Ai nivel ishte fisi p\u00ebr \u00e7\u2019gj\u00eb F. Engelsi me t\u00eb drejt\u00eb konstatoi se \u00abajo q\u00eb gjendet jasht\u00eb fisit, ka qen\u00eb jasht\u00eb s\u00eb drejt\u00ebs\u00bb. Ky adet u shfaq nga nevoja: meq\u00eb nuk ekzistonte shteti, bashk\u00ebsit\u00eb e hershme duhej t\u00eb kishin ndonj\u00eb rregull t\u00eb sjelljes: ajo ishte nj\u00eb v\u00ebrejtje e pam\u00ebdysht\u00eb drejtuar sulmmuesit se n\u00eb an\u00ebn e t\u00eb sulmuarit q\u00ebndron grupi i tij mu ashtu si\u00e7 i kanoset hakmarrja t\u00eb gjith\u00eb meshkujve t\u00eb grupit sulmues. Nj\u00eb karakteristik\u00eb e k\u00ebtill\u00eb gjakmarrjen e b\u00ebn si manifestim t\u00eb solidar\u00ebsis\u00eb t\u00eb bashk\u00ebsive t\u00eb hershme: nj\u00eb p\u00ebr t\u00eb gjith\u00eb, t\u00eb gjith\u00eb p\u00ebr nj\u00eb. Kjo solidar\u00ebsi b\u00ebhej brenda fisit\u00a0 p\u00ebr \u00e7\u2019shkak V. Bogishiqi me t\u00eb drejt\u00eb konstaton se \u00abaty ku \u00ebsht\u00eb fisi, aty \u00ebsht\u00eb edhe hakmarrja\u00bb.<\/p>\n<p><strong>\u00a0Kufizimet<\/strong><\/p>\n<p>N\u00eb dit\u00ebt e veta t\u00eb hershme gjakmarrja ishte e vrazhd\u00eb, e paskurpull dhe \u00abderi n\u00eb skaj e pafrenueshme\u00bb p\u00ebr \u00e7\u2019shkak b\u00ebnte q\u00eb t\u00eb shfarroste familje t\u00eb t\u00ebra madje edhe farefis. Kufizimi i pare i saj bazohej mbi parimin e talios: syrin p\u00ebr sy, kok\u00ebn p\u00ebr kok\u00eb. Kufizimi i dyt\u00eb ndodhi kur pal\u00ebt e konfrontuara pranonin t\u00eb gjykohej nga jasht\u00eb. Zakonisht k\u00ebt\u00eb gj\u00eb e b\u00ebnin pleqnar\u00ebt vendimet e t\u00eb cil\u00ebve ishin t\u00eb plotfuqishme \u2013 n\u00ebse t\u00eb dyjat pal\u00ebt pajtoheshin me pleq\u00ebrimin e tyre. Kufizimi i tret\u00eb i gjakmarrjes ndodhi kur ajo u ngushtua n\u00eb nj\u00eb num\u00ebr m\u00eb t\u00eb vog\u00ebl individ\u00ebsh t\u00eb cil\u00ebt mund t\u00eb goditeshin nga hakmarrja. Sot kjo zakonisht \u00ebsht\u00eb familja (e gjer\u00eb).<\/p>\n<p>Gjurm\u00ebt e shkruara p\u00ebr gjakmarrjen nd\u00ebr popujt e lasht\u00eb gjenden n\u00eb Kanunin e Hamurabit, n\u00eb Ligjin Romak prej Xll tabelave dhe n\u00eb t\u00eb drejten ruse. Shkrimi i par\u00eb p\u00ebr hakmarrjen te sllav\u00ebt e Jugut gjendet te Mavrikia.Gjurm\u00eb p\u00ebr pranin\u00eb\u00a0 e tij n\u00eb k\u00ebto an\u00eb gjenden n\u00eb Ligjin e Vinodollit, n\u00eb Statutin e Politik\u00ebs dhe n\u00eb Kanunin e Dushanit. Po ashtu edhe n\u00eb dokumentet e mbret\u00ebrve boshnjak\u00eb dhe n\u00eb dokumentet e Dubrovnikut. P\u00ebr jet\u00ebn e saj n\u00eb Mal t\u00eb Zi d\u00ebshmon Kanuni i Petrit I dhe Ligji i Vasojeviq\u00ebve nga dymb\u00ebdhjet\u00eb pika. N\u00eb at\u00eb hap\u00ebsir\u00eb si dukuri ajo q\u00ebndroi deri n\u00eb mbarim t\u00eb shek. 19. U zhduk at\u00ebher\u00eb kur kjo an\u00eb u hap s\u00eb jashtmi \u2013 krahazi me risit\u00eb shoq\u00ebrore, politike, ekonomike dhe kulturore brenda saj.