Kjo mund t\u00eb tejkalohej vet\u00ebm nga dekretet e m\u00ebparshme dhe Ligji NR. 07\/L-006 i dat\u00ebs 25 gusht 2020 p\u00ebr parandalimin dhe luftimin e pandemis\u00eb, t\u00eb cilat arrogojn\u00eb n\u00eb vetvete fuqin\u00eb p\u00ebr t\u00eb kufizuar lirin\u00eb e l\u00ebvizjes dhe lirin\u00eb e mbledhjes. Gjat\u00eb k\u00ebsaj krize sh\u00ebndet\u00ebsore, shteti ka pohuar dhe forcuar pushtetin e tij mbi shoq\u00ebrin\u00eb: \u00ebsht\u00eb treguar i gatsh\u00ebm t\u00eb p\u00ebrdor\u00eb monopolin e tij t\u00eb dhun\u00ebs legjitime p\u00ebr t\u2019i zbatuar udh\u00ebzimet e sh\u00ebndetit publik t\u00eb nxjerra n\u00eb bashk\u00ebpunim me ekspert\u00eb dhe shkenc\u00ebtar\u00eb. P\u00ebrderisa p\u00ebrgjigja e shtetit t\u00eb Kosov\u00ebs ndaj kriz\u00ebs COVID-19 ka qen\u00eb, p\u00ebr t\u00eb gjith\u00eb t\u00eb interesuarit p\u00ebr p\u00ebrgjigjet globale ndaj pandemis\u00eb, nd\u00ebr m\u00eb kufizueset p\u00ebr sa u p\u00ebrket lirive publike, situata sh\u00ebndet\u00ebsore e ka v\u00ebshtir\u00eb ta arsyetoj\u00eb nj\u00eb disproporcion t\u00eb till\u00eb n\u00eb shkeljet e t\u00eb drejtave themelore.<\/p>\n<p>Masat u materializuan me vendosjen e perimetrit dhe orareve t\u00eb daljes, ndalimin e kontakteve jasht\u00ebfamiljare dhe zbatimin e k\u00ebtyre masave nga nj\u00eb forc\u00eb e madhe policie, e cila kreu mij\u00ebra kontrolle e verbalizime. Prandaj, kjo kriz\u00eb sh\u00ebndet\u00ebsore dhe vendimet e marra q\u00eb at\u00ebher\u00eb k\u00ebrkojn\u00eb mbi t\u00eb gjitha rigjenerimin e nj\u00eb kontrolli demokratik t\u00eb emergjenc\u00ebs.<\/p>\n<p>Kufizimet jan\u00eb b\u00ebr\u00eb mbi baz\u00ebn ligjore t\u00eb urgjenc\u00ebs sh\u00ebndet\u00ebsore, q\u00eb synon mbrojtjen e t\u00eb drejtave\u00a0 njer\u00ebzore t\u00eb qytetar\u00ebve, nd\u00ebr t\u00eb cilat \u201ce drejta p\u00ebr sh\u00ebndet\u201d ose \u201ce drejta p\u00ebr jet\u00eb\u201d. N\u00eb k\u00ebt\u00eb kriz\u00eb, si kurr\u00eb m\u00eb par\u00eb, vazhdon t\u00eb prishet ekuilibri mes k\u00ebtyre t\u00eb drejtave t\u00eb njeriut dhe k\u00ebrkes\u00ebs p\u00ebr t\u2019i ruajtur lirit\u00eb publike t\u00eb qytetar\u00ebve, duke p\u00ebrfshir\u00eb lirin\u00eb e l\u00ebvizjes dhe lirin\u00eb e mbledhjes.<\/p>\n<p>N\u00eb munges\u00eb t\u00eb zhvillimit t\u00eb nj\u00eb politike efektive sh\u00ebndet\u00ebsore dhe nj\u00eb spitali publik t\u00eb rigjall\u00ebruar, shteti i Kosov\u00ebs po ua v\u00eb pesh\u00ebn e plot\u00eb t\u00eb kriz\u00ebs lirive publike t\u00eb qytetar\u00ebve. Megjithat\u00eb, kjo prishje e ekuilibrit, shpesh n\u00eb margjinat e kontrollit demokratik, \u00ebsht\u00eb nj\u00eb prirje kryesore n\u00eb politikat publike n\u00eb bot\u00ebn per\u00ebndimore. Duke mos pasur d\u00ebshir\u00eb t\u2019i fuqizoj\u00eb qytetar\u00ebt kosovar\u00eb, Qeveria konsideroi se rekomandimet e prera por t\u00eb miratuara lirisht nuk do t\u00eb ishin t\u00eb mjaftueshme. Kosova ka zgjedhur t\u00eb jet\u00eb strategjikisht ndjek\u00ebse, duke prishur me vendosm\u00ebri ekuilibrin nd\u00ebrmjet s\u00eb drejt\u00ebs p\u00ebr sh\u00ebndet dhe lirive publike.