Megjithat\u00eb, p\u00ebr shkak t\u00eb mospajtimeve t\u00eb m\u00ebdha nd\u00ebrmjet partive politike, nj\u00eb reform\u00eb e till\u00eb nuk b\u00ebhej. Vet\u00ebm n\u00eb tre vjet\u00ebt e fundit, Projektligji p\u00ebr Zgjedhjet e P\u00ebrgjithshme \u00ebsht\u00eb proceduar m\u00eb shum\u00eb se\u00a0<a href=\"https:\/\/www.kuvendikosoves.org\/shq\/projektligjet-dhe-ligjet\/\">tri her\u00eb\u00a0<\/a>n\u00eb Kuvend, por asnj\u00ebher\u00eb nuk kishte arritur n\u00eb pik\u00ebn p\u00ebrfundimtare p\u00ebr miratim n\u00eb seanc\u00eb plenare, si rezultat i moskonsensusit politik.<\/p>\n<p>P\u00ebr dallim nga vitet e kaluara, k\u00ebt\u00eb vit duket se reforma zgjedhore shkoi n\u00eb finale. Nga diskutimet n\u00eb Komisionin Ad-Hoc p\u00ebr reform\u00ebn zgjedhore, vazhdimisht \u00ebsht\u00eb v\u00ebrejtur se k\u00ebsaj here projektligji do t\u00eb miratohej me konsensus t\u00eb plot\u00eb.<\/p>\n<p>Dhe k\u00ebshtu ndodhi. T\u00eb gjitha partit\u00eb politike n\u00eb seanc\u00ebn plenare m\u00eb 8 qershor 2023 votuan projektligjin n\u00eb parim,\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=L4y9TVzzE5E\">me gjithsej 86 deputet\u00eb t\u00eb pranish\u00ebm dhe q\u00eb votuan p\u00ebr<\/a>, dhe n\u00eb nj\u00eb seanc\u00eb t\u00eb dyt\u00eb me 79 vota p\u00ebr, Kuvendi miratoi k\u00ebt\u00eb projektligj edhe n\u00eb shqyrtim t\u00eb dyt\u00eb.<\/p>\n<p>Votimi i tij u b\u00eb me procedur\u00eb t\u00eb p\u00ebrshpejtuar p\u00ebrmes shmangies s\u00eb afateve t\u00eb parapara me Rregulloren e Kuvendit, p\u00ebrkund\u00ebr faktit q\u00eb miratimi i projektligjeve me r\u00ebnd\u00ebsi jetike \u00ebsht\u00eb kritikuar n\u00eb\u00a0<a href=\"https:\/\/neighbourhood-enlargement.ec.europa.eu\/system\/files\/2022-10\/Kosovo%20Report%202022.pdf\">Raportin p\u00ebr Progresin p\u00ebr Kosov\u00ebn p\u00ebr vitin 2022 nga Komisionin Europian<\/a>.<\/p>\n<p>Projektligji i miratuar nuk p\u00ebrb\u00ebn reform\u00eb sa i p\u00ebrket p\u00ebrfaq\u00ebsimit t\u00eb barabart\u00eb gjinor, \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me vet\u00eb Kushtetut\u00ebn dhe me Ligjin p\u00ebr Barazi Gjinore, i cili k\u00ebrkon p\u00ebrfaq\u00ebsim 50% t\u00eb gjinis\u00eb s\u00eb kund\u00ebrt.<\/p>\n<p>Deri m\u00eb tani legjislacioni kosovar \u00ebsht\u00eb bazuar n\u00eb krijimin e masave afirmative p\u00ebr barazin\u00eb gjinore. Ato jan\u00eb par\u00eb si legjitime p\u00ebr parimin e mosdiskriminimit p\u00ebr aq koh\u00eb sa ato jan\u00eb proporcionale.<\/p>\n<p>Pjes\u00eb shum\u00eb e r\u00ebnd\u00ebsishme e k\u00ebsaj infrastrukture ligjore kosovare mbi barazin\u00eb gjinore \u00ebsht\u00eb Pakoja e Ligjeve Kund\u00ebr Diskriminimit, q\u00eb \u00ebsht\u00eb miratuar n\u00eb vitin 2015, ku b\u00ebjn\u00eb pjes\u00eb:\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=10924\">Ligji Kund\u00ebr Diskriminimit (LKD)<\/a>,\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=10922\">Ligji p\u00ebr Ombudspersonin (LAP)<\/a>\u00a0and\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=10923\">Ligji p\u00ebr Barazi Gjinore (LBGJ).<\/a>\u00a0T\u00eb gjitha k\u00ebto ligje formalisht garantojn\u00eb t\u00eb drejta t\u00eb barabarta t\u00eb pjes\u00ebmarrjes n\u00eb jet\u00ebn publike t\u00eb qytetar\u00ebve t\u00eb vendit.