Lidhur me shkeljet e Ligjit nr. 04\/L-219 p\u00ebr t\u00eb Huajt<\/strong><\/p>\n<p>Meqen\u00ebse shtetasit turq t\u00eb arrestuar dje dhe t\u00eb deportuar nga Republika e Kosov\u00ebs kan\u00eb qen\u00eb t\u00eb pajisur me lejeq\u00ebndrim t\u00eb rregullt n\u00eb shtetin ton\u00eb, procedur\u00ebn dhe k\u00ebrkesat q\u00eb duhet plot\u00ebsuar p\u00ebr t\u2019u pajisur me nj\u00eb lejeq\u00ebndrim t\u00eb till\u00eb nuk do t\u2019i analizojm\u00eb fare.<\/p>\n<p>Nj\u00eb shtetas i huaj, konsiderohet se \u00ebsht\u00eb duke q\u00ebndruar n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme n\u00eb territorin e Republik\u00ebs s\u00eb Kosov\u00ebs, nd\u00ebr t\u00eb tjera edhe n\u00ebse nuk ka leje q\u00ebndrimi t\u00eb vlefsh\u00ebm, i \u00ebsht\u00eb anuluar apo revokuar lejeq\u00ebndrimi. Nj\u00eb nd\u00ebr arsyet p\u00ebr anulim ose revokim t\u00eb lejeq\u00ebndrimit t\u00eb l\u00ebshuar ndaj shtetasit t\u00eb huaj, \u00ebsht\u00eb ekzistimi i rrezikut p\u00ebr rendin publik, sigurin\u00eb shtet\u00ebrore apo sh\u00ebndetin publik, gj\u00eb q\u00eb \u00ebsht\u00eb zbatuar n\u00eb m\u00ebnyr\u00eb t\u00eb padrejt\u00eb n\u00eb rastin e shtetasve turq. Si \u00ebsht\u00eb e mundur q\u00eb k\u00ebta shtetas turq t\u00eb pajisen me lejeq\u00ebndrim n\u00eb vazhdim\u00ebsi, t\u00eb zhvillojn\u00eb aktivitet t\u00eb ligjsh\u00ebm n\u00eb shtetin e Republik\u00ebs s\u00eb Kosov\u00ebs dhe p\u00ebrnj\u00ebher\u00eb t\u00eb kthehen n\u00eb rrezik p\u00ebr rendin dhe sigurin\u00eb shtet\u00ebrore?!<\/p>\n<p>Por edhe sikur ky arsyetim t\u00eb ishte i v\u00ebrtet\u00eb dhe i bazuar n\u00eb fakte, Departamenti p\u00ebr Shtet\u00ebsi, Azil dhe Migracion, do t\u00eb duhej t\u00eb nxirrte nj\u00eb urdh\u00ebr p\u00ebr largim ndaj t\u00eb huajit i cili \u00ebsht\u00eb duke q\u00ebndruar n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme n\u00eb territorin e Republik\u00ebs s\u00eb Kosov\u00ebs. Nj\u00eb urdh\u00ebr i till\u00eb do t\u00eb l\u00ebshohej n\u00eb form\u00eb t\u00eb vendimit, i cili do t\u00eb p\u00ebrmbante t\u00eb dh\u00ebnat personale p\u00ebr shtetasin e huaj i cili \u00ebsht\u00eb subjekt i largimit, si dhe arsyen e l\u00ebshimit t\u00eb nj\u00eb urdhri t\u00eb till\u00eb, afatin brenda t\u00eb cilit i huaji duhet t\u00eb largohet nga territori i Republik\u00ebs s\u00eb Kosov\u00ebs, pik\u00ebn e kalimit kufitar nga duhet t\u00eb kaloj\u00eb, si dhe afatin e ndalimit t\u00eb hyrjes n\u00eb territorin e Republik\u00ebs s\u00eb Kosov\u00ebs (n\u00ebse i shqiptohet nj\u00eb mas\u00eb e till\u00eb). Urdh\u00ebr largimi duhet t\u00eb p\u00ebrmbaj\u00eb edhe k\u00ebshill\u00ebn juridike p\u00ebr ankes\u00eb dhe procedur\u00ebn e ankimimit.