{"id":5969,"date":"2022-02-09T15:47:39","date_gmt":"2022-02-09T13:47:39","guid":{"rendered":"https:\/\/sbunker.org\/?p=5969"},"modified":"2024-10-15T15:49:55","modified_gmt":"2024-10-15T13:49:55","slug":"presidentja-therret-ne-rezistence","status":"publish","type":"post","link":"https:\/\/sbunker.org\/en\/analize\/presidentja-therret-ne-rezistence\/","title":{"rendered":"Presidentja th\u00ebrret n\u00eb rezistenc\u00eb!"},"content":{"rendered":"<div class=\"news-left\">\n<p><strong>N\u00eb t\u00eb Drejt\u00ebn Nd\u00ebrkomb\u00ebtare, shtetet mbahen p\u00ebrgjegj\u00ebse p\u00ebr shkeljen e detyrimeve t\u00eb tyre.<\/strong><\/p>\n<p><strong>Sipas presidentes s\u00eb Kosov\u00ebs, Vjosa Osmani, \u201cmodeli i Asociacionit, i n\u00ebnshkruar nga kryeministrat e kaluar,\u00a0\u00a0nuk do t\u00eb zbatohet\u201d, duke thirrur k\u00ebshtu n\u00eb rezistenc\u00eb kund\u00ebr zbatimit t\u00eb obligimeve nd\u00ebrkomb\u00ebtare t\u00eb shtetit t\u00eb cilin e drejton&#8230;<\/strong><\/p>\n<p>Presidentja e vendit, Vjosa Osmani, nuk resht s\u00eb kritikuari ish-kryeministrat (Isa Mustafa dhe Hashim Tha\u00e7i, ky i fundit pararend\u00ebs n\u00eb postin presidencial) p\u00ebr \u201cn\u00ebnshkrim t\u00eb marr\u00ebveshjeve t\u00eb d\u00ebmshme\u201d dhe t\u00ebrthorazi stigmatizon edhe Gjykat\u00ebn Kushtetuese p\u00ebr legjitimimin e atyre vendimeve. Duke u shfaqur anash patriotizmit kushtetues dhe m\u00ebnjan\u00eb\u00a0<em>raison d\u2019Etat\u00a0<\/em>dhe duke u shmangur nga roli i mbrojt\u00ebses s\u00eb imazhit dhe prestigjit t\u00eb shtetit, presidentja po b\u00ebn thirrje p\u00ebr moszbatim t\u00eb marr\u00ebveshjeve nd\u00ebrkomb\u00ebtare. P\u00ebr m\u00eb tep\u00ebr, ajo tha se \u201cproblemi i madh \u00ebsht\u00eb se kan\u00eb qen\u00eb p\u00ebrfaq\u00ebsues t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs ata q\u00eb kan\u00eb n\u00ebnshkruar marr\u00ebveshje t\u00eb d\u00ebmshme t\u00eb cilat Asociacionit t\u00eb Komunave Serbe i kan\u00eb dh\u00ebn\u00eb kompetenca ekzekutive. [&#8230;] Si p\u00ebrfaq\u00ebsues t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, ne jemi t\u00eb vendosur q\u00eb t\u00eb mos lejojm\u00eb t\u00eb implementohen n\u00eb vendin ton\u00eb, q\u00eb \u00ebsht\u00eb nd\u00ebrtuar me shum\u00eb sakrific\u00eb, modele t\u00eb cilat do ta b\u00ebnin shtetin ton\u00eb jofunksional\u201d.