{"id":7506,"date":"2022-02-11T09:48:02","date_gmt":"2022-02-11T07:48:02","guid":{"rendered":"https:\/\/sbunker.org\/?p=7506"},"modified":"2024-09-11T09:59:21","modified_gmt":"2024-09-11T07:59:21","slug":"si-shpenzoi-esm-ja-miliona-permes-marreveshjeve-negociatave-te-drejtperdrejta","status":"publish","type":"post","link":"https:\/\/sbunker.org\/en\/analize\/si-shpenzoi-esm-ja-miliona-permes-marreveshjeve-negociatave-te-drejtperdrejta\/","title":{"rendered":"Si shpenzoi ESM-ja miliona p\u00ebrmes marr\u00ebveshjeve\/negociatave t\u00eb drejtp\u00ebrdrejta"},"content":{"rendered":"<p><b>N\u00ebse n\u00eb gjasht\u00ebmujorin e par\u00eb t\u00eb vitit 2021, kompania shtet\u00ebrore p\u00ebr prodhimin e energjis\u00eb elektrike AD ESM (ELEM) ka lidhur 6 kontrata n\u00eb procedura negocimi pa shpallur konkurs me vler\u00eb totale prej 9 milion\u00eb euro, n\u00eb gjysm\u00ebn e dyt\u00eb t\u00eb vitit ka lidhur 12 kontrata t\u00eb tilla me vler\u00eb 27 milion\u00eb euro, ku dy kontratat m\u00eb t\u00eb m\u00ebdha kapin vler\u00ebn e gati 24 milion\u00eb eurove, t\u00eb dyja t\u00eb kontraktuara me t\u00eb nj\u00ebjt\u00ebn kompani.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Ligjshm\u00ebria, ekonomizimi, efikasiteti, barazia, konkurrueshm\u00ebria, transparenca &#8211; k\u00ebto jan\u00eb parimet kryesore t\u00eb cil\u00ebt duhet t\u00eb respektojn\u00eb t\u00eb gjitha institucionet n\u00eb rastet kur shpenzojn\u00eb fonde buxhetore dhe fonde t\u00eb tjera publike, p\u00ebrkat\u00ebsisht n\u00eb rastet kur b\u00ebjn\u00eb p\u00ebrzgjedhjen dhe lidhjen e kontratave me kompanit\u00eb p\u00ebr pun\u00eb, mallra dhe sh\u00ebrbime t\u00eb ndryshme.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Me fjal\u00eb t\u00eb tjera, k\u00ebto postulate baz\u00eb, t\u00eb cilat jan\u00eb pjes\u00eb integrale e <\/span><a href=\"https:\/\/www.bjn.gov.mk\/wp-content\/uploads\/2019\/05\/ZJN_Sluzben-vesnik_24-2018-od-01.02.2019.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Ligjit p\u00ebr Prokurime Publike<\/span><\/a><span style=\"font-weight: 400;\">, duhet t\u00eb mund\u00ebsojn\u00eb realizimin e suksessh\u00ebm t\u00eb objektivave dhe kompetencave t\u00eb autoriteteve kontraktuese \u2013 ministrive, komunave, nd\u00ebrmarrjeve publike, kompanive shtet\u00ebrore dhe subjekteve tjera me autorizime publike, por n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb t\u00eb menaxhoj\u00eb me p\u00ebrgjegj\u00ebsi fondet publike.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb k\u00ebt\u00eb drejtim, konkurrenca nd\u00ebrmjet operator\u00ebve ekonomik\u00eb nuk duhet t\u00eb kufizohet n\u00eb m\u00ebnyr\u00eb t\u00eb pajustifikueshme, d.m.th. p\u00ebr t\u00eb kufizuar, dhe aq m\u00eb pak &#8211; p\u00ebr t\u00eb eliminuar kompanit\u00eb q\u00eb jan\u00eb potencialisht t\u00eb interesuara p\u00ebr t\u00eb kryer pun\u00ebn e k\u00ebrkuar, p\u00ebr t\u00eb ofruar mallrat e k\u00ebrkuara ose p\u00ebr t\u00eb ofruar sh\u00ebrbimin e k\u00ebrkuar.