Tema e demarkacionit pritet t\u00eb jet\u00eb e pashmangshme. Ky shkrim argumenton se Kosova duhet t\u00eb p\u00ebrgatis ofert\u00eb maksimaliste dhe ofert\u00eb pragmatike p\u00ebr Malin e Zi lidhur me tem\u00ebn e demarkacionit. Oferta maksimaliste e Kosov\u00ebs n\u00ebnkupton k\u00ebrkes\u00eb p\u00ebr rinegocim t\u00eb Marr\u00ebveshjes apo d\u00ebrgim t\u00eb saj n\u00eb arbitrazh nd\u00ebrkomb\u00ebtar. Duke u bazuar n\u00eb q\u00ebndrimet paraprake t\u00eb ekzekutivit malazez, nj\u00eb p\u00ebrgjigje pozitive ndaj ofert\u00ebs maksimaliste t\u00eb Kosov\u00ebs duket e v\u00ebshtir\u00eb.<\/p>\n<p>N\u00eb rast t\u00eb refuzimit nga ana e Malit t\u00eb Zi t\u00eb ofert\u00ebs maksimaliste, Kosova mund t\u00eb p\u00ebrdor\u00eb ofert\u00ebn pragmatike. Kjo n\u00ebnkupton t\u00eb k\u00ebrkoj\u00eb nga Mali i Zi garanci shtet\u00ebrore se do t\u00eb rishikoj\u00eb pjes\u00eb t\u00eb marr\u00ebveshjes n\u00eb\u00a0t\u00eb ardhmen n\u00eb rast se Kosova e ratifikon marr\u00ebveshjen aktuale. Kjo gj\u00eb mund t\u00eb rregullohet nga e drejta nd\u00ebrkomb\u00ebtare n\u00ebp\u00ebrmjet nxjerrjes s\u00eb \u2018akteve unilaterale\u2019 nga udh\u00ebheq\u00ebsit shtet\u00ebror t\u00eb t\u00eb dy vendeve.<\/p>\n<p><strong>\u00c7ka \u00ebsht\u00eb akti unilateral<\/strong><\/p>\n<p>Akti unilateral paraqet shprehje t\u00eb vullnetit t\u00eb shtetit t\u00eb krijoj\u00eb efekte ligjore p\u00ebr q\u00ebndrimet e shprehura nga p\u00ebrfaq\u00ebsues t\u00eb lart\u00eb shtet\u00ebror\u00eb (presidenti, kryeministri, ministri i pun\u00ebve t\u00eb jashtme) p\u00ebr \u00e7\u00ebshtje specifike. Akti unilateral mund t\u00eb jet\u00eb n\u00eb form\u00eb gojore ose t\u00eb shkruar. Shembuj t\u00eb aktit unilateral paraqesin deklaratat p\u00ebr njohjen e shteteve dhe premtimet tjera nd\u00ebrkomb\u00ebtare q\u00eb kan\u00eb p\u00ebr q\u00ebllim t\u00eb krijojn\u00eb obligime nd\u00ebrkomb\u00ebtare.<\/p>\n<p>Garancit\u00eb p\u00ebr zbatimin e aktit unilateral jan\u00eb t\u00eb bazuara n\u00eb vullnetin e mir\u00eb dhe jo n\u00eb rregulla standarde t\u00eb traktatit. Megjithat\u00eb, r\u00ebnd\u00ebsia e aktit unilateral n\u00eb t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare \u00ebsht\u00eb konfirmuar nga\u00a0<a href=\"http:\/\/legal.un.org\/ilc\/texts\/instruments\/english\/commentaries\/9_9_2006.pdf\">Komisioni p\u00ebr t\u00eb Drejt\u00ebn Nd\u00ebrkomb\u00ebtare t\u00eb OKB-s\u00eb<\/a>\u00a0dhe Gjykata Nd\u00ebrkomb\u00ebtare e Drejt\u00ebsis\u00eb. Kjo e fundit n\u00eb rastin e\u00a0<em>Testit Nuklear (Australia k. Franc\u00ebs)<\/em>\u00a0ka konstatuar se<\/p>\n<p>\u201cdeklaratat e b\u00ebra n\u00ebp\u00ebrmjet aktit unilateral, lidhur me rrethanat ligjore ose faktike, mund t\u00eb krijojn\u00eb obligime ligjore&#8230; Nj\u00eb deklarat\u00eb e till\u00eb, e dh\u00ebn\u00eb publikisht dhe me q\u00ebllim t\u00eb jet\u00eb detyruese, edhe kur nuk \u00ebsht\u00eb dh\u00ebn\u00eb n\u00eb kontekst t\u00eb negociimit nd\u00ebrkomb\u00ebtar, \u00ebsht\u00eb detyruese.