Dallimin n\u00eb trajtim e determinon koha kur jan\u00eb pun\u00ebsuar, gjat\u00eb koh\u00ebs kur kontrata kolektive ka qen\u00eb aktive apo pas saj.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Disa nga kontratat kolektive t\u00eb realizuara n\u00eb Kosov\u00eb jan\u00eb <\/span><b>Kontrata e P\u00ebrgjithshme Kolektive<\/b><span style=\"font-weight: 400;\"> (2004-2007 dhe 2014-2017) dhe <\/span><b>kontratat sektoriale,<\/b><span style=\"font-weight: 400;\"> si\u00e7 jan\u00eb ajo e Arsimit (2005-2022), e Sh\u00ebndet\u00ebsis\u00eb (2011-2022), e PTK-s\u00eb (2015-2018) dhe n\u00eb nivelin komunal (2019-2022).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kontratat e fundit kolektive n\u00eb Kosov\u00eb kan\u00eb qen\u00eb aktive deri <\/span><span style=\"font-weight: 400;\">n\u00eb n\u00ebntor t\u00eb vitit 2022. Personat t\u00eb cil\u00ebt jan\u00eb pun\u00ebsuar pas k\u00ebsaj date trajtohen ndryshe dhe rrjedhimisht nuk p\u00ebrfitojn\u00eb asnj\u00eb nga benefitet sikurse koleg\u00ebt e tyre.<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">T\u00eb marrim shembull dy m\u00ebsimdh\u00ebn\u00ebs t\u00eb pun\u00ebsuar n\u00eb t\u00eb nj\u00ebjt\u00ebn shkoll\u00eb, me t\u00eb nj\u00ebjtin orar dhe p\u00ebrgjegj\u00ebsi. Nj\u00ebri \u00ebsht\u00eb pun\u00ebsuar n\u00eb vitin 2021, n\u00eb koh\u00ebn kur Kontrata Kolektive p\u00ebr Arsim ka qen\u00eb n\u00eb fuqi, dhe tjetri m\u00eb 2025, n\u00eb koh\u00ebn kur Kontrata Kolektive nuk ka qen\u00eb n\u00eb fuqi. M\u00ebsimdh\u00ebn\u00ebsi i pun\u00ebsuar m\u00eb 2021 merr pag\u00eb jubilare, shujt\u00eb ditore dhe kompensim p\u00ebr udh\u00ebtim dhe benefite t\u00eb tjera shtes\u00eb, nd\u00ebrsa m\u00ebsimdh\u00ebn\u00ebsi i pun\u00ebsuar m\u00eb 2025 nuk p\u00ebrfiton asnj\u00eb nga k\u00ebto benefite.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Dallimi i till\u00eb n\u00eb trajtim p\u00ebrb\u00ebn diskriminim dhe shkelje t\u00eb t\u00eb drejtave t\u00eb njeriut ndaj pun\u00ebtor\u00ebve n\u00eb sektorin publik. Kjo situat\u00eb e krijuar \u00ebsht\u00eb pasoj\u00eb direkte e mosvazhdimit t\u00eb kontratave kolektive.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Shto k\u00ebtu faktin se kjo gj\u00eb ka ndodhur gjat\u00eb qeverisjes Kurti 2 (2021-2025), e cila erdhi n\u00eb pushtet me nj\u00eb platform\u00eb socio-ekonomike nga k\u00ebndv\u00ebshtrimi i majt\u00eb social-demokratik. Kjo platform\u00eb politike nga L\u00ebvizja Vet\u00ebvendosje nuk u zhvillua asnj\u00ebher\u00eb, por mbeti n\u00eb suaza t\u00eb retorik\u00ebs politike.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/gzk.rks-gov.net\/ActDocumentDetail.aspx?ActID=2735\" target=\"_blank\" rel=\"noopener\"><b>Kontrata Kolektive<\/b><\/a><b> \u00ebsht\u00eb nj\u00eb marr\u00ebveshje nd\u00ebrmjet Qeveris\u00eb dhe sindikatave, me t\u00eb cil\u00ebn rregullohen t\u00eb drejtat, detyrat dhe p\u00ebrgjegj\u00ebsit\u00eb q\u00eb rrjedhin nga marr\u00ebdh\u00ebnia e pun\u00ebs sipas marr\u00ebveshjes s\u00eb arritur. P\u00ebrmes kontrat\u00ebs kolektive p\u00ebrcaktohen edhe benefite, si: shujtat ditore, pushimi vjetor shtes\u00eb, pagesa jubilare, kompensimi p\u00ebr udh\u00ebtim dhe siguria n\u00eb pun\u00eb.