Ky ligj u kritikua jasht\u00ebzakonisht shum\u00eb nga\u00a0<\/span><a style=\"font-size: 16px;\" href=\"http:\/\/nacionale.com\/politike\/mbi-30-organizata-e-sindikata-po-e-kundershtojne-ligjin-per-paga\" target=\"_blank\" rel=\"noopener\">sindikatat<\/a><span style=\"font-size: 16px;\">, partit\u00eb politike dhe shoq\u00ebria civile, q\u00eb konsideruan se ky ligj \u00ebsht\u00eb i padrejt\u00eb dhe diskriminues.<\/span><\/p>\n<\/div>\n<div class=\"news-down\">\n<div class=\"news-left\">\n<p>Krahas shkeljeve t\u00eb t\u00eb drejtave t\u00eb njeriut te nj\u00eb pjes\u00eb e madhe e zyrtar\u00ebve publik\u00eb, ligji n\u00eb fjal\u00eb ngriti pagat p\u00ebr disa kategori. P\u00ebr k\u00ebt\u00eb arsye, partit\u00eb politike nuk e kontestuan k\u00ebt\u00eb ligj n\u00eb Gjykat\u00ebn Kushtetuese (GjK), nga frika se si do t\u00eb ndikonte n\u00eb aspektin e mb\u00ebshtetjes elektorale.<\/p>\n<p>Diskriminimi, cenimi i pavar\u00ebsis\u00eb s\u00eb gjyq\u00ebsorit dhe pabarazia, ishin disa nga elementet q\u00eb karakterizuan k\u00ebt\u00eb ligj popullor, p\u00ebr t\u00eb cilat Sbunker\u00a0<a href=\"https:\/\/sbunker.net\/op-ed\/91624\/zyrtaret-publike-ne-kosove-nen-meshiren-e-gjykates-kushtetuese\/\" target=\"_blank\" rel=\"noopener\">botoi disa<\/a>\u00a0<a href=\"https:\/\/sbunker.net\/op-ed\/91704\/si-ndikon-ligji-i-ri-i-pagave-ne-arsimin-e-larte\/\" target=\"_blank\" rel=\"noopener\">shkrime radhazi.<\/a><\/p>\n<p>Megjithat\u00eb, ky ligji u kontestua n\u00eb Gjykat\u00ebn Kushtetuese m\u00eb\u00a0<a href=\"https:\/\/kallxo.com\/lajm\/ligji-per-paga-dergohet-ne-kushtetuese\/\" target=\"_blank\" rel=\"noopener\">7 prill 2023 nga Avokati i Popullit<\/a>, pasi ky i fundit pranoi mbi 100 ankesa nga sindikata dhe kategori t\u00eb tjer\u00eb t\u00eb zyrtar\u00ebve, q\u00eb u d\u00ebmtuan nga ky ligj.<\/p>\n<p>M\u00eb 26 dhjetor 2023, Gjykata Kushtetuese publikoi\u00a0<a href=\"https:\/\/gjk-ks.org\/njoftim-per-vendim-ne-rastin-ko-79-23\/\" target=\"_blank\" rel=\"noopener\">njoftimin p\u00ebr vendosjen e kushtetutshm\u00ebris\u00eb<\/a>, me \u00e7\u2019rast shpalli ligjin n\u00eb fjal\u00eb si pjes\u00ebrisht kund\u00ebrkushtetues.<\/p>\n<p>Specifikisht, Gjykata Kushtetuese konstatoi se ky ligj shkel Nenin 46 (Mbrojtja e Pron\u00ebs), Nenin 24 (Barazia para Ligjit), Nenin 14 (Ndalimi i diskriminimit) t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut, Nenin 4 (Forma e Qeverisjes dhe Ndarja e Pushteteve) dhe Nenin 7 (Vlerat) t\u00eb Kushtetut\u00ebs s\u00eb Kosov\u00ebs.<\/p>\n<p>Pra, ligji i propozuar nga Qeveria Kurti p\u00ebr pagat n\u00eb sektorin publik p\u00ebrmban nj\u00eb mori shkeljesh flagrante. Megjithat\u00eb, Gjykata Kushtetuese sqaroi se ky aktgjykim nuk prek kategorit\u00eb e zyrtar\u00ebve publik\u00eb t\u00eb cil\u00ebve u \u00ebsht\u00eb ngritur paga.