<\/p>\n<p>Tendenca e presidentes p\u00ebr \u2018penalizimin e ish-kryeministrave, si pretekst p\u00ebr shpalljen\u00a0<em>nul<\/em>\u00a0t\u00eb k\u00ebsaj marr\u00ebveshjeje nd\u00ebrkomb\u00ebtare \u00ebsht\u00eb n\u00eb\u00a0kund\u00ebrshtim t\u00eb hapur me Konvent\u00ebn e Vjen\u00ebs p\u00ebr t\u00eb Drejt\u00ebn e Traktateve 1969, (m\u00eb tutje n\u00eb shkrim si KVDT) q\u00eb n\u00eb Nenin 12\u00a0\u00a0sanksionon p\u00eblqimin p\u00ebr t&#8217;u lidhur me nj\u00eb traktat t\u00eb shprehur me n\u00ebnshkrim: 1. P\u00eblqimi i nj\u00eb shteti p\u00ebr t&#8217;u lidhur me nj\u00eb traktat shprehet me n\u00ebnshkrimin e p\u00ebrfaq\u00ebsuesit t\u00eb tij kur: c) synimi i shtetit p\u00ebr t&#8217;i dh\u00ebn\u00eb k\u00ebt\u00eb efekt n\u00ebnshkrimit del nga kompetencat e plota t\u00eb p\u00ebrfaq\u00ebsuesit t\u00eb tij ose \u00ebsht\u00eb shprehur gjat\u00eb negocimit.<\/p>\n<p>Ashiqare, n\u00eb akuz\u00ebn e saj, s\u00eb pari ka pasakt\u00ebsi dhe kritik\u00eb agresive q\u00eb v\u00eb n\u00eb dyshim karakterin unifikues &#8211; si prerogativ\u00eb kushtetuese &#8211; t\u00eb postit q\u00eb ajo mban<strong>:\u00a0<\/strong>Neni 83 [Statusi i Presidentit]. Kjo paraqitje e saj, s\u00eb dyti, \u00ebsht\u00eb q\u00ebndrim mohues ndaj KVDT, p\u00ebrderisa Kosova me aktin e saj themeltar &#8211; Kushtetut\u00ebn &#8211; merr p\u00ebrsip\u00ebr zotimin p\u00ebr zbatimin e Marr\u00ebveshjeve\/Traktateve Nd\u00ebrkomb\u00ebtare, (Neni 19 [Zbatimi i s\u00eb Drejt\u00ebs Nd\u00ebrkomb\u00ebtare]) t\u00eb cilat b\u00ebhen pjes\u00eb e sistemit t\u00eb brendsh\u00ebm juridik. Presidentja e di se Kuvendi i Kosov\u00ebs ka ratifikuar Marr\u00ebveshjen e Brukselit, t\u00eb prillit 2013 dhe konform Nenit 19 t\u00eb Kushtetut\u00ebs, pika 2, marr\u00ebveshjet nd\u00ebrkomb\u00ebtare t\u00eb ratifikuara dhe normat juridikisht t\u00eb detyrueshme t\u00eb s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare kan\u00eb ep\u00ebrsi ndaj ligjeve t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs.<\/p>\n<p>Kosova me Deklarat\u00ebn e Pavar\u00ebsis\u00eb n\u00eb pik\u00ebn 9 merr obligimet nd\u00ebrkomb\u00ebtare, p\u00ebrfshir\u00eb obligimet e traktateve dhe obligimet e tjera t\u00eb ish-Republik\u00ebs Socialiste Federative t\u00eb Jugosllavis\u00eb si ish-pjes\u00eb konstituive e saj.<\/p>\n<p>Kosova ka negociuar (\u201cshtet negociues\u201d sipas KVDT n\u00ebnkupton nj\u00eb shtet q\u00eb ka marr\u00eb pjes\u00eb n\u00eb hartimin dhe miratimin e tekstit t\u00eb traktatit) dhe lidhur (Neni 6: \u00c7do shtet ka kapacitet p\u00ebr t\u00eb lidhur traktate) n\u00ebnshkruar (Neni 7: Kompetencat e plota: 1. Nj\u00eb person konsiderohet se p\u00ebrfaq\u00ebson nj\u00eb shtet me q\u00ebllim t\u00eb miratimit ose v\u00ebrtetimit t\u00eb tekstit t\u00eb nj\u00eb traktati ose p\u00ebr q\u00ebllimin e shprehjes s\u00eb p\u00eblqimit t\u00eb shtetit p\u00ebr t&#8217;u lidhur nga nj\u00eb traktat n\u00ebse: (a) ai prodhon kompetencat e duhura t\u00eb plota) Marr\u00ebveshjen me Serbin\u00eb n\u00eb Bruksel p\u00ebr themelimin e Asociacionit.