Cenimi i siguris\u00eb juridike t\u00eb n\u00ebpun\u00ebsve t\u00eb sektorit publik, trajtimi i pabarabart\u00eb i tyre n\u00eb disa raste dhe cenimi i pavar\u00ebsis\u00eb funksionale t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb, jan\u00eb vet\u00ebm disa nga problemet serioze q\u00eb p\u00ebrmban ky ligj.<\/p>\n<p>Pavar\u00ebsisht defekteve t\u00eb ligjit n\u00eb fjal\u00eb, deputet\u00ebt si pal\u00eb e autorizuar p\u00ebr ta kontestuar ligjin n\u00eb Gjykat\u00ebn Kushtetuese, vendos\u00ebn t\u00eb heshtin.<\/p>\n<p>Kalkulimet politike se si do t\u00eb ndikonte n\u00eb elektorat n\u00ebse d\u00ebrgohet ky ligj n\u00eb Gjykat\u00ebn Kushtetuese, duke e ditur q\u00eb ligji ka karakter popullor dhe ndikon direkt n\u00eb xhepin e qytetar\u00ebve, b\u00ebri q\u00eb partit\u00eb opozitare n\u00eb Kuvend t\u00eb mb\u00ebshtesin k\u00ebt\u00eb ligj n\u00eb m\u00ebnyr\u00eb t\u00eb heshtur, duke mos e kontestuar at\u00eb.<\/p>\n<p>Tashm\u00eb shpresa ka mbetur tek Avokati i Popullit, i cili ka pranuar\u00a0<a href=\"https:\/\/betimiperdrejtesi.com\/arrin-ne-45-numri-i-ankesave-kunder-ligjit-te-pagave\/\">45 ankesa<\/a>\u00a0nga institucione t\u00eb ndryshme t\u00eb sektorit publik. Kompetenc\u00eb dhe detyr\u00eb kushtetuese e avokatit t\u00eb popullit \u00ebsht\u00eb ta d\u00ebrgoj\u00eb k\u00ebt\u00eb ligj n\u00eb Gjykat\u00ebn Kushtetuese, brenda 6 muajsh nga data e hyrjes n\u00eb fuqi.<\/p>\n<p>Ndon\u00ebse ligji cenon t\u00eb drejtat e punonj\u00ebsve t\u00eb sektor\u00ebve t\u00eb ndrysh\u00ebm, fokusi i k\u00ebtij shkrimi do t\u00eb jet\u00eb n\u00eb ndikimin q\u00eb ky ligj do t\u00eb ket\u00eb n\u00eb arsimin e lart\u00eb n\u00eb Kosov\u00eb.<\/p>\n<p><strong>Degradimi i kushteve dhe pozitave n\u00eb arsimin e lart\u00eb<\/strong><\/p>\n<p>Ligji p\u00ebr Arsimin e Lart\u00eb garanton mb\u00ebshtetjen financiare p\u00ebr institucionet e arsimit t\u00eb lart\u00eb p\u00ebr hulumtim dhe shkenc\u00eb (jasht\u00eb pag\u00ebs baz\u00eb p\u00ebr personelin akademik), nd\u00ebrsa Ligji (i ri) p\u00ebr Paga n\u00eb sektorin publik shfuqizon t\u00eb gjitha aktet e tjera q\u00eb rregullojn\u00eb \u00e7\u00ebshtjen e pagave, shp\u00ebrblimeve dhe shtesave, duke p\u00ebrfshir\u00eb edhe mb\u00ebshtetjen p\u00ebr pun\u00ebn k\u00ebrkimore\/hulumtuese.