<\/p>\n<p>Zgjedhja kosovare \u00ebsht\u00eb qart\u00eb edhe rezultat i munges\u00ebs s\u00eb burimeve, gj\u00eb q\u00eb p\u00ebrjashton nj\u00eb strategji t\u00eb bazuar n\u00eb menaxhimin efektiv nga spitali publik i personave me COVID-19.<\/p>\n<p>N\u00eb aspektin e organizimit shoq\u00ebror, zgjidhjet e ngurta q\u00eb mb\u00ebshteten pak n\u00eb kontributin individual t\u00eb qytetar\u00ebve t\u00eb perceptuar si marr\u00ebs t\u00eb pap\u00ebrgjegjsh\u00ebm dhe pasiv\u00eb t\u00eb politikave publike, t\u00eb cil\u00ebt duhet t\u00eb kontrollohen dhe disiplinohen, minojn\u00eb strategji m\u00eb fleksibile. K\u00ebshtu, shteti rezulton i paaft\u00eb p\u00ebr t\u00eb punuar n\u00eb marr\u00ebdh\u00ebnie t\u00eb mira me qytetar\u00ebt, gj\u00eb q\u00eb e pengon at\u00eb t\u00eb zbatoj\u00eb politika efektive parandaluese dhe t\u00eb v\u00ebr\u00eb n\u00eb dyshim dogmat e vendosura.<\/p>\n<p>\u00c7do zgjidhje q\u00eb pretendon ta eliminoj\u00eb rrezikun duke z\u00ebvend\u00ebsuar mir\u00ebsjelljen e qytetar\u00ebve dhe besimin q\u00eb ata kan\u00eb ndaj nj\u00ebri-tjetrit do t\u00eb ket\u00eb p\u00ebr efekt, n\u00eb terma afatgjat\u00eb, dob\u00ebsimin e republik\u00ebs.<\/p>\n<p>N\u00eb k\u00ebt\u00eb kuptim, Kosova do t\u00eb p\u00ebrfitonte nga frym\u00ebzimi i shteteve t\u00eb tjera, ve\u00e7an\u00ebrisht nga Suedia, n\u00eb lidhje me praktikat e saj demokratike dhe prirjen e saj p\u00ebr t\u00eb favorizuar mendjen qytetare dhe p\u00ebrgjegj\u00ebsin\u00eb individuale, krahasuar me k\u00ebrc\u00ebnimin dhe sanksionin, t\u00eb cilat nuk jan\u00eb mjete t\u00eb efektshme m\u00ebsimore. T\u00eb m\u00ebsosh s\u00eb bashku p\u00ebr t&#8217;iu p\u00ebrgjigjur m\u00eb mir\u00eb pandemive duke ruajtur lirit\u00eb publike do t\u00eb thot\u00eb t\u00eb promovosh nisma demokratike, ve\u00e7an\u00ebrisht n\u00eb fush\u00ebn e sh\u00ebndet\u00ebsis\u00eb, p\u00ebr ta rritur angazhimin e qytetar\u00ebve dhe t\u00eb kuptuarit e politikave publike.<\/p>\n<p>N\u00eb fakt, ekuilibri nd\u00ebrmjet t\u00eb drejtave t\u00eb njeriut dhe lirive publike bazohet n\u00eb kontrollin demokratik t\u00eb emergjencave. P\u00ebr sa u p\u00ebrket heqjes s\u00eb lirive, boshti i par\u00eb i kontrollit bazohet n\u00eb transparenc\u00ebn e pashmangshme t\u00eb vendimmarrjes publike. Nd\u00ebrhyrjet e p\u00ebrs\u00ebritura publike t\u00eb an\u00ebtar\u00ebve t\u00eb Qeveris\u00eb ose an\u00ebtar\u00ebve t\u00eb ekipeve shkencore nuk jan\u00eb t\u00eb mjaftueshme p\u00ebr aq sa