Kjo paraqet nj\u00eb faz\u00eb pastranzicionale ku e gjith\u00eb popullsia ka kaluar n\u00eb nj\u00eb situat\u00eb jonormale, dhe shumica kan\u00eb p\u00ebrjetuar dhun\u00eb, apo kan\u00eb humbur m\u00eb t\u00eb af\u00ebrmit. N\u00eb k\u00ebto rrethana \u00ebsht\u00eb i v\u00ebshtir\u00eb definimi i veprimeve ligjore dhe joligjore, t\u00eb cilat kan\u00eb ndodhur gjat\u00eb konfliktit. Trajtimi i rasteve t\u00eb krimeve t\u00eb luft\u00ebs \u00ebsht\u00eb nj\u00eb nd\u00ebr testet m\u00eb kritike si p\u00ebr besueshm\u00ebrin\u00eb ashtu edhe p\u00ebr kompetenc\u00ebn e sistemit t\u00eb drejt\u00ebsis\u00eb. Kjo \u00ebsht\u00eb pjes\u00ebrisht p\u00ebr shkak t\u00eb faktit se krimet e luft\u00ebs, nga vet\u00eb natyra e tyre, jan\u00eb t\u00eb nd\u00ebrlikuara dhe t\u00eb v\u00ebshtira p\u00ebr t\u2019u adresuar plot\u00ebsisht.<\/p>\n<p>Q\u00eb nga mbarimi i konfliktit n\u00eb Kosov\u00eb 1998-1999, gjykatat hibride e kishin rolin kryesor p\u00ebr gjykimin e krimeve t\u00eb kryera gjat\u00eb konfliktit. Pas d\u00ebshtimit t\u00eb UNMIK-ut dhe EULEX-it p\u00ebr trajtimin e rasteve t\u00eb krimit t\u00eb kryera gjat\u00eb konfliktit, bashk\u00ebsia nd\u00ebrkomb\u00ebtare luajti me kart\u00ebn e fundit p\u00ebr vendosjen e drejt\u00ebsis\u00eb p\u00ebr viktimat e krimit (dhe pse ky q\u00ebllim nga bashk\u00ebsia nd\u00ebrkomb\u00ebtare mbetet diskutabil). Pas presionit t\u00eb ushtruar mbi deputet\u00ebt e Kuvendit t\u00eb Kosov\u00ebs Dhomat e Specializuara dhe Zyra e Prokurorit Special (Gjykata Speciale) u b\u00eb pjes\u00eb e sistemit t\u00eb drejt\u00ebsis\u00eb s\u00eb Kosov\u00ebs. Ekzistimi i Gjykat\u00ebs Speciale \u00ebsht\u00eb \u00e7\u00ebshtje faktike, ky mekaniz\u00ebm special ekziston e pranuam ne ose jo, dhe \u00ebsht\u00eb pjes\u00eb e fatit kolektiv t\u00eb shoq\u00ebris\u00eb kosovare.<\/p>\n<p>Me ligjin p\u00ebr Gjykat\u00ebn Speciale nuk \u00ebsht\u00eb i p\u00ebrcaktuar mandati definitiv i k\u00ebsaj gjykate, por n\u00ebse e nd\u00ebrlidhim fillimin e mandatit t\u00eb gjykat\u00ebs speciale me fillimin e funksionalizimit mund t\u00eb konkludojm\u00eb se mandati i saj ka filluar n\u00eb vitin 2017 kur ka hyr\u00eb n\u00eb fuqi Rregullorja p\u00ebr Prova dhe Procedura, dhe jo me miratimin n\u00eb Kuvend t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs m\u00eb 2015, dhe ky mandat do t\u00eb vazhdoj\u00eb deri n\u00eb vitin 2023.<\/p>\n<p><strong>Vullnet i brendsh\u00ebm apo Imponim nga jasht\u00eb?