{"id":5257,"date":"2016-04-03T16:16:31","date_gmt":"2016-04-03T14:16:31","guid":{"rendered":"https:\/\/sbunker.org\/?p=5257"},"modified":"2024-12-09T16:24:02","modified_gmt":"2024-12-09T14:24:02","slug":"hisja-e-trashegimtarites","status":"publish","type":"post","link":"https:\/\/sbunker.org\/sr\/analize\/hisja-e-trashegimtarites\/","title":{"rendered":"Hisja e trash\u00ebgimtarit(es)"},"content":{"rendered":"<div class=\"news-up\">\n<p>N\u00eb pyetjen e gjyqtarit drejtuar Art\u00ebs, se a d\u00ebshiron t\u00eb pranoj\u00eb pjes\u00ebn e saj t\u00eb trash\u00ebgimis\u00eb, ajo u mendua nj\u00eb cop\u00eb her\u00eb \u2013 pa nga dy v\u00ebllez\u00ebrit e saj t\u00eb cilit tashm\u00eb kishin deklaruar se pranonin pjes\u00ebn e tyre dhe n\u00eb fund tha: Jo.<\/p>\n<\/div>\n<div class=\"news-down\">\n<div class=\"news-left\">\n<p>Arta \u00ebsht\u00eb nj\u00ebra nga shum\u00eb grat\u00eb dhe vajzat n\u00eb Kosov\u00eb, t\u00eb cilat pavar\u00ebsisht t\u00eb drejt\u00ebs s\u00eb tyre p\u00ebr t\u00eb trash\u00ebguar pasurin\u00eb nga prind\u00ebrit &#8211; t\u00eb garantuar me Kushtetut\u00eb, Ligje e Konventa Nd\u00ebrkomb\u00ebtare &#8211; shum\u00eb rrall\u00eb e shfryt\u00ebzojn\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb. T\u00eb shtyera nga presioni i familjes e i shoq\u00ebris\u00eb kosovare, ato gati asnj\u00ebher\u00eb nuk pranojn\u00eb t\u00eb trash\u00ebgojn\u00eb pjes\u00ebn e pasuris\u00eb q\u00eb ju takon. Pasuria e tyre gjithmon\u00eb kalon tek v\u00ebllez\u00ebrit, t\u00eb cil\u00ebt sipas tradit\u00ebs dhe mentalitetit shoq\u00ebror kosovar, jan\u00eb t\u00eb denj\u00eb t\u00eb trash\u00ebgojn\u00eb pasurin\u00eb e babait; nd\u00ebrsa grat\u00eb dhe vajzat marrin mjaftuesh\u00ebm nga burrat e tyre dhe se \u00ebsht\u00eb \u201cmarre me lyp hise nga baba\u201d.<\/p>\n<p>Jo shum\u00eb koh\u00eb m\u00eb par\u00eb, EULEX publikoi nj\u00eb raport me tem\u00ebn \u201cGrat\u00eb dhe e drejta e trash\u00ebgimis\u00eb n\u00eb pron\u00ebn e paluajtshme n\u00eb Kosov\u00eb\u201d. Raporti p\u00ebrve\u00e7 shifrave shqet\u00ebsuese, paraqet edhe nj\u00eb varg problemesh ligjore t\u00eb cilat i pamund\u00ebsojn\u00eb grave dhe vajzave t\u00eb shfryt\u00ebzojn\u00eb t\u00eb drejt\u00ebn\u00a0 e tyre n\u00eb trash\u00ebgimi.<\/p>\n<p>Sipas raportit, si problem par\u00ebsor paraqitet \u00e7\u00ebshtja e kompetenc\u00ebs n\u00eb mes t\u00eb gjykatave dhe noteris\u00eb &#8211; q\u00eb t\u00eb dyja k\u00ebto kompetente p\u00ebr t\u00eb vendosur n\u00eb lidhje me \u00e7\u00ebshtjet trash\u00ebgimore &#8211; gj\u00eb q\u00eb e b\u00ebn m\u00eb t\u00eb v\u00ebshtir\u00eb orientimin p\u00ebr qytetar\u00ebt se cilit institucion t\u2019i drejtohen dhe cilit t\u2019i besojn\u00eb m\u00eb shum\u00eb.