Televizionet dhe radiot i rregullon shteti, duke i licensuar fillimisht ato dhe pastaj duke u p\u00ebrkujdesur q\u00eb p\u00ebrmbajtja q\u00eb transmetojn\u00eb \u00ebsht\u00eb e ligjshme. Shtypi dhe mediat online vet\u00ebrregullohen p\u00ebrmes nj\u00eb trupi t\u00eb krijuar nga vet\u00eb industria e medias. N\u00eb disa shtete ekziston edhe modeli i bashk\u00eb-rregullimit (pjes\u00ebrisht nga shteti dhe pjes\u00ebrisht nga industria e medias), por p\u00ebr q\u00ebllime t\u00eb k\u00ebtij blogu fokusi do t\u00eb mbetet te vet\u00ebrregullimi.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Vet\u00ebrregullimi ushtrohet p\u00ebrmes k\u00ebshillave t\u00eb mediave. Ai mb\u00ebshtetet n\u00eb iden\u00eb se liria e medias \u00ebsht\u00eb e nd\u00ebrlidhur ngusht\u00eb me p\u00ebrgjegj\u00ebsin\u00eb e medias dhe t\u00eb gazetar\u00ebve. K\u00ebshillat e mediave e bazojn\u00eb pun\u00ebn e tyre n\u00eb nj\u00eb kod etik, udh\u00ebzojn\u00eb gazetar\u00ebt p\u00ebr t\u00eb respektuar etik\u00ebn e gazetaris\u00eb dhe vendosin p\u00ebr ankesat me pretendime p\u00ebr shkelje etike nga mediat n\u00eb raste si: mosraportimi i t\u00eb v\u00ebrtet\u00ebs, shkelja e privacis\u00eb, apo marrja e paautorizuar e shkrimeve mediale.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">K\u00ebshillat p\u00ebr media nuk shqiptojn\u00eb sanksione; vet\u00ebm marrin vendime dhe u k\u00ebrkojn\u00eb an\u00ebtar\u00ebve q\u00eb t\u2019i publikojn\u00eb vendimet. Vendimet e k\u00ebshillave n\u00eb shum\u00eb vende merren parasysh nga gjykatat vendore, p\u00ebrfshir\u00eb edhe nga Gjykata Europiane p\u00ebr t\u00eb Drejtat e Njeriut, dhe kan\u00eb ndikim n\u00eb industrin\u00eb e medias. K\u00ebshillat financohen n\u00eb forma t\u00eb ndryshme &#8211; nga donator\u00eb t\u00eb huaj, an\u00ebtar\u00ebt, dhe, n\u00eb disa vende, edhe nga qeveria &#8211; nd\u00ebrsa\u00a0 punojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur nga financuesit. K\u00ebshillat e mediave jan\u00eb t\u00eb r\u00ebnd\u00ebsish\u00ebm sepse jan\u00eb mekanizma q\u00eb nd\u00ebrlidhin publikun me gazetarin\u00eb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb Kosov\u00eb vet\u00ebrregullimi i mediave t\u00eb shkruara b\u00ebhet p\u00ebrmes <\/span><a href=\"https:\/\/presscouncil-ks.org\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">K\u00ebshillit t\u00eb Mediave t\u00eb Shkruara t\u00eb Kosov\u00ebs<\/span><\/a><span style=\"font-weight: 400;\"> (KMShK). K\u00ebshilli <\/span><span style=\"font-weight: 400;\">\u00ebsht\u00eb formuar nga vet\u00eb sektori i mediave n\u00eb vitin 2005, me mb\u00ebshtetjen e Organizat\u00ebs p\u00ebr Siguri dhe Bashk\u00ebpunim n\u00eb Europ\u00eb, dhe pun\u00ebn e bazon n\u00eb Kodin e Etik\u00ebs q\u00eb an\u00ebtar\u00ebt e K\u00ebshillit e kan\u00eb aprovuar, e p\u00ebrdit\u00ebsojn\u00eb rregullisht dhe zotohen ta respektojn\u00eb. Aktualisht, K\u00ebshilli ka m\u00eb shum\u00eb se 50 an\u00ebtar\u00eb &#8211; media