P\u00ebrtej p\u00ebrmbajtjes s\u00eb l\u00ebnd\u00ebs s\u00eb sinjalizimit t\u00eb tij, rasti (P. nr. 440\/13, 4 gusht, 2015) &#8211; n\u00eb t\u00eb cilin gjykata e ka gjetur n\u00eb m\u00ebnyr\u00eb t\u00eb kontestueshme fajtor &#8211; \u00ebsht\u00eb edhe fillim i <a href=\"https:\/\/sbunker.net\/s-tatus\/34100\/frikesim-i-sinjalizueseve-pro-credit\/\" target=\"_blank\" rel=\"noopener\">debatit publik rreth vet\u00eb sinjalizimit<\/a>.<\/p>\n<p>K\u00ebshilli i Europ\u00ebs e definon sinjalizimin si raportim ose zbulim t\u00eb informacionit n\u00eb lidhje me nj\u00eb k\u00ebrc\u00ebnim ose d\u00ebmtim t\u00eb interesit publik n\u00eb kontekst t\u00eb marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs, qoft\u00eb ajo n\u00eb sektorin publik, a privat. Nd\u00ebrsa sinjalizues jan\u00eb personat q\u00eb e b\u00ebjn\u00eb zbulimin e informacionit.<\/p>\n<p>Pjesa \u201cn\u00eb kontekst\u201d e fjalis\u00eb \u00ebsht\u00eb me r\u00ebnd\u00ebsi, sepse ajo e vendos t\u00eb drejt\u00ebn e sinjalizimit edhe p\u00ebrtej sinjalizimit vet\u00ebm p\u00ebr vendin e pun\u00ebs. Kjo pjes\u00eb e fjalis\u00eb e njeh p\u00ebr shembull Abdullah Tha\u00e7in, i cili e kishte raportuar nj\u00eb klient t\u00eb pun\u00ebdh\u00ebn\u00ebsit t\u00eb tij, e jo drejt pun\u00ebdh\u00ebn\u00ebsin (ProCredit), si sinjalizues.<\/p>\n<p>N\u00eb p\u00ebrgjith\u00ebsi, vet\u00ebm gjat\u00eb vitit 2015, publikisht jan\u00eb paraqitur tri raste t\u00eb sinjalizimit n\u00eb Kosov\u00eb (shih rastet m\u00eb posht\u00eb).<\/p>\n<p>P\u00ebr shkak se pun\u00ebdh\u00ebn\u00ebsit nuk preferojn\u00eb q\u00eb publiku t\u00eb informohet p\u00ebr an\u00ebt e tyre jo t\u00eb lavd\u00ebrueshme, ata shpesher\u00eb kryejn\u00eb veprime hakmarr\u00ebse dhe viktimizuese q\u00eb rezultojn\u00eb me pasoja psikike, ligjore dhe financiare p\u00ebr sinjalizuesit. Kjo b\u00ebhet edhe p\u00ebr t\u00eb shp\u00ebrqendruar v\u00ebmendjen e publikut nga informata te sinjalizuesi, edhe p\u00ebr t\u00eb frik\u00ebsuar sinjalizuesit tjer\u00eb potencial\u00eb. P\u00ebr k\u00ebto arsye, kjo kategori \u00ebsht\u00eb e mbrojtur me ligj.<\/p>\n<p>Q\u00ebllimi i k\u00ebtij blogu \u00ebsht\u00eb vler\u00ebsimi i baz\u00ebs ligjore n\u00eb Kosov\u00eb q\u00eb mbron sinjalizuesit dhe prezantimi i standardeve t\u00eb vendosura nga K\u00ebshilli i Europ\u00ebs dhe Gjykata Europiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/p>\n<p>Shkrimi shp\u00ebrfaq q\u00eb baza ligjore n\u00eb Kosov\u00eb nuk mbron mjaftuesh\u00ebm sinjalizuesit dhe q\u00eb mekanizmat q\u00eb zbatojn\u00eb ligjin nuk jan\u00eb treguar t\u00eb gatsh\u00ebm deri m\u00eb tash t\u2019i trajtojn\u00eb rastet e tilla n\u00eb p\u00ebrputhje me standardet ekzistuese europiane.