Organizimi, kompetenca dhe rregullat e procedur\u00ebs q\u00eb rregullojn\u00eb d\u00ebgjimin dhe zgjidhjen e mosmarr\u00ebveshjeve t\u00eb pun\u00ebs jan\u00eb centralizuar n\u00eb Prishtin\u00eb. Ky rregullim e ka v\u00ebshtir\u00ebsuar tejmase komunikimin nd\u00ebrmjet pun\u00ebtorit dhe sistemit gjyq\u00ebsor p\u00ebrmes t\u00eb cilit pun\u00ebtor\u00ebt presin zgjidhje n\u00eb afate optimale.<\/p>\n<p>Sistem i k\u00ebtill\u00eb mbret\u00ebronte edhe n\u00eb Belgjik\u00eb deri n\u00eb vitin 1970, ku mosmarr\u00ebveshjet juridike-sociale ishin n\u00eb kompetenc\u00eb t\u00eb nj\u00eb s\u00ebr\u00eb gjykatash: gjykata civile, gjykata p\u00ebr mosmarr\u00ebveshje n\u00eb lidhje me kontratat e pun\u00ebs, gjykatat administrative dhe madje edhe gjykatat tregtare. Pas k\u00ebtij viti u kodifikua kjo \u00e7\u00ebshtje, duke pasuar me themelimin e nj\u00eb gjykate t\u00eb ve\u00e7ant\u00eb t\u00eb pun\u00ebs me kompetenc\u00eb p\u00ebr mosmarr\u00ebveshjet juridike-sociale.<\/p>\n<p>Duhet theksuar se Belgjika e ka k\u00ebt\u00eb sistem plot\u00ebsisht t\u00eb pavarur nga sistemi tjet\u00ebr gjyq\u00ebsor. Si\u00e7 edhe shpjegohet n\u00eb raportin me titull \u201cGjykatat e pun\u00ebs n\u00eb Evrop\u00eb \u2013 Punimet e nj\u00eb takimi t\u00eb organizuar nga Instituti Nd\u00ebrkomb\u00ebtar p\u00ebr Studimet e Pun\u00ebs, \u201csistemi belg i gjykatave t\u00eb pun\u00ebs, si\u00e7 ekziston tani, \u00ebsht\u00eb nj\u00eb kompromis midis dy tendencave t\u00eb kund\u00ebrta: autonomi e plot\u00eb jasht\u00eb sistemit gjyq\u00ebsor, nga nj\u00ebra an\u00eb, e integrim i plot\u00eb n\u00eb gjykatat e zakonshme, nga ana tjet\u00ebr\u201d.<\/p>\n<p>Tutje, Gjykata e Pun\u00ebs n\u00eb Irland\u00eb ka luajtur nj\u00eb rol t\u00eb r\u00ebnd\u00ebsish\u00ebm n\u00eb marr\u00ebdh\u00ebniet e pun\u00ebs, duke pasur profil t\u00eb lart\u00eb dhe publikime t\u00eb r\u00ebnd\u00ebsishme t\u00eb cilat thelb\u00ebsisht kan\u00eb ndikuar n\u00eb t\u00eb drejtat e pun\u00ebtor\u00ebve fal\u00eb besimit publik t\u00eb lart\u00eb t\u00eb k\u00ebsaj gjykate. P\u00ebr k\u00ebt\u00eb gjykat\u00eb tashm\u00eb kemi edhe projektligjin e miratuar n\u00eb Qeveri dhe t\u00eb proceduar p\u00ebr Kuvend. Por, nuk kemi gjykat\u00eb t\u00eb pun\u00ebs dhe nuk e dim\u00eb se kur do t\u00eb procedohet dhe n\u00ebse do t\u00eb b\u00ebhet p\u00ebrnj\u00ebmend.<\/p>\n<p>Themelimi i nj\u00eb gjykate t\u00eb pun\u00ebs n\u00eb Kosov\u00eb do t\u00eb ishte dobi e madhe n\u00eb lidhje me aspektin e mbrojtjes s\u00eb t\u00eb drejtave t\u00eb pun\u00ebtor\u00ebve. Por, duke mos themeluar gjykat\u00eb sa p\u00ebr t\u2019u mund\u00ebsuar procedimi i ndonj\u00eb padie ose apelimi. Nj\u00eb gjykat\u00eb e till\u00eb do t\u00eb ishte n\u00eb funksion t\u00eb interpretimit dhe zbatimit t\u00eb norm\u00ebs juridike nga marr\u00ebdh\u00ebnia e pun\u00ebs, si\u00e7 \u00ebsht\u00eb dhe si\u00e7 parashihet me ligj.<\/p>\n<p>Ministria e Drejt\u00ebsis\u00eb, por edhe deputet\u00ebt e Kuvendit, duhen t\u00eb iniciojn\u00eb sa m\u00eb par\u00eb ndryshimin dhe plot\u00ebsimin e Ligjit p\u00ebr Gjykatat, ose edhe t\u00eb sjellin ligj t\u00eb ri p\u00ebr themelimin e Gjykat\u00ebs s\u00eb Ve\u00e7ant\u00eb t\u00eb Pun\u00ebs, e cila do t\u2019i trajtonte l\u00ebnd\u00ebt q\u00eb rrjedhin nga konfliktet n\u00eb marr\u00ebdh\u00ebniet e pun\u00ebs. E n\u00ebse kjo s\u2019do t\u00eb ishte e mundur shum\u00eb shpejt, pse t\u00eb mos themelohej fillimisht nj\u00eb departament i ve\u00e7ant\u00eb pran\u00eb secil\u00ebs gjykat\u00eb themelore n\u00eb shtat\u00eb rajonet e Kosov\u00ebs. Sepse zbatimi dhe avancimi i Ligjit t\u00eb Pun\u00ebs varet edhe nga roli i gjyq\u00ebsorit n\u00eb nj\u00eb vend t\u00eb caktuar.<\/p>\n<p>E drejta e secilit individ, n\u00eb k\u00ebt\u00eb rast e pun\u00ebtorit, duhet t\u00eb realizohet me koh\u00eb.
