Ligji p\u00ebr Trep\u00e7\u00ebn, n\u00eb vend se t\u00eb krijoj\u00eb korniz\u00eb p\u00ebr veprimtarin\u00eb komerciale t\u00eb Trep\u00e7\u00ebs dhe nd\u00ebrmarrjeve t\u00eb tjera shtet\u00ebrore, gjason m\u00eb shum\u00eb me nj\u00eb \u00e7arter ose akt biznesor q\u00eb rregullon m\u00ebnyr\u00ebn e organizimit t\u00eb nj\u00eb firme. M\u00eb shum\u00eb se nj\u00eb ligj, Kuvendi i Kosov\u00ebs pak a shum\u00eb miratoi nj\u00eb aktvendim juridik q\u00eb p\u00ebrcakton deri n\u00eb imt\u00ebsi organizimin e brendsh\u00ebm t\u00eb nj\u00eb organizate q\u00eb, n\u00eb fund, do t\u00eb duhej t\u00eb vepronte si nj\u00eb biznes i pavarur komercial.<\/p>\n<p>Kjo \u00ebsht\u00eb pasoj\u00eb e tendencave q\u00eb nga viti 2001 e mos edhe m\u00eb her\u00ebt, p\u00ebr t\u00eb ngushtuar dhe mund\u00ebsisht edhe eliminuar pranin\u00eb e nd\u00ebrmarrjeve shtet\u00ebrore n\u00eb ekonomin\u00eb e Kosov\u00ebs. N\u00ebn moton e privatizimit dhe nd\u00ebrtimit t\u00eb \u201cekonomis\u00eb s\u00eb tregut\u201d (e v\u00ebn\u00eb n\u00eb thonj\u00ebza sepse p\u00ebr protagonist\u00ebt e t\u00eb t\u00eb ashtuquajturave reforma, ky formulim ka sh\u00ebrbyer kryesisht si arm\u00eb ideologjike), drejtimi i rib\u00ebrjes s\u00eb institucioneve ekonomike n\u00eb Kosov\u00eb pas luft\u00ebs ka qen\u00eb drejt eliminimit t\u00eb pron\u00ebsis\u00eb shtet\u00ebrore n\u00eb ekonomi. Kjo p\u00ebrpjekje ka marr\u00eb hov sidomos pas vitit 2008, me p\u00ebrpjekjet e qeverive t\u00eb nj\u00ebpasnj\u00ebshme (disa t\u00eb suksesshme, disa t\u00eb d\u00ebshtuara) q\u00eb t\u00eb privatizojn\u00eb ato pak asete strategjike dhe profitabile q\u00eb kan\u00eb ngelur n\u00eb pron\u00ebsi shtet\u00ebrore, si KEDS, PTK dhe KEK-u.<\/p>\n<p>Trep\u00e7a i takon, me identitet n\u00ebse jo me kategorizim juridik, k\u00ebtij grupi nd\u00ebrmarrjesh por i cili, n\u00eb dallim nga k\u00ebto, nuk ka qen\u00eb t\u00ebrheq\u00ebs p\u00ebr investitor\u00eb p\u00ebr shkak t\u00eb k\u00ebrkesave t\u00eb m\u00ebdha t\u00eb kapitalit investues q\u00eb do t\u00eb k\u00ebrkoheshin p\u00ebr rigjenerimin e nd\u00ebrmarrjes dhe p\u00ebr shkak t\u00eb nd\u00ebrhyrjes s\u00eb drejtp\u00ebrdrejt\u00eb t\u00eb Beogradit n\u00eb k\u00ebt\u00eb nd\u00ebrmarrje p\u00ebrmes kontrollimit t\u00eb nj\u00eb pjes\u00eb t\u00eb aseteve t\u00eb saj, ato n\u00eb pjes\u00ebn veriore t\u00eb vendit, p\u00ebrmes menaxhmentit t\u00eb saj paralel. Nuk duhet n\u00ebn\u00e7muar rrezikun q\u00eb paraqet p\u00ebr cilindo investitor edhe mund\u00ebsia ligjore nd\u00ebrkomb\u00ebtare e shtetit serb p\u00ebr t\u00eb bllokuar ose t\u00eb pakt\u00ebn b\u00ebr\u00eb t\u00eb v\u00ebshtir\u00eb veprimtarin\u00eb e Trep\u00e7\u00ebs me pretendimet e veta juridike se Trep\u00e7a \u00ebsht\u00eb pron\u00eb, ose se ka obligime financiare, ndaj Serbis\u00eb.