<\/p>\n<p><strong>Ligj i ve\u00e7ant\u00eb p\u00ebr sinjalizues<\/strong><\/p>\n<p>T\u00eb pakt\u00ebn gjasht\u00eb ligje kosovare e parashohin mbrojtjen e sinjalizuesve q\u00eb raportojn\u00eb dyshimet p\u00ebr shkelje ligjore ose parregullsi, duke filluar me ligjin kryesor q\u00eb \u00ebsht\u00eb ai p\u00ebr Mbrojtjen e Informatorit. Ligjet tjera q\u00eb pjes\u00ebrisht i referohen ose nd\u00ebrlidhen me sinjalizimin jan\u00eb Ligji p\u00ebr Mbrojtjen nga Diskriminimi (neni 4), Ligji Kund\u00ebr Korrupsionit (neni 16), Ligji p\u00ebr Agjencin\u00eb e Kosov\u00ebs p\u00ebr Inteligjenc\u00eb (neni 18.5), Ligji p\u00ebr Klasifikimin e Informacioneve dhe Verifikimin e Siguris\u00eb (neni 50) \u00a0dhe Kodi Penal (neni 433).<\/p>\n<p>Aspektet kryesore q\u00eb rregullohen ligj\u00ebrisht jan\u00eb definimi i sinjalizimit, sinjalizuesve dhe llojit t\u00eb informatave q\u00eb mund t\u00eb zbulohen, m\u00ebnyrat e raportimit t\u00eb informat\u00ebs, masat mbrojt\u00ebse dhe e drejta e ankes\u00ebs dhe padis\u00eb. Ekzistimi per se i Ligjit p\u00ebr Mbrojtjen e Informator\u00ebve n\u00eb Kosov\u00eb \u00ebsht\u00eb i mir\u00ebseardhur duke marr\u00eb parasysh faktin q\u00eb n\u00eb shumic\u00ebn e shteteve europiane sinjalizimi nuk rregullohet me ligj t\u00eb ve\u00e7ant\u00eb. P\u00ebr shembull, Gjermania ende nuk e ka nj\u00eb ligj t\u00eb till\u00eb.<\/p>\n<p>Por, baza ligjore \u00ebsht\u00eb e dobishme vet\u00ebm n\u00ebse ofron mbrojtje t\u00eb mjaftueshme dhe n\u00ebse ajo gjen zbatim n\u00eb praktik\u00eb.<\/p>\n<p>Ligji p\u00ebr Mbrojtjen e Informator\u00ebve em\u00ebrton gabimisht sinjalizuesit si informator\u00eb, term ky q\u00eb n\u00eb p\u00ebrgjith\u00ebsi ka konotacion negativ, sepse lidhet me njer\u00ebzit q\u00eb paguhen t\u00eb spiunojn\u00eb, e n\u00eb rastin e Kosov\u00ebs informator\u00eb jan\u00eb quajtuar shqiptar\u00ebt q\u00eb kan\u00eb bashk\u00ebpunuar me regjimin serb. Pastaj, ligji nuk definon fare sinjalizimin si proces dhe definon ngusht\u00eb sinjalizuesit, duke ua njohur k\u00ebt\u00eb status vet\u00ebm pun\u00ebtor\u00ebve q\u00eb raportojn\u00eb brenda institucionit publik ose privat dhe jo edhe atyre q\u00eb i zbulojn\u00eb informatat n\u00eb media, ose ndonj\u00eb institucion tjet\u00ebr si prokuroria apo policia. Tutje, ligji nuk obligon institucionet t\u00eb ofrojn\u00eb kanale t\u00eb raportimit, pasi q\u00eb parasheh q\u00eb institucioni \u201cmund\u201d t\u00eb autorizoj\u00eb nj\u00eb zyrtar p\u00ebr mbik\u00ebqyrje t\u00eb parregullsive. Kanal i raportimit \u00ebsht\u00eb procedura dhe zyrtari i brendshem q\u00eb cakton institucioni privat ose publik p\u00ebr t\u00eb pranuar informata rreth dyshimeve p\u00ebr shkelje ligjore nga pun\u00ebtor\u00ebt. Mosekzistimi i kanalit t\u00eb raportimit ia pamund\u00ebson pun\u00ebtorit t\u00eb b\u00ebj\u00eb sinjalizim t\u00eb brendsh\u00ebm. Nj\u00eb shembull i mir\u00eb i vendosjes s\u00eb kanaleve t\u00eb raportimit \u00ebsht\u00eb n\u00eb Mbret\u00ebrin\u00eb e Bashkuar ku<a href=\"https:\/\/www.