<\/p>\n<p>N\u00eb k\u00ebndv\u00ebshtrimin juridik, \u00ebsht\u00eb e palogjikshme q\u00eb nj\u00eb ligj q\u00eb votohet me shumic\u00eb t\u00eb thjesht\u00eb t\u00eb shfuqizoj\u00eb dispozita juridike t\u00eb nj\u00eb ligji (Ligji p\u00ebr Arsimin e Lart\u00eb) q\u00eb ka status m\u00eb t\u00eb lart\u00eb kushtetues dhe b\u00ebn pjes\u00eb n\u00eb legjislacionin me interes vital sipas\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=3702\">nenit 81<\/a>\u00a0t\u00eb Kushtetut\u00ebs s\u00eb Kosov\u00ebs.<\/p>\n<p>Duke pasur parasysh q\u00eb pagat baz\u00eb t\u00eb profesor\u00ebve universitar\u00eb\u00a0<a href=\"https:\/\/www.gazetaexpress.com\/me-koeficientin-e-ri-ministrave-iu-rritet-paga-e-profesoreve-iu-ulet\/\">jan\u00eb ulur<\/a>\u00a0(p\u00ebr profesor\u00ebt e rregullt 200 euro m\u00eb pak, p\u00ebr profesor\u00ebt e asocuar 150 euro m\u00eb pak, p\u00ebr profesor\u00ebt asistent\u00eb 100 euro m\u00eb pak), mb\u00ebshtetja financiare p\u00ebr k\u00ebrkime dhe hulumtime \u00ebsht\u00eb ndalur, shtesat p\u00ebr mentorim t\u00eb temave t\u00eb diplom\u00ebs jan\u00eb ndalur gjithashtu, \u00ebsht\u00eb e pritshme q\u00eb cil\u00ebsia t\u00eb bjer\u00eb, sepse p\u00ebrkushtimi dhe vullneti p\u00ebr pun\u00eb do t\u00eb jet\u00eb m\u00eb i vog\u00ebl.<\/p>\n<p>Sa u p\u00ebrket pozitave udh\u00ebheq\u00ebse, legjislacioni i ri p\u00ebr \u00e7\u00ebshtjen e pagave ka parapar\u00eb nj\u00eb shtes\u00eb 20% t\u00eb pag\u00ebs baz\u00eb p\u00ebr funksionin si Rektor, 18% si Prorektor, 17% si Dekan dhe 15% si Prodekan.<\/p>\n<p>Me k\u00ebt\u00eb rregullim t\u00eb ri, vullneti i personelit akademik q\u00eb t\u00eb bart\u00eb pozitat udh\u00ebheq\u00ebse t\u00eb lartp\u00ebrmendura \u2013 t\u00eb cilat kan\u00eb p\u00ebrgjegj\u00ebsi t\u00eb madhe por kompensim t\u00eb vog\u00ebl \u2013 do t\u00eb jet\u00eb m\u00eb i ul\u00ebt. Pra, nuk do t\u00eb ket\u00eb gar\u00eb t\u00eb fort\u00eb me alternativa cil\u00ebsore p\u00ebr t\u00eb udh\u00ebhequr me k\u00ebto pozita.<\/p>\n<p>Kjo mund t\u00eb ndikoj\u00eb seriozisht n\u00eb cil\u00ebsin\u00eb e arsimit t\u00eb lart\u00eb n\u00eb vend, q\u00eb ve\u00e7se \u00ebsht\u00eb n\u00eb gjendje jo t\u00eb k\u00ebnaqshme.<\/p>\n<p><strong>Ndikimi n\u00eb cil\u00ebsin\u00eb e arsimit t\u00eb lart\u00eb<\/strong><\/p>\n<p>Veprimtaria k\u00ebrkimore-shkencore e personelit akademik (profesor\u00ebve universitar\u00eb) nuk p\u00ebrmbyllet me tet\u00eb or\u00eb pune, pasi \u00ebsht\u00eb pun\u00eb e vazhdueshme. P\u00ebr t\u00eb marr\u00eb titujt akademik\u00eb brenda universiteteve ka kritere q\u00eb duhen plot\u00ebsuar, q\u00eb n\u00ebnkupton se duhet pun\u00eb e bujshme n\u00eb aspektin shkencor, e cila padyshim q\u00eb k\u00ebrkon mb\u00ebshtetje financiare.