<\/p>\n<p>E gjetur para obligimeve ligjore e presioneve politike p\u00ebr shp\u00ebtimin e nd\u00ebrmarrjes nga zhdukja, qeveria e Isa Mustaf\u00ebs nxori k\u00ebt\u00eb ligj i cili synon ta shp\u00ebtoj\u00eb nd\u00ebrmarrjen nga likuidimi. Ky q\u00ebllim do t\u00eb arrihet, t\u00eb pakt\u00ebn n\u00eb pik\u00ebpamje afatshkurt\u00ebr. Trep\u00e7a do t\u00eb vazhdoj\u00eb t\u00eb ekzistoj\u00eb, por realitetet e Trep\u00e7\u00ebs nuk do t\u00eb ndryshojn\u00eb. Jam skeptik gjithashtu (pavar\u00ebsisht kritikave valide t\u00eb L\u00ebvizjes Vet\u00ebvendosje, se ligji synon privatizimin e nd\u00ebrmarrjes) se do t\u00eb ket\u00eb ndonj\u00eb interesim nga investitor\u00eb t\u00eb huaj privat\u00eb p\u00ebr blerjen e nd\u00ebrmarrjes. P\u00ebrve\u00e7 problemeve politike, ka faktor\u00eb t\u00eb tjer\u00eb p\u00ebr k\u00ebt\u00eb. E para, tregu i komoditeteve, ve\u00e7an\u00ebrisht i metaleve, tash e tre vite \u00ebsht\u00eb n\u00eb depresion. Importuesi m\u00eb i madh i metaleve \u2013 rrjedhimisht edhe p\u00ebrgjegj\u00ebsi kryesor p\u00ebr rritjen e \u00e7mimeve t\u00eb metaleve n\u00eb tregjet nd\u00ebrkomb\u00ebtare \u2013 Kina, ka zvog\u00ebluar k\u00ebrkes\u00ebn. Efektet e k\u00ebsaj po i shohim edhe n\u00eb Kosov\u00eb, me falimentimin e Llamkosit. E dyta, dikur Trep\u00e7a furnizonte tregun jugosllav, por riorientimi i eksporteve drejt tregjeve t\u00eb reja dhe integrimi i prodhimit me zinxhir t\u00eb furnizimit global (global supply chain) nuk ka ndodhur, apo nuk ka ndodhur mjaftuesh\u00ebm. E treta, ligji aktual garanton q\u00eb Trep\u00e7a t\u00eb mbetet n\u00ebn kontroll politik, q\u00eb do t\u00eb vazhdoj\u00eb t\u00eb jet\u00eb penges\u00eb p\u00ebr zhvillimin e aktivitetet t\u00eb mir\u00ebfillta komerciale. Kjo do t\u00eb vazhdoj\u00eb t\u00eb reflektoj\u00eb sidomos n\u00eb munges\u00ebn e menaxhmentit profesional dhe me nj\u00eb vizion global p\u00ebr k\u00ebt\u00eb nd\u00ebrmarrje, pa t\u00eb cilin nuk mund t\u00eb b\u00ebhet asnj\u00eb ristrukturim dhe riorientim i nd\u00ebrmarrjes.<\/p>\n<p>Por, ajo q\u00eb \u00ebsht\u00eb m\u00eb me r\u00ebnd\u00ebsi ka t\u00eb b\u00ebj\u00eb me munges\u00ebn e infrastruktur\u00ebs institucionale q\u00eb \u00ebsht\u00eb penges\u00eb p\u00ebr zhvillimin si t\u00eb Trep\u00e7\u00ebs, ashtu dhe t\u00eb nd\u00ebrmarrjeve t\u00eb m\u00ebdha strategjike, n\u00eb t\u00eb cilat potencialisht do t\u00eb mund t\u00eb inkuadrohej edhe kapitali privat. Kjo e fundit do t\u00eb ishte ve\u00e7an\u00ebrisht e mundur p\u00ebrmes mund\u00ebsis\u00eb q\u00eb nd\u00ebrmarrjet e m\u00ebdha t\u00eb Kosov\u00ebs t\u00eb sh\u00ebrbejn\u00eb si baz\u00eb p\u00ebr krijimin n\u00eb Kosov\u00eb t\u00eb tregut t\u00eb kapitalit.