Iniciativa synon \u2018disiplinimin\u2019 e mediave online, bazohet n\u00eb informacione t\u00eb gabuara dhe shp\u00ebrfaq mosinformimin e duhur t\u00eb deputet\u00ebve inicues rreth rregullimit t\u00eb mediave. Ajo duket si tenativ\u00eb e radh\u00ebs p\u00ebr t\u00eb censuruar mediat n\u00eb em\u00ebr t\u00eb rregullimit t\u00eb tyre.<\/p>\n<p>Mediat rregullohen kryesisht p\u00ebrmes dy modeleve: me ligj t\u00eb p\u00ebrgjithsh\u00ebm, ose me ligje t\u00eb ve\u00e7anta (lex specialis). Sipas modelit t\u00eb par\u00eb q\u00eb zbatohet n\u00eb Austri, nj\u00eb ligj organik rregullon shumic\u00ebn e aspekteve q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me pun\u00ebn e gazetar\u00ebve. Aspekte t\u00eb tilla jan\u00eb shpifja, privat\u00ebsia, konfiskimi i materialeve gazetareske, t\u00eb drejtat e autorit, e drejta e qasjes n\u00eb informacion etj. Sipas modelit t\u00eb dyt\u00eb q\u00eb aplikohet n\u00eb Mbret\u00ebrin\u00eb e Bashkuar, k\u00ebto aspekte rregullohen me ligje t\u00eb ve\u00e7anta. Nuk ka asnj\u00eb argument bind\u00ebs q\u00eb d\u00ebshmon se prania e nj\u00eb ligji t\u00eb p\u00ebrgjithsh\u00ebm e b\u00ebn sfer\u00ebn e mediave m\u00eb t\u00eb lir\u00eb dhe m\u00eb t\u00eb avancuar p\u00ebr kah rregullimi.<\/p>\n<p><strong>Nisma do t\u00eb merrte koh\u00eb<\/strong><\/p>\n<p>Q\u00eb nga shpallja e pavar\u00ebsis\u00eb (edhe m\u00eb her\u00ebt), ligjv\u00ebn\u00ebsit n\u00eb Kosov\u00eb kan\u00eb ndjekur modelin e dyt\u00eb t\u00eb rregullimit t\u00eb mediave. Ky model ofron mbrojtje m\u00eb t\u00eb madhe p\u00ebr media, ngase mund\u00ebson q\u00eb nj\u00eb aspekt, p\u00ebr shembull, mbrojtja e burimeve t\u00eb gazetar\u00ebve, t\u00eb rregullohet detajisht.<\/p>\n<p>Shumica e aspekteve q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me veprimtarin\u00eb e mediave n\u00eb Kosov\u00eb jan\u00eb t\u00eb rregulluara me t\u00eb pakt\u00ebn tet\u00eb ligje (ose nene n\u00eb ligje t\u00eb caktuara). Legjislacioni \u00ebsht\u00eb draftuar n\u00ebn monitorim t\u00eb rrept\u00eb t\u00eb komunitetit nd\u00ebrkomb\u00ebtar. Disa nga k\u00ebto ligje jan\u00eb: Ligji Civil Kund\u00ebr Shpifjes dhe Fyerjes, Ligji p\u00ebr Qasje n\u00eb Dokumente Publike, Ligji p\u00ebr t\u00eb Drejtat e Autorit, Ligji p\u00ebr Mbrojtjen e Burimeve t\u00eb Gazetaris\u00eb, Ligji p\u00ebr Komisionin e Pavarur t\u00eb Mediave, Ligji p\u00ebr Radio- Televizionin e Kosov\u00ebs, Ligji p\u00ebr Mbrojtjen e Informator\u00ebve dhe Kodi Penal (nenet q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me sigurin\u00eb e gazetar\u00ebve).