{"id":916,"date":"2023-01-27T13:38:09","date_gmt":"2023-01-27T13:38:09","guid":{"rendered":"https:\/\/sbunker.org\/?p=916"},"modified":"2023-12-05T15:20:57","modified_gmt":"2023-12-05T14:20:57","slug":"zyrtaret-publike-ne-kosove-nen-meshiren-e-gjykates-kushtetuese","status":"publish","type":"post","link":"https:\/\/sbunker.org\/en\/opinion\/zyrtaret-publike-ne-kosove-nen-meshiren-e-gjykates-kushtetuese\/","title":{"rendered":"Zyrtar\u00ebt publik\u00eb n\u00eb Kosov\u00eb, \u201cn\u00ebn m\u00ebshir\u00ebn\u201d e Gjykat\u00ebs Kushtetuese"},"content":{"rendered":"<p>Viti 2023 i priti zyrtar\u00ebt publik\u00eb me dy ligje t\u00eb reja q\u00eb u aprovuan n\u00eb Kuvendin e Kosov\u00ebs:\u00a0<a href=\"https:\/\/www.kuvendikosoves.org\/Uploads\/Data\/Documents\/PLperzyrtaretpublik_mmuNTr6dxc.pdf?__cf_chl_rt_tk=UIgv96qw7835E56cikwcK9RipDYouYO9SMwFPs3WjzA-1671785874-0-gaNycGzNCL0&amp;fbclid=IwAR02iQj9IR6xBrZAa2GHLFmdSkNvUGtx4dhGz7FnkMIGSVdELiYNYAOhQCc\">Ligjin p\u00ebr Zyrtar\u00ebt Publik<\/a>\u00eb,q\u00eb rregullon t\u00eb drejtat dhe detyrimet dhe marr\u00ebdh\u00ebnien e pun\u00ebs t\u00eb zyrtar\u00ebve publik\u00eb n\u00eb institucionet e Kosov\u00ebs dhe\u00a0<a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=68695\">Ligjin 08\/L-196 p\u00ebr Paga n\u00eb Sektorin Publik<\/a>, i cili rregullon parimet dhe rregullat p\u00ebr p\u00ebrcaktimin e pag\u00ebs dhe shp\u00ebrblimeve n\u00eb sektorin publik.<\/p>\n<p>Kryeministri Kurti vler\u00ebsoi miratimin e ligjeve si \u201c<a href=\"https:\/\/www.epokaere.com\/kryeministri-kurti-ligji-per-zyrtaret-publike-dhe-ai-per-pagat-hap-i-madh-perpara-ndryshimit-thelbesor\/\">hap t\u00eb madh drejt reform\u00ebs s\u00eb administrat\u00ebs publike<\/a>\u201d, megjithat\u00eb p\u00ebrmbajtja e tyre hedh pik\u00ebpyetjen n\u00ebse k\u00ebto ligje mund t\u00eb konsiderohen si reforma apo regres.<\/p>\n<p>Reagime dhe kritika lidhur me k\u00ebto dy ligje ka pasur mjaft shum\u00eb, kryesisht nga partit\u00eb opozitare, shoq\u00ebria civile dhe Zyra e BE-s\u00eb n\u00eb Kosov\u00eb, si p\u00ebr faz\u00ebn e konsultimeve publike gjat\u00eb hartimit t\u00eb tij, ashtu edhe p\u00ebr p\u00ebrmbajtjen e ligjeve.<\/p>\n<p>Sipas tyre, Qeveria nuk ka marr\u00eb p\u00ebr baz\u00eb\u00a0<a href=\"https:\/\/www.koha.net\/arberi\/358309\/be-ja-e-shqetesuar-per-ligjin-per-paga-dhe-ate-per-zyrtaret-publike\/\">asnj\u00eb sugjerim t\u00eb tyre<\/a>, madje nuk ka as arsyetime pse jan\u00eb injoruar komentet e tyre. Kjo qasje nuk p\u00ebrmbush standardet minimale t\u00eb konsultimit publik.