Nj\u00eb nga k\u00ebto \u00ebsht\u00eb mbyllja e 16 organizatave jo-qeveritare me nj\u00eb vendim t\u00eb Ministrit t\u00eb Brendsh\u00ebm, me dyshimin se jan\u00eb angazhuar n\u00eb aktivitete q\u00eb nd\u00ebrlidhen me terroriz\u00ebm. Pak para k\u00ebsaj, nj\u00ebra nga bankat komerciale n\u00eb Kosov\u00eb bllokoi llogarit\u00eb bankare t\u00eb disa OJQ-ve kosovare, shumica nga t\u00eb cilat financohen nga qeverit\u00eb e shteteve per\u00ebndimore p\u00ebr projekte t\u00eb ndryshme n\u00eb fush\u00ebn e demokratizimit. Vitin e kaluar, 14 nga OJQ-t\u00eb tashm\u00eb t\u00eb mbyllura ishin suspenduar p\u00ebr nj\u00eb vit me nj\u00eb vendim t\u00eb Departamentit p\u00ebr OJQ, pas k\u00ebrkes\u00ebs s\u00eb organeve t\u00eb siguris\u00eb.<\/p>\n<\/div>\n<div class=\"news-down\">\n<div class=\"news-left\">\n<p><strong>A luftohet terrorizmi duke shkelur ligjin?<\/strong><\/p>\n<p>N\u00eb shikim t\u00eb par\u00eb, t\u00eb gjitha vendimet e m\u00ebsip\u00ebrme mund t\u00eb vler\u00ebsohen si t\u00eb domosdoshme \u2013 n\u00ebse jo t\u00eb vonuara \u2013 n\u00eb luftimin e ekstremizmit dhe parandalimin e akteve terroriste n\u00eb Kosov\u00eb dhe p\u00ebrtej. N\u00eb teori, edhe mund t\u00eb jen\u00eb. Megjithat\u00eb, problemi q\u00ebndron se secili prej rasteve t\u00eb p\u00ebrmendura m\u00eb sip\u00ebr \u00ebsht\u00eb plot\u00ebsisht i paligjsh\u00ebm. Nuk ka arsye q\u00eb i jep t\u00eb drejt\u00eb nj\u00eb t\u00eb em\u00ebruari politik t\u2019ia nd\u00ebrpres\u00eb jet\u00ebn nj\u00eb organizate t\u00eb pavarur. Ngjash\u00ebm \u00ebsht\u00eb edhe me suspendimin \u2013 madje duke mos qen\u00eb fare e mundshme me ligjet kosovare, Qeveria u kujdes q\u00eb vet\u00ebm disa dit\u00eb para suspendimit t\u00eb 14 OJQ-ve n\u00eb vitin 2014 ta p\u00ebrfshij\u00eb k\u00ebt\u00eb \u201cmund\u00ebsi\u201d n\u00eb nj\u00eb udh\u00ebzim administrativ q\u00eb ishte (dhe mbetet) n\u00eb kund\u00ebrshtim me ligjin baz\u00eb p\u00ebr OJQ. P\u00ebrs\u00ebri, nuk ka arsye q\u00eb i jep t\u00eb drejt\u00eb nj\u00eb sh\u00ebrbyesi civil t\u00eb suspendoj\u00eb organizatat e pavarura, p\u00ebr m\u00eb tep\u00ebr p\u00ebr nj\u00eb periudh\u00eb nj\u00eb vje\u00e7are. Ndoshta duke marr\u00eb m\u00ebsim nga Qeveria, edhe nj\u00eb kompani private u\u2019a bllokoi mjetet dhe u\u2019a nd\u00ebrpreu sh\u00ebrbimet financiare nj\u00eb numri t\u00eb madh t\u00eb OJQ-ve, pa paralajm\u00ebrim dhe pa asnj\u00eb arsye bind\u00ebse. Edhe kjo, n\u00eb kund\u00ebrshtim t\u00eb plot\u00eb me ligjet e aplikueshme, madje edhe me vet marr\u00ebveshjen n\u00eb mes t\u00eb bank\u00ebs dhe OJQ-ve kliente.