<\/p>\n<p>S\u00eb k\u00ebndejmi, sipas Konvent\u00ebs s\u00eb Vjen\u00ebs mbi t\u00eb Drejt\u00ebn e Traktateve (m\u00eb posht\u00eb KVDT)\u00a0\u201ctraktat&#8221; do t\u00eb thot\u00eb nj\u00eb marr\u00ebveshje nd\u00ebrkomb\u00ebtare e lidhur nd\u00ebrmjet shteteve n\u00eb form\u00eb t\u00eb shkruar dhe e rregulluar nga e drejta nd\u00ebrkomb\u00ebtare, qoft\u00eb e mish\u00ebruar n\u00eb nj\u00eb instrument t\u00eb vet\u00ebm ose n\u00eb dy ose m\u00eb shum\u00eb instrumente t\u00eb lidhura dhe pavar\u00ebsisht nga p\u00ebrcaktimi i saj i ve\u00e7ant\u00eb.<\/p>\n<p>T\u00eb drejtat q\u00eb u akordohen shteteve sipas ligjit nd\u00ebrkomb\u00ebtar n\u00ebnkuptojn\u00eb p\u00ebrgjegj\u00ebsi. (Shih:\u00a0\u00a0<a href=\"https:\/\/www.britannica.com\/topic\/international-law\/The-responsibility-of-states\" target=\"_blank\" rel=\"noopener\"><em>https:\/\/www.britannica.com\/topic\/international-law\/The-responsibility-of-states\u00a0<\/em><\/a><em>)<\/em><\/p>\n<p>Shtetet jan\u00eb p\u00ebrgjegj\u00ebse p\u00ebr shkeljet e detyrimeve t\u00eb tyre, me kusht q\u00eb shkelja t&#8217;i atribuohet vet\u00eb shtetit. Nj\u00eb shtet \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr shkeljet e drejtp\u00ebrdrejta t\u00eb s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare &#8211; p.sh. shkeljen e nj\u00eb traktati dhe e till\u00eb \u00ebsht\u00eb marr\u00ebveshja e par\u00eb nd\u00ebrmjet Kosov\u00ebs dhe Serbis\u00eb, p\u00ebr normalizimin e marr\u00ebdh\u00ebnieve, pra Asociacioni i Komunave me Shumic\u00eb Serbe q\u00eb \u00ebsht\u00eb ratifikuar n\u00eb Kuvendin e Kosov\u00ebs dhe q\u00eb nuk p\u00ebrmend askund mbivendosjen e nj\u00eb pushteti t\u00eb tret\u00eb me kompetenca ekzekutive. Prandaj, secila qeveri pasuese \u00ebsht\u00eb e obliguar q\u00eb t\u00eb zbatoj\u00eb t\u00eb gjitha marr\u00ebveshjet nd\u00ebrkomb\u00ebtare. KVDT n\u00eb Nenin 39 konkludon se nj\u00eb traktat mund t\u00eb ndryshohet vet\u00ebm me marr\u00ebveshje nd\u00ebrmjet pal\u00ebve. Kurse Neni 60 i KVDT thot\u00eb se shkelja e marr\u00ebveshjes nd\u00ebrkomb\u00ebtare nga nj\u00ebra pal\u00eb i jep t\u00eb drejt\u00eb pal\u00ebs tjet\u00ebr.<\/p>\n<p>Pse presidentja e ka gabim?