Nj\u00eb marr\u00ebveshje e till\u00eb hipotetike do t\u00eb \u00e7onte n\u00eb njohjen e Kosov\u00ebs nga Serbia dhe pranimin e saj n\u00eb organizata nd\u00ebrkomb\u00ebtare. Krejt k\u00ebto procese nd\u00ebrtohen brenda suazave t\u00eb negociatave politike, q\u00eb tash e sa vjet zhvillohen n\u00eb mes qeverish e president\u00ebsh t\u00eb t\u00eb dy vendeve. Pra, negociata q\u00eb udh\u00ebhiqen nga lider\u00eb politik\u00eb t\u00eb cil\u00ebt veprojn\u00eb, t\u00eb pakt\u00ebn teorikisht, konform kornizave t\u00eb tyre ligjore e kushtetuese. Mir\u00ebpo, tema q\u00eb do t\u00eb shtjellohet m\u00eb posht\u00eb nuk ka t\u00eb b\u00ebj\u00eb drejtp\u00ebrdrejt me realitetin politik, pjes\u00eb e t\u00eb cilit jan\u00eb edhe k\u00ebto negociata. Do t\u00eb shtjellohet nj\u00eb realitet tjet\u00ebr, ai religjioz, specifikisht ai i Kish\u00ebs Ortodokse Serbe, dhe i ndikimit dhe mpleksjes s\u00eb saj me realitetin politik.<\/p>\n<p><strong>Realiteti fetar i Kish\u00ebs dhe politika<\/strong><\/p>\n<p>P\u00ebrderisa negociatat n\u00eb Bruksel kan\u00eb t\u00eb b\u00ebjn\u00eb ekskluzivisht me realitetin politik, ato nuk e prekin tem\u00ebn e realitetit fetar. Ose m\u00eb sakt\u00eb, ndoshta e prekin, por nga k\u00ebndi i mbrojtjes s\u00eb tyre (narracioni serb) e jo nga pik\u00ebv\u00ebshtrimi i ndikimit politik t\u00eb Kish\u00ebs n\u00eb d\u00ebm t\u00eb shtet\u00ebsis\u00eb s\u00eb Kosov\u00ebs (q\u00eb do t\u00eb mund t\u00eb ishte narracioni kosovar).<\/p>\n<p>N\u00eb teori thuhet se politika \u00ebsht\u00eb e ndar\u00eb nga feja dhe gjersa kjo e para merret me pun\u00ebt e shtetit, e dyta kujdeset p\u00ebr bot\u00ebn shpirt\u00ebrore e hyjnore t\u00eb grigj\u00ebs s\u00eb saj. Mir\u00ebpo, n\u00eb rastin n\u00eb fjal\u00eb, roli i fes\u00eb g\u00ebrshetohet me politik\u00eb dhe anasjelltas dhe kjo pasi vet\u00eb Kisha Ortodokse Serbe \u00ebsht\u00eb produkt i negociatave mbi statusin e Kosov\u00ebs, negociata q\u00eb e formalizuan at\u00eb n\u00eb territorin e Kosov\u00ebs. P\u00ebr m\u00eb tep\u00ebr, luft\u00ebrat e fundit n\u00eb ish-Jugosllavi d\u00ebshmuan se n\u00eb rastin m\u00eb t\u00eb mir\u00eb, kleri serb q\u00ebndroi indiferent karshi politik\u00ebs dhe agresionit t\u00eb Beogradit, e n\u00eb rastin m\u00eb t\u00eb keq ishte p\u00ebrkrah\u00ebse aktive e akteve kriminale, madje edhe duke i bekuar formacionet paramilitare para se t\u00eb niseshin p\u00ebr n\u00eb front.