<\/p>\n<p>Pas nj\u00eb dekade t\u00eb rregullimit t\u00eb mediave me ligje t\u00eb ve\u00e7anta, nisma p\u00ebr hartimin e nj\u00eb ligji t\u00eb p\u00ebrgjithsh\u00ebm p\u00ebr media tenton t\u00eb ndryshoj\u00eb t\u00ebr\u00ebsisht dhe konceptualisht m\u00ebnyr\u00ebn e rregullimit t\u00eb mediave n\u00eb Kosov\u00eb. Kjo do t\u00eb n\u00ebnkuptonte q\u00eb ligjet e lartp\u00ebrmendura do t\u00eb duhej t\u00eb shfuqizoheshin dhe t\u00eb gjitha k\u00ebto aspekte do t\u00eb rregulloheshin me nj\u00eb ligj. Kjo nd\u00ebrmarrje do t\u00eb ishte v\u00ebshtir\u00eb e realizueshme dhe do t\u00eb shkaktonte kaos ligjor t\u00eb panevojsh\u00ebm n\u00eb fush\u00ebn e t\u00eb drejt\u00ebs s\u00eb medias.<\/p>\n<p><strong>Nisma do t\u00eb \u00e7onte huq investimin e deritash\u00ebm<\/strong><\/p>\n<p>N\u00eb ve\u00e7anti, ndryshimi i legjislacionit p\u00ebr mbrojtjen nga shpifja dhe fyerja do t\u00eb ishte tejet shqet\u00ebsues n\u00eb relacion me gjyq\u00ebsorin. Gjykat\u00ebsve n\u00eb Kosov\u00eb u jan\u00eb dashur gjasht\u00eb vjet p\u00ebr t\u2019u trajnuar se si t\u00eb zbatojn\u00eb Ligjin Civil Kund\u00ebr Shpifjes dhe Fyerjes n\u00eb rastet e padive p\u00ebr shpifje kund\u00ebr gazetar\u00ebve. Nj\u00eb ligj i ri do t\u00eb n\u00ebnkuptonte q\u00eb p\u00ebrpjekjet e deritanishme n\u00eb p\u00ebrgatitjen e gjyq\u00ebsorit p\u00ebr t\u2019i trajtuar rastet e shpifjes do t\u00eb shkonin huq dhe do t\u00eb hapte mund\u00ebsin\u00eb q\u00eb politikan\u00ebt p\u00ebrs\u00ebri t\u00eb tentonin\u00a0<a href=\"https:\/\/sbunker.net\/article10-bllogje-tematike\/88818\/tentim-kriminalizimi-i-shpifjes-demi-eshte-bere\/\" target=\"_blank\" rel=\"noopener\">kriminalizimin e shpifjes.<\/a><\/p>\n<p>\u00cbsht\u00eb e v\u00ebrtet\u00eb q\u00eb disa nga k\u00ebto ligje nuk jan\u00eb t\u00ebr\u00ebsisht n\u00eb pajtim me praktikat e K\u00ebshillit t\u00eb Europ\u00ebs dhe Gjykat\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut, si\u00e7 \u00ebsht\u00eb rasti me\u00a0<a href=\"https:\/\/sbunker.net\/article10-bllogje-tematike\/89696\/sinjalizimi-lajme-te-mira-ne-kosove\/\" target=\"_blank\" rel=\"noopener\">ligjin q\u00eb rregullon mbrojtjen e sinjalizuesve<\/a>. Ligjet e k\u00ebtilla duhet t\u00eb amendamentohen, mir\u00ebpo ndryshimi duhet t\u00eb b\u00ebhet nj\u00eb nga nj\u00eb dhe vet\u00ebm pasi Komisioni p\u00ebr Media i Kuvendit ta b\u00ebj\u00eb monitorimin e zbatimit t\u00eb tyre, gj\u00eb q\u00eb ka d\u00ebshtuar ta b\u00ebj\u00eb deri m\u00eb tani.<\/p>\n<p><strong>Nisma synon censurimin<\/strong><\/p>\n<p>Problematik \u00ebsht\u00eb edhe fakti q\u00eb deputet\u00ebt jan\u00eb dakorduar p\u00ebr fillimin e hartimit t\u00eb ligjit p\u00ebr media pa konsultuar gazetar\u00ebt dhe pa ofruar analiz\u00eb ligjore paraprake q\u00eb do t\u00eb arsyetonte nevoj\u00ebn p\u00ebr nj\u00eb ligj t\u00eb ri. N<a href=\"http:\/\/www.kuvendikosoves.org\/common\/docs\/proc\/proc__2018_05_07_10_7413_al.pdf\" target=\"_blank\" rel=\"noopener\">\u00eb transkriptin e mbledhjes s\u00eb komisionit\u00a0<\/a>n\u00eb t\u00eb cilin \u00ebsht\u00eb vendosur p\u00ebr hartimin e k\u00ebtij ligji nuk ofrohen detaje t\u00eb diskutimeve q\u00eb mund t\u00eb jen\u00eb zhvilluar n\u00eb mes t\u00eb deputet\u00ebve.