<\/p>\n<p>N\u00eb secilin prej rasteve t\u00eb m\u00ebsip\u00ebrme Ministri, sh\u00ebrbyesi civil ose banka kan\u00eb mundur ta d\u00ebrgojn\u00eb rastin n\u00eb gjykat\u00eb dhe me procedur\u00eb t\u00eb p\u00ebrshpejtuar t\u2019i arrijn\u00eb po ato rezultate, n\u00ebse dyshimet e tyre do t\u00eb ishin v\u00ebrtetuar. P\u00ebr m\u00eb tep\u00ebr, secili prej tyre ka nj\u00eb baz\u00eb ligjore q\u00eb do t\u2019i mund\u00ebsonte veprim t\u00eb menj\u00ebhersh\u00ebm n\u00eb raste t\u00eb dyshimit t\u00eb bazuar. Por, p\u00ebr arsye t\u00eb ndryshme nuk e zgjodh\u00ebn rrug\u00ebn ligjore.\u00a0 Duke mos e b\u00ebr\u00eb k\u00ebt\u00eb, s\u00eb bashku e d\u00ebshmojn\u00eb nj\u00eb trend shum\u00eb t\u00eb rreziksh\u00ebm p\u00ebr shoq\u00ebrin\u00eb ton\u00eb \u2013 shtypjen e t\u00eb drejtave qytetare n\u00eb em\u00ebr t\u00eb luft\u00ebs kund\u00ebr terrorizmit.<\/p>\n<p><strong>Ligji p\u00ebr lakmi (nga&#8230;?)<\/strong><\/p>\n<p>Edhe po ta zbatonin ligjin, p\u00ebrs\u00ebri trendi nuk \u00ebsht\u00eb q\u00eb do t\u00eb ndryshonte shum\u00eb. Kosova ka vite q\u00eb ka rregullativa ligjore p\u00ebr parandalimin e financimit t\u00eb terrorizmit. I fundit \u00ebsht\u00eb\u00a0<a href=\"http:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=2715\" target=\"_blank\" rel=\"noopener\">Ligji p\u00ebr parandalim t\u00eb shp\u00ebrlarjes s\u00eb parave<\/a>\u00a0dhe financimit t\u00eb terrorizmit, i miratuar m\u00eb 2010. P\u00ebrve\u00e7 tjerash, \u00ebsht\u00eb nd\u00ebr ligjet e pakta n\u00eb Europ\u00eb q\u00eb p\u00ebrmban obligime t\u00eb ve\u00e7anta p\u00ebr OJQ-t\u00eb, nd\u00ebrsa p\u00ebr nga niveli i kufizimeve do t\u2019ia kishin lakmi edhe mjaft vende autoritare t\u00eb Azis\u00eb apo Afrik\u00ebs. Sa p\u00ebr ilustrim, asnj\u00eb OJQ nuk guxon t\u00eb pranoj\u00eb mbi 1,000 EUR brenda nj\u00eb dite nga nj\u00eb donator pa marr\u00eb leje paraprake nga Nj\u00ebsia p\u00ebr Inteligjenc\u00eb Financiare, nd\u00ebrsa kjo nj\u00ebsi ka 30 dit\u00eb afat p\u00ebr t\u2019iu p\u00ebrgjigjur k\u00ebrkes\u00ebs p\u00ebr leje, pa asnj\u00eb kriter mbi t\u00eb cilin do ta bazonte lejen ose refuzimin eventual. Edhe m\u00eb t\u00eb r\u00ebnda jan\u00eb d\u00ebnimet p\u00ebr shkeljen e k\u00ebtij kufizimi \u2013 dyfishi i shum\u00ebs s\u00eb pranuar dhe deri n\u00eb 2 vite burg. Po, po, 2 vite burg p\u00ebr pranim t\u00eb fondeve pa marr\u00eb leje nga shteti \u2013 qofshin k\u00ebto edhe fonde q\u00eb paguhen nga vet shteti.<\/p>\n<p>E mira n\u00eb k\u00ebt\u00eb t\u00eb keqe \u00ebsht\u00eb q\u00eb ky ligj m\u00eb n\u00eb fund \u00ebsht\u00eb hapur p\u00ebr ndryshim dhe ka disponim pozitiv p\u00ebr t\u00eb larguar nj\u00eb pjes\u00eb t\u00eb dispozitave kufizuese. Megjithat\u00eb, ende dominon qasja q\u00eb OJQ-t\u00eb duhet t\u00eb ndahen si nj\u00ebri nga pak sektor\u00ebt q\u00eb kan\u00eb kufizime t\u00eb ve\u00e7anta, pavar\u00ebsisht q\u00eb nuk ka asnj\u00eb analiz\u00eb t\u00eb rrezikut p\u00ebr financim t\u00eb terrorizmit nga ky sektor.