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/431221\/bis-15-289-blowing-the-whistle-to-a-prescribed-person-list-of-prescribed-persons-and-bodies-2.pdf\" target=\"_blank\" rel=\"noopener\"> ekziston lista e institucioneve<\/a> me adresa konkrete t\u00eb cilave mund t\u2019u drejtohen sinjalizuesit.<\/p>\n<p>Nj\u00eb aspekt pozitiv i ligjit t\u00eb Kosov\u00ebs \u00ebsht\u00eb se parasheh q\u00eb ndaj sinjalizuesit nuk mund t\u00eb nd\u00ebrmerren masa t\u00eb d\u00ebnimit, apo masa disiplinore. N\u00eb t\u00eb kund\u00ebrt\u00ebn, ligji parasheh t\u00eb drejt\u00ebn e sinjalizuesit q\u00eb t\u2019i drejtohet gjykat\u00ebs kompetente p\u00ebr t\u2019u kthyer n\u00eb pun\u00eb dhe p\u00ebr t\u00eb k\u00ebrkuar d\u00ebmshp\u00ebrblim. N\u00eb k\u00ebt\u00eb aspekt, ligji nuk sakt\u00ebson cila gjykat\u00eb \u00ebsht\u00eb kompetente p\u00ebr raste t\u00eb sinjalizimit.<\/p>\n<p>Ligjet tjera p\u00ebrmbajn\u00eb nga nj\u00eb ose disa nene p\u00ebr mund\u00ebsi raportimi, por asnj\u00ebra nga to nuk rregullon n\u00eb t\u00ebr\u00ebsi sinjalizimin. P\u00ebr shembull, neni 16 i Ligjit Kund\u00ebr Korrupsionit, parasheh q\u00eb rastet e raportuara do t\u00eb d\u00ebrgohen n\u00eb prokurori dhe se personi q\u00eb zbulon informacionin nuk do t\u00eb ket\u00eb pasoja. S\u00eb pari, sinjalizuesi mund t\u2019i d\u00ebrgoj\u00eb informatat vet\u00eb n\u00eb prokurori dhe s\u00eb dyti Agjencia Kund\u00ebr Korrupsion gabohet kur pretendon &#8211; p\u00ebrmes ligjit &#8211; q\u00eb mund t\u00eb mbroj\u00eb t\u00eb gjith\u00eb sinjalizuesit nga pasojat. Asnj\u00eb instititucion nuk mund t\u00eb kontrolloj\u00eb veprimet hakmarr\u00ebse t\u00eb individ\u00ebve ndaj sinjalizuesve, prandaj ligji duhet t\u00eb parashoh\u00eb t\u00eb drejt\u00ebn p\u00ebr t\u2019iu drejtuar gjykat\u00ebs.<\/p>\n<p>Ligji Kund\u00ebr Diskriminimit ia mund\u00ebson sinjalizuesit q\u00eb brenda pes\u00eb vjet\u00ebsh t\u00eb padis\u00eb institucionin publik ose privat p\u00ebr diskriminim ose viktimizim dhe t\u00eb k\u00ebrkoj\u00eb kompensim d\u00ebmi. Ligji p\u00ebr Agjencin\u00eb e Kosov\u00ebs p\u00ebr Inteligjenc\u00eb parasheh t\u00eb drejt\u00ebn e agjent\u00ebve t\u00eb saj t\u00eb sinjalizojn\u00eb parregullsi, por nuk definon procedur\u00ebn e raportimit dhe njeh vet\u00ebm sinjalizimin brenda institucionit, p\u00ebrkat\u00ebsisht n\u00eb Inspektoratin