<\/p>\n<p><strong>Shkeljet m\u00eb serioze sipas Gjykat\u00ebs Kushtetuese<\/strong><\/p>\n<p>Ligji p\u00ebr Paga n\u00eb Sektorin Publik cenoi t\u00eb drejta dhe liri themelore t\u00eb garantuara me Kushtetut\u00eb dhe me konventa nd\u00ebrkomb\u00ebtare. Duke pasur parasysh se paga \u00ebsht\u00eb pjes\u00eb p\u00ebrb\u00ebr\u00ebse e s\u00eb drejt\u00ebs n\u00eb pron\u00eb, ulja drastike e pag\u00ebs p\u00ebr disa kategori t\u00eb zyrtar\u00ebve publik\u00eb dhe rritja p\u00ebr disa t\u00eb tjer\u00eb, nuk ishte proporcionale, andaj pati shkelje t\u00eb k\u00ebsaj s\u00eb drejte.<\/p>\n<p>Aktgjykimi theksoi se ulja e pagave t\u00eb gjyqtar\u00ebve dhe prokuror\u00ebve, jo vet\u00ebm q\u00eb paraqet shkelje t\u00eb s\u00eb drejt\u00ebs n\u00eb pron\u00eb p\u00ebr k\u00ebt\u00eb kategori, por shkakton edhe pasoja serioze n\u00eb pavar\u00ebsin\u00eb e pushtetit gjyq\u00ebsor dhe prish ekuilibrin kushtetues t\u00eb pushteteve (Gjyq\u00ebsori, Legjislativi dhe Ekzekutivi).<\/p>\n<p><a href=\"https:\/\/gjk-ks.org\/wp-content\/uploads\/2020\/07\/gjk_ko_219_19_agj_shq.pdf\" target=\"_blank\" rel=\"noopener\">Gjykata Kushtetuese, n\u00eb vitin 2020<\/a>, kishte shpallur kund\u00ebrkushtetues n\u00eb t\u00ebr\u00ebsin\u00eb e tij Ligjin paraprak t\u00eb Pagave n\u00eb Sektorin Publik, andaj edhe kishte vendosur disa parime, t\u00eb cilat do t\u00eb duhej t\u00eb merreshin p\u00ebr baz\u00eb n\u00eb hartimin e legjislacionit p\u00ebr paga.<\/p>\n<p>Megjithat\u00eb, Qeveria e Kosov\u00ebs, nj\u00ebher\u00ebsh sponsorizues i k\u00ebtij ligji, neglizhoi t\u00ebr\u00ebsisht standardet kushtetuese t\u00eb vendosura n\u00eb vitin 2020, andaj solli nj\u00eb ligj me elemente t\u00eb shumta kund\u00ebrkushtetuese.<\/p>\n<p>Gjykata Kushtetuese rikujtoi faktin se pagat e gjyqtar\u00ebve dhe prokuror\u00ebve nuk mund t\u00eb zbriten p\u00ebrgjat\u00eb ushtrimit t\u00eb funksioneve t\u00eb tyre, p\u00ebrve\u00e7 n\u00ebse zbritja \u00ebsht\u00eb b\u00ebr\u00eb p\u00ebr shkak t\u00eb nj\u00eb krize komb\u00ebtare ekonomike t\u00eb shpallur zyrtarisht.<\/p>\n<p>Ligji i Pagave n\u00eb Sektorin Publik ka shfuqizuar \u00e7do dispozit\u00eb tjet\u00ebr q\u00eb rregullonte pagat n\u00eb sfer\u00ebn publike, p\u00ebr pasoj\u00eb edhe legjislacionin e pagave p\u00ebr institucionet e pavarura kushtetuese. Madje, ligji n\u00eb fjal\u00eb i jep kompetenc\u00eb vet\u00ebm ministris\u00eb p\u00ebrgjegj\u00ebse (MPB) p\u00ebr t\u00eb nxjerr\u00eb rregullore q\u00eb konkretizojn\u00eb k\u00ebt\u00eb ligj.