<\/p>\n<p><strong>Rezultatet<\/strong><\/p>\n<p>Kosova nuk \u00ebsht\u00eb e para q\u00eb ka miratuar ligje t\u00eb tilla. Duke filluar nga vet SHBA-t\u00eb me\u00a0<a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/PLAW-107publ56\/html\/PLAW-107publ56.htm\" target=\"_blank\" rel=\"noopener\">\u201cAktin patriotik\u201d,<\/a>\u00a0periudha pas 11 shtatorit 2001 \u00ebsht\u00eb karakterizuar me shkelje t\u00eb t\u00eb drejtave qytetare n\u00eb em\u00ebr t\u00eb luft\u00ebs kund\u00ebr terrorizmit. OJQ-t\u00eb, si bart\u00ebs t\u00eb organizimit qytetar, kan\u00eb qen\u00eb shpesh her\u00eb m\u00eb t\u00eb goditurat nga k\u00ebto masa, nd\u00ebrsa shum\u00eb vende e kan\u00eb keqp\u00ebrdorur k\u00ebt\u00eb situat\u00eb p\u00ebr t\u2019i heshtur organizatat kritikuese ose ato q\u00eb kan\u00eb k\u00ebrkuar llogari p\u00ebr qeverisjen e tyre. Megjithat\u00eb, nuk ka nevoj\u00eb p\u00ebr ndonj\u00eb analiz\u00eb t\u00eb thell\u00eb p\u00ebr t\u00eb par\u00eb rezultatet e k\u00ebsaj qasje \u2013 niveli i ekstremizmit dhe radikalizmit t\u00eb dhunsh\u00ebm nuk ka p\u00ebsuar r\u00ebnie. E kund\u00ebrta ka ndodhur gjithandej, p\u00ebrfshir\u00eb edhe Kosov\u00ebn. Ligji i vitit 2010, e as shum\u00eb ligje tjera n\u00eb vende t\u00eb ndryshme q\u00eb kan\u00eb kufizuar organizatat jo-qeveritare nuk e kan\u00eb penguar terrorizmin, por definitivisht vazhdojn\u00eb t\u00eb r\u00ebndojn\u00eb pun\u00ebn e sektorit jo-qeveritar.<\/p>\n<p>M\u00eb n\u00eb fund k\u00ebt\u00eb e kan\u00eb kuptuar edhe vendet t\u00eb cilat jan\u00eb n\u00eb krye t\u00eb luft\u00ebs kund\u00ebr terrorizmit. Shum\u00eb dokumente e veprime t\u00eb koh\u00ebve t\u00eb fundit nga mekanizmat nd\u00ebrkomb\u00ebtar t\u00eb luft\u00ebs kund\u00ebr terrorizmit e vler\u00ebsojn\u00eb thelb\u00ebsore fuqizimin e shoq\u00ebris\u00eb civile si mjet parandalues i ekstremizmit t\u00eb dhunsh\u00ebm. N<a href=\"https:\/\/www.thegctf.org\/documents\/10162\/88482\/Final+Ankara+Memorandum.pdf\" target=\"_blank\" rel=\"noopener\">\u00eb nj\u00eb dokument\u00a0<\/a>mbi qasjen shum\u00eb-sektorale n\u00eb luftimin e ekstremizmit t\u00eb dhunsh\u00ebm, Forumi Global Kund\u00ebr Terrorizmit thekson q\u00eb \u201cfuqizimi i shoq\u00ebris\u00eb civile n\u00eb luft\u00ebn kund\u00ebr ekstremizmit t\u00eb dhunsh\u00ebm prodhon rezultate m\u00eb efektive, nd\u00ebrsa bashk\u00ebpunimi i qeverive me partner\u00ebt jo-qeveritar\u00eb i sjell k\u00ebsaj lufte burime shtes\u00eb\u201d. Ngjash\u00ebm, organizmi nd\u00ebr-qeveritar q\u00eb cakton standarde t\u00eb k\u00ebsaj fushe (FATF), tashm\u00eb ka\u00a0<a href=\"http:\/\/www.fatf-gafi.org\/publications\/fatfrecommendations\/documents\/bpp-combating-abuse-npo.html\" target=\"_blank\" rel=\"noopener\">evidentuar\u00a0<\/a>raste t\u00eb shumta t\u00eb keqp\u00ebrdorimit t\u00eb rekomandimeve t\u00eb tyre p\u00ebr shkeljen e t\u00eb drejtave qytetare, nd\u00ebrsa n\u00eb vler\u00ebsimin e shteteve p\u00ebr masat e marra ka filluar ta trajtoj\u00eb edhe (keq)rregullimin ndaj sektorit jo-qeveritar.