<\/p>\n<p>I huaji, i cili \u00ebsht\u00eb subjekt i urdhrit t\u00eb largimit, i mund\u00ebsohet q\u00eb n\u00eb m\u00ebnyr\u00eb vullnetare ta l\u00ebshoj\u00eb territorin e Republik\u00ebs s\u00eb Kosov\u00ebs n\u00eb nj\u00eb afat kohor, i cili nuk mund t\u00eb jet\u00eb m\u00eb i shkurt\u00eb se shtat\u00eb (7) dit\u00eb dhe jo m\u00eb i gjat\u00eb se tridhjet\u00eb (30) dit\u00eb.<\/p>\n<p>N\u00eb rast se i huaji nuk e l\u00ebshon territorin e Republik\u00ebs s\u00eb Kosov\u00ebs brenda afatit kohor t\u00eb p\u00ebrcaktuar n\u00eb urdhrin p\u00ebr largim pa ndonj\u00eb arsye objektive, ai largohet me forc\u00eb dhe ky largim b\u00ebhet nga Policia Kufitare e Kosov\u00ebs.<\/p>\n<p>Mir\u00ebpo, me k\u00ebt\u00eb ligj \u00ebsht\u00eb rregulluar edhe kategoria e t\u00eb huajve t\u00eb cil\u00ebt nuk d\u00ebbohen nga territori i Republik\u00ebs s\u00eb Kosov\u00ebs. Sipas k\u00ebtij ligji, i huaji nuk d\u00ebbohet nd\u00ebr t\u00eb tjera, n\u00ebse ekziston dyshimi i bazuar se i huaji n\u00eb vendin e origjin\u00ebs apo n\u00eb nj\u00eb vend tjet\u00ebr, do t\u00eb d\u00ebnohet me vdekje, do t\u2019i n\u00ebnshtrohet tortur\u00ebs, trajtimit \u00e7njer\u00ebzor e degradues apo d\u00ebnimeve p\u00ebr shkaqe diskriminuese.<\/p>\n<p>Asnj\u00eb rrethan\u00eb ligjore nuk ka ekzistuar p\u00ebr deportimin e shtetasve turq nga Republika e Kosov\u00ebs, dhe n\u00eb munges\u00eb t\u00eb arsyeve ligjore p\u00ebr nj\u00eb deportim t\u00eb till\u00eb, shtetasit turq nuk do t\u00eb duhej t\u00eb deportoheshin n\u00eb Turqi n\u00eb asnj\u00eb rrethan\u00eb, sepse ekziston mund\u00ebsia reale q\u00eb k\u00ebta shtetas turq do t\u2019i n\u00ebnshtrohen torturave, trajtimit \u00e7njer\u00ebzor e degradues dhe mund t\u00eb d\u00ebnohen p\u00ebr shkaqe t\u00eb diskriminimit, dhe kjo \u00ebsht\u00eb v\u00ebrtetuar nga praktika e veprimit t\u00eb shtetit turk ndaj kund\u00ebrshtar\u00ebve t\u00eb presidentit Erdogan n\u00eb t\u00eb kaluar\u00ebn.<\/p>\n<p><strong>II. Lidhur me mos zbatimin e procedurave ligjore t\u00eb Ekstradimit<\/strong><\/p>\n<p>Kur nj\u00eb person arrestohet n\u00eb territorin e Republik\u00ebs s\u00eb Kosov\u00ebs n\u00eb baz\u00eb t\u00eb nj\u00eb urdh\u00ebrarresti nd\u00ebrkomb\u00ebtar t\u00eb l\u00ebshuar nga shteti k\u00ebrkues (n\u00eb k\u00ebt\u00eb rast Turqia) procedura ligjore p\u00ebr ekstradim t\u00eb personit t\u00eb k\u00ebrkuar do t\u00eb ishte kjo:<\/p>\n<p>S\u00eb pari, ndaj personit t\u00eb ndaluar dhe arrestuar, n\u00eb baz\u00eb t\u00eb propozimit t\u00eb Prokurorit t\u00eb Shtetit mund t\u2019i caktohet ndonj\u00eb mas\u00eb p\u00ebr sigurimin e pranis\u00eb s\u00eb tij gjat\u00eb zhvillimit t\u00eb k\u00ebsaj procedure t\u00eb ekstradimit nga Gjyqtari i Procedur\u00ebs Paraprake (dor\u00ebzania, arresti sht\u00ebpiak, paraburgimi).