Nj\u00eb sistem gjyq\u00ebsor i pavarur garanton q\u00eb sundimi i ligjit do t\u00eb ndiqet dhe jo sundimi i vullnetit politik, me gjyqtar\u00eb t\u00eb pavarur q\u00eb jan\u00eb n\u00eb gjendje t\u00eb zbatojn\u00eb ligjin pa u ndikuar nga faktor\u00ebt e jasht\u00ebm.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Si\u00e7 e dim\u00eb parimi i pavar\u00ebsis\u00eb s\u00eb gjyq\u00ebsorit \u00ebsht\u00eb thell\u00ebsisht i rr\u00ebnjosur n\u00eb doktrin\u00ebn e Montesquieut p\u00ebr ndarjen e pushteteve. Montsquieu ishte i mendimit se nj\u00eb ndarje e v\u00ebrtet\u00eb e pushtetit ndodh vet\u00ebm at\u00ebher\u00eb kur arrihet t\u00eb sigurohet nj\u00eb ndarje e qart\u00eb e funksioneve t\u00eb ushtruara nga tre organet e qeveris\u00eb &#8211; ekzekutivi, legjislativi dhe gjyq\u00ebsori.<\/span><br \/>\n<span style=\"font-size: 16px;\">Mir\u00ebpo, edhe pse \u00ebsht\u00eb pranuar si koncept, n\u00eb realitet n\u00eb shum\u00eb vende nuk ekziston nj\u00eb ndarje e rrept\u00eb e pushteteve, q\u00eb do t\u00eb thot\u00eb s\u00eb asnj\u00eb gjyq\u00ebsor nuk \u00ebsht\u00eb plot\u00ebsisht i ndar\u00eb nga organet administrative dhe legjislative, ngase nj\u00eb gj\u00eb e till\u00eb do t\u00eb zvog\u00ebloj\u00eb fuqin\u00eb e kontrollit dhe balancit, duke e b\u00ebr\u00eb t\u00eb pamundur komunikimin midis deg\u00ebve t\u00eb qeveris\u00eb.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">\u00cbsht\u00eb m\u00eb se e r\u00ebnd\u00ebsishme t\u00eb kemi gjyqtar\u00eb t\u00eb pavarur, t\u00eb cil\u00ebt \u00a0mbrojn\u00eb t\u00eb drejtat dhe lirit\u00eb tona, por \u00ebsht\u00eb gjithashtu e r\u00ebnd\u00ebsishme t\u00eb kemi mekanizma t\u00eb cil\u00ebt na mbrojn\u00eb nga gjyqtar\u00eb q\u00eb e ndjejn\u00eb veten \u201cshum\u00eb t\u00eb fuqish\u00ebm\u201d (superior\u00eb) apo veprojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebanshme. Me gjyqtar\u00eb t\u00eb till\u00eb (super t\u00eb pavarur dhe t\u00eb nj\u00ebansh\u00ebm) mund t\u00eb zgjidhim raste sipas preferencave personale apo t\u00eb dirigjiara \u00a0nga t\u00eb \u201cfortit e lagjes.\u201d<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Kushtetuta u jep gjyqtar\u00ebve pushtet p\u00ebr t\u00eb b\u00ebr\u00eb pun\u00ebn e tyre, por gjithashtu p\u00ebrcakton mekanizma q\u00eb parandalojn\u00eb t\u00eb nj\u00ebjtit t\u00eb keqp\u00ebrdorin kompetencat q\u00eb u jan\u00eb dh\u00ebn\u00eb. Kjo garanton se gjykatat dhe gjyqtar\u00ebt t\u00eb mbesin besnik\u00eb ndaj sundimit t\u00eb ligjit.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Mir\u00ebpo m\u00eb duhet t\u00eb theksoj se pavar\u00ebsia e gjyq\u00ebsorit n\u00eb nj\u00eb vend nuk varet vet\u00ebm nga kushtetuta dhe ligjet e atij vendi, por edhe nga struktura politike dhe klima shoq\u00ebrore, si dhe tradita juridike q\u00eb mbizot\u00ebron n\u00eb at\u00eb vend. N\u00eb k\u00ebt\u00eb kontekst, \u00ebsht\u00eb m\u00eb se e r\u00ebnd\u00ebsishme p\u00ebr nj\u00eb shtet q\u00eb gjyqtar\u00ebt