Ky veprim u d\u00ebrgua p\u00ebr shqyrtim n\u00eb Gjykat\u00ebn Kushtetuese, e cila n\u00eb fund e rr\u00ebzoi dekretin.<\/p>\n<p>Gjykata gjithashtu sqaroi qart\u00eb se kur mund t\u00eb shp\u00ebrndahet Kuvendi dhe afatet kushtetuese p\u00ebr zgjedhjen e presidentit, duke theksuar se deputet\u00ebt nuk jan\u00eb t\u00eb detyruar t\u00eb b\u00ebjn\u00eb kuorum ose t\u00eb votojn\u00eb kandidat\u00eb pa vullnetin e tyre.<\/p>\n<p>Ky vendimi i jep hap\u00ebsir\u00eb manovrimi elit\u00ebs politike n\u00eb vend, ve\u00e7an\u00ebrisht LVV-s\u00eb, e cila mban p\u00ebrgjegj\u00ebsin\u00eb si parti fituese e zgjedhjeve p\u00ebr t\u00eb propozuar kandidat\u00eb konsensual\u00eb dhe p\u00ebr t\u00eb k\u00ebrkuar bashk\u00ebpunim me opozit\u00ebn, p\u00ebrndryshe vendi shkon n\u00eb zgjedhje t\u00eb reja.<\/p>\n<h3><strong>Shp\u00ebrndarja e Kuvendit b\u00ebhet vet\u00ebm n\u00eb tri raste<\/strong><\/h3>\n<p>Vendimi i Gjykat\u00ebs p\u00ebr dekretin e saj lidhur me shp\u00ebrndarjen e Kuvendit nuk krijoi rregulla t\u00eb reja, por sqaroi se shp\u00ebrndarja e Kuvendit nuk \u00ebsht\u00eb vendim politik i presidentes, por nj\u00eb pasoj\u00eb q\u00eb buron drejtp\u00ebrdrejt nga Kushtetuta.<\/p>\n<blockquote><p><strong>Kushtetuta e Kosov\u00ebs e p\u00ebrcakton qart\u00eb se Kuvendi shp\u00ebrndahet vet\u00ebm n\u00eb tri raste: n\u00ebse nuk formohet Qeveria brenda 60 dit\u00ebsh, n\u00ebse dy t\u00eb tretat e deputet\u00ebve votojn\u00eb p\u00ebr shp\u00ebrndarjen e Kuvendit dhe n\u00ebse brenda 60 dit\u00ebsh nga fillimi i procedur\u00ebs p\u00ebr zgjedhjen e presidentit nuk zgjidhet presidenti.<\/strong><\/p><\/blockquote>\n<p>Ky interpretim nga Gjykata mbron ndarjen e pushteteve (Legjislativi\/Kuvendi, Ekzekutivi\/Qeveria dhe Gjyq\u00ebsori) dhe e b\u00ebn t\u00eb qart\u00eb se mandati i Kuvendit nuk mund t\u00eb nd\u00ebrpritet mbi baz\u00eb t\u00eb vler\u00ebsimeve politike, si\u00e7 b\u00ebri presidentja Osmani.<\/p>\n<h3><strong>Sqarimi i afateve kushtetuese <\/strong><\/h3>\n<p>Kushtetuta p\u00ebrcaktoi se procedura p\u00ebr zgjedhjen e presidentit do t\u00eb duhej t\u00eb p\u00ebrfundonte jo m\u00eb von\u00eb se 30 dit\u00eb para p\u00ebrfundimit t\u00eb mandatit, apo m\u00eb 5 mars, meq\u00eb mandati i Vjosa Osmanit do t\u00eb p\u00ebrfundonte m\u00eb 4 prill 2026.<\/p>\n<p>Por, n\u00eb rastin konkret, p\u00ebr shkak se Kuvendi u b\u00eb funksional vet\u00ebm m\u00eb 11 shkurt, Gjykata Kushtetuese e ka llogaritur afatin 60-ditor nga kjo dat\u00eb.<\/p>\n<blockquote><p><strong>Sipas vendimit, Kuvendi ka afat ligjor q\u00eb ta zgjedh\u00eb presidentin deri m\u00eb 28 prill, n\u00eb t\u00eb kund\u00ebrt\u00ebn, vendi shkon p\u00ebrs\u00ebri n\u00eb zgjedhje.