<\/strong><\/p>\n<p>Gjat\u00eb konfliktit n\u00eb Kosov\u00eb, p\u00ebrve\u00e7 krimeve t\u00eb kryera n\u00eb territorin e Kosov\u00ebs t\u00eb serb\u00ebve ndaj shqiptar\u00ebve,\u00a0<a href=\"https:\/\/www.osce.org\/kosovo\/17781\">Organizata p\u00ebr Bashk\u00ebpunim dhe Siguri n\u00eb Evrop\u00eb<\/a>, dhe\u00a0<a href=\"https:\/\/www.hrw.org\/reports\/1999\/kosov2\/\">Human Rights Watch<\/a>\u00a0\u00a0raportuan incidente dhune ndaj serbeve dhe shqiptar\u00ebve nga pjes\u00ebtar\u00ebt e Ushtris\u00eb \u00c7lirimtare t\u00eb Kosov\u00ebs. Pretendimet e ngritura n\u00eb k\u00ebto Raporte\u00a0<a href=\"https:\/\/balkaninsight.com\/2009\/04\/16\/unlocking-the-dark-secrets-of-the-kla-s-camps\/\">ishin hetuar<\/a>\u00a0dhe raportuar nga gazetar\u00ebt q\u00eb nga viti 1999. Pretendimet p\u00ebr vrasje, rr\u00ebmbim dhe trafikim organesh iu paraqit\u00ebn UNMIK-ut n\u00eb 2003, dhe m\u00eb pas edhe Tribunalit t\u00eb Hag\u00ebs p\u00ebr krime n\u00eb ish-Jugosllavi, Prokurori i k\u00ebsaj t\u00eb fundit pohonte se nuk kishte asnj\u00eb \u00e7\u00ebshtje p\u00ebr ndjekje penale p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb provave dhe shkat\u00ebrroi \u00e7far\u00ebdo prove q\u00eb mblidhej n\u00eb Shqip\u00ebri.\u00a0 T\u00eb nj\u00ebjtat akuza penale q\u00eb Tribunali i Hag\u00ebs kishte hedhur posht\u00eb p\u00ebr munges\u00eb provash u rishfaq\u00ebn n\u00eb Raport t\u00eb Dick Marty-it n\u00eb vitin 2011.<\/p>\n<p>Disa muaj pas pavar\u00ebsis\u00eb s\u00eb Kosov\u00ebs, ish-Kryeprokurorja e Tribunalit t\u00eb Hag\u00ebs Carla del Ponte pretendonte p\u00ebr krime t\u00eb kryera nga Ushtria \u00c7lirimtare e Kosov\u00ebs, sipas saj Tribunali i Hag\u00ebs dhe UNMIK-u kan\u00eb d\u00ebshtuar t\u00eb merren me k\u00ebto krime p\u00ebr shkak se nuk kan\u00eb qen\u00eb n\u00eb gjendje t\u2019i sigurojn\u00eb provat e mjaftueshme. Duke u bazuar n\u00eb librin e saj i cili nuk ishte dokument zyrtar por shkrim gazetaresk, K\u00ebshilli i Evrop\u00ebs e caktoi Dick Martin t\u00eb merret me k\u00ebto pretendime, t\u00eb cilat rezultuan me publikimin e raportit p\u00ebr krimet e pretenduara t\u00eb Ushtris\u00eb \u00c7lirimtare t\u00eb Kosov\u00ebs, q\u00eb njihet si raporti i Dick Marty-t. Edhe pse raporti i Marty-t nuk rekomandonte formimin e nj\u00eb gjykate speciale por vet\u00ebm forcimin e rolit t\u00eb EULEX-t nga ana e autoriteteve kosovare, Bashkimi Evropian e inicoi iden\u00eb e formimit t\u00eb nj\u00eb mekanizmi special q\u00eb do t\u2019i adresonte akuzat n\u00eb raportin e Marty-t dhe rekomandimet e dala nga hulumtimi i Task Forc\u00ebs Hetimore.<\/p>\n<p>Vendimi i bashk\u00ebsis\u00eb nd\u00ebrkombatare ishte se do t\u00eb formohej nj\u00eb gjykat\u00eb me ligje t\u00eb Kosov\u00ebs, ose do t\u00eb formohej nj\u00eb gjykat\u00eb nd\u00ebrkomb\u00ebtare n\u00eb kuad\u00ebr t\u00eb K\u00ebshillit t\u00eb Sigurimit t\u00eb OKB-s\u00eb. N\u00eb k\u00ebt\u00eb rast nuk ka pasur mund\u00ebsi kompromisi, p\u00ebr k\u00ebt\u00eb arsye formimi i gjykat\u00ebs speciale ka qen\u00eb imponim nga jasht\u00eb, dhe assesi vullnet i brendsh\u00ebm nga institucionet e Kosov\u00ebs, apo deputetet e Kuvendit t\u00eb Kosov\u00ebs.