t\u00eb jen\u00eb t\u00eb paansh\u00ebm dhe t\u00eb pavarur nga t\u00eb gjitha presionet e paraqitura n\u00eb \u00e7far\u00ebdo forme n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb paraqiten para publikut t\u00eb gjer\u00eb si gardian\u00eb t\u00eb v\u00ebrtet\u00eb t\u00eb ligjit, t\u00eb fitojn\u00eb besimin dhe t\u00eb krijojn\u00eb bindje tek publiku se rastet e tyre do t\u00eb vendosen n\u00eb m\u00ebnyr\u00eb t\u00eb drejt\u00eb dhe n\u00eb p\u00ebrputhje me ligjin.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Ekzistojn\u00eb nj\u00eb varg konventash nd\u00ebrkomb\u00ebtare t\u00eb cilat proklamojn\u00eb parimet e pavar\u00ebsis\u00eb s\u00eb gjyq\u00ebsorit dhe nj\u00ebkoh\u00ebsisht detyrojn\u00eb shtetin t\u00eb nd\u00ebrmarr\u00eb masa p\u00ebr zbatimin e k\u00ebtyre parimeve n\u00eb praktik\u00eb.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">P\u00ebr m\u00eb tep\u00ebr \u00a0organizatat e ndryshme nd\u00ebrkomb\u00ebtare kan\u00eb dizajnuar nj\u00eb num\u00ebr t\u00eb madh t\u00eb deklaratave dhe rekomandimeve p\u00ebr t\u00eb promovuar pavar\u00ebsin\u00eb e gjyq\u00ebsorit. Megjith\u00ebse k\u00ebto dokumente nuk jan\u00eb t\u00eb detyrueshme n\u00eb kuptimin juridik, ato kan\u00eb krijuar standarde dhe jan\u00eb t\u00eb pranuara gjer\u00ebsisht dhe si t\u00eb tilla jan\u00eb b\u00ebr\u00eb mjet dhe udh\u00ebzim i r\u00ebnd\u00ebsish\u00ebm p\u00ebr shum\u00eb vende p\u00ebr krijimin e nj\u00eb sistemi gjyq\u00ebsor efektiv. Pra, p\u00ebrmbajn\u00eb parime q\u00eb rekomandojn\u00eb q\u00eb t\u00eb dy pushtetet, pushteti ekzekutiv dhe ai legjislativ t\u00eb miratojn\u00eb dhe t\u00eb nd\u00ebrmarrin t\u00eb gjitha masat p\u00ebr t\u00eb siguruar pavar\u00ebsin\u00eb e gjyqtar\u00ebve, t\u2019ua mund\u00ebsojn\u00eb atyre t\u00eb veprojn\u00eb pa kufizime, pa ndikime nga jasht\u00eb dhe nd\u00ebrhyrje t\u00eb pahijshme e t\u00eb pajustifikuar (Rekomandimi i K\u00ebshillit t\u00eb Evrop\u00ebs 94 \/ 12).<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Poashtu vlen t\u00eb p\u00ebrmendet se si koncept pavar\u00ebsia e gjyq\u00ebsorit perceptohet ndryshe nga ana e ekspert\u00ebve t\u00eb shkencave juridike, mir\u00ebpo shumica pajtohen se ekzistojn\u00eb dy aspekte t\u00eb ndryshme t\u00eb pavar\u00ebsis\u00eb s\u00eb gjyq\u00ebsorit, pavar\u00ebsia e gjyq\u00ebsorit n\u00eb raport me legjislativin dhe pavar\u00ebsia e gjyqtar\u00ebve individual\u00eb, q\u00eb p\u00ebrfshin pavar\u00ebsin\u00eb personale dhe substanciale.<\/span><br \/>\n<span style=\"font-size: 16px;\">N\u00eb k\u00ebt\u00eb drejtim, pavar\u00ebsia kolektive n\u00ebnkupton pavar\u00ebsin\u00eb e gjyq\u00ebsorit si nj\u00eb organ kolektiv i pavarur nga faktor\u00ebt e jasht\u00ebm (p\u00ebrfshin gjykatat dhe administrat\u00ebn qendrore). Kjo form\u00eb e pavar\u00ebsis\u00eb i referohet pavar\u00ebsis\u00eb s\u00eb stafit administrativ, pavar\u00ebsis\u00eb s\u00eb gjykatave lidhur me buxhetin, mir\u00ebmbajtjen e nd\u00ebrtesave