<\/p>\n<p>E para, Asociacioni nuk ishte vullnet as arbitraritet i kryeministrave (t\u00eb kaluar) kosovar\u00eb, porse zotim nga Pako Ahtisaari qe e ka \u00e7uar vendin n\u00eb pavar\u00ebsi komb\u00ebtare (17 shkurt 2008) dhe e ka derivuar Kushtetut\u00ebn e Kosov\u00ebs; pra, Asociacioni buron nga\u00a0<strong>Aneksi III<\/strong>\u00a0<strong>Decentralizimi<\/strong>: 9.1.2, q\u00eb sistemon nj\u00eb partneritet t\u00eb komunave ne shumic\u00eb serbe, bazuar n\u00eb parimet e Kart\u00ebs Evropiane p\u00ebr Vet\u00ebqeverisje Lokale, (9.2).<\/p>\n<p>E dyta, n\u00eb Parimet e P\u00ebrgjithshme t\u00eb dakorduara n\u00eb Bruksel (2015) ka qen\u00eb shqet\u00ebsues togfjal\u00ebshi \u2018kuvend kushtetutdh\u00ebn\u00ebs\u2019 n\u00eb versionin anglisht (si gjuh\u00eb e marr\u00ebveshjes), porse dokumenti i Parimeve e p\u00ebrmban klauzol\u00ebn se Statuti i AKShS do t\u2019i n\u00ebnshtrohet \u2018shqyrtimit\u2019 t\u00eb gjykatave kushtetuese t\u00eb Kosov\u00ebs dhe Serbis\u00eb, e k\u00ebt\u00eb e ka pranuar edhe presidenti serb Aleksandar Vu\u00e7iq (duke u pajtuar k\u00ebshtu me aspektin e m\u00ebvet\u00ebsish\u00ebm t\u00eb gjyq\u00ebsis\u00eb\u00a0\u00a0kushtetuese t\u00eb Kosov\u00ebs).<\/p>\n<p>E treta, Gjykata Kushtetuese e Kosov\u00ebs me aktgjykimin\u00a0 Rasti Nr. KO130\/15, ka konstatuar se Parimet e p\u00ebrgjithshme t\u00eb Asociacionit nuk jan\u00eb t\u00ebr\u00ebsisht n\u00eb p\u00ebrputhshm\u00ebri me frym\u00ebn e Kushtetut\u00ebs, p\u00ebrkat\u00ebsisht me Nenin 3, i cili ka t\u00eb b\u00ebj\u00eb me barazin\u00eb para ligjit, me Kapitullin II q\u00eb ka t\u00eb b\u00ebj\u00eb me t\u00eb drejtat dhe lirit\u00eb themelore, si dhe me Kapitullin III p\u00ebr t\u00eb drejtat e komuniteteve dhe pjes\u00ebtar\u00ebve t\u00eb tyre, porse Gjykata konkludon se nuk \u00ebsht\u00eb brenda juridiksionit t\u00eb saj\u00a0<em>Ratione Materiae<\/em>\u00a0t\u00eb vler\u00ebsoj\u00eb kushtetutshm\u00ebnin\u00eb e Marr\u00ebveshjes s\u00eb Par\u00eb Nd\u00ebrkomb\u00ebtare, por ka sakt\u00ebsuar decidivisht se Asociacioni i Komunave me Shumic\u00eb Serbe duhet t\u00eb themelohet sipas Marr\u00ebveshjes s\u00eb Par\u00eb, e ratifikuar n\u00eb Kuvendin e Kosov\u00ebs m\u00eb 27 qershor 2013, me 84 vota p\u00ebr, 3 kund\u00ebr dhe nj\u00eb abstenim.\u00a0KVDT n\u00eb Neni 11 thot\u00eb: p\u00eblqimi i nj\u00eb shteti p\u00ebr t&#8217;u lidhur nga nj\u00eb traktat mund t\u00eb shprehet me n\u00ebnshkrim, shk\u00ebmbim t\u00eb instrumenteve q\u00eb p\u00ebrb\u00ebjn\u00eb nj\u00eb traktat, ratifikimi, pranimi, miratimi ose aderimi, ose me \u00e7do mjet tjet\u00ebr n\u00ebse \u00ebsht\u00eb r\u00ebn\u00eb dakord. Dhe n\u00eb Nenin 14 sakt\u00ebsohen instrumentet e traktatit.