\u00ebr m\u00eb diskrecionale t\u00eb raportimit.<\/span><\/p>\n<p><span style=\"font-family: 'courier new', courier;\">Parimet e theksuara m\u00eb lart\u00eb dhe praktika e Gjykat\u00ebs s\u00eb Strasburgut jan\u00eb drejtp\u00ebrdrejt\u00eb t\u00eb zbatueshme n\u00eb Kosov\u00eb.