<\/p>\n<p><strong>P\u00ebrkrahja n\u00eb vend t\u00eb kufizimit<\/strong><\/p>\n<p>Radikalizimi dhe shnd\u00ebrrimi n\u00eb persona t\u00eb dhunsh\u00ebm q\u00eb potencialisht kryejn\u00eb akte terroriste paraqet nj\u00eb proces shum\u00eb kompleks dhe ndikohet nga shum\u00eb faktor\u00eb, p\u00ebrfshir\u00eb ato socio-ekonomik. Sigurimi i mjeteve financiare p\u00ebr t\u00eb kryer aktin terrorist (q\u00eb sipas institucioneve t\u00eb k\u00ebsaj fushe shpesh her\u00eb jan\u00eb vet\u00ebm disa qindra euro) paraqet vet\u00ebm faz\u00ebn e fundit para vet aktit. V\u00ebshtir\u00eb t\u00eb imagjinohet rasti kur disa qindra euro (me supozimin teorik q\u00eb k\u00ebto kanalizohen n\u00ebp\u00ebrmjet OJQ-ve) do t\u00eb mund ta parandalonin dik\u00eb t\u00eb hidhte veten (dhe t\u00eb tjer\u00ebt) n\u00eb er\u00eb, n\u00ebse ve\u00e7 ka vendosur p\u00ebr nj\u00eb gj\u00eb t\u00eb till\u00eb si pasoj\u00eb e shum\u00eb arsyeve tjera.<\/p>\n<p>E p\u00ebr trajtimin e \u201carsyeve tjera\u201d, nuk ka sektor m\u00eb t\u00eb p\u00ebrshtatsh\u00ebm se OJQ-t\u00eb dhe grupet e komunitetit. \u00c7ka mund t\u00eb parandalonte m\u00eb mir\u00eb radikalizimin e nj\u00eb t\u00eb riu sesa p\u00ebrfshirja sociale? \u00c7ka mund t\u00eb d\u00ebmtonte m\u00eb shum\u00eb terrenin p\u00ebr rekrutim t\u00eb \u201cterrorist\u00ebve potencial\u201d sesa edukimi i djemve dhe vajzave? \u00c7ka mund ta hapte mendjen e atyre q\u00eb jan\u00eb t\u00eb bombarduar me \u201ct\u00eb v\u00ebrteta absolute mbi bot\u00ebn\u201d sesa liria e shprehjes, mendimi kritik dhe aktivizmi qytetar? T\u00eb gjitha k\u00ebto e shum\u00eb t\u00eb tjera t\u00eb ngjashme jan\u00eb aktivitete t\u00eb p\u00ebrditshme t\u00eb OJQ-ve, t\u00eb cilat normalisht do t\u00eb duhej t\u00eb p\u00ebrkraheshin nga shteti. Aktualisht ndodh e kund\u00ebrta, nd\u00ebrsa rezultati i vet\u00ebm \u00ebsht\u00eb b\u00ebrja m\u00eb e v\u00ebshtir\u00eb e pun\u00ebs s\u00eb OJQ-ve.<\/p>\n<p>Lufta kund\u00ebr terrorizmit dhe sektori jo-qeveritar nuk e kund\u00ebrshtojn\u00eb nj\u00ebra tjetr\u00ebn. P\u00ebrkundrazi, i dyti \u00ebsht\u00eb i domosdosh\u00ebm p\u00ebr t\u00eb par\u00ebn. Kjo qasje duhet t\u00eb futet n\u00eb mendjen e vendim-marr\u00ebsve tan\u00eb dhe t\u00eb p\u00ebrkthehet n\u00eb ligje, politika e veprime p\u00ebrkrah\u00ebse p\u00ebr sektorin jo-qeveritar dhe grupet e komunitetit.