<\/p>\n<p>N\u00ebse deputet\u00ebt e legjislatur\u00ebs s\u00eb pest\u00eb t\u00eb Kuvendit t\u00eb Kosov\u00ebs nuk do t\u00eb pranonin formimin e nj\u00eb gjykate n\u00eb kuad\u00ebr t\u00eb ligjeve t\u00eb Kosov\u00ebs, Organizata e Kombeve t\u00eb Bashkuara do ta formonte n\u00eb kuad\u00ebr t\u00eb K\u00ebshillit t\u00eb Sigurimit, formimi i nj\u00eb gjykate t\u00eb till\u00eb do t\u00eb dob\u00ebsonte subjektivitetin e shtetit, kjo pasi Kosova do t\u00eb paraqitej n\u00eb aren\u00ebn nd\u00ebrkomb\u00ebtare si nj\u00eb shtet jo i aft\u00eb p\u00ebr t\u2019u ballafaquar me t\u00eb kaluar\u00ebn, dhe p\u00ebr t\u2019i marr\u00eb p\u00ebrsip\u00ebr p\u00ebrgjegj\u00ebsit\u00eb p\u00ebr veprat e kryera. Por, Kosova e d\u00ebshmoi t\u00eb kund\u00ebrt\u00ebn duke e formuar k\u00ebt\u00eb mekaniz\u00ebm special n\u00eb kuad\u00ebr t\u00eb vet\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb. Megjith\u00ebse Serbia do t\u00eb kishte preferuar \u00a0nj\u00eb gjykat\u00eb speciale t\u00eb administruar nga OKB, zyrtar\u00ebt n\u00eb Beograd haptazi kan\u00eb pohuar se\u00a0<a href=\"http:\/\/www.mfa.gov.rs\/en\/component\/content\/article\/64-daily-survey\/14534-daily-survey-1008201\">ne do t\u00eb shfryt\u00ebzojm\u00eb \u00e7do mund\u00ebsi<\/a>\u00a0p\u00ebr t\u00eb nd\u00ebshkuar kriminel\u00ebt, pasi kjo \u00ebsht\u00eb n\u00eb interesin ton\u00eb. Formimi i Dhomave t\u00eb Specializuara nga ana e Kosov\u00ebs e tregon gatishm\u00ebrin\u00eb e institucioneve kosovare n\u00eb ballafaqimin me t\u00eb kaluar\u00ebn, drejt\u00ebsin\u00eb, dhe pasigurin\u00eb p\u00ebr vlerat, n\u00eb t\u00eb cilat \u00ebsht\u00eb thirr\u00eb Ushtria \u00c7lirimtare e Kosov\u00ebs.<\/p>\n<p>Pas konfirmimit t\u00eb aktakuzave t\u00eb udh\u00ebheq\u00ebsve dhe pjes\u00ebtar\u00ebve t\u00eb U\u00c7K-s\u00eb, Kosov\u00ebs i \u00ebsht\u00eb shtuar nj\u00eb njoll\u00eb n\u00eb imazhin nd\u00ebrkomb\u00ebtar duke u paraqitur si vend q\u00eb \u00ebsht\u00eb udh\u00ebhequr nga persona q\u00eb kan\u00eb kryer krime, kjo mund t\u00eb ket\u00eb pasoja n\u00eb ndaljen e njohjeve t\u00eb m\u00ebtejme t\u00eb shtetit t\u00eb Kosov\u00ebs nga vendet e reja, poashtu shteti serb ka tendenca t\u2019i p\u00ebrdor\u00eb k\u00ebto konfirmime t\u00eb aktakuzave si arsye p\u00ebr fushat\u00ebn e \u00e7njohjeve t\u00eb Kosov\u00ebs nga vendet q\u00eb e kan\u00eb njohur tanim\u00eb, gjithashtu mund