<\/p>\n<p>Kjo gj\u00eb nuk ndodhi n\u00eb Shqip\u00ebrin\u00eb e Veriut ku gjakmarrja zgjati m\u00eb shum\u00eb. Gjithashtu edhe n\u00eb Kosov\u00eb ku ekziston ende \u2013 te banor\u00ebt e saj t\u00eb komb\u00ebsis\u00eb shqiptare. N\u00eb t\u00eb dyja k\u00ebto hap\u00ebsira shqiptar\u00ebt shekuj me rradh\u00eb i rregullonin marr\u00ebdh\u00ebniet e tyre ndaj norm\u00ebs zakonore-juridike q\u00eb zakonisht quhet Kanuni I Lek\u00eb Dukagjinit. K\u00ebto rregulla, i mblodhi, i ndreqi dhe i botoi Sh. Gje\u00e7ovi. \u00cbsht\u00eb t\u00eb thuash e sigurt se ato nuk qene t\u00eb shkruara; ato rregulla jan\u00eb normativ\u00eb gojore e sjelljeve q\u00eb gjat\u00eb kalimit t\u00eb koh\u00ebs fituan forc\u00ebn e ligjit juridik. N\u00eb t\u00eb jan\u00eb caktuar rregullat p\u00ebrkat\u00ebse t\u00eb gjakmarrjes, kushtet e tij dhe rrjedhojat\u2026<\/p>\n<p><strong>Pasojat<\/strong><\/p>\n<p>Pasojat politike t\u00eb gjakmarrjes n\u00eb dit\u00ebt tona shfaqen n\u00eb kufizimet t\u00eb cilat ky zakon qysh m\u00eb pare ua b\u00ebn njer\u00ebzve n\u00eb sjelljet e tyre private, e sidomos, n\u00eb sjelljet publike. Gjith\u00eb ajo q\u00eb, ta z\u00ebm\u00eb, n\u00eb fjal\u00ebn e th\u00ebn\u00eb publike, mund t\u00eb jet\u00eb fyerje nuk varet nga normat e p\u00ebrvet\u00ebsuara shoq\u00ebrore , porse vet\u00ebm nga gjykimi ose vler\u00ebsimi i atij q\u00eb i drejtohet ajo fjal\u00eb. T\u00eb thuhet, prandaj, p\u00ebr nj\u00eb njeri se \u00ebsht\u00eb i marr\u00eb ose hor mund t\u00eb jet\u00eb e sakt\u00eb, por e rrezikshme, sepse nuk dihet kurr\u00eb se gj\u00ebn\u00eb e th\u00ebn\u00eb n\u00eb at\u00eb m\u00ebnyr\u00eb ai tjetri do ta marr\u00eb si gjykim t\u00eb sin\u00e7ert\u00eb apo si fyerje. P\u00ebr k\u00ebt\u00eb shkak njer\u00ebzit me pik\u00ebpamje t\u00eb k\u00ebtilla drojn\u00eb nga fjala publike. K\u00ebtu dikund duhet t\u00eb k\u00ebrkohen rr\u00ebnj\u00ebt e asaj q\u00eb zakonisht quhet opotuniz\u00ebm n\u00eb sjelljet publike t\u00eb njer\u00ebzve.<\/p>\n<p>Pasojat juridike t\u00eb gjakmarrjes n\u00eb k\u00ebt\u00eb hap\u00ebsir\u00eb sot e gjith\u00eb dit\u00ebn shihen n\u00eb pasigurin\u00eb personale t\u00eb njer\u00ebzve meq\u00eb k\u00ebta nuk din\u00eb se kur as me \u00e7\u2019forc\u00eb do t\u2019i godas\u00eb hakmarrja. Nganj\u00ebher\u00eb nuk din\u00eb as p\u00ebr \u00e7\u2019arsye. N\u00eb k\u00ebt\u00eb pik\u00ebpamje nuk ndihmon fort prania e gjyqeve dhe ligjeve sepse e drejta zakonore nuk e njeh shtetin si gjykat\u00ebs. E drejta t\u00eb merret haku nuk nd\u00ebrpritet me aktvendimet e gjyqit, ajo mbetet madje edhe n\u00ebse gjyqi e ekzekuton me denim me vdekje. Gjithashtu nuk jan\u00eb hi\u00e7 m\u00eb t\u00eb m\u00ebdha as mund\u00ebsit\u00eb\u00a0 e shtetit t\u2019i mbroj\u00eb familjet n\u00eb \u00abburgjet sht\u00ebpiake\u00bb sepse ato \u00abvullnetarisht\u00bb mbyllen Brenda kat\u00ebr mureve t\u00eb veta. P\u00ebr \u00e7\u2019arsye as nuk k\u00ebrkojn\u00eb mbrojtjen e saj, ndonj\u00eb ndihm\u00eb t\u00eb saj edhe m\u00eb pak.