<\/p>\n<p>S\u00eb dyti, shteti k\u00ebrkues (n\u00eb k\u00ebt\u00eb rast Turqia) do t\u00eb duhej q\u00eb t\u00eb d\u00ebrgonte p\u00ebrmes rrug\u00ebve diplomatike k\u00ebrkes\u00ebn p\u00ebr ekstradim t\u00eb personit t\u00eb k\u00ebrkuar n\u00eb t\u00eb cil\u00ebn do t\u00eb b\u00ebhej nj\u00eb p\u00ebrshkrim i sakt\u00eb i personit t\u00eb k\u00ebrkuar (emri dhe mbiemri, fotografia). Po ashtu k\u00ebrkes\u00ebs do t\u00eb duhej t\u2019i bashk\u00ebngjitej urdh\u00ebr ndalimi (urdh\u00ebrarresti i l\u00ebshuar), si dhe nj\u00eb p\u00ebrshkrim i fakteve mbi baz\u00ebn e t\u00eb cilave \u00ebsht\u00eb k\u00ebrkuar ekstradimi s\u00eb bashku me cil\u00ebsimin ligjor p\u00ebr vepr\u00ebn penale q\u00eb dyshohet.<\/p>\n<p>N\u00eb rast se shteti k\u00ebrkues n\u00eb afat prej 40 dit\u00ebsh nuk dor\u00ebzon k\u00ebrkes\u00eb p\u00ebr ekstradim dhe asnj\u00eb informacion tjet\u00ebr lidhur me rastin, procedura e ekstradimit ndaj personit t\u00eb k\u00ebrkuar pushohet menj\u00ebher\u00eb.<\/p>\n<p>S\u00eb treti, n\u00eb rast se shteti k\u00ebrkues (Turqia) dor\u00ebzon k\u00ebrkes\u00ebn e plot\u00eb p\u00ebr ekstradim, procedura e ekstradimit zhvillohet pran\u00eb Gjykat\u00ebs Themelore, dhe ndaj \u00e7far\u00ebdo vendimi t\u00eb saj lidhur me ekstradim ose jo t\u00eb personit t\u00eb k\u00ebrkuar, pal\u00ebt kan\u00eb t\u00eb drejt\u00eb t\u00eb ushtrojn\u00eb ankes\u00eb n\u00eb Gjykat\u00eb t\u00eb Apelit e cila merr nj\u00eb vendim p\u00ebrfundimtar lidhur me k\u00ebrkes\u00ebn p\u00ebr ekstradim.<\/p>\n<p>N\u00eb rast se Gjykata e Apelit vendos p\u00ebr ekstradim t\u00eb personit t\u00eb k\u00ebrkuar dhe ndaj k\u00ebtij vendimi pal\u00ebt nuk kan\u00eb t\u00eb drejt\u00eb n\u00eb ankes\u00eb, vendimi p\u00ebrfundimtar p\u00ebr ekstradim ose jo t\u00eb personit t\u00eb k\u00ebrkuar merret nga Ministri i Drejt\u00ebsis\u00eb s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, i cili nuk \u00ebsht\u00eb i lidhur me vendimin gjyq\u00ebsor dhe mund t\u00eb refuzoj\u00eb ekstradimin e personit t\u00eb k\u00ebrkuar.