<\/p>\n<p>Nj\u00eb rregullim i till\u00eb padyshim q\u00eb \u00ebsht\u00eb kund\u00ebrkushtetues, duke pasur parasysh se institucionet e pavarura kushtetuese do t\u00eb jen\u00eb t\u00eb varura nga rregullimi i hartuar nga Qeveria, duke ua mohuar k\u00ebshtu institucioneve t\u00eb pavarura kushtetuese t\u00eb drejt\u00ebn e garantuar q\u00eb t\u00eb operojn\u00eb financiarisht n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur.<\/p>\n<p>Tutje, ligji n\u00eb fjal\u00eb ka ndaluar edhe \u00e7do ndryshim n\u00eb struktur\u00ebn, komponent\u00ebt apo nivelet e koeficienteve t\u00eb pagave, nd\u00ebrsa \u00e7do krijim i funksioneve apo pozitave t\u00eb reja duhet t\u00eb b\u00ebhet me miratimin e Qeveris\u00eb.<\/p>\n<p>Rregullimi n\u00eb k\u00ebt\u00eb form\u00eb ka cenuar pavar\u00ebsin\u00eb funksionale dhe organizative t\u00eb brendshme t\u00eb institucioneve t\u00eb pavarura kushtetuese, duke sjell\u00eb nd\u00ebrhyrje t\u00eb pushtetit ekzekutiv n\u00eb pushtetin gjyq\u00ebsor.<\/p>\n<p>N\u00eb vazhd\u00ebn e shkeljeve, karakteristik\u00eb \u00ebsht\u00eb edhe pabarazia n\u00eb pun\u00eb, e cila u konstatua nga Gjykata Kushtetuese, sidomos te sh\u00ebrbimi i jasht\u00ebm dhe te zyrtar\u00ebt q\u00eb u pun\u00ebsuan pas hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji.<\/p>\n<p>P\u00ebr zyrtar\u00ebt publik\u00eb, t\u00eb cil\u00ebve me ligjin e kontestuar u ishte ulur paga dhe t\u00eb cil\u00ebt k\u00ebt\u00eb periudh\u00eb nuk afektoheshin nga ulja e pag\u00ebs, parashihej nj\u00eb shtes\u00eb tranzitore prej 100% p\u00ebr vitin e par\u00eb, nd\u00ebrsa p\u00ebr vitin e dyt\u00eb parashihej nj\u00eb shtes\u00eb tranzitore prej 50%.<\/p>\n<p>N\u00eb an\u00ebn tjet\u00ebr, t\u00eb gjith\u00eb zyrtar\u00ebt q\u00eb filluan pun\u00ebn pas hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji nuk g\u00ebzuan shtes\u00eb tranzitore, andaj p\u00ebr pun\u00ebn e nj\u00ebjt\u00eb, punonj\u00ebs t\u00eb kategoris\u00eb s\u00eb nj\u00ebjt\u00eb, diskriminoheshin dhe nuk paguheshin n\u00eb m\u00ebnyr\u00eb t\u00eb barabart\u00eb, duke shkelur parimin \u201cpag\u00eb e barabart\u00eb p\u00ebr pun\u00eb t\u00eb barabart\u00eb\u201d.<\/p>\n<p>Pabarazi ende m\u00eb e lart\u00eb v\u00ebrehet n\u00eb pagat e sh\u00ebrbimit t\u00eb jasht\u00ebm, ku shtesa tranzitore nuk u g\u00ebzua asnj\u00ebher\u00eb, pavar\u00ebsisht se ligji ua uli pagat, duke i diskriminuar k\u00ebsisoj n\u00eb raport me t\u00eb gjith\u00eb zyrtar\u00ebt e tjer\u00eb. Pra, zyrtar\u00ebt nga sh\u00ebrbimi i jasht\u00ebm u afektuan nga ulja e pagave menj\u00ebher\u00eb pas hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji.<\/p>\n<p><strong>Cilat jan\u00eb efektet e aktgjykimit?