<\/p>\n<p>Pasojat ekonomike t\u00eb gjakmarrjes jan\u00eb m\u00eb t\u00eb dukshmet dhe m\u00eb t\u00eb r\u00ebndat n\u00eb fatet e sht\u00ebpive n\u00eb \u00abburgjet sht\u00ebpiake\u00bb. K\u00ebto jan\u00eb familje meshkujt e t\u00eb cilave pas hakmarrjes, sipas zakonit, duhet t\u00eb mbyllen vullnetarisht. Kjo mbyllje nuk b\u00ebhet vet\u00ebm p\u00ebr t\u2019i ikur hakmarrjes, ky \u00ebsht\u00eb , gjithashtu, veprim me t\u00eb cilin nderohet ajo ana tjeter, e, bashke me k\u00ebt\u00eb, t\u2019i shmanget takimit me t\u00eb dhe ndonj\u00eb t\u00eb papriture t\u00eb re. Meshkujt e k\u00ebtyre familjeve pa lejen e pales tjet\u00ebr, nuk b\u00ebn t\u00eb dalin jasht\u00eb pragut t\u00eb oborrit. P\u00ebr k\u00ebt\u00eb shkak token e k\u00ebtyre familjeve zakonisht e punojn\u00eb femrat. Ato, gjithashtu, b\u00ebjn\u00eb pun\u00eb tradicionale meshkujsh (shesin, blejn\u00eb, paguajn\u00eb tatimin). Kjo, pra, \u00ebsht\u00eb koha kur kryhet shkolla fillore. Kur t\u2019I mbush\u00eb k\u00ebto vjet f\u00ebmija mashkull i n\u00ebnshtrohet hakmarrjes p\u00ebr \u00e7\u2019arsye shumica e djaloshave t\u00eb k\u00ebsaj moshe strehohet n\u00eb \u00abburgun sht\u00ebpiak\u00bb, me \u00e7\u2019gj\u00eb e nd\u00ebrpret shkollimin e m\u00ebtutjesh\u00ebm, pastaj aft\u00ebsimin punues dhe, n\u00eb fund, pun\u00ebsimin.<\/p>\n<p><strong>P\u00ebrfundimisht<\/strong><\/p>\n<p>Pasojat sociale t\u00eb gjakmarrjes t\u00eb pranis\u00eb s\u00eb gjakmarrjes n\u00eb koh\u00ebn ton\u00eb dhe n\u00eb hap\u00ebsir\u00ebn ton\u00eb, jan\u00eb edhe m\u00eb t\u00eb dukshme dhe m\u00eb t\u00eb r\u00ebnda. Ky zakon, edhe si vet\u00ebgjykim, \u00ebsht\u00eb problem social aspak i thjesht\u00eb sepse n\u00eb vend t\u00eb modeleve bashk\u00ebkohore t\u00eb sjelljes i konservon ato anakronike. Konservon gjithashtu sistemin e vlerave q\u00eb bie ndesh me k\u00ebt\u00eb shoq\u00ebri dhe q\u00eb ka p\u00ebr baz\u00eb arbirtraritetin n\u00eb vend t\u00eb pajtimit, frik\u00ebn n\u00eb vend t\u00eb q\u00ebndrimit t\u00eb lir\u00eb. Me veti t\u00eb tilla gjakmarrja n\u00eb dit\u00ebt tona \u00ebsht\u00eb sjellje me t\u00eb cil\u00ebn shoq\u00ebria e qytet\u00ebruar, sidomos ajo vet\u00ebqeveris\u00ebse nuk mund t\u00eb pajtohet me t\u00eb edhe pse, si duket, duhet ta duroj\u00eb edhe do koh\u00eb.<\/p>\n<p>Se ky zakon po e humb mb\u00ebshtetjen \u00abnatyrore\u00bb d\u00ebshmojn\u00eb deformimet gjithnj\u00eb m\u00eb t\u00eb shpeshta t\u00eb k\u00ebsaj sjelljeje, apo th\u00ebn\u00eb tro\u00e7, sjelljet e panjer\u00ebzishme n\u00eb dit\u00ebt tona.