nuk lejojn\u00eb as publicitet real t\u00eb vendimit, as ballafaqim t\u00eb ideve dhe strategjive, ve\u00e7an\u00ebrisht p\u00ebr sa u p\u00ebrket pasojave t\u00eb tyre p\u00ebr lirit\u00eb publike. Po b\u00ebhet e nevojshme q\u00eb t\u00eb parashtrohen mekanizma q\u00eb leht\u00ebsojn\u00eb debatet me qytetar\u00ebt, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb mund\u00ebsohet zot\u00ebrimi m\u00eb i mir\u00eb i masave t\u00eb sh\u00ebndetit publik nga popullsia. \u00cbsht\u00eb nj\u00eb garanci m\u00eb e mir\u00eb ndaj vendimeve arbitrare t\u00eb marra n\u00eb qarqe t\u00eb mbyllura dhe uniforme q\u00eb kan\u00eb vet\u00ebm nj\u00eb k\u00ebndv\u00ebshtrim mjek\u00ebsor.<\/p>\n<p>Nj\u00eb parim tjet\u00ebr themelor bazohet n\u00eb p\u00ebrgjegjshm\u00ebrin\u00eb e nevojshme t\u00eb pushtetar\u00ebve ndaj popullit. Q\u00eb nga Athina e shekullit V, parimi i dh\u00ebnies s\u00eb llogarive k\u00ebrkon q\u00eb ata t\u00eb cil\u00ebve u \u00ebsht\u00eb besuar autoriteti publik t\u00eb vijn\u00eb p\u00ebr t\u2019i shpjeguar vendimet e tyre dhe t\u00eb b\u00ebjn\u00eb t\u00eb mundur, n\u00ebp\u00ebrmjet diskutimeve publike dhe jopartiake, marrjen e shpjegimeve mbi masat e zgjedhura dhe p\u00ebr ta informuar shoq\u00ebrin\u00eb p\u00ebr politikat publike.<\/p>\n<p>Megjithat\u00eb, nj\u00eb nga mjetet m\u00eb t\u00eb menj\u00ebhershme p\u00ebr ta mposhtur gjendjen e p\u00ebrjashtimit \u00ebsht\u00eb t\u00eb kusht\u00ebzohet shfaqja e saj me nj\u00eb konsensus t\u00eb gjer\u00eb politik. \u00cbsht\u00eb jonormale q\u00eb kufizime t\u00eb tilla mund t\u00eb merren n\u00eb K\u00ebshillin e Ministrave dhe t\u00eb ruhen n\u00eb koh\u00ebzgjatje dhe shtrirje pa kontroll efektiv nga parlamenti. P\u00ebrqendrimi n\u00eb bashk\u00ebpunimin midis lojtar\u00ebve t\u00eb ndrysh\u00ebm n\u00eb sistem mund t\u00eb jet\u00eb nj\u00eb m\u00ebnyr\u00eb efektive p\u00ebr t\u2019i frenuar tepricat e vendimeve t\u00eb urgjenc\u00ebs sh\u00ebndet\u00ebsore.<\/p>\n<p>\u00cbsht\u00eb m\u00eb e v\u00ebshtir\u00eb se kurr\u00eb, n\u00eb nj\u00eb kontekst shqet\u00ebsimesh t\u00eb p\u00ebrgjith\u00ebsuara dhe legjitime, t\u00eb jesh mbrojt\u00ebs i lirive reale dhe t\u00eb fuqishme publike. N\u00eb t\u00eb v\u00ebrtet\u00eb, nj\u00eb mbrojtje e till\u00eb p\u00ebrfshin t\u00eb shkosh kund\u00ebr instinktit natyror t\u00eb nj\u00eb humanizmi t\u00eb dashamir\u00ebsis\u00eb dhe sh\u00ebndetit, drejt nj\u00eb humanizmi politik, gati tragjik, t\u00eb qytetarit, t\u00eb pajisur me liri t\u00eb patjet\u00ebrsueshme, vlera e s\u00eb cil\u00ebs \u00ebsht\u00eb padyshim superiore p\u00ebr vet\u00eb jet\u00ebn. Megjithat\u00eb, heqja dor\u00eb nga nj\u00eb pjes\u00eb e madhe e lirive t\u00eb dikujt p\u00ebr p\u00ebrfitimin e sh\u00ebndetit ose siguris\u00eb n\u00eb vetvete nuk