<\/b><\/p>\n<p><b>Kontratat kolektive sh\u00ebrbejn\u00eb si mekanizma shtes\u00eb p\u00ebr t\u00eb garantuar barazin\u00eb n\u00eb pun\u00eb dhe p\u00ebr t\u00eb p\u00ebrmir\u00ebsuar kushtet e pun\u00ebs p\u00ebrmes dialogut shoq\u00ebror mes sindikatave dhe Qeveris\u00eb.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">P\u00ebr m\u00eb shum\u00eb se dy dekada, kontratat kolektive kan\u00eb garantuar t\u00eb drejta shtes\u00eb p\u00ebr dhjet\u00ebra-mij\u00ebra pun\u00ebtor\u00eb n\u00eb Kosov\u00eb. Pas skadimit t\u00eb k\u00ebtyre marr\u00ebveshjeve, pun\u00ebtor\u00ebt t\u00eb cil\u00ebt jan\u00eb pun\u00ebsuar gjat\u00eb koh\u00ebs kur kontratat kolektive nuk kan\u00eb qen\u00eb n\u00eb fuqi, nuk g\u00ebzojn\u00eb t\u00eb nj\u00ebjtat privilegjet e nj\u00ebjta si koleg\u00ebt e tyre.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Trajtimi i bazuar vet\u00ebm n\u00eb koh\u00ebn e pun\u00ebsimit \u00ebsht\u00eb shembull klasik i diskriminimit t\u00eb institucionalizuar. Kjo gjendje e krijuar nga mosvazhdimi i kontratave p\u00ebrb\u00ebn shkelje t\u00eb <\/span><a href=\"https:\/\/www.kuvendikosoves.org\/Uploads\/Data\/Files\/6\/KushtetutaeRepublikesseKosoves_nJ4SXNnEAT.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">parimeve kushtetuese<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=10924\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ligjore<\/span><\/a><span style=\"font-weight: 400;\"> dhe <\/span><a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2000\/78\/oj\/eng\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">nd\u00ebrkomb\u00ebtare<\/span><\/a><span style=\"font-weight: 400;\"> mbi barazin\u00eb dhe ndalimin e diskriminimit.\u00a0<\/span><\/p>\n<p><a href=\"https:\/\/api.webgjk-ks.org\/Custom\/ko_190_19_agj_shq.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Gjykata Kushtetuese e Kosov\u00ebs<\/span><\/a><span style=\"font-weight: 400;\">, ashtu si Komisioni i Venecias, kan\u00eb theksuar se dallimi n\u00eb trajtim nd\u00ebrmjet personave q\u00eb ndodhen n\u00eb pozita t\u00eb nj\u00ebjta, p\u00ebrve\u00e7 n\u00eb rastet kur ka nj\u00eb justifikim objektiv dhe t\u00eb arsyesh\u00ebm p\u00ebr ta, p\u00ebrb\u00ebn diskriminim dhe shkelje t\u00eb t\u00eb drejtave t\u00eb njeriut.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kjo situat\u00eb e krijuar do t\u00eb mund t\u00eb ishte shmangur fare leht\u00eb me n\u00ebnshkrimin e kontratave t\u00eb reja kolektive dhe me nj\u00eb planifikim t\u00eb mir\u00ebfillt\u00eb, duke i buxhetuar ato n\u00eb <\/span><i><span style=\"font-weight: 400;\">Ligjin p\u00ebr Ndarjet Buxhetore<\/span><\/i><span style=\"font-weight: 400;\"> p\u00ebr secilin vit.<\/span><\/p>\n<p><b>Ligji i Pun\u00ebs p\u00ebrcakton q\u00eb kontratat kolektive t\u00eb zgjasin tre vjet dhe t\u00eb rishikohen para skadimit, duke reflektuar ndryshimet ekonomike e sociale p\u00ebr t\u00eb p\u00ebrmir\u00ebsuar t\u00eb drejtat e pun\u00ebtor\u00ebve.