<\/strong><\/p><\/blockquote>\n<h3><strong>Pjes\u00ebmarrje po, por jo detyrim p\u00ebr kuorum dhe votim<\/strong><\/h3>\n<p>Nj\u00eb nga sqarimet m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb Gjykat\u00ebs lidhet me rolin e deputet\u00ebve. N\u00eb k\u00ebt\u00eb aktgjykim, Gjykata ka folur p\u00ebr nj\u00eb detyrim t\u00eb p\u00ebrgjithsh\u00ebm kushtetues q\u00eb deputet\u00ebt t\u00eb jen\u00eb pjes\u00eb e procesit dhe ta shfryt\u00ebzojn\u00eb koh\u00ebn n\u00eb m\u00ebnyr\u00eb racionale p\u00ebr ta zgjedhur presidentin dhe p\u00ebr t\u00eb vepruar n\u00eb interesin m\u00eb t\u00eb mir\u00eb t\u00eb vendit.<\/p>\n<p>Megjithat\u00eb, ndryshe nga rastet q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me konstituimin e Kuvendit, me \u00e7\u2019rast Gjykata kishte p\u00ebrdorur <a href=\"https:\/\/api.webgjk-ks.org\/Custom\/e42461bd-a4ef-4845-b9f7-2e6b86518586.pdf\" target=\"_blank\" rel=\"noopener\">gjuh\u00eb detyruese<\/a> n\u00eb dispozitiv, n\u00eb rastin e zgjedhjes s\u00eb presidentit Gjykata nuk ka urdh\u00ebruar deputet\u00ebt t\u00eb marrin pjes\u00eb fizikisht n\u00eb sall\u00eb dhe as nuk ka vendosur ndonj\u00eb detyrim konkret procedural p\u00ebr ta.<\/p>\n<blockquote><p><strong>Kjo \u00ebsht\u00eb thelb\u00ebsore p\u00ebr demokracin\u00eb parlamentare. Mandati i deputetit \u00ebsht\u00eb i lir\u00eb dhe jo detyrues.<\/strong><\/p><\/blockquote>\n<p>N\u00eb rastin e konstituimit t\u00eb Kuvendit, pjes\u00ebmarrja n\u00eb votim \u00ebsht\u00eb e detyrueshme p\u00ebr t\u00eb funksionalizuar institucionin. Por, n\u00eb proceset politike si zgjedhja e presidentit apo e Qeveris\u00eb, vota \u00ebsht\u00eb vullnet i lir\u00eb.<\/p>\n<h3><strong>Test i p\u00ebrgjegj\u00ebsis\u00eb politike t\u00eb LVV-s\u00eb<\/strong><\/h3>\n<p>Procedura p\u00ebr zgjedhjen e presidentit filloi m\u00eb 5 mars 2026, me diskutime t\u00eb minut\u00ebs s\u00eb fundit t\u00eb iniciuara nga LVV-ja, pa nj\u00eb kandidat t\u00eb dakorduar dhe pa nj\u00eb shumic\u00eb t\u00eb sigurt. Nj\u00eb pjes\u00eb e opozit\u00ebs refuzoi t\u00eb marr\u00eb pjes\u00eb n\u00eb k\u00ebt\u00eb proces.<\/p>\n<p>P\u00ebr zgjedhjen e presidentit duhet t\u00eb jen\u00eb t\u00eb pranish\u00ebm t\u00eb pakt\u00ebn dy t\u00eb tretat e deputet\u00ebve n\u00eb sall\u00eb, q\u00eb t\u00eb nis\u00eb procesi i votimit. N\u00eb nj\u00eb demokraci parlamentare si Kosova, vendimet e m\u00ebdha arrihen vet\u00ebm p\u00ebrmes kompromisit dhe marr\u00ebveshjeve politike.<\/p>\n<blockquote><p><strong>LVV-ja, me 51% t\u00eb mandateve, nuk ka vet\u00ebm legjitimitetin, por edhe p\u00ebrgjegj\u00ebsin\u00eb kryesore p\u00ebr t\u00eb nd\u00ebrtuar konsensus me partit\u00eb opozitare.