gjyq\u00ebsore, etj. Nd\u00ebrsa pavar\u00ebsia personale e gjyqtar\u00ebve ka t\u00eb b\u00ebj\u00eb me sigurimin dhe ruajtjen e mandatit gjyq\u00ebsor dhe t\u00eb ushtrimit t\u00eb k\u00ebtij mandati n\u00eb m\u00ebnyr\u00eb adekuate, gj\u00eb q\u00eb n\u00ebnkupton ndalimin e kontrollit ekzekutiv mbi em\u00ebrimet gjyq\u00ebsore, caktimin e \u00a0pagave, caktimin e l\u00ebnd\u00ebve, l\u00ebvizjet e mundshme t\u00eb gjyqtar\u00ebve prej nj\u00eb vendi n\u00eb tjetrin.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">\u00cbsht\u00eb e njohur gjer\u00ebsisht se secila shoq\u00ebri tranzicionale ballafaqohet p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb me pasojat q\u00eb rrjedhin nga faza para-tranzicionale, e cila karakterizohet me nj\u00eb kultur\u00eb t\u00eb dob\u00ebt juridike, ku gjyq\u00ebsori ishte subjekt i presioneve t\u00eb shum\u00ebfishta dhe ku ekzistonte nj\u00eb drejt\u00ebsi e dirigjuar p\u00ebrmes telefonit, e njohur si \u201cdrejt\u00ebsi e telefonit\u201d. Si\u00e7 dihet, gjat\u00eb regjimit n\u00eb ish-Jugosllavi, gjyq\u00ebsori nuk g\u00ebzonte pavar\u00ebsin\u00eb nga deg\u00ebt e tjera e qeverisjes. Gjyq\u00ebsori ishte aty p\u00ebr t\u00eb mbrojtur interesat e klas\u00ebs n\u00eb pushtet. Gjyqtar\u00ebt nuk ishin gj\u00eb pos veg\u00ebl e ekzekutivit dhe e shefave t\u00eb partis\u00eb. Pra n\u00eb regjimet e para-tranzicionit gjyq\u00ebsia ishte \u2018e varur\u2019 ose \u2018e negociuar\u2019. Gjyq\u00ebsori \u00a0nuk \u00ebsht\u00eb perceptuar si nj\u00eb trup i pavarur dhe i paansh\u00ebm, i cili ofron drejt\u00ebsi dhe mbron t\u00eb drejtat legjitime t\u00eb individ\u00ebve.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Ky regjim para-tranzicional ka ngadal\u00ebsuar procesin e tranzicionit. Fatkeq\u00ebsisht, edhe pas nj\u00ebzet vitesh t\u00eb p\u00ebrpjekjeve t\u00eb shumta p\u00ebr ta zgjeruar pavar\u00ebsin\u00eb e organeve gjyq\u00ebsore, shoq\u00ebria jon\u00eb ende nuk arriti t\u00eb krijoj\u00eb nj\u00eb gjyq\u00ebsi t\u00eb pavarur, t\u00eb udh\u00ebhequr nga gjyqtar\u00eb t\u00eb cil\u00ebt mb\u00ebshtesin integritetin dhe pavar\u00ebsin\u00eb e gjyq\u00ebsorit dhe q\u00eb p\u00ebrpiqen t\u00eb fitojn\u00eb besimin e humbur t\u00eb popullit n\u00eb gjyq\u00ebsi. T\u00eb minimizojn\u00eb sjelljet t\u00eb pahijshme t\u00eb gjyqtar\u00ebve q\u00eb shfaqen n\u00eb veprimtarin\u00eb e tyre zyrtare dhe private. Pra nuk arrit\u00ebm as t\u00eb krijojm\u00eb po as ta kuptojm\u00eb r\u00ebnd\u00ebsin\u00eb dhe esenc\u00ebn q\u00eb ka nj\u00eb gjyq\u00ebsor i pavarur.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Ata q\u00eb na mbanin leksione p\u00ebr pavar\u00ebsin\u00eb e gjyq\u00ebsorit (nd\u00ebrkomb\u00ebtar\u00ebt) nuk \u00a0ishin as vet\u00eb t\u00eb pavarur. Sistemi gjyq\u00ebsor i tyre ishte n\u00eb t\u00ebr\u00ebsi i varur nga ekzekutivi, nga P\u00ebrfaq\u00ebsuesi Special i Sekretarit t\u00eb P\u00ebrgjithsh\u00ebm t\u00eb OKB-s\u00eb. Si rezultat i k\u00ebsaj, ne vazhduam t\u00eb ecim zvarr\u00eb, duke e nd\u00ebrtuar nj\u00eb gjyq\u00ebsi sipas parametrave t\u00eb p\u00ebrcaktuara nga faktor\u00eb t\u00eb ndrysh\u00ebm, vendor\u00eb dhe nd\u00ebrkomb\u00ebtar\u00eb.