Jan\u00eb k\u00ebto parimet baz\u00eb kushtetues t\u00eb cilitdo shtet q\u00eb pretendon demokracin\u00eb. Q\u00eb nga viti 2013 kur ishte ratifikuar Marr\u00ebveshja e par\u00eb p\u00ebr normalizimin e marr\u00ebdh\u00ebnieve mes Kosov\u00ebs e Serbis\u00eb, parafuar at\u00ebbot\u00eb nga kryeministri i Kosov\u00ebs H.Tha\u00e7i dhe kryeministri i Serbis\u00eb I.Da\u00e7iq. Ajo marr\u00ebveshje q\u00eb n\u00eb pik\u00ebn e saj t\u00eb par\u00eb kusht\u00ebzon themelimin e Asociacionit\/Bashk\u00ebsis\u00eb s\u00eb komunave me shumic\u00eb serbe. Kjo pike \u00ebsht\u00eb e r\u00ebnd\u00ebsishme t\u00eb p\u00ebrmendet sepse procesi e ideja e normalizimit t\u00eb marr\u00ebdh\u00ebnieve n\u00eb diskursin publik e politik n\u00eb Kosov\u00eb bart\u00eb konotacion t\u00eb njohjes reciproke. Por jo edhe n\u00eb marr\u00ebveshjen e parafuar e negociuar. Aty obligimi del i qart\u00eb q\u00eb n\u00eb pik\u00ebn e par\u00eb: Do t\u00eb themelohet Asociacioni\/Bashk\u00ebsia e komunave me shumic\u00eb serbe. Tjerat jan\u00eb histori. Por histori e r\u00ebnd\u00ebsishme. Sepse pika kulmuese e dialogut t\u00eb Brukselit (Marr\u00ebveshja e par\u00eb, pas s\u00eb cil\u00ebs nuk ka pasur tjet\u00ebr) normalizon ndarjen sipas vijave etnike dhe etablon pabarazin\u00eb mes komuniteteve n\u00eb Kosov\u00eb. Asnj\u00eb komun\u00eb tjet\u00ebr n\u00eb Kosov\u00eb nuk ka p\u00ebrcaktim etnik p\u00ebrve\u00e7 atyre me shumic\u00eb serbe. N\u00eb asnj\u00eb post publik n\u00eb Kosov\u00eb nuk ka ekskluzivitet etnik p\u00ebrve\u00e7 p\u00ebr komandantin e policis\u00eb n\u00eb veri. E nj\u00ebjta vlen edhe p\u00ebr gjykat\u00ebs e prokuror\u00eb. Marr\u00ebveshja e par\u00eb p\u00ebr normalizim e sanksionon n\u00eb nj\u00eb nivel t\u00eb ri ndarjen sipas vijave etnike, duke sanksionuar nj\u00ebkoh\u00ebsisht ep\u00ebrsi p\u00ebrmes ve\u00e7antis\u00eb t\u00eb komunitetit serb karshi gjith\u00eb t\u00eb tjer\u00ebve. Nj\u00eb ndarje e till\u00eb shkon ndesh me Kushtetut\u00ebn. Prandaj Laj\u00e7ak k\u00ebrkon q\u00eb ajo t\u00eb nd\u00ebrrohet. Por, qe besa, shkon ndesh edhe me parimet baz\u00eb t\u00eb Evrop\u00ebs s\u00eb bashkuar, barazis\u00eb mes popujve, \u00e7etnifikimit t\u00eb politik\u00ebs e t\u00eb institucionit publik, solidaritetit e demokracis\u00eb q\u00eb kjo Evrop\u00eb p\u00ebrfaq\u00ebson. E k\u00ebto kush do t\u2019i ndryshoj\u00eb?