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pra, praktikisht \u00e7do operator ekonomik duhet t\u00eb ket\u00eb akses t\u00eb lir\u00eb dhe t\u00eb papenguar n\u00eb informacione p\u00ebr l\u00ebnd\u00ebn e prokurimit publik, p\u00ebr kushtet e dokumentacionit t\u00eb tenderit, p\u00ebr karakteristikat e specifikacionit teknik&#8230; T\u00eb gjitha dokumentet duhet t\u00eb b\u00ebhen publike, p\u00ebrve\u00e7 n\u00eb disa raste t\u00eb rralla\u00a0 ku k\u00ebrkohet respektimi i parimit t\u00eb fsheht\u00ebsis\u00eb dhe konfidencialitetit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb fakt, q\u00ebllimi \u00ebsht\u00eb q\u00eb t\u00eb gjitha kompanit\u00eb dhe furnitor\u00ebt t\u00eb ken\u00eb trajtim t\u00eb barabart\u00eb n\u00eb t\u00eb gjitha fazat e procedur\u00ebs, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb rritet konkurrueshm\u00ebria dhe oferta, sepse n\u00eb at\u00eb m\u00ebnyr\u00eb sigurohen p\u00ebrfitime ve\u00e7an\u00ebrisht t\u00eb r\u00ebnd\u00ebsishme. S\u00eb pari, konkurrojn\u00eb m\u00eb shum\u00eb kompani, sigurohet nj\u00eb ofert\u00eb m\u00eb e mir\u00eb.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb an\u00ebn tjet\u00ebr, n\u00eb at\u00eb m\u00ebnyr\u00eb, p\u00ebr autoritetin kontraktues ofrohet \u00e7mim m\u00eb i ul\u00ebt i kostos. Kur ka m\u00eb shum\u00eb kompani, ato, n\u00eb rastin e konkurrenc\u00ebs reale dhe jo fiktive, ulin \u00e7mimin n\u00eb nj\u00eb ankand negativ derisa pjes\u00ebmarr\u00ebsit n\u00eb ofert\u00eb t\u00eb vler\u00ebsojn\u00eb se nuk kan\u00eb interes afarist p\u00ebr t\u00eb ulur m\u00eb tej \u00e7mimin.<\/span><\/p>\n<p><b>E Drejta diskrecionale<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Prandaj, n\u00ebse nuk b\u00ebhet fjal\u00eb p\u00ebr nj\u00eb prokurim publik me vler\u00eb t\u00eb vog\u00ebl, m\u00eb s\u00eb shumti rekomandohet shpenzimi i paras\u00eb publike p\u00ebrmes t\u00eb ashtuquajtur\u00ebs procedur\u00eb tenderimi t\u00eb hapur, e cila parasheh shpalljen e nj\u00eb konkursi n\u00eb t\u00eb cilin \u00e7do operator ekonomik i interesuar mund t\u00eb parashtroj\u00eb ofert\u00eb, natyrisht n\u00ebse i plot\u00ebson kushtet e p\u00ebrcaktuara dhe kriteret nga tenderi dhe dokumentacioni shoq\u00ebrues.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Megjithat\u00eb, ligjv\u00ebn\u00ebsi ka parashikuar edhe nj\u00eb lloj tjet\u00ebr procedure, e cila mund t\u00eb p\u00ebrdoret, por n\u00eb situata dhe rrethana t\u00eb caktuara specifike. Nj\u00ebra prej tyre \u00ebsht\u00eb procedura me negocim, e cila mund t\u00eb zhvillohet n\u00eb dy variante \u2013 me ose pa shpallje paraprake t\u00eb konkursit publik. N\u00ebse hyjm\u00eb dhe shqyrtojm\u00eb struktur\u00ebn e kontratave, rezulton se madje gjysma e k\u00ebtyre fondeve t\u00eb shpenzuara me procedura jotransparente, n\u00eb fakt jan\u00eb shpenzuar nga kompania shtet\u00ebrore p\u00ebr prodhimin e energjis\u00eb elektrike AD ESM.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sipas t\u00eb dh\u00ebnave t\u00eb Byros\u00eb s\u00eb Prokurimit Publik, termocentralet shtet\u00ebrore n\u00eb gjysm\u00ebn e par\u00eb t\u00eb vitit 2021 kan\u00eb lidhur 6 kontrata me negociata t\u00eb drejtp\u00ebrdrejta pa shpallje konkursi, vlera totale e t\u00eb cilave \u00ebsht\u00eb 4 milion\u00eb euro. M\u00eb t\u00eb vlefshmet jan\u00eb kontratat p\u00ebr <\/span><a