online dhe agjenci t\u00eb lajmeve &#8211; p\u00ebrfaq\u00ebsuesit e t\u00eb cil\u00ebve jan\u00eb pjes\u00eb e Kuvendit t\u00eb KMShK-s\u00eb. T\u00eb gjith\u00eb personat q\u00eb pretendojn\u00eb q\u00eb nj\u00eb media e shkruar ka shkelur Kodin mund t\u2019i drejtohen me ankes\u00eb KMShK-s\u00eb, i cili vendos n\u00ebse ka shkelje dhe vendimin e publikon n\u00eb uefaqen e vet (rreth <\/span><span style=\"font-weight: 400;\">1,600 ankesa deri m\u00eb tash)<\/span><span style=\"font-weight: 400;\">. K\u00ebshilli \u00ebsht\u00eb an\u00ebtar n\u00eb <\/span><a href=\"https:\/\/www.presscouncils.eu\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Alliance of Independent Press Councils of Europe<\/span><\/a><span style=\"font-weight: 400;\"> (AIPCE). K\u00ebshilli ka edhe mb\u00ebshtetje ligjore, meq\u00eb <\/span><a href=\"https:\/\/gzk.rks-gov.net\/ActDocumentDetail.aspx?ActID=2503%5d\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Ligji Civil Kund\u00ebr Shpifjes dhe Fyerjes<\/span><\/a><span style=\"font-weight: 400;\"> e njeh at\u00eb si trup vet\u00ebrregullues.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sqarimi i m\u00ebnyr\u00ebs s\u00eb rregullimit \u00ebsht\u00eb relevant n\u00eb kontekstin aktual p\u00ebr shkak se <\/span><a href=\"https:\/\/konsultimet.rks-gov.net\/viewConsult.php?ConsultationID=41259\"><span style=\"font-weight: 400;\">projektligji i KPM-s\u00eb<\/span><\/a><span style=\"font-weight: 400;\"> parasheh ndryshim rr\u00ebnj\u00ebsor duke ia transferuar kompetenc\u00ebn e rregullimit t\u00eb mediave online q\u00eb publikojn\u00eb video dhe audio rregullatorit shtet\u00ebror. Shumica d\u00ebrmuese e mediave online publikojn\u00eb video dhe rrjedhimisht t\u00eb gjitha do t\u2019i kalonin p\u00ebr rregullim KPM-s\u00eb.<\/span><\/p>\n<p><b>Rregullimi i mediave online p\u00ebrmes sistemit t\u00eb lejeve dhe licencave<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Projekligji p\u00ebr KPM-n\u00eb ka zgjeruar definicionin e mediave audiovizuele duke p\u00ebrfshir\u00eb edhe mediat online q\u00eb publikojn\u00eb video dhe audio. Neni 3 i projektligjit parasheh se <\/span><span style=\"font-weight: 400;\">sh\u00ebrbim medial audovizuel<\/span> <span style=\"font-weight: 400;\">duhet t\u00eb konsiderohen edhe \u201csh\u00ebrbimet mediale audiovizuele online q\u00ebllimi kryesor i t\u00eb cilave \u00ebsht\u00eb ofrimi i programeve me q\u00ebllim t\u00eb informimit, arg\u00ebtimit dhe edukimit\u201d.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Projektligji parasheh \u2013 n\u00eb m\u00ebnyr\u00eb konfuze &#8211; licencim dhe regjistrim t\u00eb tyre. Neni 4 (paragrafi 2 dhe n\u00ebnparagrafi 2.2) thot\u00eb se KPM-ja l\u00ebshon leje p\u00ebr ofruesit e <\/span><i><span style=\"font-weight: 400;\">sh\u00ebrbimeve audio, audiovizuele,<\/span><\/i><span style=\"font-weight: 400;\"> platformat p\u00ebr shp\u00ebrndarjen e videove, operator\u00ebt e shp\u00ebrndarjes, operator\u00ebt e rrjetit