<\/p>\n<p>Si rezultat,\u00a0<a href=\"https:\/\/kallxo.com\/lajm\/pdk-dorezoi-ne-kushtetuese-ligjin-per-zyrtaret-publike\/\">deputet\u00ebt e PDK-s\u00eb<\/a>\u00a0kan\u00eb kontestuar Ligjin p\u00ebr Zyrtar\u00ebt Publik\u00eb n\u00eb Gjykat\u00ebn Kushtetuese (GjK), nd\u00ebrsa Ligji p\u00ebr Paga n\u00eb Sektorin Publik ende nuk \u00ebsht\u00eb kontestuar, me gjith\u00eb faktin se organizata IKD\u00a0<a href=\"https:\/\/www.koha.net\/arberi\/360150\/ikd-ja-i-kerkon-avokatit-te-popullit-qe-ta-deponoje-ne-kushtetuese-ligjin-per-pagat\/\">i ka b\u00ebr\u00eb thirrje Avokatit t\u00eb Popullit<\/a>\u00a0(si pal\u00eb e autorizuar) p\u00ebr ta d\u00ebrguar k\u00ebt\u00eb ligj n\u00eb Gjykat\u00ebn Kushtetuese, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb sigurohet p\u00ebrputhshm\u00ebria e tij me Kushtetut\u00ebn.<\/p>\n<p>Mir\u00ebpo, ekziston nj\u00eb arsye pse partit\u00eb opozitare, p\u00ebrkat\u00ebsisht deputet\u00ebt e opozit\u00ebs, nuk e kontestuan Ligjin p\u00ebr Paga n\u00eb Sektorin Publik.<\/p>\n<p>Kjo mund t\u00eb jet\u00eb strategji politike e opozit\u00ebs, duke pasur parasysh q\u00eb me paga \u00ebsht\u00eb b\u00ebr\u00eb fushat\u00eb n\u00eb vazhdim\u00ebsi, andaj edhe kontestimi i k\u00ebtij ligji \u2013 q\u00eb supozohet se rrit pagat \u2013 mund t\u00eb jet\u00eb i disfarvorsh\u00ebm n\u00eb kuptimin elektoral.<\/p>\n<p>Me gjith\u00eb prapavij\u00ebn politike, Ligji p\u00ebr Zyrtar\u00ebt Publik\u00eb dhe Ligji p\u00ebr Paga n\u00eb Sektorin Publik p\u00ebrfshijn\u00eb disa defekte serioze.<\/p>\n<p><strong>Defektet n\u00eb Ligjin p\u00ebr Zyrtar\u00ebt Publik\u00eb<\/strong><\/p>\n<p>Rregullimi i Ligjit p\u00ebr Zyrtar\u00ebt Publik\u00eb \u00ebsht\u00eb nj\u00eb \u00e7\u00ebshtje mjaft komplekse, q\u00eb duhet rregulluar n\u00eb at\u00eb form\u00eb q\u00eb t\u00eb mos cenohet pavar\u00ebsia e administrat\u00ebs publike dhe t\u00eb m\u00ebnjanohet politizimi i saj.<\/p>\n<p>N\u00eb Ligjin p\u00ebr Zyrtar\u00ebt Publik\u00eb ekzistojn\u00eb nene t\u00eb cilat kan\u00eb munges\u00eb serioze t\u00eb harmonizimit dhe shfaqin kontradikta mes dispozitave ligjore.<\/p>\n<p>P\u00ebrderisa Neni 46.1 specifikon qart\u00eb se mandati p\u00ebr pozita t\u00eb nivelit t\u00eb ul\u00ebt dhe t\u00eb mes\u00ebm drejtues \u00ebsht\u00eb kat\u00ebr vjet me t\u00eb drejt\u00eb rizgjedhjeje vet\u00ebm nj\u00eb her\u00eb (pra, m\u00eb s\u00eb shumti dy mandate \u2013 tet\u00eb vjet), Neni 46.7 p\u00ebrcakton se pas p\u00ebrfundimit t\u00eb mandatit dyt\u00eb i nj\u00ebjti mund t\u00eb konkurroj\u00eb p\u00ebr t\u00eb nj\u00ebjt\u00ebn pozit\u00eb q\u00eb e ka mbajtur.<\/p>\n<p>Ky nen, p\u00ebrve\u00e7q\u00eb cenon administrat\u00ebn publike, hartimi i tij n\u00eb k\u00ebt\u00eb form\u00eb tregon munges\u00eb serioze t\u00eb profesionalizmit nga sponsorizuesit e k\u00ebtij ligji.<\/p>\n<p>Kjo dispozit\u00eb minon ambiciet e profesionist\u00ebve t\u00eb pun\u00ebsuar n\u00eb administrat\u00eb publike p\u00ebr ngritje n\u00eb karrier\u00eb dhe hap rrug\u00eb p\u00ebr politizim me k\u00ebto pozita. Sh\u00ebrbimi civil \u00ebsht\u00eb sh\u00ebrbim i p\u00ebrhersh\u00ebm dhe si i till\u00eb duhet trajtuar.