Kjo \u00ebsht\u00eb hera e tret\u00eb q\u00eb gjykata gjen shkelje t\u00eb Ligjit p\u00ebr Qasje n\u00eb Dokumente Publike nga autoritetet publike.<\/p>\n<\/div>\n<div class=\"news-down\">\n<div class=\"news-left\">\n<p><a href=\"http:\/\/www.institutigap.org\/documents\/71809_PadiaMZHE.pdf\" target=\"_blank\" rel=\"noopener\">Gjykata Themelore n\u00eb Prishtin\u00eb ka urdh\u00ebruar Ministrin\u00eb e Zhvillimit Ekonomik<\/a>\u00a0(MZHE) q\u00eb brenda 30 dit\u00ebsh, pasi aktgjykimi t\u00eb b\u00ebhet i plotfuqish\u00ebm, t\u2019i lejoj\u00eb Institutit p\u00ebr Studime t\u00eb Avancuara (GAP) qasje n\u00eb dokumentet publike q\u00eb nd\u00ebrlidhen me ofertimin p\u00ebr nd\u00ebrtimin e termocentralit \u201cKosova e Re\u201d dhe procesin e privatizimit t\u00eb KEDS-it.<\/p>\n<p>Rasti ka t\u00eb b\u00ebj\u00eb me t\u00eb drejt\u00ebn e qasjes n\u00eb dokumente publike dhe vendimi gjyq\u00ebsor sh\u00ebnon fitoren e radh\u00ebs s\u00eb shoq\u00ebris\u00eb civile ndaj institucioneve publike &#8211; q\u00eb deri m\u00eb tani p\u00ebrgjith\u00ebsisht nuk kan\u00eb treguar vullnet politik p\u00ebr transparenc\u00eb. E nj\u00ebjta gjykat\u00eb, m\u00eb 2015 dhe 2016, kishte vendosur n\u00eb favor t\u00eb Rrjetit Ballkanik p\u00ebr Gazetari Hulumtuese q\u00eb kishte k\u00ebrkuar qasje n\u00eb vendimet disiplinore kund\u00ebr prokuror\u00ebve dhe faturat e shpenzimeve n\u00eb udh\u00ebtimet jasht\u00eb vendit t\u00eb ish-kryeministrit Hashim Tha\u00e7i.<\/p>\n<p>Aktgjykimi q\u00eb mban dat\u00ebn 12 dhjetor 2017, i publikuar m\u00eb 11 janar 2018, nuk p\u00ebrcakton n\u00ebse Ministri i Zhvillimit Ekonomik duhet t\u00eb publikoj\u00eb edhe kontrat\u00ebn p\u00ebr termocentralin e ri. N\u00eb koh\u00ebn kur ishte shtruar k\u00ebrkesa p\u00ebr qasje n\u00eb dokumente publike, ky dokument nuk ekzistonte. Kontrata p\u00ebr termocentralin n\u00eb vler\u00eb prej rreth nj\u00eb miliard euro \u00ebsht\u00eb lidhur n\u00eb mes t\u00eb Qeveris\u00eb s\u00eb Kosov\u00ebs dhe kompanis\u00eb amerikane \u201cContourGlobal\u201d m\u00eb 21 dhjetor 2017. Lluk\u00ebs i \u00ebsht\u00eb k\u00ebrkuar vazhdimisht q\u00eb ta publikoj\u00eb at\u00eb.<\/p>\n<p>Instituti GAP kishte\u00a0<a href=\"http:\/\/www.institutigap.org\/lajme\/2081\" target=\"_blank\" rel=\"noopener\">ushtruar k\u00ebrkesat<\/a>\u00a0p\u00ebr qasje n\u00eb dokumente para MZHE-s\u00eb dhe Korporat\u00ebs Energjetike t\u00eb Kosov\u00ebs (KEK) m\u00eb 25 mars 2013 bazuar n\u00eb Ligjin p\u00ebr Qasje n\u00eb Dokumente Publike. Disa prej dokumenteve p\u00ebr privatizimin e distribucionit t\u00eb energjis\u00eb elektrike ishin ofruar vet\u00ebm p\u00ebr t\u2019u par\u00eb, pa iu lejuar zyrtar\u00ebve t\u00eb institutit qasje n\u00eb kopje fizike ose elektronike. Nd\u00ebrmarrja KEK kishte refuzuar qasjen n\u00eb t\u00ebr\u00ebsi, n\u00ebn arsyetimin se marr\u00ebveshja p\u00ebr shitjen e aksioneve ishte lidhur mes qeveris\u00eb dhe konzorciumit \u201cCali &amp; Lima\u201d.<\/p>\n<p>Themelorja e Prishtin\u00ebs duke vendosur n\u00eb favor t\u00eb institutit GAP ka adresuar \u00e7\u00ebshtje me r\u00ebnd\u00ebsi p\u00ebr t\u00eb drejt\u00ebn e informimit, si e drejt\u00eb q\u00eb buron nga e drejta e liris\u00eb s\u00eb shprehjes.