dhe operator\u00ebt e multipleksit. Sipas definicionit t\u00eb p\u00ebrmendur m\u00eb lart\u00eb, mediat online konsiderohen si sh\u00ebrbim audiovizuel dhe kjo do t\u00eb thot\u00eb q\u00eb mediat online duhet t\u00eb aplikojn\u00eb p\u00ebr leje pran\u00eb KPM-s\u00eb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Neni 58 i dispozitave kalimtare parasheh se \u201cofruesit e sh\u00ebrbimeve audio dhe audiovizuale online dor\u00ebzojn\u00eb aplikimin p\u00ebr regjistrim pran\u00eb KPM brenda gjasht\u00eb muajve nga hyrja n\u00eb fuqi e k\u00ebtij ligji\u201d. Kjo do t\u00eb thot\u00eb q\u00eb regjistrimi do t\u00eb jet\u00eb procedur\u00eb e obligueshme p\u00ebr mediat online. Rrjedhimisht, deklaratat e disa deputet\u00ebve nga radh\u00ebt e pushtetit, se regjistrimi i mediave online sipas projektligjit \u00ebsht\u00eb vullnetar, jan\u00eb t\u00eb pav\u00ebrteta.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sidoqoft\u00eb, pavar\u00ebsisht a parasheh ligji leje apo regjistrim t\u00eb mediave online, ky ndryshim i propozuar ligjor n\u00ebnkupton q\u00eb mediat online do t\u00eb trajtohen sipas sistemit t\u00eb lejeve dhe licencave q\u00eb rregullohet me<\/span><a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=8967\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\"> Ligjin p\u00ebr Sistemin e Lejeve dhe Licencave<\/span><\/a><span style=\"font-weight: 400;\">. Ky ligj njeh kat\u00ebr lloje t\u00eb lejeve, me t\u00eb cilat n\u00eb k\u00ebt\u00eb rast do rregullohej veprimtaria mediale: njoftimi, regjistrimi, leja dhe licencimi. Lejimi mund t\u00eb b\u00ebhet vet\u00ebm n\u00ebse p\u00ebrmbushen kat\u00ebr kritere: a) veprimtaria q\u00eb rregullohet duhet t\u00eb paraqes\u00eb rrezik p\u00ebr sh\u00ebndetin publik, sigurin\u00eb publike, mjedisin ose t\u00eb ket\u00eb ndikim n\u00eb p\u00ebrdorimin e resurseve natyrore, b) rreziku nuk mund t\u00eb adresohet p\u00ebrmes mekanizmave t\u00eb tregut t\u00eb lir\u00eb, c) forma e lejimit \u00ebsht\u00eb proporcionale me rrezikun dhe d) lejimi i till\u00eb shfryt\u00ebzon mjetet m\u00eb pak kufizuese p\u00ebr t\u00eb adresuar.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Propozimi p\u00ebr t\u00eb rregulluar mediat online p\u00ebrmes KPM-s\u00eb \u00ebsht\u00eb b\u00ebr\u00eb pa dh\u00ebn\u00eb arsyetim mbi rreziqet me t\u00eb cilat kanoset shteti nga mediat online, q\u00eb do binin n\u00eb ndonj\u00ebrin nga kriteret e rreziqeve m\u00eb lart t\u00eb parapara me Ligjin p\u00ebr Sistemin p\u00ebr Leje dhe Licenca. Arsyetimi se mediat online p\u00ebrb\u00ebjn\u00eb rreziqe t\u00eb k\u00ebtilla \u00ebsht\u00eb i v\u00ebshtir\u00eb n\u00eb nj\u00eb sistem demokratik ku promovohet liria e shprehjes. Rrjedhimisht ndryshimi i modelit nga sistemi i vet\u00ebrregullimit n\u00eb sistemin e lejeve dhe licencave do t\u00eb p\u00ebrb\u00ebnte shkelje t\u00eb Ligjit p\u00ebr Sistemin e Lejeve dhe Licencave. P\u00ebr t\u00eb funksionuar ky model i propozuar, qeveria do t\u00eb duhej t\u00eb fillonte ndryshimin e Ligjit p\u00ebr Sistemin e Lejeve dhe Licencave p\u00ebr t\u00eb b\u00ebr\u00eb p\u00ebrjashtim p\u00ebr rregullimin e mediave online.