Gjat\u00eb muajve t\u00eb fundit kjo gjykat\u00eb p\u00ebrs\u00ebri \u00ebsht\u00eb subjekt i presionit dhe ushtrimit t\u00eb ndikimit t\u00eb jasht\u00ebm nga akter\u00ebt institucional dhe politik lidhur me shqyrtimin e kushtetutshm\u00ebris\u00eb s\u00eb dekretit t\u00eb Presidentit p\u00ebr caktimin e mandatarit p\u00ebr Kryeminist\u00ebr.<\/p>\n<p>P\u00ebr k\u00ebt\u00eb tem\u00eb, n\u00eb sallonin e s\u00eb mart\u00ebs t\u00eb organizuar nga D4D, kan\u00eb diskutuar panelist\u00eb nga fusha juridike akademike, t\u00eb cil\u00ebt kan\u00eb debatuar aspektet kushtetuese n\u00eb pritje t\u00eb vendimit t\u00eb Gjykat\u00ebs Kushtetuese.<\/p>\n<p>Panelist\u00ebt konsiderojn\u00eb se kjo gjykat\u00eb do ta ket\u00eb t\u00eb v\u00ebshtir\u00eb t\u00eb p\u00ebrmir\u00ebsoj\u00eb precedentin e nd\u00ebrtuar gjat\u00eb vitit 2014, si dhe se Gjykata Kushtetuese gjat\u00eb vendimmarrjes nuk mund t\u00eb krijoj\u00eb norm\u00eb t\u00eb re kushtetuese, pasi asaj i takon ta interpretoj vet\u00ebm Dekretin e Presidentit.<\/p>\n<p>Aktgjykimi i vitit 2014, n\u00eb rastin VLAN,\u00a0sipas tyre,\u00a0paraqet nj\u00eb vendim procedural, i cili nuk favorizon humb\u00ebsit e zgjedhjeve por ruan standardet kushtetuese. Aktgjykimi definon n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb se kush jan\u00eb fituesit dhe humb\u00ebsit e zgjedhjeve dhe me k\u00ebt\u00eb edhe e drejta e fituesit t\u00eb zgjedhjeve p\u00ebr t\u00eb formuar institucionet n\u00eb nivel qendror. Me aktgjykimin e ri, mbetet t\u00eb shihet n\u00ebse Gjykata Kushtetuese do t\u00eb ruaj apo ndryshoj\u00eb k\u00ebt\u00eb praktik\u00eb, dhe\u00a0se\u00a0a do t\u00eb evitohet praktika e deritanishme ku problemeve politike t\u2019u ipet zgjidhje p\u00ebrmes vendimeve t\u00eb Gjykat\u00ebs Kushtetuese.<\/p>\n<p>Kosova n\u00eb Kushtetut\u00eb ka instaluar demokraci koncesionale, si pasoj\u00eb e drejtp\u00ebrdrejt\u00eb e ndikimit t\u00eb fuqish\u00ebm t\u00eb faktorit nd\u00ebrkomb\u00ebtar n\u00eb draftimin e Deklarat\u00ebs s\u00eb Pavar\u00ebsis\u00eb dhe Kushtetut\u00ebs s\u00eb Kosov\u00ebs. Gjithashtu,\u00a0n\u00eb Kosov\u00eb n\u00eb munges\u00eb t\u00eb tradit\u00ebs politike dhe tradit\u00ebs pluraliste \u00ebsht\u00eb nd\u00ebrtuar praktika q\u00eb problemet politike t\u00eb zgjidhen me mekanizma kushtetues. Sipas k\u00ebsaj pik\u00ebpamje,\u00a0panelist\u00ebt vler\u00ebsuan se\u00a0problemi kryesor me t\u00eb cil\u00ebn do t\u00eb p\u00ebrballet Gjykata Kushtetuese lidhur me dekretin e Presidentit nuk do t\u00eb jet\u00eb se \u00e7ka thot\u00eb Kushtetuta ose cila do t\u00eb jet\u00eb zgjidhja kushtetuese, por precedenti i vitit 2014. Ky aktgjykim ka nd\u00ebrtuar disa shkall\u00eb t\u00eb formimit t\u00eb qeveris\u00eb dhe kompetencave t\u00eb Presidentit. N\u00eb an\u00ebn tjet\u00ebr,\u00a0 Gjykata Kushtetuese n\u00eb t\u00eb kaluar\u00ebn shpesh her\u00eb \u00ebsht\u00eb akuzuar se ka tejkaluar kufijt\u00eb e saj me aktgjykime. Kjo kryesisht edhe p\u00ebr shkak se elitat politike n\u00eb Kosov\u00eb jan\u00eb t\u00eb pa emancipuara, dhe se nuk kuptojn\u00eb themelet e demokracis\u00eb dhe vet Kushtetut\u00ebn. P\u00ebr k\u00ebt\u00eb arsye Gjykata Kushtetuese shpesh her\u00eb ka pasur sjellje agresive p\u00ebr shkak t\u00eb polemikave q\u00eb ka ngritur n\u00eb raport me normimin e jet\u00ebs institucionale. K\u00ebt\u00eb qasje t\u00eb Gjykat\u00ebs Kushtetutese politikan\u00ebt e kan\u00eb shfryt\u00ebzuar dhe p\u00ebrdorur p\u00ebr interesat e tyre.