P\u00ebrmes saj, pun\u00ebtor\u00ebt sjellin jo vet\u00ebm njohuri dhe aft\u00ebsi, por edhe q\u00ebndrueshm\u00ebri institucionale, nd\u00ebrsa qytetar\u00ebt p\u00ebrfitojn\u00eb nga sh\u00ebrbime publike m\u00eb cil\u00ebsore.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Me ardhjen n\u00eb pushtet t\u00eb Qeveris\u00eb Kurti, njohja e p\u00ebrvoj\u00ebs s\u00eb pun\u00ebs te zyrtar\u00ebt publik\u00eb u p\u00ebrgjysmua. Qeveria miratoi <\/span><b>Ligjin p\u00ebr Zyrtar\u00ebt Publik\u00eb<\/b><span style=\"font-weight: 400;\"> dhe <\/span><b>Ligjin p\u00ebr Paga n\u00eb Sektorin Publik<\/b><span style=\"font-weight: 400;\">, t\u00eb cil\u00ebt, n\u00eb vend se ta zgjidhin situat\u00ebn, krijuan probleme t\u00eb shumta ligjore e financiare.\u00a0<\/span><\/p>\n<h3><b>Ligji i Pagave t\u00eb N\u00ebpun\u00ebsve Civil\u00eb synon q\u00ebndrueshm\u00ebri institucionale duke vler\u00ebsuar p\u00ebrvoj\u00ebn e pun\u00ebs<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Prej m\u00eb shum\u00eb se nj\u00eb dekade, p\u00ebrvoja e pun\u00ebs ishte e mbrojtur dhe shp\u00ebrblyer me <\/span><a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=2678\" target=\"_blank\" rel=\"noopener\"><b>Ligjin e Pagave t\u00eb N\u00ebpun\u00ebsve Civil\u00eb<\/b><\/a><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"> i miratuar n\u00eb vitin 2010. Ky ligj kishte p\u00ebrcaktuar se paga mujore e \u00e7do sh\u00ebrbyesi civil do t\u00eb rritej me 0.5% p\u00ebr \u00e7do vit t\u00eb plot\u00eb t\u00eb pun\u00ebs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nj\u00eb politik\u00eb e till\u00eb synonte t\u00eb krijonte nj\u00eb administrat\u00eb m\u00eb t\u00eb q\u00ebndrueshme, ku p\u00ebrvoja dhe kontributi afatgjat\u00eb njiheshin financiarisht. Ishte nj\u00eb m\u00ebnyr\u00eb p\u00ebr t\u00eb motivuar pun\u00ebtor\u00ebt t\u00eb q\u00ebndronin brenda sistemit publik dhe p\u00ebr ta shmangur migrimin e ekspertiz\u00ebs drejt sektorit privat.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">P\u00ebr nj\u00eb administrat\u00eb publike t\u00eb re si ajo e Kosov\u00ebs, e cila po nd\u00ebrtohej pas pavar\u00ebsis\u00eb, ky ligj kishte r\u00ebnd\u00ebsi tejet strategjike. Edhe pse n\u00eb nivel minimal, rritja prej 0.5% p\u00ebr nj\u00eb vit t\u00eb p\u00ebrvoj\u00ebs s\u00eb pun\u00ebs i p\u00ebrfshinte at\u00ebbot\u00eb rreth 75 mij\u00eb zyrtar\u00eb publik\u00eb.<\/span><\/p>\n<h3><b>Qeveria Kurti vjen me ide t\u00eb reja, miraton ligje t\u00eb cilat e ulin shtes\u00ebn e bazuar n\u00eb p\u00ebrvoj\u00eb t\u00eb pun\u00ebs<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">N\u00eb mars t\u00eb vitit 2021, n\u00eb pushtet erdhi L\u00ebvizja Vet\u00ebvendosje, e cila prioritizoi krijimin e nj\u00eb sistemi m\u00eb transparent e m\u00eb t\u00eb drejt\u00eb p\u00ebr paga. Q\u00ebllimi ishte q\u00eb p\u00ebr pun\u00eb t\u00eb nj\u00ebjt\u00eb, punonj\u00ebsit t\u00eb merrnin pag\u00eb t\u00eb nj\u00ebjt\u00eb.