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Zgjerimi i fush\u00ebveprimit t\u00eb KPM-s\u00eb edhe mbi videot dhe audiot e plasuara n\u00eb mediat online \u00ebsht\u00eb edhe politikisht i rreziksh\u00ebm. Ndon\u00ebse n\u00eb koh\u00ebt e fundit ka l\u00ebvizje pozitive rreth depolitizimit t\u00eb KPM-s\u00eb p\u00ebrmes s\u00eb p\u00ebrzgjedhjes s\u00eb disa prej an\u00ebtar\u00ebve t\u00eb saj, ky institucion vazhdimisht \u00ebsht\u00eb pre e ndikimeve ose tentimndikimeve politike.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">P\u00ebr shembull, p\u00ebrgjat\u00eb muajit shkurt 2024, komisioni parlamentar p\u00ebr media dhe disa deputet\u00eb t\u00eb pushtetit organizuan d\u00ebgjime mbikqyr\u00ebse, q\u00eb n\u00eb fakt ishin takime denigruese dhe t\u00eb rrezikshme p\u00ebr sigurin\u00eb fizike t\u00eb an\u00ebtar\u00ebve t\u00eb pavarur t\u00eb komisionit t\u00eb cil\u00ebve u k\u00ebrkohej <\/span><a href=\"https:\/\/www.koha.net\/veshtrime\/409432\/litmus-testi-i-albinit\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">llogari p\u00ebr vendimet e tyre<\/span><\/a><span style=\"font-weight: 400;\">. N\u00eb ato takime, kat\u00ebr an\u00ebtar\u00ebt e pavarur u akuzuan me fjal\u00ebt m\u00eb t\u00eb r\u00ebnda si \u201ctradh\u00ebtar\u00eb\u201d, \u201cbashk\u00ebpuntor\u00eb t\u00eb Serbis\u00eb\u201d apo \u201ct\u00eb korruptuar\u201d. D\u00ebgjimi mbikqyr\u00ebs p\u00ebrb\u00ebn nd\u00ebrhyrje n\u00eb pavar\u00ebsin\u00eb e tyre dhe tentim p\u00ebr shkarkimin e kat\u00ebr an\u00ebtar\u00ebve t\u00eb pavarur t\u00eb KPM-s\u00eb (nga pes\u00eb sa ka gjithsej). Asnj\u00eb argument ligjor nuk u ofrua p\u00ebr shkarkimin e tyre. U b\u00ebn\u00eb vet\u00ebm komente nacionaliste e populiste. Deputet\u00ebt duket se u detyruan t\u00eb t\u00ebrhiqen pas reagimeve t\u00eb komunitetit nd\u00ebrkomb\u00ebtar dhe t\u00eb dhjetra organizatave vendore \u2013 p\u00ebrfshir\u00eb <\/span><a href=\"https:\/\/sbunker.org\/en\/njoftime\/reagim-forumi-per-integritetin-e-informacionit-denon-perpjekjet-per-cenimin-e-pavaresise-se-kpm-se\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Forumin p\u00ebr Integritetin e Informacionit<\/span><\/a><span style=\"font-weight: 400;\"> &#8211; q\u00eb treguan mb\u00ebshtetje t\u00eb madhe p\u00ebr KPM-n\u00eb.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">KPM \u00ebsht\u00eb gjithashtu e paaft\u00eb q\u00eb t\u00eb mbik\u00ebqyr\u00eb mediat online edhe p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb burimeve njer\u00ebzore dhe munges\u00ebs s\u00eb pavar\u00ebsis\u00eb financiare. Ajo ende operon n\u00ebn hijen e nj\u00eb procesi gjyq\u00ebsor penal, q\u00eb n\u00eb faz\u00ebn e par\u00eb t\u00eb procesit ka rezultuar me d\u00ebnime p\u00ebr korrupsion. N\u00eb rast t\u00eb shtrirjes s\u00eb fush\u00ebveprimit t\u00eb KPM-s\u00eb edhe mbi videot e mediave online, jo vet\u00ebm se nuk do t\u00eb ket\u00eb aft\u00ebsi t\u00eb monitoroj\u00eb mediat online, por rrezikon q\u00eb t\u00eb paralizohet t\u00ebr\u00ebsisht.