e \u00e7on p\u00ebrpara ardhjen e nj\u00eb shoq\u00ebrie t\u00eb bazuar n\u00eb t\u00eb mir\u00ebn e p\u00ebrbashk\u00ebt. Nuk \u00ebsht\u00eb e nevojshme t\u00eb kryhen p\u00ebrllogaritje shkencore t\u00eb viteve t\u00eb jet\u00ebs s\u00eb ruajtur p\u00ebr t\u00eb ditur se jeta n\u00eb gjendje t\u00eb jasht\u00ebzakonshme nuk \u00ebsht\u00eb nj\u00eb jet\u00eb reale, pavar\u00ebsisht nga mekanizmat e kompensimit t\u00eb vendosur nga mendja p\u00ebr ta racionalizuar t\u00eb papranueshmen.<\/p>\n<p>Prandaj, pandemia COVID-19 duket se po imponohet \u2013 n\u00eb m\u00ebnyr\u00eb kund\u00ebrintuitive \u2013 mbi t\u00eb gjitha si nj\u00eb mund\u00ebsi e humbur p\u00ebr sa i p\u00ebrket t\u00eb m\u00ebsuarit kolektiv, p\u00ebrgjegj\u00ebsis\u00eb individuale dhe zhvillimit t\u00eb besimit n\u00eb institucione. Me pap\u00ebrgatitjen e saj n\u00eb planin material, Qeveria b\u00ebri q\u00eb t\u00eb gjith\u00eb pesh\u00ebn e kriz\u00ebs ta peshoj\u00eb mbi lirit\u00eb publike t\u00eb kosovar\u00ebve p\u00ebrmes kufizimeve t\u00eb ngurta. Qytetar\u00ebt do t\u00eb kishin gjithashtu t\u00eb drejt\u00eb t\u00eb k\u00ebrkonin sanksione kund\u00ebr atyre q\u00eb kan\u00eb d\u00ebshtuar n\u00eb mbrojtjen e k\u00ebtyre lirive publike p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb p\u00ebrgatitjes dhe parashikimit. Sulmet ndaj lirive t\u00eb shkaktuara nga vendimet e fundit na ftojn\u00eb t\u2019i rimendojm\u00eb p\u00ebrgjigjet tona ndaj pandemis\u00eb. Ato inkurajojn\u00eb gjithashtu reflektimin kolektiv mbi pajtimin e nevojsh\u00ebm t\u00eb mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut me nj\u00eb mbrojtje t\u00eb fuqishme t\u00eb lirive publike dhe kontroll real demokratik t\u00eb masave emergjente, qofshin ato sh\u00ebndet\u00ebsore apo t\u00eb tjera.<\/p>\n<p>Kur i pak\u00ebsojm\u00eb lirit\u00eb p\u00ebr t\u00eb pasur m\u00eb shum\u00eb siguri, sigurisht q\u00eb do t\u00eb kemi m\u00eb pak liri, por kurr\u00eb nuk jemi t\u00eb sigurt se do t\u00eb kemi m\u00eb shum\u00eb siguri. P\u00ebrball\u00eb p\u00ebrpar\u00ebsis\u00eb q\u00eb u \u00ebsht\u00eb dh\u00ebn\u00eb sh\u00ebndetit dhe siguris\u00eb, ne duhet t\u00eb mbrojm\u00eb nj\u00eb hierarki q\u00eb i b\u00ebn lirit\u00eb publike t\u00eb ushtruara me p\u00ebrgjegj\u00ebsi dhe shqet\u00ebsim p\u00ebr t\u00eb mir\u00ebn e p\u00ebrbashk\u00ebt: gurthemelin e sistemeve tona demokratike.<\/p>\n<p>Prandaj, dalja nga lart e nj\u00eb krize t\u00eb till\u00eb varet n\u00eb zgjerimin e fush\u00ebs s\u00eb besimit dhe n\u00eb refuzimin e emergjenc\u00ebs si nj\u00eb m\u00ebnyr\u00eb qeverisjeje. Pesha e shtetit nuk duhet t\u00eb ulet, ajo madje duhet t\u00eb rritet, por vet\u00ebm n\u00eb mas\u00ebn e p\u00ebrvet\u00ebsuar nga proceset demokratike t\u00eb diskutimit dhe llogaridh\u00ebnies.