\u201d [para 43]<\/p>\n<p>N\u00eb baz\u00eb t\u00eb k\u00ebsaj, n\u00eb rast se kryeministri, presidenti, apo ministri i pun\u00ebve t\u00eb jashtme t\u00eb Kosov\u00ebs shprehet n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb se merr obligim p\u00ebr rishikim t\u00eb marr\u00ebveshjes me Malin e Zi, ai \u2018akt unilateral\u2019 krijon pritshm\u00ebri nd\u00ebrkomb\u00ebtare q\u00eb Kosova t\u00eb zbatoj\u00eb obligimet n\u00eb fjal\u00eb. Nj\u00eb deklarat\u00eb e till\u00eb duhet t\u00eb jet\u00eb shum\u00eb precize, t\u00eb p\u00ebmbaj\u00eb afate kohore dhe pikat ky\u00e7e q\u00eb mund t\u00eb negociohen. Ta z\u00ebm\u00eb duhet t\u00eb parasheh obligimin p\u00ebr t\u00eb negociuar pjes\u00eb t\u00eb marr\u00ebveshjes edhe n\u00eb rast se vet\u00ebm nj\u00ebra pal\u00eb sjell\u00eb argumente. Detajet e tekstit duhet t\u00eb rregullohen nga ekspert\u00eb t\u00eb s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb evitohen dyshimet eventuale lidhur me detyrimet q\u00eb dalin nga akti unilateral.<\/p>\n<p>Akti unilateral i nj\u00eb vendi megjithat\u00eb nuk krijon obligim nd\u00ebrkomb\u00ebtar p\u00ebr nj\u00eb vend tjet\u00ebr. P\u00ebr k\u00ebt\u00eb arsye, \u00ebsht\u00eb e r\u00ebnd\u00ebsishme q\u00eb Kosova t\u00eb negocioj\u00eb me p\u00ebrfaq\u00ebsuesit shtet\u00ebror t\u00eb Malit t\u00eb Zi q\u00eb k\u00ebta t\u00eb fundit t\u00eb l\u00ebshojn\u00eb nj\u00eb akt unilateral me q\u00ebndrime t\u00eb nj\u00ebjta me ato t\u00eb pal\u00ebs kosovare.<\/p>\n<p><strong>Qasja ndaj Malit t\u00eb Zi<\/strong><\/p>\n<p>Kosova nuk mund ta obligoj\u00eb Malin e Zi q\u00eb t\u00eb nxjerr\u00eb nj\u00eb akt unilateral n\u00eb lidhje me rishikimin e pjes\u00ebve t\u00eb marr\u00ebveshjes p\u00ebr demarkimin e kufirit me Kosov\u00ebn. Kjo gj\u00eb mbetet n\u00eb gjykimin e Malit t\u00eb Zi. Megjithat\u00eb, ratifikimi i marr\u00ebveshje me Malin e Zi me k\u00ebrkes\u00ebn p\u00ebr nxjerrjen e aktit unilateral nga t\u00eb dyja pal\u00ebt tregon se Kosova \u00ebsht\u00eb e gatshme t\u00eb gjej\u00eb zgjidhje konsensuale n\u00eb baz\u00eb t\u00eb praktik\u00ebs t\u00eb s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare. Kosova duhet t\u2019i qaset Malit t\u00eb Zi me k\u00ebrkes\u00eb p\u00ebr mir\u00ebkuptim dhe t\u00eb p\u00ebrdor\u00eb miqt\u00eb nd\u00ebrkomb\u00ebtar\u00eb p\u00ebr t\u00eb k\u00ebrkuar nga Mali i Zi t\u00eb marr\u00eb qasje pragmatike.