Disiplinor. Sanksione shum\u00eb t\u00eb r\u00ebnda p\u00ebr sinjalizues parasheh Ligji p\u00ebr Klasifikimin e Informacioneve dhe Verifikimin e Siguris\u00eb, sipas s\u00eb cilit publikimi i informacioneve top secret mund t\u00eb d\u00ebnohet deri m\u00eb 12 vjet burg. Kodi Penal po ashtu d\u00ebnon zbulimin e fsheht\u00ebsis\u00eb zyrtare deri me pes\u00eb vjet burg, por ky ligj p\u00ebrmban nj\u00eb p\u00ebrjashtim q\u00eb mund t\u00eb p\u00ebrdoret n\u00eb favor t\u00eb sinjalizuesve. Sipas nenit 433, informatat dhe dokumentet t\u00eb cilat kan\u00eb p\u00ebr q\u00ebllim fshehjen e kryesit t\u00eb vepr\u00ebs penale t\u00eb d\u00ebnueshme me s\u00eb paku pes\u00eb vjet burgim nuk konsiderohen fsheht\u00ebsi zyrtare. Abdullah Tha\u00e7i \u00ebsht\u00eb d\u00ebnuar bazuar n\u00eb k\u00ebt\u00eb nen, por gjykata gabimisht nuk e ka p\u00ebrdorur k\u00ebt\u00eb p\u00ebrjashtim ligjor n\u00eb favor t\u00eb Tha\u00e7it.<\/p>\n<p>P\u00ebrve\u00e7 baz\u00ebs ligjore t\u00eb mang\u00ebt, edhe mekanizmat zbatues t\u00eb ligjit, si\u00e7 jan\u00eb Inspektorati i Pun\u00ebs dhe Gjykata Themelore n\u00eb Prizren, gjat\u00eb vendosjes n\u00eb dy raste t\u00eb sinjalizimit kan\u00eb d\u00ebshmuar q\u00eb nuk jan\u00eb t\u00eb p\u00ebrgatitura t\u00eb trajtojn\u00eb sinjalizimin sipas standardeve nd\u00ebrkomb\u00ebtare. N\u00eb vendimin e Inspektoratit t\u00eb Pun\u00ebs ndaj sinjalizuesve t\u00eb RTK-s\u00eb nuk p\u00ebrmendet fare e drejta e liris\u00eb s\u00eb shprehjes s\u00eb pun\u00ebtor\u00ebve n\u00eb vendin e pun\u00ebs, si\u00e7 ndodh vazhdimisht me vendimet e Tribunaleve t\u00eb Pun\u00ebs n\u00eb Mbret\u00ebrin\u00eb e Bashkuar dhe Gjykatat e Pun\u00ebs n\u00eb Belgjik\u00eb. Po ashtu aktgjykimi i Gjykat\u00ebs Themelore t\u00eb Prizrenit, n\u00eb rastin e Tha\u00e7it p\u00ebrpos q\u00eb \u00ebsht\u00eb i shkruar me gabime dhe ka arsyetim t\u00eb dob\u00ebt ligjor, fare nuk e p\u00ebrmend lirin\u00eb e shprehjes si e drejt\u00eb e pun\u00ebtorit n\u00eb vendin e pun\u00ebs. Ligjet e dob\u00ebta nuk mund t\u00eb p\u00ebrdoren si argument nga k\u00ebta mekanizma, sepse ata mund t\u00eb zbatojn\u00eb drejtp\u00ebrs\u00ebdrejti vendimet e GjEDNj-s\u00eb n\u00eb rastet e sinjalizuesve.<\/p>\n<p><strong>Gjasht\u00eb faktor\u00ebt e GjEDNj-s\u00eb n\u00eb Vler\u00ebsimin e Rasteve t\u00eb Sinjalizimit<\/strong><\/p>\n<p>Nj\u00eb nd\u00ebr zhvillimet m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb Gjykat\u00ebs s\u00eb Strasburgut \u00ebsht\u00eb mbrojtja e sinjalizuesve p\u00ebrmes nenit 10 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut q\u00eb garanton lirin\u00eb e shprehjes. Pra, sipas gjykat\u00ebs, pun\u00ebtor\u00ebt mund t\u00eb shfryt\u00ebzojn\u00eb t\u00eb drejt\u00ebn e liris\u00eb s\u00eb shprehjes p\u00ebr t\u00eb informuar publikun p\u00ebr shkelje ligjore q\u00eb ndodhin n\u00eb ambientin e pun\u00ebs.