href=\"https:\/\/www.e-nabavki.gov.mk\/PublicAccess\/home.aspx#\/dossie-acpp\/d1557df2-b749-423f-97c8-e98fcbb4091e\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">p\u00ebrgatitjen e seksionit ndar\u00ebs me kompanin\u00eb <\/span><b><i>\u201eToplina DOOEL\u201c<\/i><\/b><\/a><span style=\"font-weight: 400;\"> prej rreth 2.5 milion\u00eb euro dhe p\u00ebr<\/span><a href=\"https:\/\/www.e-nabavki.gov.mk\/PublicAccess\/home.aspx#\/dossie-acpp\/d895cfa8-2dd0-4d8f-828b-b9b25189d5d9\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\"> \u0440rivitalizimin dhe rikonstruksionin e KU 300 (REK Manastir) me kompanin\u00eb <\/span><b><i>\u201eMZT Inzhenering\u201c<\/i><\/b><\/a><span style=\"font-weight: 400;\"> prej rreth 960 mij\u00eb euro.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">P\u00ebr m\u00eb tep\u00ebr, kompania shtet\u00ebrore n\u00eb tremujorin e p\u00ebrmendur ka lidhur edhe 4 kontrata t\u00eb tilla, em\u00ebruesi i p\u00ebrbashk\u00ebt i t\u00eb cilave, p\u00ebrve\u00e7, natyrisht, fakti q\u00eb jan\u00eb lidhur n\u00eb t\u00eb nj\u00ebjt\u00ebn procedur\u00eb jotransparente, \u00ebsht\u00eb se jan\u00eb arritur n\u00eb vler\u00eb pothuajse t\u00eb nj\u00ebjt\u00eb me vler\u00ebn e tyre t\u00eb parashikuar, e cila madje p\u00ebrmban edhe indikacione p\u00ebr marr\u00ebveshje t\u00eb mundshme p\u00ebr \u00e7mimin p\u00ebrfundimtar.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mir\u00ebpo, ky trend i ESM-s\u00eb p\u00ebr zbatimin e procedurave tenderuese p\u00ebrmes negociatave t\u00eb drejtp\u00ebrdrejta vazhdoi edhe n\u00eb gjysm\u00ebn e dyt\u00eb t\u00eb vitit t\u00eb kaluar, me nj\u00eb dinamik\u00eb edhe m\u00eb t\u00eb p\u00ebrforcuar, duke qen\u00eb se sipas t\u00eb dh\u00ebnave t\u00eb Byros\u00eb s\u00eb Prokurimeve Publike, kompania shtet\u00ebrore n\u00eb k\u00ebt\u00eb periudh\u00eb ka lidhur 12 kontrata n\u00eb \u201c4 sy\u201d n\u00eb nj\u00eb vler\u00eb totale prej mbi 27 milion\u00eb euro.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">K\u00ebshtu, AD ESM n\u00eb gjysm\u00ebn e dyt\u00eb t\u00eb vitit t\u00eb kaluar ka lidhur dy her\u00eb m\u00eb shum\u00eb kontrata t\u00eb tilla n\u00eb krahasim me gjysm\u00ebn e par\u00eb, nd\u00ebrsa vlera e tyre totale \u00ebsht\u00eb 3.5 her\u00eb m\u00eb e lart\u00eb, ose p\u00ebrndryshe 18 milion\u00eb euro. Kjo rritje \u00ebsht\u00eb kryesisht p\u00ebr shkak t\u00eb 2 kontratave m\u00eb t\u00eb m\u00ebdha, t\u00eb cilat peshojn\u00eb gjithsej af\u00ebrsisht 24 milion\u00eb euro, t\u00eb cilat jan\u00eb lidhur me t\u00eb nj\u00ebjt\u00ebn kompani &#8211; <\/span><b><i>\u201eMarkovski Kompani\u201c<\/i><\/b><span style=\"font-weight: 400;\">, e cila ka <\/span><a href=\"https:\/\/fokus.mk\/arhiva-kako-pelister-i-markovski-kompani-vojuvaat-za-bogatite-tenderi-na-rek-bitola\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">p\u00ebrjetuar rritje t\u00eb biznesit<\/span><\/a><span style=\"font-weight: 400;\"> me ndihm\u00ebn e tender\u00ebve dhe ka fituar pothuajse t\u00eb gjith\u00eb tender\u00ebt pik\u00ebrisht nga i nj\u00ebjti vend &#8211; AD ESM.