<\/p>\n<p>Si \u00e7\u00ebshtje dyt\u00ebsore e ngritur n\u00eb k\u00ebt\u00eb raport, heqja dor\u00eb e grave nga trash\u00ebgimia, paraqitet si problem shum\u00eb i madh. Po ashtu, edhe legjislacioni q\u00eb garanton k\u00ebt\u00eb t\u00eb drejt\u00eb \u00ebsht\u00eb shpesh i paqart\u00eb dhe nuk parasheh masa mbrojt\u00ebse. K\u00ebto t\u00eb fundit do t\u00eb sh\u00ebrbenin si p\u00ebrforcues t\u00eb s\u00eb drejt\u00ebs s\u00eb grave p\u00ebr t\u00eb trash\u00ebguar, dhe do ta b\u00ebnin m\u00eb t\u00eb v\u00ebshtir\u00eb heqjen dor\u00eb nga trash\u00ebgimia. Dhe s\u00eb fundi, taksat dhe tarifat mjaft t\u00eb larta, t\u00eb parapara pran\u00eb noter\u00ebve dhe zyrave t\u00eb gjendjes civile, p\u00ebr regjistrimin e transaksioneve pron\u00ebsore, jan\u00eb nj\u00eb dekurajim shtes\u00eb p\u00ebr grat\u00eb kosovare q\u00eb t\u00eb kryejn\u00eb transaksione t\u00eb tilla. Ky raport v\u00eb sidomos n\u00eb dukje faktin q\u00eb organet e lartp\u00ebrmendura, kan\u00eb munges\u00eb t\u00eb dukshme t\u00eb ofrimit t\u00eb mbrojtjes s\u00eb t\u00eb drejtave t\u00eb grave dhe vajzave p\u00ebr t\u00eb trash\u00ebguar at\u00eb q\u00eb ju takon. Mbrojtja m\u00eb efikase e k\u00ebtyre t\u00eb drejtave do t\u00eb mund t\u00eb arrihej p\u00ebrmes nj\u00eb procedure gjyq\u00ebsore e cila do t\u00eb analizonte qart\u00eb faktor\u00ebt t\u00eb cil\u00ebt e kan\u00eb shtyer personin e caktuar t\u00eb heq\u00eb dor\u00eb nga pjesa e trash\u00ebgimis\u00eb q\u00eb i takon, n\u00eb rast se ajo ka qen\u00eb e vullnetshme ose n\u00eb rast se ajo \u00ebsht\u00eb ndikuar nga faktor\u00ebt e jasht\u00ebm.<\/p>\n<p>Problemet e tilla t\u00eb paraqitura n\u00eb k\u00ebt\u00eb raport, m\u00eb s\u00eb miri i pasqyrojn\u00eb shifrat. Kosova ka p\u00ebrqindjen m\u00eb t\u00eb ul\u00ebt t\u00eb pronave t\u00eb regjistruara n\u00eb em\u00ebr t\u00eb grave n\u00eb Ballkan. N\u00eb Gjykat\u00ebn e Apelit, gjat\u00eb viteve 2013\/2014 nga 4,265 t\u00eb rasteve civile t\u00eb d\u00ebrguara p\u00ebr zgjidhje n\u00eb k\u00ebt\u00eb organ gjyq\u00ebsor, vet\u00ebm 6.8% t\u00eb rasteve jan\u00eb t\u00eb p\u00ebrfshira grat\u00eb, pra vet\u00ebm 290 raste. Nd\u00ebrkaq n\u00eb 88% t\u00eb rasteve nga k\u00ebto 290 raste, grat\u00eb jan\u00eb pal\u00eb ankuese s\u00eb bashku me burrat. Rastet kur vet\u00ebm grat\u00eb jan\u00eb padit\u00ebse\/pal\u00eb ankuese n\u00eb nj\u00eb \u00e7\u00ebshtje gjyq\u00ebsore gjat\u00eb viteve 2013\/2014 jan\u00eb vet\u00ebm 0.82% ose 35 raste nga 4,265 raste sa jan\u00eb n\u00eb total n\u00eb Gjykat\u00ebn e Apelit. K\u00ebto shifra p\u00ebrkthehen n\u00eb sinjalizues t\u00eb qart\u00eb q\u00eb grat\u00eb, krahas tjerave, kan\u00eb shum\u00eb pak mund\u00ebsi p\u00ebr t\u00eb hyr\u00eb n\u00eb procedura gjyq\u00ebsore dhe p\u00ebr t\u00eb k\u00ebrkuar realizimin e t\u00eb drejtave p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb pasuris\u00eb n\u00eb em\u00ebr t\u00eb tyre.