<\/p>\n<p>P\u00eblqimi p\u00ebr ta lidhur nj\u00eb traktat shprehet me ratifikim, pranim ose miratim.<\/p>\n<p>S\u00eb k\u00ebndejmi, presidentja po th\u00ebrret n\u00eb rezistenc\u00eb kund\u00ebr zbatimit t\u00eb marr\u00ebveshjeve t\u00eb arritura e t\u00eb validuara nga\u00a0\u00a0qeverit\u00eb paraprake, Kuvendi apo Gjykata Kushtetuese, precendet ky i rreziksh\u00ebm dhe shkat\u00ebrrues p\u00ebr vendin. Minimalja e normativ\u00ebs p\u00ebr q\u00ebndrueshm\u00ebrin\u00eb e demokracis\u00eb \u00ebsht\u00eb \u201cvet\u00ebp\u00ebrmbajtja institucionale\u201d e presidentes, e kjo d.m.th. vet\u00ebkufizim n\u00eb detyr\u00eb. Nj\u00eb shtet \u00ebsht\u00eb gjithashtu p\u00ebrgjegj\u00ebs nd\u00ebrkomb\u00ebtarisht p\u00ebr shkeljet e kryera nga institucionet e tij t\u00eb brendshme, megjithat\u00eb ato p\u00ebrcaktohen nga legjislacioni i tij i brendsh\u00ebm, nga subjektet dhe personat q\u00eb ushtrojn\u00eb autoritet shtet\u00ebror, si dhe nga persona q\u00eb veprojn\u00eb n\u00ebn drejtimin ose kontrollin e shtetit.\u00a0Prandaj, n\u00eb k\u00ebt\u00eb \u2018mbajtje p\u00ebrgjegj\u00ebse\u2019 bie edhe moszbatimi (eventual) i vendimit t\u00eb Gjykat\u00ebs Kushtetuese p\u00ebr themelimin e AKShS.<\/p>\n<p>Shtetet q\u00eb nuk respektojn\u00eb detyrimet nd\u00ebrkomb\u00ebtare minojn\u00eb sundimin e ligjit, konkludojn\u00eb s\u00eb fundi delegat\u00ebt e Komitetit t\u00eb Gjasht\u00eb t\u00eb Asambles\u00eb s\u00eb P\u00ebrgjithshme t\u00eb Kombeve t\u00eb Bashkuara. Ky komitet \u00ebsht\u00eb nj\u00eb nga gjasht\u00eb komitetet kryesore t\u00eb Asambles\u00eb. Ai merret kryesisht me \u00e7\u00ebshtje juridike dhe \u00ebsht\u00eb forumi kryesor p\u00ebr shqyrtimin e s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare dhe \u00e7\u00ebshtjeve t\u00eb tjera ligjore n\u00eb lidhje me Kombet e Bashkuara. Ata b\u00ebjn\u00eb thirrje q\u00eb\u00a0t\u00eb mbizot\u00ebroj\u00eb diplomacia, tradita e konsensusit q\u00eb mb\u00ebshtet zbatimin e parimit t\u00eb sundimit t\u00eb ligjit n\u00eb nivel nd\u00ebrkomb\u00ebtar, ve\u00e7an\u00ebrisht n\u00eb fush\u00ebn e zgjidhjes s\u00eb konflikteve, q\u00eb po minohet nga shtetet q\u00eb nuk respektojn\u00eb detyrimet e tyre nd\u00ebrkomb\u00ebtare, s\u00eb bashku me zbatimin dhe shfryt\u00ebzimin selektiv t\u00eb kornizave dhe mekanizmave ekzistues. Neni 26 i KVDT thot\u00eb: \u201c\u00c7do traktat n\u00eb fuqi \u00ebsht\u00eb i detyruesh\u00ebm p\u00ebr pal\u00ebt n\u00eb t\u00eb dhe duhet t\u00eb zbatohet prej tyre n\u00eb mir\u00ebbesim\u201d. Kurse Neni 27 sakt\u00ebson se nj\u00eb pal\u00eb nuk mund t\u00eb p\u00ebrdor\u00eb dispozitat e ligjit t\u00eb saj t\u00eb brendsh\u00ebm si justifikim p\u00ebr d\u00ebshtimin e saj p\u00ebr t\u00eb p\u00ebrmbushur nj\u00eb traktat.