<\/p>\n<p>Gjykata fillimisht ka vendosur se sikurse MZHE-ja ashtu edhe KEK-u jan\u00eb institucione publike. K\u00ebshtu aktgjykimi kontribuon n\u00eb qart\u00ebsimin e p\u00ebrkufizimeve t\u00eb parapara me nenin 3 t\u00eb Ligjit p\u00ebr Qasje n\u00eb Dokumente Publike, sipas t\u00eb cilit institucionet publike jan\u00eb edhe \u201cpersonat fizik\u00eb apo juridik\u00eb, me kusht q\u00eb t\u00eb ushtrojn\u00eb autoritet administrativ, kryejn\u00eb detyra publike, apo operojn\u00eb me fonde publike sipas ligjeve t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs (bart\u00ebsit privat\u00eb t\u00eb kompetencave publike).\u201d Ligji nuk u referohet konkretisht nd\u00ebrmarrjeve publike.<\/p>\n<p>N\u00eb pyetjen para gjykat\u00ebs n\u00ebse dokumentet e k\u00ebrkuara jan\u00eb publike, gjykata ka vendosur t\u2019i konsideroj\u00eb ato si publike, meq\u00eb MZHE-ja kishte d\u00ebshtuar t\u00eb ofronte d\u00ebshmi p\u00ebr t\u00eb arsyetuar ndonj\u00ebrin nga p\u00ebrjashtimet q\u00eb lejon mospublikimin e dokumenteve. Rrjedhimisht, \u00ebsht\u00eb krijuar nj\u00eb precedent pozitiv gjyq\u00ebsor sipas t\u00eb cilit dokumentet e ofertimit dhe t\u00eb privatizimit tash e tutje duhet t\u00eb konsiderohen n\u00eb parim si dokumente publike. Deri m\u00eb tani k\u00ebto dokumente jan\u00eb mbajtur top sekret.<\/p>\n<p>Nj\u00eb element tjet\u00ebr m\u00eb r\u00ebnd\u00ebsi i k\u00ebtij aktgjykimi \u00ebsht\u00eb \u201ce drejta p\u00ebr t\u2019i shikuar\u201d dokumentet n\u00eb vend t\u00eb qasjes n\u00eb kopjet fizike ose elektronike, q\u00eb zakonisht p\u00ebrdoret nga autoritetet publike p\u00ebr t\u2019ua v\u00ebshtir\u00ebsuar ose pamund\u00ebsuar gazetar\u00ebve raportimin. MZHE-ja ishte arsyetuar se nuk mund t\u00eb ofronte qasje n\u00eb kopjet e dokumenteve meq\u00eb ishin n\u00eb form\u00eb t\u00eb draftit t\u00eb pafinalizuar. Gjykata e ka vler\u00ebsuar k\u00ebt\u00eb pretendim si t\u00eb pabazuar duke th\u00ebn\u00eb se \u201cdokumentet e tilla t\u00eb institucioneve publike duhet t\u00eb jen\u00eb t\u00eb hapura p\u00ebr qytetar\u00ebt&#8230;. dhe nga ky aspekt ata kan\u00eb drejtp\u00ebrs\u00ebdrejti interes t\u00eb arsyesh\u00ebm t\u00eb informohen lidhur me k\u00ebt\u00eb p\u00ebrmbajtje\u201d. Duke mos b\u00ebr\u00eb dallim n\u00eb mes t\u00eb dokumenteve t\u00eb finalizuara dhe atyre q\u00eb jan\u00eb n\u00eb form\u00eb t\u00eb draftit, gjykata ka zgjedhur qasje tejet liberale. Nj\u00eb gj\u00eb e till\u00eb \u00ebsht\u00eb e mir\u00ebseardhur duke marr\u00eb parasysh se paragrafi 1.11 i nenit 12 t\u00eb Ligjit p\u00ebr Qasje n\u00eb Dokumente Publike ua mund\u00ebson institucioneve publike q\u00eb t\u00eb mos publikojn\u00eb dokumente n\u00ebse ato jan\u00eb pjes\u00eb e \u201cdiskutimeve brenda apo nd\u00ebrmjet institucioneve publike lidhur me shqyrtimin e ndonj\u00eb \u00e7\u00ebshtjeje\u201d.<\/p>\n<p>Ndon\u00ebse rezultati final i k\u00ebtij aktgjykimi \u00ebsht\u00eb n\u00eb favor t\u00eb liris\u00eb s\u00eb shprehjes, arsyetimi i aktgjykimit \u00ebsht\u00eb i dob\u00ebt dhe injoron elemente t\u00eb r\u00ebnd\u00ebsishme q\u00eb duhet t\u00eb merren parasysh n\u00eb raste t\u00eb tilla- si intresi publik n\u00eb publikimin e dokumenteve t\u00eb k\u00ebrkuara, roli i organizatave joqeveritare n\u00eb shoq\u00ebri, etj. Themelorja ka p\u00ebrmendur shkurtimisht, p\u00ebrmes metod\u00ebs copy-paste, nenin 10 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut, por pa ofruar arsyetim se si nd\u00ebrlidhet e drejta e liris\u00eb s\u00eb shprehjes me t\u00eb drejt\u00ebn p\u00ebr t\u2019u informuar.