<\/p>\n<p>Aktgjykimi i par\u00eb n\u00eb lidhje me sinjalizimin \u00ebsht\u00eb marr\u00eb nga kjo gjykat\u00eb m\u00eb 2008 n\u00eb rastin Guja kund\u00ebr Moldavis\u00eb. N\u00eb k\u00ebt\u00eb rast, drejtori i Zyr\u00ebs p\u00ebr Komunikim me Media t\u00eb Prokuroris\u00eb s\u00eb P\u00ebrgjithshme t\u00eb Moldavis\u00eb kishte rrjedhur n\u00eb media dy letra q\u00eb tregonin ndikimin e parlamentit dhe t\u00eb politik\u00ebs n\u00eb prokurori. Pas publikimit t\u00eb shkrimeve q\u00eb citonin letrat, ai ishte p\u00ebrjashtuar nga puna p\u00ebr shkelje t\u00eb rregullores s\u00eb brendshme, n\u00ebn arsyetimin se kishte d\u00ebshtuar t\u00eb merrte aprovim nga mbik\u00ebqyr\u00ebsi i tij p\u00ebr t\u00eb publikuar letrat. T\u00eb gjitha gjykatat n\u00eb Moldavi kishin vendosur kund\u00ebr tij, duke mos e kthyer n\u00eb pun\u00eb.<\/p>\n<p>Ai e kishte d\u00ebrguar rastin n\u00eb GjEDNj duke paditur shtetin moldav p\u00ebr shkelje t\u00eb liris\u00eb s\u00eb shprehjes n\u00eb vendin e pun\u00ebs. Gjykata n\u00eb Strasburg vendosi n\u00eb favor t\u00eb tij dhe me k\u00ebt\u00eb rast themeloi testin prej gjasht\u00eb faktor\u00ebsh t\u00eb cilin e p\u00ebrdor p\u00ebr t\u00eb vler\u00ebsuar n\u00ebse nj\u00eb sinjalizues duhet t\u00eb mbrohet.<\/p>\n<p>Sipas gjykat\u00ebs, sinjalizuesi g\u00ebzon mbrojtje n\u00ebse institucioni nuk ka procedur\u00eb p\u00ebr sinjalizim, ose n\u00ebse kanalet e raportimet brenda institucionet nuk jan\u00eb t\u00eb p\u00ebrshtatshme (n\u00eb k\u00ebt\u00eb rast pranohet edhe sinjalizimi n\u00eb media), n\u00ebse ka interes publik n\u00eb zbulimin e informacionit, n\u00ebse informatat apo dokumentet e zbuluara jan\u00eb t\u00eb v\u00ebrteteta dhe autentike, n\u00ebse pun\u00ebtori ka vepruar n\u00eb mir\u00ebbesim (veprimet e nxitura nga hakmarrja apo armiq\u00ebsia ndaj pun\u00ebdh\u00ebn\u00ebsit nuk g\u00ebzojn\u00eb mbrojtje), n\u00ebse d\u00ebnimi ndaj sinjalizuesit mund t\u00eb rrezikoj\u00eb karrier\u00ebn e tij dhe n\u00ebse interesi publik \u00ebsht\u00eb m\u00eb i lart\u00eb se ruajtja e imazhit t\u00eb institucionit.<\/p>\n<p>Q\u00eb nga viti 2008, k\u00ebt\u00eb test Gjykata e ka p\u00ebrdorur edhe n\u00eb pes\u00eb raste t\u00eb tjera t\u00eb sinjalizimit, respektivisht n\u00eb Marchenko v. Ukrain\u00ebs (2009), Kudeshkina v. Rusis\u00eb (2009), Heinisch v. Gjermanis\u00eb (2011), Bucur dhe Toma v. Rumanis\u00eb (2013) dhe Mat\u00faz v. Hungaris\u00eb (2014).