<\/strong><\/p>\n<p>Fillimisht, p\u00ebr zyrtar\u00eb t\u00eb cil\u00ebve u \u00ebsht\u00eb ulur paga me ligjin e ri, aktgjykimi i Gjykat\u00ebs Kushtetuese e rikthen pag\u00ebn e nj\u00ebjt\u00eb paraprake, derisa kjo t\u00eb b\u00ebhet e barasvlershme me pag\u00ebn ekzistuese.<\/p>\n<p>N\u00eb k\u00ebt\u00eb drejtim, zyrtar\u00ebt t\u00eb cil\u00ebt jan\u00eb pun\u00ebsuar pas hyrjes n\u00eb fuqi t\u00eb k\u00ebtij ligji do t\u00eb p\u00ebrfitojn\u00eb pag\u00eb m\u00eb t\u00eb lart\u00eb, sikurse koleg\u00ebt e tyre q\u00eb kan\u00eb qen\u00eb t\u00eb pun\u00ebsuar para hyrjes n\u00eb fuqi t\u00eb Ligjit p\u00ebr Pagat n\u00eb Sektorin Publik, duke u bazuar n\u00eb parimin \u201cpag\u00eb e barabart\u00eb p\u00ebr pun\u00eb t\u00eb barabart\u00eb\u201d.<\/p>\n<p>Lidhur me uljen e shtes\u00ebs p\u00ebr p\u00ebrvoj\u00ebn n\u00eb pun\u00eb nga 05% n\u00eb 0.25, Gjykata Kushtetuese konstatoi se kjo ulje \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn dhe, k\u00ebsisoj, Kuvendi u urdh\u00ebrua q\u00eb brenda gjasht\u00eb muajve t\u00eb b\u00ebj\u00eb plot\u00ebsim\/ndryshimet e nevojshme, nd\u00ebrsa efekti i aktgjykimit p\u00ebr k\u00ebt\u00eb pjes\u00eb shtrihet nga hyrja n\u00eb fuqi e tij.<\/p>\n<p>Nd\u00ebrsa sa u p\u00ebrket dispozitave q\u00eb cenuan pavar\u00ebsin\u00eb funksionale, organizative dhe buxhetore t\u00eb institucioneve t\u00eb pavarura, Gjykata Kushtetuese ruajti pavar\u00ebsin\u00eb e k\u00ebtyre organeve, duke anuluar dispozitat q\u00eb obligonin miratimin nga MPB-ja, me rastin e krijimit t\u00eb funksioneve apo pozitave t\u00eb reja. Andaj, Gjykata Kushtetuese nuk obligoi Kuvendin t\u00eb b\u00ebj\u00eb ndonj\u00eb ndryshim lidhur me k\u00ebt\u00eb \u00e7\u00ebshtje, por udh\u00ebzoi t\u00eb veprohet konform gjetjeve t\u00eb k\u00ebtij aktgjykimi.<\/p>\n<p>Ndryshe, t\u00eb gjitha shkeljet e t\u00eb drejtave individuale nuk do t\u00eb mund t\u00eb kompensohen p\u00ebr koh\u00ebn e kaluar, p\u00ebr shkak t\u00eb anulimit t\u00eb dispozitave kund\u00ebrkushtetuese, t\u00eb cilat juridikisht konsiderohen q\u00eb nuk kan\u00eb ekzistuar asnj\u00ebher\u00eb, gjithashtu edhe p\u00ebr faktin se Gjykata Kushtetuese ka parapar\u00eb q\u00eb ky aktgjykim do t\u00eb hyj\u00eb n\u00eb fuqi m\u00eb 1 shkurt 2024 dhe do t\u00eb prodhoj\u00eb efekte juridike nga kjo dat\u00eb.<\/p>\n<p>Andaj, si rezultat i moshartimit profesional t\u00eb ligjit, Qeveria Kurti neglizhoi standardet kushtetuese, duke diskriminuar zyrtar\u00ebt publik\u00eb dhe duke shkaktuar d\u00ebme t\u00eb pariparueshme financiare p\u00ebr ta.<\/p>\n<\/div>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>M\u00eb 16 shkurt 2023, hyri n\u00eb fuqi Ligji nr. 08\/L-196 p\u00ebr Paga n\u00eb Sektorin Publik.