<\/strong><\/p><\/blockquote>\n<p>Fakti q\u00eb LVV-ja nuk arriti ta zgjedh\u00eb presidentin edhe pse kontrollon m\u00eb shum\u00eb se gjysm\u00ebn e Kuvendit, flet shum\u00eb p\u00ebr munges\u00ebn e kompromisit dhe dialogut. Qeverit\u00eb e kaluara kan\u00eb arritur t\u2019i zgjedhin president\u00ebt me m\u00eb pak mandate dhe me koalicione shum\u00eb m\u00eb t\u00eb brishta.<\/p>\n<p>Kalkulimet politike dhe mospropozimi i emrave konkret\u00eb deri n\u00eb dit\u00ebn e fundit p\u00ebrb\u00ebjn\u00eb tallje me qytetar\u00ebt dhe me vet\u00eb institucionin e presidentit. Zgjedhja e presidentit nuk \u00ebsht\u00eb loj\u00eb taktike, por proces q\u00eb k\u00ebrkon seriozitet, transparenc\u00eb dhe p\u00ebrgjegj\u00ebsi.<\/p>\n<p>Propozimi i emrit t\u00eb Glauk Konjufc\u00ebs p\u00ebr president, vet\u00ebm disa jav\u00eb pasi ai u em\u00ebrua minist\u00ebr i Pun\u00ebve t\u00eb Jashtme, \u00ebsht\u00eb v\u00ebshtir\u00eb t\u00eb shihet si propozim serioz. Kjo e forcon p\u00ebrshtypjen se emrat jan\u00eb p\u00ebrdorur m\u00eb shum\u00eb si instrument p\u00ebr kalkulime politike, sesa si kandidatura reale p\u00ebr konsensus.<\/p>\n<p>Po ashtu, kryetari i LVV-s\u00eb, kryeministri Kurti, nuk ka treguar asnj\u00ebher\u00eb qart\u00eb n\u00ebse do ta mb\u00ebshteste apo jo kandidatur\u00ebn e Vjosa Osmanit p\u00ebr nj\u00eb mandat t\u00eb dyt\u00eb. Pas pes\u00eb vitesh bashk\u00ebpunimi politik dhe pas faktit se kan\u00eb kandiduar s\u00eb bashku n\u00eb zgjedhje, minimumi i p\u00ebrgjegj\u00ebsis\u00eb politike do t\u00eb ishte nj\u00eb deklarim i qart\u00eb p\u00ebr p\u00ebrkrahje ose mosp\u00ebrkrahje.<\/p>\n<p>Kjo paqart\u00ebsi, e kombinuar me insistimin p\u00ebr t\u00eb p\u00ebrfituar politikisht n\u00eb \u00e7do situat\u00eb, po e rrezikon seriozisht stabilitetin e institucioneve t\u00eb vendit dhe po e shtyn Kosov\u00ebn drejt nj\u00eb cikli t\u00eb ri zgjedhor, n\u00eb nj\u00eb koh\u00eb kur vendi ka nevoj\u00eb p\u00ebr institucione stabile dhe funksionale.<\/p>\n<p>28 prilli do t\u00eb tregoj\u00eb n\u00ebse LVV-ja do ta zgjedh\u00eb vendin mbi partin\u00eb, duke u ofruar qytetar\u00ebve institucione stabile, apo do ta shfryt\u00ebzoj\u00eb k\u00ebt\u00eb mund\u00ebsi p\u00ebr p\u00ebrfitim politik, duke e \u00e7uar vendin n\u00eb zgjedhje t\u00eb reja dhe plot\u00ebsisht t\u00eb panevojshme.<\/p>","protected":false},"excerpt":{"rendered":"<p>Kriza politike rreth zgjedhjes s\u00eb presidentit t\u00eb Kosov\u00ebs e riktheu p\u00ebrs\u00ebri v\u00ebmendjen te Gjykata Kushtetuese, p\u00ebr t\u00eb sqaruar kufijt\u00eb e kompetencave kushtetuese.