<\/p>\n<p>Ka nj\u00eb arsye t\u00eb fuqishme pse Asociacionin e quajm\u00eb ndryshe: Asociacion n\u00eb shqip dhe Zajednica (Bashk\u00ebsia) n\u00eb serbisht. Dhe dallimi nuk \u00ebsht\u00eb gjuh\u00ebsor. \u00cbsht\u00eb juridik dhe politik. P\u00ebr nga kuptimi k\u00ebto dy terme dallojn\u00eb thelb\u00ebsisht. Po e p\u00ebrmendi vet\u00ebm nj\u00eb prej dallimeve: Asociacioni apo shoq\u00ebrorizimi n\u00ebnkupton ruajtjen dhe kultivimin e subjektivitetit. Ne shoq\u00ebrohemi p\u00ebr ta avancuar e p\u00ebrmir\u00ebsuar jet\u00ebn ton\u00eb, t\u00eb krijojm\u00eb hap\u00ebsira t\u00eb reja p\u00ebr subjektin ton\u00eb, e mund\u00ebsi t\u00eb reja zhvillimi p\u00ebr lirin\u00eb e mir\u00ebqenien ton\u00eb. N\u00eb an\u00ebn tjet\u00ebr bashk\u00ebsia kusht\u00ebzon shkrirjen e subjektivitetit n\u00eb nj\u00eb entitet m\u00eb t\u00eb lart\u00eb p\u00ebrbashkues. Intensiteti i bashk\u00ebpunimit n\u00eb Bashk\u00ebsi \u00ebsht\u00eb shum\u00eb m\u00eb i lart\u00eb sesa n\u00eb asociim, madje edhe m\u00eb i lart\u00eb se sa n\u00eb bashkim. Bashk\u00ebsia \u00ebsht\u00eb lidhje natyrore q\u00eb pamund\u00ebson individin, subjektin individual. P\u00ebr sa koh\u00eb q\u00eb asociimi ndodh n\u00eb shoq\u00ebri dhe organizohet p\u00ebrmes parimit t\u00eb qytetaris\u00eb, bashk\u00ebsia ndodh n\u00eb familje dhe organizohet p\u00ebrmes parimit t\u00eb etnis\u00eb, gjakut, p\u00ebrkat\u00ebsis\u00eb. Dhe pik\u00ebrisht kjo ndodh me Bashk\u00ebsin\u00eb e Komunave me Shumic\u00eb Serbe (Zajednica Srpskih Op\u0161tina). K\u00ebshtu ka v\u00ebrejtur Gjykata Kushtetuese n\u00eb aktgjykimin e saj t\u00eb dhjetorit t\u00eb vitit 2015, se \u201cParimet themelore\/Elementet kryesore\u201d t\u00eb Asociacionit\/Bashk\u00ebsis\u00eb mes tjerash themelojn\u00eb nj\u00eb pushtet t\u00eb tret\u00eb n\u00eb Kosov\u00eb q\u00eb vendoset n\u00eb mes t\u00eb atij qendror dhe pushtetit lokal. Pra, q\u00eb p\u00ebrmes Bashk\u00ebsis\u00eb komunat nuk b\u00ebhen bashk\u00eb p\u00ebr t\u2019i avancuar e p\u00ebrmir\u00ebsuar sh\u00ebrbimet publike p\u00ebr t\u00eb cilat jan\u00eb p\u00ebrgjegj\u00ebse, por q\u00eb ato i delegojn\u00eb kompetencat e tyre n\u00eb nj\u00eb organ t\u00eb tret\u00eb, q\u00eb merr ekskluzivitetin e pushtetit ekzekutiv p\u00ebr k\u00ebto komuna.<\/p>\n<p>Prandaj Laj\u00e7ak k\u00ebrkon ndryshimin e Kushtetut\u00ebs. Kjo e fundit, n\u00eb kushtet e normalizimit t\u00eb Asociacionit\/Bashk\u00ebsia del t\u00eb jet\u00eb abnormale. Prandaj duhet normalizuar. Dhe p\u00ebr k\u00ebt\u00eb edhe mund t\u00eb kuptohet Laj\u00e7ak. Pra ai po b\u00ebn pun\u00ebn e vet prej burokrati. Praktikisht po na thot\u00eb se duhet ta zbatojm\u00eb at\u00eb p\u00ebr t\u00eb cil\u00ebn jemi dakorduar. N\u00eb munges\u00eb t\u00eb nj\u00eb ideje t\u00eb qart\u00eb sesi ta vazhdojm\u00eb e p\u00ebrfundojm\u00eb dialogun, Laj\u00e7ak po na e tregon nj\u00ebr\u00ebn prej mund\u00ebsive. Megjithat\u00eb ka di\u00e7ka tejet bezdis\u00ebse n\u00eb k\u00ebt\u00eb qasje: leht\u00ebsia me t\u00eb cil\u00ebn Laj\u00e7ak