t\u00eb ndikoj\u00eb n\u00eb pak\u00ebsimin e investimeve t\u00eb huaja n\u00eb Kosov\u00eb. Por, p\u00ebrgjigjja pozitive e krer\u00ebve t\u00eb U\u00c7K-s\u00eb ftesave t\u00eb gjykat\u00ebs speciale dhe gatishm\u00ebria e tyre p\u00ebr t\u2019u p\u00ebrballur me drejt\u00ebsin\u00eb paraqet nj\u00eb tregues q\u00eb Ushtria \u00c7lirimtare e Kosov\u00ebs nuk \u00ebsht\u00eb nj\u00eb Nd\u00ebrrmarrje e P\u00ebrbashk\u00ebt Kriminale si\u00e7 po e quajn\u00eb prokuror\u00ebt e Gjykat\u00ebs Speciale. Dhe kur do t\u00eb dalin (n\u00ebse) t\u00eb pafajsh\u00ebm nga gjykata speciale t\u00eb gjitha pasojat e larp\u00ebrmendura do t\u00eb shnd\u00ebrrohen n\u00eb pik\u00ebt m\u00eb t\u00eb forta p\u00ebr Kosov\u00ebn duke e forcuar subjektivitetin e saj n\u00eb aren\u00ebn nd\u00ebrkomb\u00ebtare.<\/p>\n<p>Gjykata speciale e Kosov\u00ebs nuk \u00ebsht\u00eb e vetme e k\u00ebtij lloji, pasi edhe Timori Lindor, Sierra Leone dhe shum\u00eb vende tjera n\u00eb periudh\u00ebn paskonfliktuoze i kan\u00eb formuar gjykatat speciale p\u00ebr gjykimin e krimeve q\u00eb kan\u00eb ndodhur gjat\u00eb konflikit. Megjithat\u00eb, gjykat\u00ebs speciale t\u00eb Kovov\u00ebs p\u00ebr t\u2019iu larguar epiteti mono-etnike duhet ta zgjeroj\u00eb mandatin dhe territorialitetin n\u00eb m\u00ebnyr\u00eb q\u00eb t\u2019i ndjek\u00eb penalisht krimet q\u00eb kan\u00eb ndodhur gjat\u00eb konfliktit nga forcat serbe; p\u00ebr ta arritur k\u00ebt\u00eb q\u00ebllim mund ta ndryshoj\u00eb statutin e saj, nga nj\u00eb gjykat\u00eb e \u2018Kosov\u00ebs\u2019 n\u00eb gjykat\u00eb nd\u00ebrkomb\u00ebtare duke e vendosur k\u00ebshtu jo nj\u00eb drejt\u00ebsi speciale, por nj\u00eb drejt\u00ebsi t\u00eb p\u00ebrgjithshme, si\u00e7 ka ndodhur rasti me Tribunalin e Hag\u00ebs p\u00ebr Krime n\u00eb ish-Jugosllavi q\u00eb n\u00eb fillim ishte gjykat\u00eb e p\u00ebrkohshme, por p\u00ebr shkak t\u00eb krimeve q\u00eb kan\u00eb ndodhur n\u00eb Bosnje e Hercegovin\u00eb ka kaluar n\u00eb gjykat\u00eb nd\u00ebrkomb\u00ebtare.<\/p>\n<p>Gjasat q\u00eb gjykata speciale t\u00eb fitoj\u00eb legjitimitet n\u00eb Kosov\u00eb jan\u00eb t\u00eb m\u00ebdha duke e marr\u00eb parasysh q\u00ebllimin fisnik t\u00eb gjith\u00eb atyre q\u00eb luftuan p\u00ebr hir t\u00eb fitimit t\u00eb liris\u00eb s\u00eb Kosov\u00ebs. Nj\u00eb fakt tjet\u00ebr \u00ebsht\u00eb edhe d\u00ebshmia e secilit prej ushtar\u00ebve, pjes\u00ebmarr\u00ebsve e krer\u00ebve t\u00eb U\u00c7K-s\u00eb q\u00eb kjo nism\u00eb nuk i ngjan as p\u00ebr s\u00eb af\u00ebrmi nj\u00eb nd\u00ebrrmarrjeje kriminale, por nj\u00eb nd\u00ebrmarrje krenarie me t\u00eb cil\u00ebn u hodh\u00ebn bazat e shtet\u00ebsis\u00eb s\u00eb Kosov\u00ebs.