<\/p>\n<p>N\u00eb k\u00ebto raste, gjykata ka mbrojtur nj\u00eb m\u00ebsues q\u00eb kishte akuzuar drejtoresh\u00ebn e shkoll\u00ebs p\u00ebr keqp\u00ebrdorim t\u00eb pozit\u00ebs s\u00eb saj, nj\u00eb gjykat\u00ebse q\u00eb kishte folur n\u00eb media se si kryetarja e s\u00eb nj\u00ebjt\u00ebs gjykat\u00eb ndikohej nga politika, nj\u00eb infermiere q\u00eb kishte paditur pun\u00ebdh\u00ebn\u00ebsin e saj p\u00ebr keqmenaxhim t\u00eb institucionit sh\u00ebndet\u00ebsor, nj\u00eb zyrtar t\u00eb agjencis\u00eb s\u00eb inteligjenc\u00ebs q\u00eb kishte treguar para mediave p\u00ebr p\u00ebrgjimet e paligjshme dhe nj\u00eb gazetar q\u00eb kishte botuar lib\u00ebr ku d\u00ebshmonte censur\u00ebn brenda televizionit publik.<\/p>\n<p>Kur sinjalizuesit zbulojn\u00eb informacione p\u00ebrmes mediave, ata shpesh akuzohen p\u00ebr prishje t\u00eb imazhit t\u00eb institucionit, pavar\u00ebsisht faktit q\u00eb p\u00ebr ta shpesher\u00eb \u00ebsht\u00eb e pamundur q\u00eb t\u00eb ngrisin rastet e tyre brenda institucionit.<\/p>\n<p>N\u00eb shumic\u00ebn e rasteve t\u00eb lartp\u00ebrmendura, sinjalizuesit kan\u00eb g\u00ebzuar mbrojtje nga GjEDNj-ja edhe pse kishin publikuar informatat p\u00ebrmes mediave dhe n\u00eb institucione t\u00eb tjera, por fillimisht gjykata k\u00ebrkon nga sinjalizuesit q\u00eb t\u00eb adresojn\u00eb dyshimet e tyre brenda institucionit dhe vet\u00ebm kur nuk \u00ebsht\u00eb e mundur ose e p\u00ebrshtatshme, at\u00ebher\u00eb pranohet sinjalizimi i jasht\u00ebm.<\/p>\n<p>Edhe K\u00ebshilli i Europ\u00ebs parasheh t\u00eb drejt\u00ebn e sinjalizuesit q\u00eb t\u00eb zbulohen informata drejtp\u00ebrs\u00ebdrejti n\u00eb media. M\u00eb konkretisht, dokumenti kryesor p\u00ebr mbrojtjen e sinjalizuesve i K\u00ebshillit t\u00eb Europ\u00ebs \u00ebsht\u00eb Rekomandimi i K\u00ebshillit t\u00eb Ministrave num\u00ebr CM\/RC(2014)7 p\u00ebr Mbrojtjen e Sinjalizuesve, sipas t\u00eb cilit sinjalizimi p\u00ebrfshin edhe raportimet n\u00eb media kur nj\u00eb gj\u00eb e till\u00eb nuk \u00ebsht\u00eb e mundur brenda pun\u00ebdh\u00ebn\u00ebsit.<\/p>\n<p>P\u00ebrve\u00e7 KE-s\u00eb dhe GjEDNj-s\u00eb, edhe Mbret\u00ebria e Bashkuar e cila e ka ligjin m\u00eb t\u00eb mir\u00eb n\u00eb Europ\u00eb p\u00ebr mbrojtjen e sinjalizuesve, t\u00eb quajtuar Ligji p\u00ebr Zbulimin e Interesit Publik (Public Interest Disclosure Act, PIDA), njeh zbulimin e informatave n\u00eb media.<\/p>\n<p>Ligjet e mira dhe praktikat gjyq\u00ebsore promovojn\u00eb sinjalizimin n\u00eb kontekstin e pun\u00ebs q\u00eb b\u00ebhet p\u00ebrmes procedurave t\u00eb raportimit ose mediave, p\u00ebr raste q\u00eb p\u00ebrfshijn\u00eb interesin publik dhe nga pun\u00ebtor\u00eb q\u00eb veprojn\u00eb n\u00eb mir\u00ebbesim.