<\/p>\n<p>S\u00eb kat\u00ebrti, ekzistojn\u00eb disa pengesa p\u00ebr ekstradim t\u00eb personit t\u00eb k\u00ebrkuar t\u00eb cilat jan\u00eb t\u00eb p\u00ebrcaktuara me Konvent\u00ebn Evropiane p\u00ebr Ekstradimin dhe Ligjin p\u00ebr Bashk\u00ebpunim Juridik Nd\u00ebrkomb\u00ebtar n\u00eb \u00c7\u00ebshtjet Penale. Nj\u00eb nd\u00ebr pengesat kryesore p\u00ebr ekstradim jan\u00eb veprat penale politike. Nd\u00ebrsa, si pengesa procedurale p\u00ebr mosekstradim t\u00eb personit t\u00eb k\u00ebrkuar jan\u00eb shkaqet e arsyeshme se personi i k\u00ebrkuar mund t\u2019i n\u00ebnshtrohet tortur\u00ebs apo trajtimit mizor, \u00e7njer\u00ebzor, posht\u00ebrues ose nd\u00ebshkimit.<\/p>\n<p>Ekstradimi nuk lejohet n\u00ebse ka dyshim t\u00eb bazuar se k\u00ebrkesa p\u00ebr ekstradim \u00ebsht\u00eb b\u00ebr\u00eb me q\u00ebllim t\u00eb ndjekjes ose nd\u00ebshkimit t\u00eb personit p\u00ebr shkak t\u00eb rac\u00ebs, fes\u00eb, gjinis\u00eb, shtet\u00ebsis\u00eb, bindjes politike, p\u00ebrkat\u00ebsis\u00eb etnike ose an\u00ebtar\u00ebsis\u00eb n\u00eb ndonj\u00eb grup shoq\u00ebror.<\/p>\n<p>Shtetasit turq, p\u00ebrkrah\u00ebs t\u00eb l\u00ebvizjes Gyleniste, e cila l\u00ebvizje \u00ebsht\u00eb kund\u00ebrshtare politike e presidentit Erdogan, jan\u00eb t\u00eb k\u00ebrkuar p\u00ebr shkak t\u00eb bindjeve t\u00eb tyre politike dhe kund\u00ebrshtimit t\u00eb politikave udh\u00ebheq\u00ebse t\u00eb presidentit Erdogan, e po ashtu si pasoj\u00eb e k\u00ebsaj do t\u2019i n\u00ebnshtroheshin nj\u00eb procesi t\u00eb padrejt\u00eb dhe t\u00eb ansh\u00ebm gjyq\u00ebsor n\u00eb shtetin turk, prandaj, procedura e ekstradimit t\u00eb k\u00ebtyre shtetasve turq n\u00eb \u00e7do rast do t\u00eb duhej t\u00eb refuzohej.<\/p>\n<p>N\u00eb rast se shtetasit turq jan\u00eb ekstraduar duke mos respektuar asnj\u00eb procedur\u00eb gjyq\u00ebsore t\u00eb parashikuar me ligj, ashtu si edhe ka ndodhur n\u00eb k\u00ebt\u00eb rast, do t\u00eb duhej q\u00eb t\u00eb gjith\u00eb personat e involvuar t\u00eb thirren n\u00eb p\u00ebrgjegj\u00ebsi penale, sepse arrestimi dhe dor\u00ebzimi i tyre i ngjan m\u00eb shum\u00eb nj\u00eb kidnapimi se sa nj\u00eb arrestimi t\u00eb ligjsh\u00ebm t\u00eb parapar\u00eb me dispozita ligjore nd\u00ebrkomb\u00ebtare dhe vendore.<\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<div class=\"news-right\">\n<div class=\"post\">\n<p class=\"author\">\n<\/div>\n<\/div>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>Meqen\u00ebse ekziston nj\u00eb mjegull e madhe me rastin e dor\u00ebzimit t\u00eb shtetasve turq te autoritetet e shtetit turk, dhe nuk dihet se cila procedur\u00eb \u00ebsht\u00eb zbatuar n\u00eb rastin e tyre, ajo e d\u00ebbimit apo e ekstradimit, m\u00eb posht\u00eb mund t\u00eb lexoni opinionin tim lidhur me shkeljet ligjore n\u00eb rast t\u00eb zbatimit t\u00eb k\u00ebtyre dy procedurave.