<\/p>\n<p>\u00c7\u00ebshtja m\u00eb e diskutueshme n\u00eb publik mes partive politike dhe opinionit publik lidhet me faktin, n\u00ebse pas mocionit t\u00eb suksessh\u00ebm t\u00eb mosbesimit, vendi t\u00eb shkoj\u00eb n\u00eb zgjedhje apo t\u00eb procedohet me formimin e qeveris\u00eb s\u00eb re. Respektivisht n\u00ebse duhet t\u00eb zbatohet neni 82.2 i Kushtetut\u00ebs dhe t\u00eb shp\u00ebrndahet Kuvendi apo neni 95 i Kushtetut\u00ebs, q\u00eb lidhet me\u00a0<strong>ushtrimin e diskrecionit<\/strong>\u00a0t\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr formim t\u00eb qeveris\u00eb pa shkuar n\u00eb zgjedhje. Apo edhe tejkalimin e partis\u00eb fituese p\u00ebr t\u00eb formuar qeverin\u00eb e re nga ana e Presidentit. Sipas nj\u00eb k\u00ebndv\u00ebshtrimi\u00a0t\u00eb panelist\u00ebve, n\u00eb baz\u00eb t\u00eb praktik\u00ebs parlamentare t\u00eb nd\u00ebrtuar me rastet e mocioneve t\u00eb suksesshme te mos besimit n\u00eb vitet 2017 dhe 2019, n\u00eb asnj\u00ebrin rast nuk \u00ebsht\u00eb zbatuar neni 95, por vendi ka shkuar n\u00eb zgjedhje duke zbatuar nenin 82 t\u00eb Kushtetut\u00ebs. Fakt tjet\u00ebr, sipas k\u00ebtij opinion, \u00ebsht\u00eb afati prej 20 dit\u00ebsh p\u00ebr partin\u00eb fituese p\u00ebr t\u00eb d\u00ebrguar mandatarin p\u00ebr Kryeminist\u00ebr, i cili afat nuk \u00ebsht\u00eb i p\u00ebrcaktuar me Kushtetut\u00eb.<\/p>\n<p>Presidenti me rastin e n\u00ebnshkrimit t\u00eb dekretit ka marr kompetenca q\u00eb nuk i takojn\u00eb funksionit t\u00eb tij. Dekreti b\u00ebn interpretim t\u00eb Kushtetut\u00ebs, duke anashkaluar aktgjykimin e Gjykat\u00ebs Kushtetuese t\u00eb vitit 2014. Ky aktgjykim ka nd\u00ebrtuar precedent, sipas s\u00eb cilit, pas mocionit t\u00eb mosbesimit, vendi shkon menj\u00ebher\u00eb n\u00eb zgjedhje. Nj\u00eb qasje e till\u00eb konsiderohet si abuzim me pushtetin nga Presidenti dhe mosp\u00ebrfillje e Gjykat\u00ebs Kushtetuese. Sikurse kishte pajtim q\u00eb Kushtetuta nuk duhet t\u00eb p\u00ebrcaktoj afate ligjore p\u00ebr t\u00eb caktuar koh\u00ebn brenda s\u00eb cil\u00ebs duhet t\u00eb formohet Qeveria. P\u00ebrderisa, Kuvendi duhet t\u00eb ushtroj\u00eb kontroll m\u00eb t\u00eb madh n\u00eb rastet e qeverive n\u00eb detyr\u00eb p\u00ebr t\u00eb p\u00ebrmbushur obligimet ligjore.<\/p>\n<p>Gjykata Kushtetuese duhet t\u00eb luaj rolin e saj kushtetues n\u00eb intepretimin e Kushtetut\u00ebs gjat\u00eb vler\u00ebsimit t\u00eb dekretit t\u00eb l\u00ebshuar nga Presidenti. Gjykata Kushtetuese nuk duhet t\u00eb sh\u00ebrbej si mekaniz\u00ebm kushtetues p\u00ebr zgjidhjen e problemeve politike t\u00eb shkaktuara nga institucionet apo partit\u00eb politike. P\u00ebrderisa, lider\u00ebt dhe partit\u00eb politike duhet t\u00eb njohin dhe trajtojn\u00eb me respekt rolin kushtetues q\u00eb ka Gjykata Kushtetuese n\u00eb interpretimin e Kushtetut\u00ebs dhe n\u00eb sigurimin e funksionalitetit t\u00eb institucioneve t\u00eb vendit n\u00eb pajtim me Kushtetut\u00ebn.<\/p>\n<p>&#8212;-<\/p>\n<p><strong><em>Sallonet e s\u00eb mart\u00ebs jan\u00eb nj\u00eb nism\u00eb javore e Institutit Demokraci p\u00ebr Zhvillim (D4D).