<\/span><\/p>\n<p><b>Kufizimi i regjistrimit t\u00eb mediave: vet\u00ebm si kompani<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Me rregullat e tanishme, t\u00eb drejt\u00eb q\u00eb t\u00eb pajisen me licens\u00eb p\u00ebr televizion ose radio kan\u00eb bizneset dhe organizatat joqeveritare (OJQ). Licensimi i OJQ-ve ua mund\u00ebson mediave &#8211; sidomos mediave nga minoritetet &#8211; q\u00eb t\u00eb gjejn\u00eb mb\u00ebshtetje financiare nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb ofruar p\u00ebrmbajtje mediatike. Pas aprovimit t\u00eb projektligjit, organizatat joqeveritare nuk do ta g\u00ebzojn\u00eb m\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Projektligji n\u00eb pjes\u00ebn e definicioneve parasheh q\u00eb <\/span><span style=\"font-weight: 400;\">subjekt transmetues privat mund t\u00eb jet\u00eb \u00e7do<\/span> <span style=\"font-weight: 400;\">sh\u00ebrbim medial audiovizuel, operator i<\/span> <span style=\"font-weight: 400;\">rrjetit apo shp\u00ebrndarjes i licencuar qoft\u00eb<\/span> <span style=\"font-weight: 400;\">si OJQ apo subjekt i regjistruar biznesor. Mir\u00ebpo, sipas nenit 4, KPM-ja do t\u00eb jap\u00eb leje vet\u00ebm n\u00ebse pala aplikuese dor\u00ebzon certifikat\u00ebn e biznesit dhe v\u00ebrtetimin tatimor. OJQ-t\u00eb nuk mund t\u00eb ofrojn\u00eb certifikat\u00eb t\u00eb biznesit p\u00ebr t\u00eb k\u00ebnaqur k\u00ebt\u00eb k\u00ebrkes\u00eb ligjore prandaj do t\u00eb detyrohen t\u00eb fillojn\u00eb s\u00eb operuari si biznese.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fillimisht u ngrit nj\u00eb pohim shfajsues p\u00ebr qeverin\u00eb, se gjoja ky mund t\u00eb ishte nj\u00eb gabim teknik. Mir\u00ebpo, z\u00ebvend\u00ebskryeministri Besnik Beslimi, n\u00eb komisionin parlamentar p\u00ebr media, derisa e prezantonte projektligjin, konfirmoi q\u00eb projektligji synon ta pamund\u00ebsoj\u00eb operimin e organizatave joqeveritare si media<\/span><a href=\"https:\/\/betimiperdrejtesi.com\/projektligji-per-kpm-ne-kalon-ne-lexim-te-pare-ne-komisionin-per-media\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\">\u201cMediat online plasojn\u00eb kontent dhe q\u00ebllimi i kontentit \u00ebsht\u00eb me gjeneru t\u00eb hyra, bizneset gjenerojn\u00eb t\u00eb hyra\u201d, ka deklaruar Bislimi.<\/span><\/a><\/p>\n<p><b>Gjobat<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Nj\u00eb nd\u00ebr aspektet shqet\u00ebsuese t\u00eb k\u00ebtij projektligji \u00ebsht\u00eb edhe m\u00ebnyra e rregullimit t\u00eb gjobave. Fillimisht, projektligji parasheh d\u00ebnime deri n\u00eb 40,000 euro, shum\u00eb m\u00eb t\u00eb ul\u00ebta se ligji aktual q\u00eb parasheh d\u00ebnime deri n\u00eb 100,000 euro. N\u00ebse Projektligji jet\u00ebsohet, nj\u00eb gjob\u00eb prej 40,000 eurosh mund t\u00eb mbyll\u00eb secilin medium online dhe kjo p\u00ebrb\u00ebn argument shtes\u00eb p\u00ebrse mediat online nuk duhet t\u00eb rregullohen nga rregullatori shtet\u00ebror.