<\/p>\n<p><strong>Rastet e sinjalizimit: ProCredit, RTK, Nj\u00ebsia Financiare e Inteligjenc\u00ebs<\/strong><\/p>\n<p>Abdullah Tha\u00e7i derisa punonte si arkatar n\u00eb bank\u00ebn ProCredit n\u00eb Prizren kishte v\u00ebrejtur q\u00eb drejtori i arsimit t\u00eb Komun\u00ebs s\u00eb Prizrenit Nexhat \u00c7o\u00e7aj kishte transferuar t\u00eb holla nga buxheti i Kosov\u00ebs n\u00eb llogarin\u00eb e tij. Drejtori i kishte marr\u00eb mjetet n\u00eb em\u00ebr t\u00eb organizimit t\u00eb nj\u00eb manifestimi, por dyshohet q\u00eb i kishte shfryt\u00ebzuar p\u00ebr t\u00eb paguar qira dhe k\u00ebste t\u00eb kredis\u00eb. Duke nxjerr\u00eb jasht\u00eb bank\u00ebs gjendjen e llogaris\u00eb s\u00eb klientit, Tha\u00e7i ka shkelur kontrat\u00ebn e pun\u00ebs dhe Kodin Penal q\u00eb e obligon t\u00eb ruaj\u00eb fsheht\u00ebsit\u00eb e pun\u00ebs. P\u00ebr k\u00ebt\u00eb arsye, ai \u00ebsht\u00eb d\u00ebnuar me gjasht\u00eb muaj burg, mas\u00eb kjo q\u00eb \u00ebsht\u00eb shnd\u00ebrruar n\u00eb gjob\u00eb prej pes\u00eb mij\u00eb eurosh pas pranimit t\u00eb \u201cfaj\u00ebsis\u00eb.\u201d N\u00eb k\u00ebt\u00eb rast gjykata fare nuk e ka trajtuar t\u00eb drejt\u00ebn e liris\u00eb s\u00eb shprehjes n\u00eb vendin e pun\u00ebs, e cila sipas GjEDNj-s\u00eb, kur ka interes publik arsyeton shkeljen e parimit t\u00eb konfidencialitetit.<\/p>\n<p>N\u00eb nj\u00eb rast tjet\u00ebr, sipas raportimeve n\u00eb media t\u00eb dat\u00ebs 9 prill, Nj\u00ebsia e Inteligjenc\u00ebs Financiare ka filluar hetimet ndaj sinjalizuesit q\u00eb e rrodhi n\u00eb media gjendjen e llogaris\u00eb bankare t\u00eb kryeprokurorit Aleksand\u00ebr Lumezit, e q\u00eb p\u00ebrmbante transaksione t\u00eb shumave t\u00eb larta t\u00eb parave gjat\u00eb koh\u00ebs sa po kandidonte p\u00ebr t\u00eb drejtuar institucionin e ndjekjes. Rrjedhja e k\u00ebtyre informatave potencialisht ka mundur t\u00eb ndikoj\u00eb jo vet\u00ebm n\u00eb d\u00ebmtimin e reputacionit t\u00eb Lumezit, por edhe n\u00eb kandidimin t\u00eb tij. N\u00eb an\u00ebn tjet\u00ebr, duke marr\u00eb parasysh t\u00eb hyrat mujore t\u00eb pun\u00ebtor\u00ebve t\u00eb sistemit gjyq\u00ebsor, publiku ka t\u00eb drejt\u00eb t\u00eb informohet p\u00ebr prejardhjen e atyre parave, n\u00ebse t\u00eb dh\u00ebnat e bank\u00ebs kan\u00eb qen\u00eb t\u00eb v\u00ebrteta. Identiteti i sinjalizuesi q\u00eb ka rrjedhur informatat fatmir\u00ebsisht ende nuk \u00ebsht\u00eb zbuluar publikisht.<\/p>\n<p>An\u00ebtar\u00ebt e Sindikat\u00ebs s\u00eb Radio-Televizionit Publik Fadil Hoxha dhe Arsim Halili \u00a0qen\u00eb larguar p\u00ebrkoh\u00ebsisht nga puna m\u00eb 26 mars 2015, p\u00ebr shkak se publikisht kishin informuar publikun p\u00ebr censur\u00eb dhe dyshime p\u00ebr keqp\u00ebrdorime t\u00eb buxhetit t\u00eb transmetuesit publik.