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Si rezultat i k\u00ebtyre ngecjeve sot n\u00eb shoq\u00ebrin\u00eb ton\u00eb, mbret\u00ebron nj\u00eb klim\u00eb p\u00ebrplot dyshime n\u00eb gjyq\u00ebsor. N\u00eb vitin 2016 kam zhvilluar nj\u00eb hulumtim lidhur m\u00eb performanc\u00ebn e drejt\u00ebsis\u00eb nd\u00ebrkomb\u00ebtare penale n\u00eb Kosov\u00eb dhe kam pas\u00eb rastin t\u00eb intervistoj individ\u00eb t\u00eb ndrysh\u00ebm. Gjat\u00eb intervistimit, t\u00eb gjith\u00eb t\u00eb intervistuarit kan\u00eb paraqitur nj\u00eb varg kritikash p\u00ebr gjykatat hibride (gjykatat e nd\u00ebrkomb\u00ebtarizuara n\u00eb Kosov\u00eb), mir\u00ebpo p\u00ebrkund\u00ebr asaj ata deklaruan se k\u00ebto gjykata paraqesin t\u00eb vetmen alternativ\u00eb, pasi q\u00eb gjyqtar\u00ebt nd\u00ebrkomb\u00ebtar\u00eb jan\u00eb t\u00eb vetmit q\u00eb mund t\u00eb ofrojn\u00eb pak drejt\u00ebsi p\u00ebr ato raste t\u00eb cilat konsiderohen si \u201cpolitikisht t\u00eb ndjeshme\u201d apo \u201cpolitikisht t\u00eb paprekshme\u201d. Gati t\u00eb gjith\u00eb t\u00eb intervistuarit kan\u00eb shfaqur dyshime n\u00eb gjykatat vendore duke i konsideruar \u00a0ato t\u00eb nj\u00ebanshme dhe t\u00eb varura nga faktor\u00ebt e jasht\u00ebm.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Sa e komplikuar \u00ebsht\u00eb \u00e7\u00ebshtja e pavar\u00ebsis\u00eb s\u00eb gjyq\u00ebsorit m\u00eb s\u00eb miri e tregon rasti i reagimit t\u00eb Od\u00ebs s\u00eb Avokat\u00ebve ndaj rekomandimit dhe urdh\u00ebres\u00ebs s\u00eb l\u00ebshuar nga K\u00ebshilli Gjyq\u00ebsor e q\u00eb ka t\u00eb b\u00ebj\u00eb me qasjen e avokat\u00ebve dhe pal\u00ebve t\u00eb tjera n\u00eb gjykat\u00eb, t\u00eb nxjerr\u00eb dit\u00eb m\u00eb par\u00eb. Q\u00ebllimi i rekomandimit dhe i urdh\u00ebres\u00ebs \u00ebsht\u00eb q\u00eb t\u00eb vendos\u00eb nj\u00eb rend sht\u00ebpiak n\u00ebp\u00ebr gjykata dhe n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb t\u00eb rris\u00eb sigurin\u00eb brenda objekteve, si dhe t\u00eb pengoj\u00eb komunikimin joetik ex-parte.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">Ky rekomandim dhe kjo urdh\u00ebres\u00eb nuk u prit\u00ebn mir\u00eb nga avokat\u00ebt, t\u00eb cil\u00ebt n\u00ebn urdhrin e Od\u00ebs s\u00eb Avokat\u00ebve p\u00ebr disa dit\u00eb me radh\u00eb refuzuan t\u00eb futen n\u00ebp\u00ebr objekte t\u00eb gjykatave dhe n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb cenuan t\u00eb drejtat e klient\u00ebve t\u00eb tyre. Mua nuk m\u00eb habit aspak reagimi i avokat\u00ebve, sepse ky rekomandim i K\u00ebshillit Gjyq\u00ebsor ishte i papritur. Kush mund ta kishte imagjinuar q\u00eb nj\u00eb dit\u00eb nj\u00eb avokat nuk do t\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb t\u00eb trokas\u00eb n\u00eb der\u00ebn