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Edhe pse Ligji i Pun\u00ebs dhe standardet nd\u00ebrkomb\u00ebtare e parashohin dialogun social si proces t\u00eb vazhduesh\u00ebm, n\u00eb Kosov\u00eb ai \u00ebsht\u00eb nd\u00ebrprer\u00eb. Kontrata e P\u00ebrgjithshme Kolektive dhe kontratat sektoriale (p.sh., arsim dhe sh\u00ebndet\u00ebsi), q\u00eb dikur ishin n\u00eb fuqi, tashm\u00eb kan\u00eb skaduar t\u00eb gjitha dhe nuk jan\u00eb rinegociuar.<\/span><\/p>\n<p><a href=\"https:\/\/nacionale.com\/politike\/ekskluzive-ministria-e-arsimit-e-shkeput-kontraten-kolektive-me-sbashk-un\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Ministria e Arsimit<\/span><\/a><span style=\"font-weight: 400;\"> dhe ajo e <\/span><a href=\"https:\/\/indeksonline.net\/msh-shkeput-kontraten-kolektive-me-federaten-sindikale-te-shendetesise\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Sh\u00ebndet\u00ebsis\u00eb<\/span><\/a><span style=\"font-weight: 400;\"> jan\u00eb t\u00ebrhequr nj\u00ebansh\u00ebm nga marr\u00ebveshjet me sindikatat p\u00ebrkat\u00ebse, duke mos nd\u00ebrmarr\u00eb asnj\u00eb hap p\u00ebr t\u00eb rifilluar procesin e negociatave.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00eb tetor t\u00eb vitit 2024, Sindikata e Bashkuar e Arsimit (SBASHK) i ka dor\u00ebzuar formalisht Ministris\u00eb s\u00eb Arsimit nj\u00eb <\/span><a href=\"https:\/\/www.koha.net\/lajmet-e-mbremjes-ktv\/sbashk-u-pret-nenshkrimin-e-shpejte-per-draftin-e-kontrates-kolektive-te-arsimit\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">draft-kontrat\u00eb t\u00eb re<\/span><\/a><span style=\"font-weight: 400;\">. Megjithat\u00eb, q\u00eb nga ajo koh\u00eb nuk \u00ebsht\u00eb nd\u00ebrmarr\u00eb ndonj\u00eb veprim konkret p\u00ebr finalizimin e saj. Madje, nuk \u00ebsht\u00eb krijuar as komiteti i nevojsh\u00ebm p\u00ebr zhvillimin e negociatave.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pas m\u00eb shum\u00eb se dhjet\u00eb muajsh pritje, SBASHK-u ka <\/span><a href=\"https:\/\/www.koha.net\/arberi\/sbashk-u-paralajmeron-greve-nese-nuk-arrihet-dialog-me-mashti-n-deri-ne-shtator\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">paralajm\u00ebruar nj\u00eb protest\u00eb<\/span><\/a><span style=\"font-weight: 400;\"> m\u00eb 20 shtator n\u00eb rast se k\u00ebrkesa e tyre nuk merret parasysh.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kosova ka nevoj\u00eb urgjente p\u00ebr t\u2019u rikthyer te parimet baz\u00eb t\u00eb shtetit t\u00eb mir\u00ebqenies sociale. Qeveria e ardhshme duhet t\u00eb rifilloj\u00eb menj\u00ebher\u00eb negociatat p\u00ebr kontrat\u00ebn e p\u00ebrgjithshme kolektive dhe ato sektoriale me sindikatat.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00c7do dit\u00eb q\u00eb kalon pa miratimin e k\u00ebtyre marr\u00ebveshjeve, \u00ebsht\u00eb nj\u00eb dit\u00eb m\u00eb shum\u00eb n\u00eb favor t\u00eb pabarazis\u00eb.