<\/p>\n<p>Kisha Ortodokse Serbe, e njohur si e till\u00eb, u zyrtarizua gjat\u00eb negociatave t\u00eb Vjen\u00ebs p\u00ebr statusin e ardhsh\u00ebm t\u00eb Kosov\u00ebs. N\u00eb dokumentet e m\u00ebhershme &#8211; ato q\u00eb krijuan bazamentin p\u00ebr Kosov\u00ebn e pasluft\u00ebs (Marr\u00ebveshja e Rambujes\u00eb, Rezoluta 1244, dhe Korniza Kushtetuese p\u00ebr Vet\u00ebqeverisje t\u00eb P\u00ebrkohshme) &#8211; i referohej vet\u00ebm p\u00ebrgjith\u00ebsisht parimit t\u00eb s\u00eb drejt\u00ebs s\u00eb praktikimit t\u00eb fes\u00eb dhe t\u00eb ruajtjes s\u00eb trash\u00ebgimis\u00eb kulturore, fetare e historike. Negociatat e Vjen\u00ebs e konkretizuan at\u00eb duke i dh\u00ebn\u00eb em\u00ebr e mbiem\u00ebr si dhe pron\u00ebsi. Ajo \u00e7far\u00eb rezultoi nga k\u00ebto negociata &#8211; Propozimi Gjith\u00ebp\u00ebrfshir\u00ebs i Ahtisaarit, p\u00ebrkat\u00ebsisht Aneksi V mbi Trash\u00ebgimin\u00eb Fetare dhe Kulturore &#8211; flet p\u00ebr t\u00eb drejtat, privilegjet dhe imunitetet e k\u00ebsaj kishe n\u00eb Kosov\u00eb. M\u00eb tutje, deklaron se Kosova njeh Kish\u00ebn Ortodokse Serbe n\u00eb Kosov\u00eb, duke p\u00ebrfshir\u00eb manastiret, kishat dhe vendet e tjera q\u00eb p\u00ebrdoren p\u00ebr q\u00ebllime fetare, \u201dsi pjes\u00eb integrale t\u00eb Kish\u00ebs Ortodokse Serbe me seli n\u00eb Beograd\u201d.<\/p>\n<p>Kushtetuta e Republik\u00ebs s\u00eb Kosov\u00ebs nuk i referohet specifikisht k\u00ebsaj teme, mir\u00ebpo n\u00eb Nenin 9 (Trash\u00ebgimia Kulturore dhe Fetare), ajo stipulon se Kosova \u201dsiguron ruajtjen dhe mbrojtjen e trash\u00ebgimis\u00eb s\u00eb vet kulturore dhe fetare\u201d. Po ashtu, n\u00eb Dispozitat P\u00ebrfundimtare t\u00eb Kushtetut\u00ebs deklarohet qart\u00eb se autoritetet e Kosov\u00ebs veprojn\u00eb me t\u00eb gjitha detyrimet sipas Propozimit Gjith\u00ebp\u00ebrfshir\u00ebs t\u00eb Ahtisaarit. P\u00ebr m\u00eb tep\u00ebr, dispozitat e Propozimit Gjith\u00ebp\u00ebrfshir\u00ebs \u201dkan\u00eb ep\u00ebrsi ndaj t\u00eb gjitha dispozitave t\u00eb tjera ligjore n\u00eb Kosov\u00eb\u201d.<\/p>\n<p>Rrjedhimisht, edhe pse Kushtetuta nuk e p\u00ebrmend deklarativisht Kish\u00ebn Ortodokse Serbe, ajo i merr p\u00ebrsip\u00ebr t\u00eb gjitha obligimet, pra edhe ndaj k\u00ebsaj kishe, si pasoj\u00eb e p\u00ebrvet\u00ebsimit t\u00eb Propozimit Gjith\u00ebp\u00ebrfshir\u00ebs. Dhe n\u00eb fund \u00ebsht\u00eb edhe Ligji p\u00ebr Zonat e Ve\u00e7anta t\u00eb Mbrojtura, q\u00eb mes t\u00eb tjerash stipulon t\u00eb \u201dsiguroj\u00eb mbrojtjen e manastireve ortodokse serbe, kishave, vendeve t\u00eb tjera fetare, si dhe vendeve historike dhe kulturore t\u00eb nj\u00eb r\u00ebnd\u00ebsie t\u00eb ve\u00e7ant\u00eb p\u00ebr komunitetin serb, si dhe p\u00ebr komunitetet e tjera n\u00eb Republik\u00ebn e Kosov\u00ebs\u201d.<\/p>\n<p>N\u00eb shikim t\u00eb par\u00eb e gjith\u00eb kjo korniz\u00eb ligjore e kushtetuese ka nj\u00eb q\u00ebllim fisnik dhe qytet\u00ebrues: at\u00eb t\u00eb ushtrimit t\u00eb lir\u00eb t\u00eb s\u00eb drejt\u00ebs bazike njer\u00ebzore t\u00eb praktikimit t\u00eb fes\u00eb, si dhe t\u00eb ruajtjes s\u00eb trash\u00ebgimis\u00eb kulturore dhe fetare. Jam i sigurt se edhe n\u00eb negociatat e Vjen\u00ebs ky ishte rezonimi i delegacionit kosovar: n\u00eb shk\u00ebmbim t\u00eb pavar\u00ebsis\u00eb s\u00eb Kosov\u00ebs dhe njohjes s\u00eb saj nga Serbia (q\u00eb n\u00eb at\u00eb koh\u00eb ishte ende \u201dn\u00eb loj\u00eb\u201d bashk\u00eb me Rusin\u00eb), ishte e logjikshme dhe e kuptueshme q\u00eb klerit t\u00eb pakic\u00ebs serbe n\u00eb vend t\u2019i njihej statusi i ve\u00e7ant\u00eb si Kish\u00eb Ortodokse Serbe.