<\/p>\n<p>Projektligji i sponsorizuar nga Komisioni Ad-Hoc nuk ka marr\u00eb parasysh nj\u00eb informat\u00eb kritike se Ligji p\u00ebr Barazi Gjinore \u00ebsht\u00eb ligj special. Sipas standardit nd\u00ebrkomb\u00ebtarisht t\u00eb njohur, lex specialis derogat lex generali, \u00e7do ndryshim i LBGJ afekton dispozitat e ligjeve t\u00eb tjera t\u00eb p\u00ebrgjithshme q\u00eb bien n\u00eb kund\u00ebrshtim me t\u00eb.<\/p>\n<p>N\u00eb rastin konkret, secila dispozit\u00eb n\u00eb LBGJ afekton dhe i b\u00ebn pa efekt dispozitat e ligjeve mbi kuotat gjinore q\u00eb ekzistojn\u00eb n\u00eb Ligjin p\u00ebr Zgjedhjet e P\u00ebrgjithshme, si dhe n\u00eb Projektligjin p\u00ebr zgjedhjet e p\u00ebrgjithshme, tashm\u00eb t\u00eb miratuar.<\/p>\n<p>LBZ \u00ebsht\u00eb dashur q\u00eb t\u00eb p\u00ebrdorej si ligj special, q\u00eb t\u00eb sigurohet pjes\u00ebmarrja e barabart\u00eb n\u00eb listat zgjedhore si paramet\u00ebr mat\u00ebs p\u00ebr harmonizim t\u00eb tij me ligjet e tjera sektoriale q\u00eb jan\u00eb ky\u00e7 p\u00ebr afirmimin dhe realizmin e plot\u00eb t\u00eb barazis\u00eb gjinore.<\/p>\n<p>Projektligji i miratuar nuk e zvog\u00eblon deficitin e pjes\u00ebmarrjes s\u00eb grave n\u00eb listat zgjedhore dhe ky projektligj nuk harmonizohet me\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=10923\">Nenin 6, paragrafi 2.1, 7 dhe 8 Ligjit p\u00ebr Barazi Gjinore<\/a>, dhe \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn dhe me konventat t\u00eb cilat zbatohen drejtp\u00ebrdrejt n\u00eb Kosov\u00eb.<\/p>\n<p>Projektligji i miratuar nuk prek ndryshime rr\u00ebnj\u00ebsore sa i p\u00ebrket p\u00ebrfaq\u00ebsimit t\u00eb barabart\u00eb gjinor n\u00eb listat zgjedhore. N\u00eb fakt, dispozita e ligjit n\u00eb fuqi p\u00ebr zgjedhjet e p\u00ebrgjithshme p\u00ebr kuot\u00ebn gjinore \u00ebsht\u00eb b\u00ebr\u00eb pjes\u00eb e projektligjit q\u00eb synon reform\u00ebn zgjedhore\u00a0<em>copy-paste<\/em>.<\/p>\n<p>Sipas dispozit\u00ebs n\u00eb fuqi, p\u00ebrfaq\u00ebsimi i secil\u00ebs gjini do t\u00eb jet\u00eb s\u00eb paku 30%. Ajo \u00e7ka kan\u00eb b\u00ebr\u00eb subjektet politike deri m\u00eb tani \u00ebsht\u00eb se kan\u00eb respektuar pragun minimal prej m\u00eb paku 30% kandidateve gra n\u00eb listat e tyre. E nj\u00ebjta dispozit\u00eb \u00ebsht\u00eb b\u00ebr\u00eb pjes\u00eb e projektligjit t\u00eb miratuar.<\/p>\n<p>Projektligji adreson vet\u00ebm nj\u00eb \u00e7\u00ebshtje me r\u00ebnd\u00ebsi sa i p\u00ebrket buxhetimit gjinor, e cila \u00ebsht\u00eb e mir\u00eb, por adresimi i k\u00ebsaj problematike \u00ebsht\u00eb n\u00eb shuma minimale. Sipas k\u00ebtij projektligji, KQZ do t\u00eb ndaj\u00eb 1% t\u00eb shum\u00ebs s\u00eb p\u00ebrgjithshme t\u00eb alokuar p\u00ebr subjektin politik p\u00ebr secilin mandat t\u00eb fituar nga grat\u00eb mbi kuot\u00ebn 30% n\u00eb momentin e certifikimit.<\/p>\n<p>Projektligji p\u00ebr Zgjedhjet e P\u00ebrgjithshme, sa i p\u00ebrket p\u00ebrfaq\u00ebsimit t\u00eb barabart\u00eb gjinor, nuk b\u00ebn p\u00ebrpjekje serioze p\u00ebr t\u2019i zbatuar parimet nd\u00ebrkomb\u00ebtare p\u00ebr barazin\u00eb gjinore. N\u00eb k\u00ebt\u00eb kuptim, moskalimi nga kuota prej 30% n\u00eb 50% p\u00ebrb\u00ebn veprim kund\u00ebr detyrimeve p\u00ebr t\u00eb krijuar kushte t\u00eb dosmosdoshme p\u00ebr pjes\u00ebmarrje efektive dhe t\u00eb barabart\u00eb t\u00eb grave n\u00eb jet\u00ebn publike kosovare.