\u00a0<\/span><\/p>\n<p><b>Mandati i an\u00ebtar\u00ebve t\u00eb KPM-s\u00eb<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Vendimet n\u00eb KPM merren nga an\u00ebtar\u00ebt e saj q\u00eb zgjedhen nga Parlamenti. Nga 7 sa i ka tash, qeveria ka propozuar q\u00eb KPM t\u00eb ket\u00eb 11 an\u00ebtar\u00eb. Mandati i tyre nuk do t\u00eb jet\u00eb m\u00eb i p\u00ebrshkall\u00ebzuar prej dy, tre dhe kat\u00ebr vitesh, por secili prej tyre do t\u2019i ket\u00eb kat\u00ebr vite mandat. P\u00ebrdorimi i mosaprovimit t\u00eb raportit vjetor si baz\u00eb p\u00ebr inicimimin\u00a0 e shkarkimit \u00ebsht\u00eb mekaniz\u00ebm q\u00eb do t\u00eb p\u00ebrdorej si k\u00ebrc\u00ebnim kund\u00ebr an\u00ebtar\u00ebve gjat\u00eb t\u00ebr\u00eb vitit dhe do t\u00eb aktivizohej sipas d\u00ebshir\u00ebs dhe preferencave politike t\u00eb deputet\u00ebve.<\/span><\/p>\n<p><b>Konsultimi publik<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Pasi projektligji u kritikua nga shoq\u00ebria civile, zyrtar\u00eb politik\u00eb t\u00eb z\u00ebn\u00eb ngusht\u00eb me reagimin e AGK-s\u00eb dhe KMShK-s\u00eb, q\u00eb gjeti mbulueshm\u00ebri dhe interesim nd\u00ebrkomb\u00ebtar, deklaruan publikisht se qeveria ka organizuar takime konsultative. Konsultimi publik duhet t\u00eb jet\u00eb i mir\u00ebfillt\u00eb dhe me hap\u00ebsir\u00eb t\u00eb mjaftueshme p\u00ebr dialog n\u00eb mes t\u00eb pal\u00ebve. Zyra e Kryeministrit ka d\u00ebshtuar n\u00eb t\u00ebr\u00ebsi t\u00eb p\u00ebrfshij\u00eb aketer\u00ebt joqeveritar\u00eb, p\u00ebrkund\u00ebr shprehjes s\u00eb interesimit nga ana e tyre.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fillimisht, projekligji kishte dal\u00eb n\u00eb <\/span><a href=\"https:\/\/konsultimet.rks-gov.net\/viewConsult.php?ConsultationID=41259\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">platform\u00ebn qeveritare p\u00ebr konsultim publik<\/span><\/a><span style=\"font-weight: 400;\"> m\u00eb 15 n\u00ebntor 2021. At\u00ebkoh\u00eb nuk pati ndonj\u00eb reagim publik meq\u00eb drafti i v\u00ebn\u00eb n\u00eb dispozicion p\u00ebr publikun nuk parashihte rregullimin e mediave online nga KPM-ja. I vetmi nen q\u00eb p\u00ebrmendtte mediat online ishte ai p\u00ebr sponsorizimet. Pra nuk mund t\u00eb konsiderohet q\u00eb projektligji aktual ka dal\u00eb n\u00eb platform\u00ebn p\u00ebr konsultime publike ashtu si\u00e7 k\u00ebrkojn\u00eb rregullat e qeveris\u00eb.