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb k\u00ebt\u00eb drejtim, Qeveria Kurti miratoi dy ligje: <\/span><b>Ligjin p\u00ebr Zyrtar\u00ebt Publik\u00eb<\/b><span style=\"font-weight: 400;\"> dhe <\/span><b>Ligjin p\u00ebr Paga n\u00eb Sektorin Publik<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Por, n\u00eb vend se ta zgjidhnin problemin, k\u00ebto ligje soll\u00ebn sfidat dhe probleme t\u00eb shumta. Gjithashtu, k\u00ebto ligje bart\u00ebn probleme kushtetuese, duke p\u00ebrfshir\u00eb edhe dispozita t\u00eb marra nga projektligjet e m\u00ebparshme, q\u00eb m\u00eb par\u00eb ishin shpallur n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nj\u00ebri nga k\u00ebto ligje, ai p\u00ebr <\/span><a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=68695\" target=\"_blank\" rel=\"noopener\"><b>Pagat n\u00eb Sektorin Publik<\/b><\/a><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"> e p\u00ebrgjysmoi shtes\u00ebn p\u00ebr p\u00ebrvoj\u00ebn e pun\u00ebs p\u00ebr 15 vitet e para, nga 0.5% n\u00eb 0.25% p\u00ebr \u00e7do vit pune. Pas vitit t\u00eb 15-t\u00eb, shtesa mbetet 0.5% p\u00ebr \u00e7do vit sh\u00ebrbimi n\u00eb administrat\u00ebn publike.<\/span><\/p>\n<p><b>Kjo rezultoi n\u00eb nj\u00eb ulje t\u00eb p\u00ebrfitimit t\u00eb pun\u00ebtor\u00ebve q\u00eb kishin mbi 15 vjet p\u00ebrvoj\u00eb pune, nga 7.5% n\u00eb 3.75%. Pra, nj\u00eb p\u00ebrgjysmim i njohjes s\u00eb p\u00ebrvoj\u00ebs s\u00eb pun\u00ebs, duke ndikuar negativisht te mbi 94 mij\u00eb zyrtar\u00eb publik\u00eb.<\/b><\/p>\n<h3><b>Gjykata Kushtetuese e shpall Ligjin n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">P\u00ebr ta adresuar k\u00ebt\u00eb gj\u00eb, Avokati i Popullit k\u00ebrkoi vler\u00ebsimin e Ligjit nga Gjykata Kushtetuese. <\/span><a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=85575\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Verdikti i Gjykat\u00ebs Kushtetuese<\/span><\/a><span style=\"font-weight: 400;\"> konstatoi se ulja e kompensimit p\u00ebr p\u00ebrvoj\u00ebn e pun\u00ebs (nga 7% n\u00eb 3.5%) ishte n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn e Kosov\u00ebs dhe Konvent\u00ebn Europiane p\u00ebr t\u00eb Drejtat e Njeriut.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Megjithat\u00eb, Gjykata nuk e shfuqizoi dispozit\u00ebn, por i dha Kuvendit nj\u00eb afat prej gjasht\u00eb muajsh (deri m\u00eb 1 gusht 2024) p\u00ebr ta korrigjuar k\u00ebt\u00eb rregullim.