<\/p>\n<p>N\u00eb fund t\u00eb fundit, si mund t\u00eb refuzohet e drejta legjitime e nj\u00eb qytetari serb q\u00eb t\u00eb ket\u00eb lidhje shpirt\u00ebrore direkte me kish\u00ebn zyrtare t\u00eb kombit t\u00eb vet (Serbis\u00eb)? Ne si shtet, jo vet\u00ebm q\u00eb duhet t\u2019i lejojm\u00eb t\u00eb drejtat fetare, por edhe t\u2019i mbrojm\u00eb e t\u2019i promovojm\u00eb ato n\u00eb m\u00ebnyr\u00eb proaktive. Madje edhe pa asnj\u00eb hezitim ta njohim relacionin direkt t\u00eb kishave e manastireve n\u00eb Kosov\u00eb me Kish\u00ebn Ortodokse Serbe n\u00eb Beograd. Kjo ishte logjika mbizot\u00ebruese n\u00eb at\u00eb koh\u00eb sepse n\u00eb fund t\u00eb fundit feja \u00ebsht\u00eb e ndar\u00eb nga politika, apo jo?<\/p>\n<p><strong>Pretendimi i \u201dpafajsh\u00ebm\u201d hyjnor<\/strong><\/p>\n<p>Si rrjedhoj\u00eb rezulton se Kisha Ortodokse Serbe, n\u00eb em\u00ebr t\u00eb liris\u00eb s\u00eb ushtrimit t\u00eb fes\u00eb dhe mbrojtjes s\u00eb trash\u00ebgimis\u00eb kulturore, g\u00ebzon t\u00eb drejta supra-kushtetuese. P\u00ebr m\u00eb tep\u00ebr, ato t\u00eb drejta madje nuk mund t\u00eb derogohen nj\u00ebansh\u00ebm nga autoritetet e Kosov\u00ebs. Kjo nd\u00ebrlidhet pastaj edhe me sundim t\u00eb ligjit. Madje,\u00a0<a href=\"https:\/\/phrg.padovauniversitypress.it\/2021\/2\/3\" target=\"_blank\" rel=\"noopener\">p\u00ebr komunitetin nd\u00ebrkomb\u00ebtar, mbrojtja e saj gjithmon\u00eb do t\u00eb jet\u00eb kriter q\u00eb do t\u00eb informoj\u00eb zbatimin e sundimit t\u00eb ligjit n\u00eb vend<\/a>.<\/p>\n<p>Natyrisht se mbrojtja e lirive fetare dhe e trash\u00ebgimis\u00eb kulturore \u00ebsht\u00eb akt civilizues dhe q\u00eb duhet mb\u00ebshtetur, sidomos nga korniza kushtetuese e ligjore moderne si kjo e Kosov\u00ebs. Mir\u00ebpo, kjo do t\u00eb ishte m\u00eb e natyrshme n\u00eb situat\u00eb kur shteti fqinj njeh pavar\u00ebsin\u00eb t\u00ebnde, nuk ka pretendime territoriale ndaj teje dhe e konsideron t\u00eb ndar\u00eb pushtetin politik nga ai religjioz. Por ky nuk \u00ebsht\u00eb realiteti politik. Prandaj, k\u00ebshtu si \u00ebsht\u00eb, Kosova ka nd\u00ebrtuar nj\u00eb raport skizofrenie karshi Kish\u00ebs Ortodokse Serbe n\u00eb vend: n\u00eb nj\u00ebr\u00ebn an\u00eb zotohet n\u00eb mbrojtjen e saj (ashtu si edhe duhet), pasi i konsideron ato trash\u00ebgimi t\u00eb veten po ashtu, nd\u00ebrsa n\u00eb an\u00ebn tjet\u00ebr \u00ebsht\u00eb ambivalente p\u00ebr rolin e klerit t\u00eb saj dhe i druhet asaj si potencialisht Kal\u00eb i Troj\u00ebs brenda shtetit. Pse \u00ebsht\u00eb k\u00ebshtu?