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">S\u00eb dyti, pun\u00ebtoria e organizuar nga projekti i Bashkimit Europian <\/span><a href=\"https:\/\/neighbourhood-enlargement.ec.europa.eu\/funding-and-technical-assistance\/taiex_en\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">TIAEX<\/span><\/a><span style=\"font-weight: 400;\"> dhe Zyra e Kryeministrit ishte m\u00eb shum\u00eb prezantim i projektligjit sesa takim konsultim. Asnj\u00eb nga pjes\u00ebmarr\u00ebsit ne pun\u00ebtori nuk mban mend t\u2019i jet\u00eb pranuar ndonj\u00eb sugjerim konkret nga ana e zyrtar\u00ebve t\u00eb qeveris\u00eb. Takimi ishte organizuar aq keq dhe joseriozisht sa pjes\u00ebmarr\u00ebsit kan\u00eb pasur vet\u00ebm tri dit\u00eb koh\u00eb p\u00ebr t\u00eb lexuar, analizuar dhe p\u00ebrgatitur komentet p\u00ebr nj\u00eb projektligj 100 e ca faqesh. Poashtu, n\u00eb k\u00ebt\u00eb takim \u00ebsht\u00eb konfirmuar q\u00eb KPM-ja tenton t\u00eb rregulloj\u00eb \u00e7\u00ebshtjen e licencimit p\u00ebrmes Ligjit p\u00ebr Sistemin e Lejeve dhe Licencave.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">S\u00eb treti, pas pun\u00ebtoris\u00eb, p\u00ebrfaq\u00ebsues t\u00eb shoq\u00ebris\u00eb civile kishin k\u00ebrkuar me urgjenc\u00eb nj\u00eb takim me shefin e kabinetit t\u00eb Kryeministrit dhe k\u00ebshilltaren e tij ligjore. Takimi ishte mbajtur m\u00eb 11 tetor 2023 dhe n\u00eb at\u00eb takim atyre u ishte k\u00ebrkuar t\u00eb mos e procedonin Projektligjin n\u00eb at\u00eb form\u00eb si\u00e7 ishte prezantuar n\u00eb pun\u00ebtori. Zyrtar\u00ebve politik\u00eb u ishte dor\u00ebzuar nj\u00eb analiz\u00eb e shkurt\u00ebr ligjore dhe nj\u00eb list\u00eb argumentesh p\u00ebrse Projektligji ishte i d\u00ebmsh\u00ebm. P\u00ebrkunder premtimeve q\u00eb nj\u00eb gj\u00eb e till\u00eb nuk do t\u00eb ndodhte, k\u00ebrkesa e shoq\u00ebris\u00eb civile ishte injoruar n\u00eb t\u00ebr\u00ebsi. <\/span><span style=\"font-weight: 400;\">Rrjedhimisht, Projektligji \u00ebsht\u00eb b\u00ebr\u00eb pa konsultim publik, pa p\u00ebrfshirje t\u00eb industris\u00eb s\u00eb medias dhe akter\u00ebve t\u00eb interesuar dhe duke injoruar t\u00ebr\u00ebsisht sugjerimet e shoq\u00ebris\u00eb civile.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Projektligji p\u00ebr KPM-n\u00eb \u00ebsht\u00eb aprovuar n\u00eb lexim t\u00eb par\u00eb n\u00eb Kuvend m\u00eb 7 mars 2024 dhe Komisioni parlamentar p\u00ebr media ka ende mund\u00ebsi q\u00eb t\u00eb organizoj\u00eb d\u00ebgjim publik dhe t\u00eb p\u00ebrfshij\u00eb akter\u00ebt e interesuar gjat\u00eb trajtimit t\u00eb projektligjit deri n\u00eb leximin e dyt\u00eb.<\/span><\/p>\n<p><b>Harmonizimi i projekligjit me rregullat e Bashkimit Europian<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Inicimi i ndryshimit t\u00eb projektligjit p\u00ebr KPM-n\u00eb \u00ebsht\u00eb b\u00ebr\u00eb me shtytje t\u00eb Bashkimit Europian, i cili i k\u00ebrkon Kosov\u00ebs q\u00eb ta harmonizoj\u00eb at\u00eb me <\/span><a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/audiovisual-and-media-services\"><span style=\"font-weight: 400;\">Direktiven e rishikuar t\u00eb Sh\u00ebrbimeve t\u00eb Medias Audiovizuale<\/span><\/a><span style=\"font-weight: 400;\"> (AVMS)<\/span><span style=\"font-weight: 400;\">. P\u00ebr k\u00ebt\u00eb <\/span><span style=\"font-weight: 