<\/p>\n<p>According to\u00a0<a href=\"https:\/\/www.kuvendikosoves.org\/Uploads\/Data\/Files\/5\/KushtetutaeRepublikesseKosovesmeamendamentetI-XXV_LhUTS2m6dV.pdf\">Kushtetut\u00ebs s\u00eb Kosov\u00ebs<\/a>, \u201c<em>p\u00ebrb\u00ebrja e Kuvendit t\u00eb Kosov\u00ebs do t\u00eb respektoj\u00eb parimet e barazis\u00eb gjinore t\u00eb cilat duhet t\u00eb jen\u00eb n\u00eb pajtim me parimet nd\u00ebrkomb\u00ebtare<\/em>.\u201d<\/p>\n<p>Kosova ka marr\u00eb p\u00ebrsip\u00ebr p\u00ebrmbushjen e kritereve t\u00eb caktuara q\u00eb rrjedhin si pasoj\u00eb e p\u00ebrfshirjes s\u00eb k\u00ebtyre konventave. N\u00eb rastin konkret, ne kemi adaptuar te Neni 22 Konvent\u00ebn p\u00ebr Eliminimin e t\u00eb gjitha Formave t\u00eb Diskriminimit ndaj Gruas.<\/p>\n<p>Neni 2 i Konvent\u00ebs p\u00ebrmend obligimin e shteteve q\u00eb t\u00eb p\u00ebrfshijn\u00eb parimin e barazis\u00eb nd\u00ebrmjet burrit dhe gruas, por edhe obligimin e shteteve q\u00eb ato duhet t\u00eb ofrojn\u00eb sigurin\u00eb q\u00eb\u00a0<a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/Documents\/ProfessionalInterest\/cedaw.pdf\">n\u00ebp\u00ebrmjet legjislacionit dhe masave t\u0451 tjera t\u00eb p\u00ebrshtatshme ta vendosin zbatimin n\u00eb praktik\u00eb t\u00eb k\u00ebtij parimi<\/a>.<\/p>\n<p>Masat e tilla p\u00ebrfshijn\u00eb pjes\u00ebmarrjen efektive n\u00eb jet\u00ebn politike, shoq\u00ebrore, ekonomike dhe kulturore, \u201cduke p\u00ebrfshir\u00eb edhe legjislacionin, p\u00ebr t\u00eb siguruar zhvillimin e plot\u0451 dhe p\u0451rparimin e grave me q\u00ebllim q\u00eb t&#8217;u garantojn\u0451 atyre ushtrimin dhe g\u00ebzimin e t\u00eb drejtave e t\u00eb lirive themelore t\u0451 njeriut mbi baz\u00ebn e barazis\u00eb me burrat.\u201d<\/p>\n<p>Kjo pjes\u00ebmarrje ka r\u00ebnd\u00ebsi p\u00ebr t\u00eb qen\u00eb hisedar\u00eb n\u00eb jet\u00ebn publike. Q\u00eb kjo t\u00eb ndodh\u00eb duhet t\u00eb ekzistojn\u00eb mjete t\u00eb shtetit dhe masa t\u00eb posa\u00e7me q\u00eb garantojn\u00eb dhe sigurojn\u00eb p\u00ebrfaq\u00ebsimin e barabart\u00eb gjinor.<\/p>\n<p>Partit\u00eb politike t\u00eb p\u00ebrfaq\u00ebsuara n\u00eb Kuvend e kan\u00eb detyrim q\u00eb t\u00eb propozojn\u00eb dhe t\u00eb miratojn\u00eb politika t\u00eb p\u00ebrshtatshme legjislative. N\u00eb k\u00ebt\u00eb drejtim, duke propozuar ndryshime ligjore t\u00eb ve\u00e7anta dhe t\u00eb p\u00ebrkohshme t\u00eb rritjes s\u00eb kuot\u00ebs n\u00eb 50%, sepse p\u00ebrmes pranis\u00eb s\u00eb barabart\u00eb t\u00eb grave n\u00eb listat zgjedhore do t\u00eb eliminoheshin faktor\u00ebt socio-ekonomik\u00eb, kulturor\u00eb dhe politik\u00eb q\u00eb e pengojn\u00eb k\u00ebt\u00eb prani.<\/p>\n<p>N\u00eb mes t\u00eb dy leximeve, deputet\u00ebt e pat\u00ebn mund\u00ebsin\u00eb q\u00eb t\u00eb propozojn\u00eb amendament p\u00ebr ndryshimin dhe plot\u00ebsimin e Nenit 28, p\u00ebr rritjen e kuot\u00ebs n\u00eb p\u00ebrfaq\u00ebsim, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb tregohej se gruaja nuk \u00ebsht\u00eb vet\u00ebm p\u00ebr t\u2019u par\u00eb n\u00eb m\u00ebnyr\u00eb simbolike te pozitat politike p\u00ebrfaq\u00ebsuese.