<\/p>\n<p>Negociatat n\u00eb Bruksel na b\u00ebjn\u00eb t\u00eb harrojm\u00eb nganj\u00ebher\u00eb se pretendime ndaj Kosov\u00ebs nuk ka vet\u00ebm shteti serb, por edhe Kisha Ortodokse Serbe. Bile, sipas Kish\u00ebs dhe narracionit t\u00eb saj, pretendimi mbi Kosov\u00ebn daton q\u00eb nga mesjeta e hershme. Q\u00ebndrimi i tyre n\u00eb Kosov\u00eb pretendohet t\u00eb jet\u00eb detyr\u00eb e shenjt\u00eb. Nj\u00eb kalvar i leht\u00eb p\u00ebr mishin (krahasuar me shp\u00ebrblimin e bot\u00ebs s\u00eb p\u00ebrtejme) p\u00ebrkund\u00ebr v\u00ebshtir\u00ebsive t\u00eb \u00e7astit, si\u00e7 \u00ebsht\u00eb rasti tani me Kosov\u00ebn e pavarur.\u00a0<a href=\"https:\/\/journals.sagepub.com\/doi\/abs\/10.1177\/0010836720972435?journalCode=caca\" target=\"_blank\" rel=\"noopener\">Vet\u00eb Dio\u00e7eza e Kish\u00ebs Ortodokse Serbe n\u00eb Kosov\u00eb e prezanton veten si &#8220;bastion kund\u00ebr t\u00eb pafeve, josllav\u00ebve dhe joserb\u00ebve&#8221; q\u00eb p\u00ebr 1000 vjet rresht \u00ebsht\u00eb p\u00ebrballur me sfida t\u00eb Golgot\u00ebs<\/a>.<\/p>\n<p>Momentalisht, sfid\u00eb \u00ebsht\u00eb Kosova e pavarur q\u00eb, sipas logjik\u00ebs mij\u00ebvje\u00e7are t\u00eb pretendimit hyjnor, \u00ebsht\u00eb pengesa e radh\u00ebs q\u00eb eventualisht do t\u00eb tejkalohet. Nga distanca selestiale e gj\u00ebrave, nuk \u00ebsht\u00eb me r\u00ebnd\u00ebsi se a do t\u00eb vazhdoj\u00eb kjo penges\u00eb p\u00ebr 10 vjet apo 100. N\u00eb nd\u00ebrkoh\u00eb, \u00e7do incident \u00ebsht\u00eb i pad\u00ebshiruesh\u00ebm por edhe rast oportunist, pasi ato ushqejn\u00eb sensin e viktim\u00ebs nga kleri.\u00a0<a href=\"https:\/\/balkaninsight.com\/2021\/06\/11\/liturgjia-ne-kishen-e-kontestuar-serbe-shkakton-protesta-ne-kosove\/?lang=sq\" target=\"_blank\" rel=\"noopener\">Kujtojm\u00eb liturgjin\u00eb n\u00eb qershor t\u00eb klerit serb n\u00eb objektin e pap\u00ebrfunduar n\u00eb kampusin universitar n\u00eb Prishtin\u00eb<\/a>. \u00c7far\u00ebdo incidenti do t\u00eb shfryt\u00ebzohej n\u00eb maksimum p\u00ebr martirizimin e popullit serb n\u00eb duart e shqiptar\u00ebve t\u00eb pap\u00ebrmir\u00ebsuesh\u00ebm. Pra, kleri e konsideron veten martir i popullit q\u00eb sakrifikon trupin e vet p\u00ebr hir t\u00eb shpirtit t\u00eb kombit. Viktimizimi pastaj ushqen narracionin e &#8220;tok\u00ebs s\u00eb shenjt\u00eb&#8221; t\u00eb Kosov\u00ebs n\u00eb t\u00eb cil\u00ebn nj\u00eb dit\u00eb ata do t\u00eb kthehen.