k\u00ebrkon ndryshimin e Kushtetut\u00ebs. Dhe at\u00eb si k\u00ebrkes\u00eb nga jasht\u00eb, e jo si vullnet nga brenda. Kur e \u00e7\u2018shenjt\u00ebron kushtetut\u00ebn aktuale t\u00eb Kosov\u00ebs, Laj\u00e7ak, me leht\u00ebsin\u00eb e burokratit nga qendra (kur flet p\u00ebr p\u00ebriferin\u00eb), harron q\u00eb rrezikon ta \u00e7\u2018shenjt\u00ebroj\u00eb kushtetutshm\u00ebrin\u00eb n\u00eb p\u00ebrgjith\u00ebsi, dhe \u00e7\u2018shenjt\u00ebrin\u00eb e kushtetut\u00ebs ta paraqes ai parim absolut. N\u00ebse kjo kushtetut\u00eb nuk qenka Bib\u00ebl, at\u00ebher\u00eb asnj\u00eb kushtetut\u00eb, a ligj, a marr\u00ebveshje, nuk \u00ebsht\u00eb Bib\u00ebl. Pra as Marr\u00ebveshja e vitit 2013. As ajo e vitit 2015. Madje as dokumentet baz\u00eb t\u00eb BE-s\u00eb!<\/p>\n<p>Parimi themelor dhe m\u00eb i vlefsh\u00ebm q\u00eb duhet ta ndjekim n\u00eb Kosov\u00eb \u00ebsht\u00eb ai i barazis\u00eb s\u00eb qytetar\u00ebve karshi ligjit, institucionit publik, pasuris\u00eb publike e mir\u00ebqenies. Dhe ky parim baz\u00eb duhet t\u00eb jet\u00eb i shenjt\u00eb. Cilado rrug\u00eb e dialogut q\u00eb shtrohet sipas parimit etnik domosdo do t\u00eb sjell\u00eb te ndarja (e brendshme ose e jashtme qoft\u00eb ajo). Prandaj edhe jemi sot n\u00eb nj\u00eb udh\u00ebkryq q\u00eb duket se nuk ka rrug\u00ebdalje. N\u00eb nj\u00ebr\u00ebn an\u00eb na ofrohet Bashk\u00ebsia e komunave me shumic\u00eb serbe (ndarja e brendshme); ose n\u00ebse k\u00ebt\u00eb nuk e pranojm\u00eb at\u00ebher\u00eb ecim drejt rrug\u00ebs s\u00eb korrigjimit t\u00eb kufirit. Pra q\u00eb t\u00eb ndahen serb\u00ebt e shqiptar\u00ebt nj\u00ebher\u00eb e p\u00ebrgjithmon\u00eb. Edhe p\u00ebr k\u00ebt\u00eb duhet t\u00eb ndryshohet kushtetuta.<\/p>\n<p>Megjithat\u00eb duhet insistuar n\u00eb rrug\u00ebn e tret\u00eb: at\u00eb t\u00eb kthimit t\u00eb problemit te politika, aty ku ka qen\u00eb gjithmon\u00eb. Kosova duhet t\u00eb jet\u00eb Republike e qytetar\u00ebve t\u00eb barabart\u00eb, q\u00eb i akomodon t\u00eb drejtat e secilit pa dallim, dhe q\u00eb krijon hap\u00ebsir\u00eb t\u00eb duhur p\u00ebr komunitetet pakic\u00eb, p\u00ebr zhvillimin e tyre ekonomik, politik e kulturor. N\u00ebse i shkojm\u00eb \u00e7\u00ebshtjes n\u00eb thelb, leht\u00eb mund t\u00eb v\u00ebrejm\u00eb se kemi m\u00eb shum\u00eb gj\u00ebra q\u00eb na bashkojn\u00eb sesa gj\u00ebra q\u00eb na ndajn\u00eb. Ekonomia e brisht\u00eb \u00ebsht\u00eb problem n\u00eb t\u00ebr\u00eb Kosov\u00ebn pavar\u00ebsisht sesi e ke emrin. Sh\u00ebndet\u00ebsia e arsimi jan\u00eb t\u00eb shkat\u00ebrruara gjithandej pavar\u00ebsisht komun\u00ebs. Gjyq\u00ebsori \u00ebsht\u00eb i kapur nga krimi si n\u00eb veri ashtu edhe n\u00eb jug.