<\/p>\n<p>Nj\u00eb qasje e till\u00eb do ta shnd\u00ebrronte Kosov\u00ebn nga nj\u00eb vend ku traktat-b\u00ebrja b\u00ebhet me befasi dhe t\u00eb panjohura n\u00eb nj\u00eb vend ku problemet zgjidhen me qasje profesionale dhe n\u00eb harmoni me t\u00eb drejt\u00ebn dhe praktik\u00ebn nd\u00ebrkomb\u00ebtare.<\/p>\n<p><strong>\u00c7ka n\u00eb rast t\u00eb (mos)suksesit t\u00eb aktit unilateral<\/strong><\/p>\n<p>P\u00ebrderisa rishikimi i marr\u00ebveshjes aktuale p\u00ebr Malin e Zi n\u00ebnkupton kthimin n\u00eb gjendjen zero dhe anulim t\u00eb vendimeve paraprake, akti unilateral nuk e cenon marr\u00ebveshjen dhe vendimet rreth validimit t\u00eb saj. Akti unilateral vet\u00ebm do t\u00eb qart\u00ebsonte gatishm\u00ebrin\u00eb e Malit t\u00eb Zi p\u00ebr t\u00eb negociuar n\u00eb t\u00eb ardhmen p\u00ebr pjes\u00eb t\u00eb marr\u00ebveshjes. Politikisht, nj\u00eb veprim i till\u00eb nuk duket i pamundur p\u00ebr t\u2019u realizuar nga\u00a0<a href=\"http:\/\/www.gazetaexpress.com\/lajme\/qeveria-e-malit-te-zi-flasim-me-kosoven-per-demarkacion-por-ne-e-kemi-miratuar-437684\/\">qeveria aktuale Malit t\u00eb Zi.<\/a><\/p>\n<p>N\u00eb rast se Mali i Zi pajtohet t\u00eb aprovoj\u00eb aktin unilateral n\u00eb fjal\u00eb dhe Kosova ratifikon marr\u00ebveshjen me Malin e Zi, Kosova duhet t\u00eb propozoj\u00eb krijimin e nj\u00eb komisioni t\u00eb ri p\u00ebr vler\u00ebsimin e marr\u00ebveshjes me Malin e Zi. Ky komision, p\u00ebr dallim nga t\u00eb m\u00ebhershmit, duhet t\u00eb p\u00ebrb\u00ebhet nga emra q\u00eb rekomandohen nga i gjith\u00eb spektri politik. Komisionet paraprake, pa paragjykuar pun\u00ebn e tyre, kan\u00eb qen\u00eb t\u00eb krijuara nga figura politike q\u00eb ose e kan\u00eb p\u00ebrkrahur ose kund\u00ebrshtuar marr\u00ebveshjen n\u00eb parim, duke e krijuar p\u00ebrshtypjen, qoft\u00eb edhe t\u00eb gabuar, se gjetjet e komisioneve profesionale kan\u00eb qen\u00eb t\u00eb parap\u00ebrcaktuara.<\/p>\n<p>Mandati i komisionit t\u00eb ri t\u00eb do t\u00eb duhej t\u00eb kufizohet n\u00eb identifikimin konkret t\u00eb gabimeve eventuale n\u00eb marr\u00ebveshjen me Malin e Zi. K\u00ebt\u00eb vler\u00ebsim duhet ta b\u00ebj\u00eb duke u bazuar n\u00eb kriteret p\u00ebrcaktuese t\u00eb kufirit q\u00eb rrjedhin nga marr\u00ebveshja ekzistuese me Malin e Zi. N\u00eb rast t\u00eb gjetjeve t\u00eb tilla, Kosova do ta p\u00ebrdorte aktin unilateral si burim ligjor p\u00ebr t\u2019ju qasur Malit t\u00eb Zi p\u00ebr rishikimin eventual t\u00eb marr\u00ebveshjes.<\/p>\n<p>N\u00eb rast se Mali i Zi refuzon nxjerrjen e aktit unilateral n\u00eb fjal\u00eb, Kosov\u00ebs i mbetet t\u00eb zgjedh\u00eb n\u00eb mes t\u00eb ratifikimit dhe mosratifikimit.