<\/p>\n<p>Pra, ndryshe nga shteti serb q\u00eb e pretendon Kosov\u00ebn me kushtetut\u00eb e ligje, mund t\u00eb thuhet se pretendimet e Kish\u00ebs Ortodokse Serbe jan\u00eb edhe m\u00eb t\u00eb gjera dhe etereale. Ato jan\u00eb pretendime territoriale e ajrore, jan\u00eb t\u00eb k\u00ebsaj bote e asaj tjetr\u00ebs, pra jan\u00eb t\u00eb tejbotshme e t\u00eb p\u00ebrjetshme. Bashk\u00ebjetesa incestuoze shtet-kler fetar e b\u00ebn \u00e7pleksjen e k\u00ebtij pretendimi mjaft kompleks. Kjo sepse, ta z\u00ebm\u00eb, edhe n\u00ebse shteti serb vendos nes\u00ebr q\u00eb ta njoh\u00eb pavar\u00ebsin\u00eb e Kosov\u00ebs, nuk do t\u00eb mjaftonte amandametimi i kushtetut\u00ebs s\u00eb tyre. Ky \u00ebsht\u00eb akt politik n\u00eb fund t\u00eb fundit. Mir\u00ebpo, si do t\u00eb hiqej dor\u00eb nga pretendimi territorial e hyjnor i Kish\u00ebs Ortodokse Serbe mbi Kosov\u00ebn? Si t\u00eb amandamentohet mend\u00ebsia shpirt\u00ebrore e nj\u00eb populli?<\/p>\n<p><a href=\"https:\/\/kallxo.com\/lajm\/kurti-i-kerkon-dialog-sava-janjiqit-kryemurgut-te-manastirit-te-decanit\/\" target=\"_blank\" rel=\"noopener\">N\u00eb letr\u00ebn e 20 majit t\u00eb k\u00ebtij viti, drejtuar Sava Janji\u00e7it, kryemurgut t\u00eb Manastirit t\u00eb De\u00e7anit, kryeministri Kurti<\/a>\u00a0shpreh interesimin q\u00eb ta vizitoj\u00eb at\u00eb, n\u00ebnvizon p\u00ebrkushtimin e shtetit kosovar p\u00ebr mbrojtjen e \u201dtrash\u00ebgimis\u00eb kulturore t\u00eb t\u00eb gjitha komuniteteve n\u00eb Kosov\u00eb\u201d dhe thekson se \u201dasetet e trash\u00ebgimis\u00eb s\u00eb pasur t\u00eb Kosov\u00ebs\u201d jan\u00eb burim krenarie, identiteti e edukimi.\u00a0<a href=\"https:\/\/www.evropaelire.org\/a\/kisha-ortodokse-refuzon-dialogun-me-kurtin-\/31277094.html\" target=\"_blank\" rel=\"noopener\">N\u00eb njoftimin q\u00eb pasoi, Dioqeza e Rashk\u00ebs dhe Prizrenit<\/a>\u00a0informon se takimi i sugjeruar \u00ebsht\u00eb \u201dkrejt\u00ebsisht i pakuptimt\u00eb\u201d p\u00ebrderisa nuk zbatohet nj\u00ebvendim i m\u00ebhersh\u00ebm i Gjykat\u00ebs Kushtetuese t\u00eb Kosov\u00ebs p\u00ebr pron\u00ebn e Manastirit t\u00eb De\u00e7anit (vendimi i vitit 2016 flet p\u00ebr njohjen e pron\u00ebs s\u00eb manastirit). Sidoqoft\u00eb, nuk mund t\u00eb mos potencohen edhe disa arsye t\u00eb tjera q\u00eb shpjegojn\u00eb refuzimin e tyre p\u00ebr t\u2019u takuar me kryeministrin.<\/p>\n<p>N\u00eb letr\u00ebn e tij v\u00ebrehet se Kurti asnj\u00ebher\u00eb nuk flet p\u00ebr \u201dKish\u00ebn Ortodokse Serbe\u201d. Kur flet p\u00ebr trash\u00ebgimin\u00eb kulturore ai u referohet t\u00eb gjitha komuniteteve e nuk e ve\u00e7on at\u00eb serbe. P\u00ebr m\u00eb tep\u00ebr, k\u00ebt\u00eb trash\u00ebgimi e quan t\u00eb Kosov\u00ebs. P\u00ebrderisa letra e tij i q\u00ebndron logjik\u00ebs shtet\u00ebrore, medoemos se k\u00ebto referime do t\u00eb ken\u00eb qen\u00eb t\u00eb papranueshme p\u00ebr klerin serb. Kjo sepse Kisha Ortodokse Serbe dhe prezenca e saj n\u00eb Kosov\u00eb nuk jan\u00eb thjesht realitete fetare por edhe faktor\u00eb politik\u00eb. Veprimet e Kish\u00ebs, sidomos karshi Qeveris\u00eb n\u00eb Prishtin\u00eb, jan\u00eb politike.