<\/p>\n<p>Tek organet noteriale, p\u00ebrqindja e grave q\u00eb kan\u00eb pranuar pjes\u00ebn e tyre t\u00eb trash\u00ebgimis\u00eb \u00ebsht\u00eb n\u00ebn 20%. Pjesa tjet\u00ebr, pra m\u00eb shum\u00eb se 80% kan\u00eb hequr dor\u00eb nga trash\u00ebgimia. N\u00eb baz\u00eb t\u00eb databaz\u00ebs t\u00eb disa prej noter\u00ebve n\u00eb Kosov\u00eb, nga t\u00eb gjitha transaksionet pron\u00ebsore vet\u00ebm n\u00eb 15% t\u00eb rasteve grat\u00eb jan\u00eb p\u00ebrfituese t\u00eb k\u00ebtyre transaksioneve. N\u00eb zonat rurale, kjo p\u00ebrqindje \u00ebsht\u00eb edhe m\u00eb e ul\u00ebt &#8211; n\u00eb fshatrat e Komun\u00ebs s\u00eb Gjilanit vet\u00ebm n\u00eb 6% (11 nga 163 kontrata) t\u00eb rasteve t\u00eb shitblerjes s\u00eb pronave p\u00ebrfituese jan\u00eb grat\u00eb. Edhe n\u00eb k\u00ebt\u00eb rast, sikurse n\u00eb Gjykata edhe n\u00eb Noteri shifrat jan\u00eb alarmante. Shumica prej grave nuk pranojn\u00eb pasuri, p\u00ebr t\u00eb vetmin shkak se jan\u00eb t\u00eb bindura se p\u00ebr to kujdeset financiarisht bashk\u00ebshorti. Pasuria e tyre gjithmon\u00eb i lihet prapa v\u00ebllez\u00ebrve t\u00eb tyre, t\u00eb cil\u00ebt shpesh edhe nuk i pyesin n\u00ebse ato d\u00ebshirojn\u00eb t\u00eb pranojn\u00eb pjes\u00ebn e tyre t\u00eb trash\u00ebgimis\u00eb. Por edhe n\u00ebse pyeten p\u00ebr nj\u00eb gj\u00eb t\u00eb till\u00eb, do ta b\u00ebnin k\u00ebt\u00eb vet\u00ebm sa \u201cp\u00ebr sy e faqe\u201d.<\/p>\n<p>Pavar\u00ebsisht realitetit t\u00eb brisht\u00eb n\u00eb terren, baza ligjore q\u00eb grat\u00eb t\u00eb realizojn\u00eb t\u00eb drejt\u00ebn e tyre p\u00ebr t\u00eb trash\u00ebguar e p\u00ebr t\u00eb mos u diskriminuar, ekziston. K\u00ebshtu, neni 7 i Kushtetut\u00ebs s\u00eb Kosov\u00ebs garanton barazin\u00eb e grave dhe ndarjen e barabart\u00eb t\u00eb trash\u00ebgimis\u00eb n\u00eb mes t\u00eb trash\u00ebgimtar\u00ebve. Neni 7.5 i Kushtetut\u00ebs s\u00eb Kosov\u00ebs, ndalon diskriminimin e gruas. Nd\u00ebrkaq neni 22 i Kushtetut\u00ebs garanton zbatimin e drejtp\u00ebrdrejt\u00eb t\u00eb marr\u00ebveshjeve dhe instrumenteve nd\u00ebrkomb\u00ebtare, e me k\u00ebt\u00eb rast edhe t\u00eb Konvent\u00ebs p\u00ebr Eleminimin e t\u00eb Gjitha Formave t\u00eb Diskriminimit ndaj Gruas. Shteti yn\u00eb ka nj\u00eb mori ligjesh t\u00eb cilat sigurojn\u00eb dhe garantojn\u00eb n\u00eb let\u00ebr k\u00ebto t\u00eb drejta. Por, si\u00e7 duket, ato nuk jan\u00eb t\u00eb mjaftueshme.<\/p>\n<p>Tradita zakonore, kultura, mang\u00ebsia e ligjeve si dhe procedurave t\u00eb p\u00ebrcaktara qart\u00eb, por edhe mungesa e informatave p\u00ebr t\u00eb drejtat q\u00eb i g\u00ebzojm\u00eb kan\u00eb shkaktuar at\u00eb q\u00eb sot kemi \u2013 ligje t\u00eb mira n\u00eb let\u00ebr dhe aspak t\u00eb tilla n\u00eb zbatimin e tyre.<\/p>\n<p>Nj\u00eb ligj, sa do i mir\u00eb q\u00eb t\u00eb jet\u00eb n\u00eb m\u00ebnyr\u00ebn e formulimit t\u00eb tij, \u00ebsht\u00eb i pasuksessh\u00ebm n\u00ebse ai nuk gjen aplikim n\u00eb realitetin e p\u00ebrditsh\u00ebm.