<\/p>\n<p>Kjo munges\u00eb institucionale \u00ebsht\u00eb e trefisht\u00eb. E para, \u00ebsht\u00eb komercializimi i pamjaftuesh\u00ebm i nd\u00ebrmarrjeve ekzistuese shtet\u00ebrore. Ky komercializim i gjymtuar \u00ebsht\u00eb pjes\u00ebrisht rezultat i mbajtjes s\u00eb nd\u00ebrmarrjeve n\u00ebn kontroll politik (si baz\u00eb p\u00ebr patronazh politik, ndarje vendesh pune p\u00ebr familjar\u00eb e lojalist\u00eb partiak\u00eb, ndarje tenderesh etj.). Me nj\u00eb fjal\u00eb, para se t\u00eb jen\u00eb nd\u00ebrmarrje me q\u00ebllime komerciale, ato mbesin n\u00eb radh\u00eb t\u00eb par\u00eb instrumente politike e elektorale t\u00eb partive n\u00eb pushtet. E dyta, mungesa e infrastruktur\u00ebs institucionale ka t\u00eb b\u00ebj\u00eb me mosdefinimin e rolit t\u00eb shtetit si aksionar n\u00eb nd\u00ebrmarrjet ekonomike t\u00eb Kosov\u00ebs. Sot, ekzistojn\u00eb nj\u00eb mori formash se si Republika e Kosov\u00ebs ushtron pron\u00ebsin\u00eb e saj mbi nd\u00ebrmarrje t\u00eb ndryshme n\u00eb Kosov\u00eb. P\u00ebr nd\u00ebrmarrje komerciale, nj\u00eb p\u00ebrkufizim i rolit t\u00eb shtetit si pronar i aseteve ekonomike do t\u00eb ndodhte sikur t\u00eb krijohej nj\u00eb agjension i vet\u00ebm i pavarur p\u00ebrmes t\u00eb cilit Republika e Kosov\u00ebs do t\u00eb ushtronte pron\u00ebsin\u00eb ose bashk\u00ebpron\u00ebsin\u00eb e vet mbi t\u00eb gjitha asetet ekonomike n\u00eb t\u00eb cilat ajo ka interes. Pavar\u00ebsia e k\u00ebtij agjensioni do t\u00eb garantonte se asetet ekonomike sh\u00ebrbejn\u00eb p\u00ebr q\u00ebllime ekonomike dhe nuk p\u00ebrdor\u00ebn p\u00ebr q\u00ebllime politike, pasi q\u00eb veprimtaria e saj do t\u00eb vler\u00ebsohej n\u00eb baz\u00eb t\u00eb pasqyrave financiare.<\/p>\n<p>Dhe n\u00eb fund, \u00ebsht\u00eb mungesa e vet\u00eb kapitalit q\u00eb p\u00ebrb\u00ebn penges\u00eb si p\u00ebr Trep\u00e7\u00ebn, ashtu dhe p\u00ebr nd\u00ebrmarrjet tjera ekzistuese shtet\u00ebrore, por edhe p\u00ebr zhvillimin e sektor\u00ebve t\u00eb rinj ekonomik. Ky problem do t\u00eb zgjidhej pjes\u00ebrisht me themelimin e nj\u00eb Banke Zhvillimore, e cila do t\u00eb mund t\u00eb sh\u00ebrbente si financuesi kryesor i investimeve t\u00eb m\u00ebdha strategjike n\u00eb Kosov\u00eb, p\u00ebrfshir\u00eb edhe Trep\u00e7\u00ebn.<\/p>\n<p>P\u00ebr ta p\u00ebrmbyllur, do t\u00eb thosha se ligji p\u00ebr Trep\u00e7\u00ebn p\u00ebrb\u00ebn kryesisht nj\u00eb akt simbolik t\u00eb qeveris\u00eb s\u00eb Kosov\u00ebs p\u00ebr Trep\u00e7\u00ebn. Zhvillimi ekonomik n\u00eb Kosov\u00eb, brenda t\u00eb cilit do t\u00eb p\u00ebrfshiheshin edhe burimet minerare t\u00eb vendit, nuk mund t\u00eb ndodh\u00eb brenda nj\u00eb kornize institucionale e cila \u00ebsht\u00eb d\u00ebshmuar si e d\u00ebshtuar.