<\/p>\n<p>P\u00ebr profesionist\u00ebt q\u00eb kan\u00eb menduar t\u00eb krijojn\u00eb karrier\u00eb n\u00eb administrat\u00eb publike, q\u00ebndrimi n\u00eb k\u00ebto institucione nuk do t\u00eb shihet si mund\u00ebsi, andaj rezultati do t\u00eb jet\u00eb krijimi i nj\u00eb administrate shtet\u00ebrore t\u00eb dob\u00ebt, joprofesionale dhe politike.<\/p>\n<p><strong>Defektet n\u00eb Ligjin e Pagave n\u00eb Sektorin Publik\u00a0<\/strong><\/p>\n<p>Ligji i Pagave n\u00eb Sektorin Publik, i\u00a0<a href=\"https:\/\/kallxo.com\/lajm\/presidentja-osmani-dekreton-ligjin-per-paga-ne-sektorin-publik\/\">dekretuar nga presidentja<\/a>\u00a0me dat\u00eb 4 janar 2023, pritet t\u00eb hyj\u00eb n\u00eb fuqi m\u00eb 5 shkurt. Deri m\u00eb tash ky ligj nuk \u00ebsht\u00eb kontestuar nga asnj\u00eb pal\u00eb e autorizuar (Kuvendi, Qeveria, Presidenti dhe Avokati i Popullit)\u00a0n\u00eb Gjykat\u00ebn Kushtetuese.<\/p>\n<p>Ndon\u00ebse supozohet se i nj\u00ebjti do t\u2019u rris\u00eb pagat shum\u00eb sektor\u00ebve \u2013 mbi t\u00eb gjitha do t\u2019i nivelizoj\u00eb ata \u2013 \u00ebsht\u00eb mjaft e dyshimt\u00eb n\u00ebse ky nivelizim do t\u00eb p\u00ebrcillet duke u bazuar n\u00eb parimet e drejt\u00ebsis\u00eb dhe barazis\u00eb.<\/p>\n<p>Kan\u00eb mbetur edhe disa dit\u00eb nga hyrja n\u00eb fuqi e k\u00ebtij ligji, por t\u00eb prekurit e k\u00ebtij ligji, pra zyrtar\u00ebt publik\u00eb, ende nuk e din\u00eb se sa do t\u00eb jet\u00eb paga e tyre.<\/p>\n<p>Neni 9.1 i k\u00ebtij Ligji p\u00ebrcakton:\u00a0<em>\u201cVlera monetare e koeficientit p\u00ebrcaktohet me ligjin vjetor t\u00eb buxhetit. P\u00ebrcaktimi i vler\u00ebs s\u00eb koeficientit b\u00ebhet n\u00eb pajtim me legjislacionin p\u00ebr menaxhimin e financave publike.\u201d<\/em><\/p>\n<p>Kjo dispozit\u00eb \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me parimin e parashikueshm\u00ebris\u00eb dhe cenon sigurin\u00eb juridike. Sipas k\u00ebsaj dispozite nuk do t\u00eb ket\u00eb stabilitet t\u00eb pagave, sepse var\u00ebsisht prej Ligjit p\u00ebr Buxhetin, koeficienti mund t\u00eb ndryshoj\u00eb vazhdimisht dhe po ashtu edhe paga.<\/p>\n<p>Nj\u00eb problem tjet\u00ebr n\u00eb k\u00ebt\u00eb ligj \u00ebsht\u00eb fakti q\u00eb duke u munduar t\u00eb krijohet barazi \u00ebsht\u00eb krijuar pabarazi.<\/p>\n<p>Mund t\u00eb arsyetohet dallimi n\u00eb paga t\u00eb stafit politik n\u00eb nivelin lokal (kryetar komune, drejtor komunal, k\u00ebshilltar komunal), mes kryeqytetit n\u00eb nj\u00ebr\u00ebn an\u00eb dhe qyteteve t\u00eb tjera n\u00eb an\u00ebn tjet\u00ebr, var\u00ebsisht nga numri i banor\u00ebve q\u00eb p\u00ebrfaq\u00ebsojn\u00eb.<\/p>\n<p>Megjithat\u00eb, nuk arsyetohet fakti q\u00eb me t\u00eb nj\u00ebjtin standard t\u00eb vazhdohet edhe me n\u00ebpun\u00ebsit civil\u00eb q\u00eb punojn\u00eb n\u00eb komuna.