<\/p>\n<p>Kur paga baz\u00eb \u00ebsht\u00eb zbritur, normalisht \u00ebsht\u00eb m\u00eb i ul\u00ebt dhe vullneti n\u00eb avancimin e pun\u00ebs k\u00ebrkimore-hulumtuese, andaj pritshm\u00ebrit\u00eb jan\u00eb t\u00eb vogla sa i p\u00ebrket cil\u00ebsis\u00eb s\u00eb studimeve.<\/p>\n<p>Mes t\u00eb tjerash, personeli akademik (profesor\u00ebt universitar\u00eb) shpeshher\u00eb jan\u00eb t\u00eb zgjedhur dhe t\u00eb angazhuar n\u00eb organe\/komisione vendimmarr\u00ebse brenda universiteteve, pa t\u00eb cilat nuk mund t\u00eb funksionojn\u00eb institucionet e arsimit t\u00eb lart\u00eb.\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=68695\">Rregullorja p\u00ebr kompensimin p\u00ebr funksionin shtes\u00eb<\/a>, kufizon n\u00eb mas\u00eb t\u00eb madhe pages\u00ebn e an\u00ebtar\u00ebve q\u00eb jan\u00eb pjes\u00eb e k\u00ebtyre komisioneve.<\/p>\n<p>Jo vet\u00ebm n\u00eb universitete, por n\u00eb \u00e7do institucion pun\u00ebtor\u00ebt paguhen p\u00ebr detyrimet q\u00eb rrjedhin nga kontrata e pun\u00ebs, andaj angazhimet shtes\u00eb q\u00eb i kan\u00eb jasht\u00eb kontrat\u00ebs duhen paguar, duke u mb\u00ebshtetur n\u00eb legjislacionin vendor dhe nd\u00ebrkomb\u00ebtar, q\u00eb rregullojn\u00eb marr\u00ebdh\u00ebnien e pun\u00ebs.<\/p>\n<p>Do t\u00eb jet\u00eb sfiduese p\u00ebr universitetet q\u00eb t\u00eb gjejn\u00eb personel p\u00ebr t\u00eb angazhuar n\u00eb komisione q\u00eb p\u00ebrb\u00ebjn\u00eb pun\u00eb shtes\u00eb dhe q\u00eb nuk paguhen, duke mos harruar q\u00eb k\u00ebto organe\/komisione t\u00eb brendshme t\u00eb universiteteve jan\u00eb t\u00eb domosdoshme p\u00ebr funksionimin normal t\u00eb k\u00ebtyre institucioneve t\u00eb dijes.<\/p>\n<p>Nj\u00eb problem tjet\u00ebr i duksh\u00ebm \u00ebsht\u00eb mungesa e cil\u00ebsis\u00eb s\u00eb temave t\u00eb diplomave, por n\u00ebse mendohet se zgjidhja e problemit \u00ebsht\u00eb duke i hequr pagesat p\u00ebr mentorim dhe p\u00ebr komisionin vler\u00ebsues, \u00ebsht\u00eb gabim fatal sepse kjo do t\u00eb rris\u00eb edhe m\u00eb shum\u00eb problemin n\u00eb fjal\u00eb. N\u00ebse deri m\u00eb tani ka pasur tema t\u00eb diplom\u00ebs q\u00eb jan\u00eb jocil\u00ebsore, numri i tyre ve\u00e7se do t\u00eb rritet.<\/p>\n<p>Ky ligj dhe aktet e tjera n\u00ebnligjore kan\u00eb goditur n\u00eb palc\u00eb institucionet e arsimit t\u00eb lart\u00eb, cil\u00ebsin\u00eb e studimeve dhe veprimtarin\u00eb shkencore-k\u00ebrkimore.