e gjyqtarit dhe t\u00eb k\u00ebrkoj\u00eb informata lidhur me rastin. Pse jo? Kjo \u00ebsht\u00eb nj\u00eb gj\u00eb q\u00eb ka ekzistuar q\u00eb nga koha e para-tranzicionit. Mendoj se ka qen\u00eb e domosdoshme q\u00eb K\u00ebshilli Gjyq\u00ebsor t\u00eb njoftoj\u00eb paraprakisht Od\u00ebn e Avokat\u00ebve lidhur me rekomandimin dhe urdh\u00ebres\u00ebn n\u00eb fjal\u00eb dhe t\u00eb k\u00ebrkoj\u00eb nga Oda mb\u00ebshtetje, mir\u00ebkuptim dhe p\u00ebrgjegj\u00ebsi. Thjesht t\u2019ua kujtoj \u00e7far\u00eb n\u00ebnkupton ex-parte komunikimi dhe \u00e7far\u00eb r\u00ebnd\u00ebsie ka. T\u00eb informohen p\u00ebr standardet nd\u00ebrkomb\u00ebtare t\u00eb cilat proklamojn\u00eb paanshm\u00ebrin\u00eb e gjyqtar\u00ebve duke theksuar se \u201cnj\u00eb gjyqtar duhet t\u00eb shmang\u00eb \u00e7do sjellje q\u00eb mund t\u00eb shkaktoj\u00eb nj\u00eb shfaqje t\u00eb anshm\u00ebris\u00eb\u201d (Kodi i Standardeve Minimale t\u00eb Pavar\u00ebsis\u00eb s\u00eb Gjyq\u00ebsorit \/IBA).<\/span><\/p>\n<p><span style=\"font-size: 16px;\">T\u2019ua kujtoj se ekzistojn\u00eb rregullat e sjelljes gjyq\u00ebsore t\u00eb cilat ua ndalojn\u00eb gjyqtar\u00ebve angazhimin n\u00eb komunikimet ex parte. T\u2019ju tregojn\u00eb se avokat\u00ebve u ndalohet komunikimi me nj\u00eb gjyqtar jasht\u00eb pranis\u00eb s\u00eb avokatit t\u00eb pal\u00ebs kund\u00ebrshtare. Kjo ka t\u00eb bej\u00eb m\u00eb rregullat e etik\u00ebs ligjore. T\u2019ju tregojn\u00eb s\u00eb \u00e7far\u00ebdo komunikimi i pahijsh\u00ebm ex-parte midis gjyqtarit dhe avokatit krijon baz\u00eb p\u00ebr t\u00eb inicuar procedur\u00eb disiplinore. T\u2019ju tregohet se atyre u lejohet t\u00eb komunikojn\u00eb me gjyqtar\u00eb, mir\u00ebpo \u00e7do kontakt i till\u00eb duhet t\u00eb kryhet n\u00eb p\u00ebrputhje me rregullat e etik\u00ebs t\u00eb cilat jan\u00eb t\u00eb dizajnuara p\u00ebr t\u00eb siguruar pavar\u00ebsin\u00eb dhe paan\u00ebsin\u00eb e gjyqtarit. T\u2019ju tregojn\u00eb q\u00eb vet\u00eb fakti q\u00eb nj\u00eb avokat mund t\u00eb frekuentoj\u00eb hap\u00ebsir\u00ebn ku jan\u00eb gjyqtar\u00ebt sa her\u00eb dhe kurdo q\u00eb t\u00eb d\u00ebshiroj\u00eb, mund t\u00eb krijoj\u00eb dyshime. T\u2019ju tregojn\u00eb se \u00ebsht\u00eb e nevojshme t\u00eb nd\u00ebrtohet nj\u00eb mur i paduksh\u00ebm rreth secilit gjyqtar i cili do ta b\u00ebj\u00eb at\u00eb t\u00eb paduksh\u00ebm n\u00eb raste t\u00eb caktuara.<\/span><\/p>\n<p><span style=\"font-size: 16px;\">E gjith\u00eb kjo \u00ebsht\u00eb e nevojshme p\u00ebr t\u00eb nd\u00ebrtuar nj\u00eb kultur\u00eb t\u00eb pavar\u00ebsis\u00eb gjyq\u00ebsore, q\u00eb \u00ebsht\u00eb esenciale p\u00ebr demokracin\u00eb, lirin\u00eb, sundimin e ligjit, t\u00eb drejtat e njeriut dhe zhvillimin ekonomik brenda nj\u00eb shoq\u00ebrie.<\/span><\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>Pavar\u00ebsia e gjyq\u00ebsorit \u00ebsht\u00eb nj\u00eb nga parimet m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb sistemit gjyq\u00ebsor.