<\/p>\n<p>Natyrisht se ky obligim nd\u00ebrkomb\u00ebtar i Kosov\u00ebs \u00ebsht\u00eb riaktualizuar s\u00eb fundi edhe nga Ambasadori amerikan n\u00eb Prishtin\u00eb, Jeffrey Hovenier, por edhe nga i d\u00ebrguari amerikan p\u00ebr Ballkanin Per\u00ebndimor, Gabriel Escobar. Ata jan\u00eb shprehur (shkurt, 2022) p\u00ebr Asociacionin &#8211; p\u00ebr k\u00ebt\u00eb \u201celefant n\u00eb dhom\u00eb\u201d &#8211; se \u201cn\u00eb koh\u00ebn e Ahtisaarit, askush nuk kishte n\u00eb mendje di\u00e7ka q\u00eb do t\u00eb kishte nj\u00eb shtres\u00eb tjet\u00ebr t\u00eb qeveris\u00eb\u201d dhe si\u00a0<em>modus<\/em>\u00a0i p\u00ebrbashk\u00ebt i tyre &#8211; lajm i mir\u00eb p\u00ebr Kosov\u00ebn &#8211; del t\u00eb jet\u00eb se \u201caskush nuk \u00ebsht\u00eb i interesuar p\u00ebr nj\u00eb tjet\u00ebr Republika S\u00ebrpska\u201d.<\/p>\n<p>Af\u00ebrmendsh, Qeveria e Kosov\u00ebs duhet ta akomodoj\u00eb k\u00ebt\u00eb k\u00ebrkes\u00eb nd\u00ebrkomb\u00ebtare n\u00eb korniz\u00ebn e saj kushtetuese duke:\u00a0<strong>a)<\/strong>\u00a0rimodeluar Parimet e P\u00ebrgjithshme dhe Statutin e AKShS p\u00ebrmes rinegociimit nd\u00ebrmjet pal\u00ebve me sh\u00ebrbime t\u00eb mira (propozime) t\u00eb pal\u00ebs s\u00eb tret\u00eb, ShBA dhe BE;<\/p>\n<p><strong>b)<\/strong>\u00a0me mund\u00ebsin\u00eb q\u00eb kjo t\u00eb inkorporohet n\u00eb marr\u00ebveshjen finale, ligj\u00ebrisht obligative, nd\u00ebrmjet Kosov\u00ebs dhe Serbis\u00eb q\u00eb presupozon njohjen e Kosov\u00ebs nga shteti serb, si aneks; ose\u00a0<strong>c)<\/strong>\u00a0duke marr\u00eb zotimin n\u00eb fusnot\u00eb se Kosova me n\u00ebnshkrimin e k\u00ebsaj marr\u00ebveshjeje merr p\u00ebrsip\u00ebr edhe themelimin e nj\u00eb modeli t\u00eb asociacionit q\u00eb ruan karakterin unitar t\u00eb shtetit, nj\u00eb bashk\u00ebsi q\u00eb ushtron t\u00eb drejta t\u00eb deleguara shtes\u00eb por q\u00eb nuk prodhon nj\u00eb kuvend kushtetutdh\u00ebn\u00ebs.<\/p>\n<p>Asociacioni sipas Marr\u00ebveshjes s\u00eb Par\u00eb (2013) \u00ebsht\u00eb detyrim nd\u00ebrkomb\u00ebtar i shtetit si zgjidhje kushtetuese dhe \u00e7do ide p\u00ebr zgjidhje kreative (jokushtetuese) \u00ebsht\u00eb fatale p\u00ebr Republik\u00ebn e Kosov\u00ebs.<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>N\u00eb t\u00eb Drejt\u00ebn Nd\u00ebrkomb\u00ebtare, shtetet mbahen p\u00ebrgjegj\u00ebse p\u00ebr shkeljen e detyrimeve t\u00eb tyre.