\u00a0<\/span><\/p>\n<h3><b>Kuvendi, kryetari i Kuvendit dhe kryetari i Komisionit Parlamentar p\u00ebrgjegj\u00ebs, nuk nd\u00ebrmor\u00ebn masat e duhura<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Deri m\u00eb tani, asnj\u00eb veprim nuk \u00ebsht\u00eb nd\u00ebrmarr\u00eb, edhe pse obligimi kushtetues ka kaluar. P\u00ebrgjegj\u00ebs p\u00ebr k\u00ebt\u00eb jan\u00eb Kuvendi, ish-kryetari i Kuvendit, <\/span><b>Glauk Konjufca<\/b><span style=\"font-weight: 400;\"> dhe ish-kryetari i Komisionit p\u00ebr Administrat\u00eb Publike, Pushtet Lokal, Media dhe Zhvillim Rajonal, <\/span><b>Valon Ramadani<\/b><span style=\"font-weight: 400;\">, t\u00eb cil\u00ebve u \u00ebsht\u00eb dor\u00ebzuar Aktgjykimi dhe t\u00eb cil\u00ebt jan\u00eb p\u00ebrgjegj\u00ebs p\u00ebr mosp\u00ebrmbushjen e k\u00ebtij obligimi n\u00eb koh\u00eb.<\/span><\/p>\n<p><b>Glauk Konjufca<\/b><span style=\"font-weight: 400;\">, si figura m\u00eb e lart\u00eb drejtuese e k\u00ebtij institucioni, kishte kompetenc\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb p\u00ebr t\u00eb mbik\u00ebqyrur pun\u00ebn e komisioneve parlamentare dhe p\u00ebr ta orientuar komisionin p\u00ebrkat\u00ebs drejt trajtimit urgjent t\u00eb \u00e7\u00ebshtjes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nga ana tjet\u00ebr, <\/span><b>Valon Ramadani<\/b><span style=\"font-weight: 400;\"> kishte p\u00ebr detyr\u00eb q\u00eb ta fuste ligjin n\u00eb agjend\u00eb, t\u00eb propozonte grupin punues, t\u00eb organizonte shqyrtimin n\u00eb komision dhe t\u00eb propozonte kalimin n\u00eb seanc\u00eb plenare.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Moszbatimi i k\u00ebtyre hapave e b\u00ebn p\u00ebrgjegj\u00ebs p\u00ebr vones\u00ebn dhe injorimin e nj\u00eb vendimi t\u00eb Gjykat\u00ebs Kushtetuese. Ky mosveprim, si n\u00eb nivel individual, ashtu edhe kolektiv, p\u00ebrb\u00ebn shkelje t\u00eb qart\u00eb t\u00eb detyrimeve kushtetuese dhe cenon t\u00eb drejtat sociale t\u00eb mij\u00ebra zyrtar\u00ebve publik\u00eb.<\/span><\/p>\n<h3><b>Pasojat financiare\u00a0<\/b><\/h3>\n<blockquote><p><strong><span style=\"font-size: 17px;\">Ulja e shtes\u00ebs p\u00ebr p\u00ebrvoj\u00ebn e pun\u00ebs nga 0.5% n\u00eb 0.25% ndikon negativisht n\u00eb t\u00eb ardhurat e 90,696 zyrtar\u00ebve publik\u00eb dhe t\u00eb familjeve t\u00eb tyre. Ky reduktim \u00e7on n\u00eb humbje mesatare prej 12.5 deri n\u00eb 40 euro n\u00eb muaj p\u00ebr secilin zyrtar publik, duke cenuar burimet e domosdoshme p\u00ebr p\u00ebrballimin e shpenzimeve t\u00eb p\u00ebrditshme.<\/span><\/strong><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">P\u00ebr t\u2019i shmangur pasojat ligjore dhe financiare q\u00eb do t\u00eb vijn\u00eb nga mosp\u00ebrmbushja e Aktgjykimit, Kuvendi duhet t\u00eb konstituohet sa m\u00eb par\u00eb dhe t\u00eb trajtoj\u00eb me prioritet k\u00ebt\u00eb \u00e7\u00ebshtje, si\u00e7 k\u00ebrkohet nga Gjykata Kushtetuese, duke e zbatuar at\u00eb q\u00eb nga 1 shkurti 2024.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kjo do t\u00eb garantonte realizimin kolektiv t\u00eb t\u00eb drejtave t\u00eb zyrtar\u00ebve publik\u00eb.