400;\">arsye, BE-ja kishte ofruar ekspertiz\u00eb nga p\u00ebrspektiva e rregullimit shtet\u00ebror p\u00ebr t\u00eb ndihmuar qeverin\u00eb dhe kjo ekspertiz\u00eb avokonte p\u00ebr rregullim shtet\u00ebror t\u00eb mediave online q\u00eb p\u00ebrmbajn\u00eb video dhe audio. Nj\u00ebkoh\u00ebsisht, Komisioni i Pavarur p\u00ebr Media kishte k\u00ebrkuar ekspertiz\u00eb nga K\u00ebshilli i Europ\u00ebs, e cila ekspertiz\u00eb n\u00eb fakt v\u00eb theksin tek modelet e vet\u00ebrregullimit. N\u00eb linj\u00eb me K\u00ebshillin e Europ\u00ebs \u00ebsht\u00eb edhe organizata p\u00ebr Siguri dhe Bashk\u00ebpunim n\u00eb Europ\u00eb (OSBE) e cila ka b\u00ebr\u00eb <\/span><a href=\"https:\/\/balkaninsight.com\/2018\/10\/19\/albania-website-registration-request-criticized-10-18-2018\/\"><span style=\"font-weight: 400;\">t\u00eb qart\u00eb disa her\u00eb q\u00eb m\u00eb e shumta q\u00eb<\/span><\/a><span style=\"font-weight: 400;\"> nj\u00eb rregullator mund t\u00eb propozoj\u00eb \u00ebsht\u00eb regjistrimi vullnetar i mediave online. Fal\u00eb presionit t\u00eb madh publik vendor dhe nd\u00ebrkomb\u00ebtar dhe ekspertiz\u00ebs s\u00eb K\u00ebshillit t\u00eb Europ\u00ebs, qeveria e Shqip\u00ebris\u00eb ishte detyruar t\u00eb t\u00ebrhiqte projektligjet e ngjashme nga parlamenti.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">P\u00ebr t\u2019u zbatuar direktiva AVMS, jan\u00eb dy parakushte q\u00eb duhet t\u00eb plot\u00ebsohen p\u00ebrpara se shteti t\u00eb fus\u00eb n\u00ebn regjimin e tij mediat online q\u00eb publikojn\u00eb video dhe audio. Parakushti i par\u00eb \u00ebsht\u00eb fuqizimi i K\u00ebshillit t\u00eb Mediave. Neni 4a i Direktiv\u00ebs thot\u00eb q\u00eb shtetet an\u00ebtare duhet t\u00eb inkurajojn\u00eb p\u00ebrdorimin e bashk\u00eb-rregullimit dhe duhet t\u00eb nxisin vet\u00ebrregullimin e mediave. P\u00ebr ilustrim, ishte pik\u00ebrisht parakushti p\u00ebr mb\u00ebshtetjen e vet\u00ebrregullimit q\u00eb kishte \u00e7uar, <\/span><span style=\"font-weight: 400;\">gjat\u00eb transpozimit t\u00eb AVMS-s\u00eb n\u00eb Finland\u00eb, qeverin\u00eb<\/span> <span style=\"font-weight: 400;\">dhe parlamentin finalandez t\u00eb pajtoheshin q\u00eb k\u00ebt\u00eb kompetenc\u00eb t\u2019ia linin K\u00ebshillit t\u00eb<\/span> <span style=\"font-weight: 400;\">Mediave dhe t\u00eb mos b\u00ebnin ndryshime<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Me ndryshimet ligjore n\u00eb Kosov\u00eb, vet\u00ebrregullimit do t\u2019i ndodh\u00eb e kund\u00ebrta e asaj q\u00eb parasheh direktiva.<\/span><span style=\"font-weight: 400;\"> KMShK-ja &#8211; ndon\u00ebse storie suksesi &#8211; <\/span><span style=\"font-weight: 400;\">do t\u00eb dob\u00ebsohet duksh\u00ebm dhe nuk do t\u00eb mund ta luaj\u00eb rolin e saj n\u00eb rritjen e llogaridh\u00ebnies s\u00eb mediave.<\/span><span style=\"font-weight: 400;\"> Parakushti i dyt\u00eb \u00ebsht\u00eb pavar\u00ebsia e rregullatorit, n\u00eb k\u00ebt\u00eb rast e KPM-s\u00eb.