<\/p>\n<p>Kryetari i Komisionit Parlamentar p\u00ebr Media,\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=Z7vsHS9AD7w&amp;t=602s\" target=\"_blank\" rel=\"noopener\">Nait Hasani, deklaroi\u00a0<\/a>se deputet\u00ebt jan\u00eb inspiruar nga nj\u00eb vizit\u00eb studimore e b\u00ebr\u00eb n\u00eb Itali duke iu referuar \u2018ligjit p\u00ebr media\u2019 t\u00eb k\u00ebtij vendi. N\u00eb fakt, n\u00eb Itali nuk \u00ebsht\u00eb aprovuar ndonj\u00eb ligj i p\u00ebrgjithsh\u00ebm p\u00ebr media si\u00e7 pretendon Hasani. N\u00eb k\u00ebt\u00eb vend n\u00eb vitin 2013 kishte pasur iniciativ\u00eb ligjore p\u00ebr dekriminalizimin e shpifjes. Draftligji ende nuk \u00ebsht\u00eb aprovuar nga parlamenti dhe Italia mbetet nd\u00ebr vendet m\u00eb t\u00eb kritikuara sa i p\u00ebrket legjislacionit p\u00ebr media dhe nuk duhet t\u00eb merret si shembull pozitiv.<\/p>\n<p>Por ndon\u00ebse nuk jan\u00eb dh\u00ebn\u00eb arsyetime, jan\u00eb dh\u00ebn\u00eb sinjale p\u00ebr q\u00ebllimin e v\u00ebrtet\u00eb t\u00eb k\u00ebsaj iniciative: censurimin e mediave online.<\/p>\n<p>Deputeti Hasani thoshte se \u201cMe k\u00ebt\u00eb [ligj] k\u00ebrkojm\u00eb t\u2019i regjistrojm\u00eb, t\u2019i disiplinojm\u00eb ato portale t\u00eb cilat nuk jan\u00eb [t\u00eb regjistruara]. Lajmet e rreme jan\u00eb pjes\u00eb e proceseve q\u00eb me an\u00eb t\u00eb ligjit duhet t\u00eb [adresohen]. Besoj q\u00eb ky ligj p\u00ebr media do t\u2019i v\u00ebj\u00eb n\u00eb kontroll [mediat]\u201d.<\/p>\n<p>Ky arsyetim bazohet\u00a0 n\u00eb iluzionin se mediat online mund t\u00eb \u201ckontrollohen dhe disiplinohen\u201d.<\/p>\n<p>Gjat\u00eb viteve t\u00eb fundit\u00a0<a href=\"https:\/\/sbunker.net\/article10-bllogje-tematike\/89522\/iluzionet-e-qeverise-per-ndalimin-e-lajmeve-te-rreme\/\" target=\"_blank\" rel=\"noopener\">jan\u00eb organizuar qindra diskutime<\/a>\u00a0p\u00ebr lajmet e rreme n\u00eb nivel shtet\u00ebror, europian dhe global. Por, ato nuk kan\u00eb rezultuar n\u00eb hapa konkret\u00eb legjislativ\u00eb p\u00ebr shkak t\u00eb frik\u00ebs se mund t\u00eb cenojn\u00eb lirin\u00eb e shprehjes.<\/p>\n<p>Mediat audio-vizuele (televizionet dhe radiot) rregullohen nga shteti, p\u00ebrkat\u00ebsisht nga Komisioni i Pavarur p\u00ebr Media, p\u00ebr shkak se hap\u00ebsira e frekuenc\u00ebs \u00ebsht\u00eb e kufizuar dhe shteti duhet t\u00eb siguroj\u00eb ndarjen e tyre n\u00eb at\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb garantoj\u00eb pluraliz\u00ebm n\u00eb media. Mediat online dhe t\u00eb printuara vet\u00ebrregullohen nga industria e mediave p\u00ebrmes K\u00ebshillit t\u00eb Mediave t\u00eb Shkruara t\u00eb Kosov\u00ebs,\u00a0<a href=\"http:\/\/www.aipce.net\/aboutAipce.html\" target=\"_blank\" rel=\"noopener\">model ky i ndjekur n\u00eb shumic\u00ebn e vendeve<\/a>\u00a0n\u00eb Europ\u00eb dhe i pranuar nga Bashkimi Europian dhe K\u00ebshilli i Europ\u00ebs.