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meq\u00eb ra fjala, padyshim m\u00eb e larta \u00ebsht\u00eb <\/span><a href=\"https:\/\/www.e-nabavki.gov.mk\/PublicAccess\/home.aspx#\/dossie-acpp\/79ff95d9-74e6-45b9-9f5e-a652a52c0c78\"><span style=\"font-weight: 400;\">kontrata<\/span><\/a><span style=\"font-weight: 400;\"> mes ESM-s\u00eb dhe \u201cMarkovski Kompani\u201d p\u00ebr zgjerimin e prodhimit t\u00eb nj\u00eb seksioni p\u00ebr ndarje prej gati 19 milion\u00eb euro. Pothuajse nj\u00ebkoh\u00ebsisht, t\u00eb dyja pal\u00ebt, n\u00eb t\u00eb nj\u00ebjt\u00ebn procedur\u00eb, kan\u00eb lidhur edhe nj\u00eb <\/span><a href=\"https:\/\/www.e-nabavki.gov.mk\/PublicAccess\/home.aspx#\/dossie-acpp\/a3e986eb-af4e-4954-b426-90b944ccd306\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">kontrat\u00eb<\/span><\/a><span style=\"font-weight: 400;\"> tjet\u00ebr p\u00ebr marrjen e makinerive ndihm\u00ebse p\u00ebr minierat e REK Manastirit n\u00eb vler\u00eb totale prej 4.8 milion\u00eb euro.<\/span><\/p>\n<p><b>Urgjenc\u00eb apo munges\u00eb planifikimi?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">K\u00ebto dy kontrata milion\u00ebshe, n\u00eb funksion t\u00eb funksionimit t\u00eb pand\u00ebrprer\u00eb t\u00eb termocentralit REK Manastir, vijn\u00eb n\u00eb nj\u00eb koh\u00eb t\u00eb kriz\u00ebs s\u00eb r\u00ebnd\u00eb energjetike, kur buxheti i shtetit ndihmoi likuiditetin e ESM-s\u00eb, p\u00ebr t\u00eb rritur prodhimin vendas t\u00eb energjis\u00eb elektrike, sepse rezervat e qymyrit jan\u00eb n\u00eb r\u00ebnie, importet e qymyrit nga jasht\u00eb po ecin me v\u00ebshtir\u00ebsi, kurse \u00e7mimet e energjis\u00eb elektrike n\u00eb bursat nd\u00ebrkomb\u00ebtare jan\u00eb rritur deri n\u00eb qiell.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Si\u00e7 <\/span><a href=\"https:\/\/fokus.mk\/esm-objasnuva-zoshto-sprovede-itna-postapka-za-iskop-vo-rek\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">sqarojn\u00eb<\/span><\/a><span style=\"font-weight: 400;\"> nga ESM-ja, ata \u00ebsht\u00eb dashur t\u00eb kryejn\u00eb prokurime pa shpallur konkurs, pasi Qeveria i ka obliguar q\u00eb n\u00eb periudh\u00ebn janar-qershor 2022, n\u00eb vend t\u00eb 60 p\u00ebr qind t\u00eb parashikuar me ligj, t\u00eb sigurojn\u00eb 100 p\u00ebr qind t\u00eb sasis\u00eb s\u00eb nevojshme t\u00eb energjis\u00eb elektrike p\u00ebr furnizuesin universal EVN Home, e cila, nga ana tjet\u00ebr, furnizon me energji elektrike amvis\u00ebrit\u00eb dhe konsumator\u00ebt e vegj\u00ebl.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Por pyetja kryesore nuk \u00ebsht\u00eb n\u00ebse shteti duhet t\u00eb mbronte interesat e qytetar\u00ebve, por n\u00ebse mund t\u00eb parashikohej rrjedha e ngjarjeve dhe t\u00eb ishin planifikuar m\u00eb mir\u00eb shpenzimet e fondeve publike? Pse ESM-ja nuk ka filluar m\u00eb par\u00eb procedur\u00ebn e zakonshme t\u00eb hapur t\u00eb tenderimit, ku do t\u00eb paraqiten t\u00eb gjitha kompanit\u00eb e interesuara, n\u00eb vend q\u00eb t\u00eb th\u00ebrrasin urgjentisht disa kompani p\u00ebrmes nj\u00eb procedure urgjente?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nuk ka dyshim se vendi po p\u00ebrballet me nj\u00eb kriz\u00eb t\u00eb r\u00ebnd\u00eb, por duhet ditur se kriza nuk ka nisur brenda nat\u00ebs, por zgjat disa muaj n\u00eb vend dhe n\u00eb mbar\u00eb Evrop\u00ebn.
